<official-title>To establish a Federal District Court of American Samoa.</official-title>

<section id="H0750B424C7EC41CDBF921583F89245C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal District Court of American Samoa Act of 2006</short-title></quote>.</text> </section> 
<section id="H697B584F6CC0480FA13472821E5F0789"><enum>2.</enum><header>Federal District Court for American Samoa</header> 
<subsection id="HC085370C71554DBCBE18986B5D9B3705"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established for and within American Samoa a court of record to be known as the Federal District Court of American Samoa. Terms of court shall be held on Tutuila and at such other places in American Samoa and at such times as the court may designate by rule or order.</text></subsection> 
<subsection id="H83971212A4984955B1AD22EAF148CB82"><enum>(b)</enum><header>Jurisdiction of the federal district court</header><text display-inline="yes-display-inline">The jurisdiction of the Federal District Court of American Samoa shall, to the extent that the Constitution and laws of the United States apply to American Samoa, be limited to the jurisdiction of a district court of the United States and that of a bankruptcy court of the United States, except that—</text> 
<paragraph id="HDDDD372E973E4C0AB9C3B7F186F0D68E"><enum>(1)</enum><text>the Federal District Court shall in no case have jurisdiction of a case or proceeding that puts in issue the tenure to any communal lands located in American Samoa, or any matter pertaining to the adjudication of traditional chieftain or matai titles; and</text></paragraph> 
<paragraph id="HF684261ED53B40C4ACC3C5966D194B01"><enum>(2)</enum><text>the Federal District Court and the High Court of American Samoa shall have concurrent jurisdiction over cases involving the interpretation of—</text> 
<subparagraph id="H39A802E440CF4CE7B06F6EF5E92DEF06"><enum>(A)</enum><text>the 1900 Treaty or Deed of Cession between the Islands of Tutuila and Aunu’u and the United States, and the 1904 Treaty or Deed of Cession between Manu’a Islands and the United States; and</text></subparagraph> 
<subparagraph id="H1852F98933D34BC79D2E1883CA45C1E1"><enum>(B)</enum><text>the 1967 Revised Constitution of American Samoa, and any amendments thereto. </text></subparagraph></paragraph> </subsection> 
<subsection id="HB320AD513C46489DA2956699D8ECF9D8"><enum>(c)</enum><header>Relationship between courts of United States and courts of American Samoa</header><text display-inline="yes-display-inline">The relations between the courts established by the Constitution or laws of the United States and the courts of American Samoa with respect to appeals, certiorari, removal of causes, the issuance of writs of habeas corpus, and other matters or proceedings shall be governed by the laws of the United States pertaining to the relations between the courts of the United States, including the Supreme Court of the United States, and the courts of the several States in such matters and proceedings. </text></subsection></section> 
<section id="HE539191FACBE4A86003097C47520F700"><enum>3.</enum><header>Appointment of judge, U.S. attorney, and U.S. marshal</header> 
<subsection id="H858EB90D72A54A95B3AE38DDCB5309DB"><enum>(a)</enum><header>Appointment of judge</header><text>The President shall, by and with the advice and consent of the Senate, appoint a judge for the Federal District Court of American Samoa, who shall hold office for the term of 10 years and until his or her successor is chosen and qualified, unless sooner removed by the President for cause. The judge shall receive a salary payable by the United States which shall be at the rate prescribed for judges of the United States district courts.</text></subsection> 
<subsection id="HDF599EE77D6442FDA3D578107F4C8984"><enum>(b)</enum><header>Temporary assignments</header><text>The Chief Judge of the Ninth Judicial Circuit of the United States may assign a judge of a local court of record in American Samoa, a circuit or district judge of the ninth judicial circuit, or a recalled senior judge of the United States District Court for the District of Hawaii, or the Chief Justice of the United States may assign any other United States circuit or district judge, with the consent of the judge so assigned and of the chief judge of that circuit, to serve temporarily as a judge in the Federal District Court of American Samoa whenever such an assignment is for the proper conduct, administration, and necessary business of the court.</text></subsection> 
<subsection id="H0107701E0F584F4DBDA133D4B7D746E2"><enum>(c)</enum><header>U.S. attorney and U.S. marshal</header><text>The President shall appoint, by and with the advice and consent of the Senate, a United States attorney and United States marshal for American Samoa to whose offices the provisions of chapters 35 and 37 of title 28, United States Code, respectively, shall apply.</text></subsection></section> 
<section id="H10789CA902314F76B5D35B5733145D43"><enum>4.</enum><header>Rules of practice and procedure</header><text display-inline="no-display-inline">Where appropriate, the rules of practice and procedure promulgated and made effective by the Congress or the Supreme Court of the United States pursuant to titles 11, 18, and 28, United States Code, shall apply to the Federal District Court of American Samoa and appeals therefrom; except that the terms <quote>Attorney for the government</quote> and <quote>United States Attorney,</quote> as used in the Federal Rules of Criminal Procedure, shall, when applicable, include the Attorney General of American Samoa or such other person or persons as may be authorized by the laws of American Samoa to act therein.</text></section> 
