<official-title>To amend titles XVIII and XIX of the Social Security Act to make improvements to payments to Medicare Advantage plans and to reinstate protections in the Medicaid program for working families, their children, and the disabled against excessive out-of-pocket costs, inadequate benefits, and health care coverage loss.</official-title>

<section id="HC4FAA7F991DA419693F3AA4C62A9C82F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Patients Before Profits Act of 2006</short-title></quote>.</text></section> 
<section id="HAF852E65575A4A9AADEB6344DCDBCE20" section-type="subsequent-section"><enum>2.</enum><header>Elimination of certain Medicare Advantage overpayments</header> 
<subsection id="HD7C58F063D874D518CA125CD7AF0951"><enum>(a)</enum><header>In general</header><text>Section 1853(a)(1)(C)(ii) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-23">42 U.S.C. 1395w–23(a)(1)(C)(ii)</external-xref>), as added by section 5301 of the Deficit Reduction Act of 2005, is amended—</text> 
<paragraph id="H2129283796C146198EE8CF5971BFA4F5"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="clause" style="OLC">during phase-out of budget neutrality factor</header-in-text></quote>;</text></paragraph> 
<paragraph id="H3F04E81AE964443BB36E4C7BB7FA2B75"><enum>(2)</enum><text>in the matter preceding subclause (I), by striking <quote>through 2010</quote> and inserting <quote>and subsequent years</quote>; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H10DC824801B24DD700754735E32E9DAD"><enum>(3)</enum><text>in subclause (II), by striking <quote>only for 2008, 2009, and 2010</quote> and inserting <quote>for 2008 and subsequent years</quote>.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HD710A2BD77B14040AC02D7ACE93C943F"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the enactment of section 5301 of the Deficit Reduction Act of 2005.</text></subsection></section> 
<section id="HF6641085EF76480E9E6313F57801D803"><enum>3.</enum><header>Elimination of private insurance slush fund</header> 
<subsection id="HFDEAD830383D4935819400E2E22576FC"><enum>(a)</enum><header>Elimination</header><text>Subsection (e) of section 1858 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-27a">42 U.S.C. 1395w–27a</external-xref>) is repealed.</text></subsection> 
<subsection id="H1A217B1B479A48E1B88965483C291316"><enum>(b)</enum><header>Conforming Amendment</header><text>Section 1858(f)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395w–27a(f)(1)) is amended by striking <quote>subject to subsection (e),</quote>.</text></subsection> 
<subsection id="H468F56A1B7CD4BD7844C4B327C15BF4C"><enum>(c)</enum><header>Effective Date</header><text>The amendments made by this section shall take effect as if included in the enactment of section 221(c) of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat. 2181).</text></subsection></section> 
<section id="HCD5011DAD6E84D56AD5BDAC72BF41DFF"><enum>4.</enum><header>Reinstating protections for adequate benefits and affordable cost sharing</header> 
<subsection id="H9E083EE2F0484DB78BED54BCD0005C7F"><enum>(a)</enum><header>Repeal of state option for alternative premiums and cost sharing</header> 
<paragraph id="HC4808467292345C2AFD6241ED9F10049"><enum>(1)</enum><header>Repeal</header><text>Section 1916A of the Social Security Act, as added by sections 6041(a), 6042(a), and 6043(a) of the Deficit Reduction Act of 2005, is repealed.</text></paragraph> 
<paragraph id="H8543FF1B07E74D8ABF07AE4C2D3EA600"><enum>(2)</enum><header>Conforming amendments</header> 
<subparagraph id="H5840F20CCA6440A2874112D7AAF3AE21"><enum>(A)</enum><text>Subsection (y) of section 1903 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b</external-xref>), as added by section 6043(b) of the Deficit Reduction Act of 2005, is repealed.</text></subparagraph> 
<subparagraph id="H9B20EFA4BB22435CBE5FCBD27ECE7D37"><enum>(B)</enum><text>Section 1916 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o">42 U.S.C. 1396o</external-xref>) is amended—</text> 
<clause id="H305F3CDCF73E4931AB823522ACCB3964"><enum>(i)</enum><text>in subsection (f), by striking <quote>and section 1916A</quote> after <quote>(b)(3)</quote>; and</text></clause> 
<clause id="H4216762738FE40B38ED0C18B40C83CAB"><enum>(ii)</enum><text>by striking subsection (h).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HEF182A4B307049ACAD95004417CFC0D3"><enum>(b)</enum><header>Repeal of state option of providing benchmark benefit packages</header><text>Section 1937 of the Social Security Act, as added by section 6044(a) of the Deficit Reduction Act of 2005, is repealed.</text></subsection> 
<subsection id="H1C1EC346106C4B36B079FC8C30FBF700"><enum>(c)</enum><header>Repeal of health opportunity accounts demonstration</header><text>Section 1938 of the Social Security Act, as added by section 6082 of the Deficit Reduction Act of 2005, is repealed.</text></subsection> 
<subsection id="HE28AA7DBD40F4E8D867DFC9C64FF3743"><enum>(d)</enum><header>Additional conforming amendment</header><text>Section 1939 of the Social Security Act, as redesignated by section 6082 of the Deficit Reduction Act of 2005, is redesignated as section 1937 of the Social Security Act.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H47546577C0F345DCAAFAFCB71FD34309"><enum>(e)</enum><header>Effective date</header><text>The repeals and amendments made by subsections (a) through (d) shall take effect as if included in the enactment of the Deficit Reduction Act of 2005.</text></subsection></section>
