<section id="HEE922B80076A4F9D95A0E169AE5FC4BC" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Elimination of part D cost-sharing for certain full-benefit dual eligible individuals</header> 
<subsection id="HD7057445E8074A328000646FA2E042F1"><enum>(a)</enum><header>In general</header><text>Section 1860D–14(a)(1)(D)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(1)(D)(i)</external-xref>) is amended—</text> 
<paragraph id="HC681FED997A245D4B04340663CEEAC"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="clause" style="OLC">Institutionalized individuals</header-in-text>.—In</quote> and inserting <quote><header-in-text level="clause" style="OLC">Elimination of cost-sharing for certain full-benefit dual eligible individuals</header-in-text>.—</quote></text>

<subclause id="HFD65AF0706F2406DA4B8A0004FD2C840"><enum>(I)</enum><header>Institutionalized individuals</header><text>In</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7A935714A14743B3BE9F178BB0B87F22"><enum>(2)</enum><text>by adding at the end the following new subclauses:</text>

<subclause id="HC7F111A121A04881BEC001B511B6E8F8"><enum>(II)</enum><header>Certain other individuals</header><text>In the case of an individual who is a full-benefit dual eligible individual and who receives services from a facility or program described in subclause (III), the elimination of any beneficiary coinsurance described in section 1860D–2(b)(2) (for all amounts through the total amount of expenditures at which benefits are available under section 1860D–2(b)(4)).</text></subclause> 
<subclause id="H491830D49DC745FBA0EC00D9EA06003C"><enum>(III)</enum><header>Facility described</header><text>For purposes of subclause (II), a facility or program described in this subclause is a board and care facility, a custodial care facility, a group home, or an assisted living facility (as such terms are defined by the Secretary), or any other facility or program that the Secretary determines provides services without which the individual would require long-term care in a medical institution or nursing facility.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7A152820E9D8448BB03C02E6FBE3C7B1"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="H692DF12DA8724D299385BB129CF9F5AE"><enum>(1)</enum><header>In general</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of section 101 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text></paragraph> 
<paragraph id="HFA82107393574674B96452FB5539504F"><enum>(2)</enum><header>Reimbursement of cost-sharing payments</header><text>The Secretary shall provide for reimbursement of any beneficiary coinsurance described in section 1860D–2(b)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(b)(2)</external-xref>) paid by or on behalf of an individual described in section 1860D–14(a)(1)(D)(i)(II) of such Act, as added by subsection (a), during the period beginning on January 1, 2006, and ending on the date of enactment of this Act.</text></paragraph></subsection></section>
