<official-title>To amend the Packers and Stockyards Act, 1921, to make it unlawful for a packer to own, feed, or control livestock intended for slaughter.</official-title>

<section id="HF114206930A94A21B624F55200C913BA" section-type="section-one"><enum>1.</enum><header>Prohibition on packers owning, feeding, or controlling livestock</header> 
<subsection id="H1EFA3DC83F1F4B30BDB6AB503785FE00"><enum>(a)</enum><header>Prohibition</header><text>Section 202 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>), is amended—</text> 
<paragraph id="H854E2115E88B4D2E92CE6D4C9CDBF82D"><enum>(1)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively; and</text></paragraph> 
<paragraph id="H9CCACEE0339E4AF7BAB3BC2C6C4C35D"><enum>(2)</enum><text>by inserting after subsection (e) the following new subsection (f):</text>

<subsection id="H15FE95A4EFFF4DEA95B7EE7DA387A8E8"><enum>(f)</enum><text>Own or feed livestock directly, through a subsidiary, or through an arrangement that gives the packer operational, managerial, or supervisory control over the livestock, or over the farming operation that produces the livestock, to such an extent that the producer is no longer materially participating in the management of the operation with respect to the production of the livestock, except that this subsection shall not apply to—</text> 
<paragraph id="H673929272E17425C8705493C4CEB7185"><enum>(1)</enum><text>an arrangement entered into within 7 days (excluding any Saturday or Sunday) before slaughter of the livestock by a packer, a person acting through the packer, or a person that directly or indirectly controls, or is controlled by or under common control with, the packer;</text></paragraph> 
<paragraph id="HD60C2A733951462CAB1E16EA4583B52B"><enum>(2)</enum><text>a cooperative or entity owned by a cooperative, if a majority of the ownership interest in the cooperative is held by active cooperative members that—</text> 
<subparagraph id="H214AECB7730E492EBB43EE660065C6E"><enum>(A)</enum><text>own, feed, or control livestock; and</text></subparagraph> 
<subparagraph id="H2A26B8AA5FFE482AAFB0005A3D639BC"><enum>(B)</enum><text>provide the livestock to the cooperative for slaughter;</text></subparagraph></paragraph> 
<paragraph id="H1712D35DCE634792BF7F241849B489B6"><enum>(3)</enum><text>a packer that is not required to report to the Secretary on each reporting day (as defined in section 212 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635a">7 U.S.C. 1635a</external-xref>)) information on the price and quantity of livestock purchased by the packer; or</text></paragraph> 
<paragraph id="H115EEB4EEA594CAA8D269E5690E7E9DF"><enum>(4)</enum><text>a packer that owns one livestock processing plant; or</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB178B2D0171640E8AF8D3B9BD8634873"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="H4447738A41A14428A4EBF514027D2E6F"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amendments made by subsection (a) take effect on the date of enactment of this Act.</text></paragraph> 
<paragraph id="HCA237BFD6B51488C9FB45B9DDC00EED7"><enum>(2)</enum><header>Transition rules</header><text>In the case of a packer that, on the date of enactment of this Act, owns, feeds, or controls livestock intended for slaughter in violation of section 202(f) of the Packers and Stockyards Act, 1921 (as added by subsection (a)), such section shall not apply to the packer—</text> 
<subparagraph id="H0769740EC4B341CF81B0CD85609E725"><enum>(A)</enum><text>in the case of a packer of swine, until the end of the 18-month period beginning on the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph id="HC43171C4673F471FA6F4CFF6D7C85526"><enum>(B)</enum><text>in the case of a packer of any other type of livestock, until such date as the Secretary of Agriculture considers practicable, but not later than 180 days after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection></section>
