<official-title>To require the Secretary of Health and Human Services to provide Federal Medicaid funding for State costs associated with ensuring access to prescription drug benefits to part D eligible individuals.</official-title>

<section id="HEA25E497491244D8811C9412D04F3E" section-type="section-one"><enum>1.</enum><header>Federal Medicaid funding for State costs incurred to ensure prescription drug access</header> 
<subsection id="H1EC5843B8ED043AAADF6D55B0003BB1"><enum>(a)</enum><header>Reimbursement of costs</header><text>Notwithstanding section 1935(d)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-5">42 U.S.C. 1396u-5(d)(1)</external-xref>), the Secretary of Health and Human Services shall make available to a State under section 1903(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(a)</external-xref>) Federal financial participation with respect to costs, including administrative costs, incurred by such State (as reported by the State) on or after January 1, 2006—</text> 
<paragraph id="H9222C2516652420FB85CE910BE634416"><enum>(1)</enum><text>for medical assistance for covered part D drugs for full-benefit dual eligible individuals who are enrolled under a prescription drug plan under part D of title XVIII of such Act (or an MA–PD plan under part C of such title) but who were not reasonably able to access on a timely basis prescription drug benefits to which they were entitled under such part; and</text></paragraph> 
<paragraph id="H13064EE6E18F44C0B248B6F500D074B9"><enum>(2)</enum><text>which the State reasonably expected would have been covered under such part.</text></paragraph> </subsection> 
<subsection id="H322F62877F2C4C2D96ABAED1E57FE6F8"><enum>(b)</enum><header>Recovery of reimbursement amounts from plans</header><text>The Secretary of Health and Human Services shall provide for the recovery of the amount of Federal financial participation made available to States under subsection (a) from prescription drug plans under part D of title XVIII of the Social Security Act (and MA–PD plans under part C of such title) if the Secretary determines that such plans should have incurred such costs. Amounts recovered pursuant to the preceeding sentence shall be treated in the same manner as the recovery of third party liability under section 1902(a)(25) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(25)</external-xref>).</text></subsection> 
<subsection id="HB02108626AEE4F35A14B825913456600"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="HBBE3194B98CD4DE19DE3914457C06E5F"><enum>(1)</enum><header>Covered part D drug</header><text>The term <term>covered part D drug</term> has the meaning given such term in section 1860D–2(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(e)</external-xref>).</text></paragraph> 
<paragraph id="HE2E5CB2F4B6D4FD088DA29950742C55E"><enum>(2)</enum><header>Full-benefit dual eligible individual</header><text>The term <term>full-benefit dual eligible individual</term> has the meaning given such term in section 1935(c)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-5">42 U.S.C. 1396u–5(c)(6)</external-xref>).</text></paragraph> 
<paragraph id="H935969EC6F2E49F9ADB32B51AE281B59"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means each of the 50 States and the District of Columbia.</text></paragraph></subsection></section>