<section id="H282E9CFE7115477E9E4C62B47963D5DF" section-type="subsequent-section" display-inline="no-display-inline"><enum>5.</enum><header>Technical and conforming amendments</header> 
<subsection id="H4347F84BE28E4A9DB5F3A2819FE5EB11"><enum>(a)</enum><header>Appeals</header><text>The item relating to the Ninth Circuit in the table contained in <external-xref legal-doc="usc" parsable-cite="usc/28/41">section 41</external-xref> of title 28, United States Code, is amended by inserting <quote>American Samoa,</quote> after <quote>Guam,</quote>. </text> </subsection> 
<subsection id="H244D09FA9AEA47AEB4B8D53C5579DA63"><enum>(b)</enum><header>Retirement and survivors’ annuities</header> 
<paragraph id="HE08F748C2FE7427EA9B426C07355D562"><enum>(1)</enum><header>Retirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/373">Section 373</external-xref> of title 28, United States Code, is amended in subsections (a) and (e) by inserting <quote>, the Federal District Court of American Samoa,</quote> after <quote>the District Court of Guam,</quote>. </text></paragraph> 
<paragraph id="HC136548BD66E49F6ACBC7F0092A31F4E"><enum>(2)</enum><header>Survivors’ annuities</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/376">Section 376(a)</external-xref> of title 28, United States Code, is amended in paragraphs (1)(B) and (2)(B) by inserting <quote>the Federal District Court of American Samoa,</quote> after <quote>the District Court of Guam,</quote>.</text></paragraph></subsection> 
<subsection id="H743DF07CC2F344D3A0248B30F8ECCDF2"><enum>(c)</enum><header>U.S. trustee</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/581">Section 581(a)(15)</external-xref> of title 28, United States Code, is amended by inserting <quote>, American Samoa,</quote> after <quote>Guam</quote>. </text> </subsection> 
<subsection id="HCEA379670EB44D7FA81055CD069FF4C6"><enum>(d)</enum><header>Courts defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/610">Section 610</external-xref> of title 28, United States Code, is amended by striking <quote>the United States District Court for the District of the Canal Zone</quote> and inserting <quote>the Federal District Court of American Samoa</quote>.</text></subsection> 
<subsection id="H2A1302158A904B54A402D13D00658610"><enum>(e)</enum><header>Magistrate judges</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/631">Section 631(a)</external-xref> of title 28, United States Code, is amended—</text> 
<paragraph id="H917E4BFBDF004B1CAFDA08DC78A2015F"><enum>(1)</enum><text>in the first sentence, by inserting <quote>, the Federal District Court of American Samoa,</quote> after <quote>United States district court</quote>; and</text></paragraph> 
<paragraph id="HCB00D15A89FE4B7C9025887B6FB938C"><enum>(2)</enum><text>in the second sentence, by inserting <quote>American Samoa,</quote> after <quote>Guam,</quote>.</text></paragraph></subsection> 
<subsection id="H352FD857295D48F9A019D8A654B8D6F"><enum>(f)</enum><header>Court reporters</header><text>The first paragraph of <external-xref legal-doc="usc" parsable-cite="usc/28/753">section 753(a)</external-xref> of title 28, United States Code, is amended—</text> 
<paragraph id="H300F9FB34F5E4EB4971EB71EA0F3514C"><enum>(1)</enum><text>by striking <quote>the United States District Court for the District of the Canal Zone,</quote>; and</text></paragraph> 
<paragraph id="H2ADF72BB87BE464DA97DEA89D163A800"><enum>(2)</enum><text>by inserting <quote>the Federal District Court of American Samoa,</quote> after <quote>the District Court of Guam,</quote>. </text></paragraph></subsection> 
<subsection id="H398D1039F83B4100A75CB48C6B599B25"><enum>(g)</enum><header>Courts of appeals</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/1291">Section 1291</external-xref> of title 28, United States Code, is amended—</text> 
<paragraph id="HC4A4B95EE69D4AB887C517E22DCEA3EF"><enum>(1)</enum><text>by striking <quote>, the United States District Court for the District of the Canal Zone,</quote>; and</text></paragraph> 
<paragraph id="HD9F84BD8CB9F4EDAB866D44E905726D4"><enum>(2)</enum><text>by inserting <quote>the Federal District Court of American Samoa,</quote> after <quote>the District Court of Guam,</quote>.</text></paragraph></subsection> 
<subsection id="H3B105C26BFD64B51AC0021686F90F29E"><enum>(h)</enum><header>Interlocutory decisions</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/1292">Section 1292</external-xref> of title 28, United States Code, is amended—</text> 
<paragraph id="H12192FF619B54932B263AEC6479B2CDE"><enum>(1)</enum><text>in subsection (a)(1)—</text> 
<subparagraph id="H26FD52830AD44831B2A1D09CF4C81570"><enum>(A)</enum><text>by striking <quote>the United States District Court for the District of the Canal Zone,</quote>; and</text></subparagraph> 
<subparagraph id="HCA1192CBD6204CF08EBC5FD7D301D8D0"><enum>(B)</enum><text>by inserting <quote>the Federal District Court of American Samoa,</quote> after <quote>the District Court of Guam,</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H61444359755B4BD300F44961BA44C7C"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)(4)(A), by inserting <quote>the Federal District Court of American Samoa,</quote> after <quote>the District Court of Guam,</quote>.</text></paragraph></subsection> 
<subsection id="H099803BF581B4A6B8930426355A0B9F8"><enum>(i)</enum><header>Circuits in which decisions reviewable</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/1294">Section 1294</external-xref> of title 28, United States Code, is amended—</text> 
<paragraph id="HACA49A0098F24D9E83F175762BA895D"><enum>(1)</enum><text>by striking paragraph (2) and redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively; and</text></paragraph> 
<paragraph id="HADF899D46DB741498B84F162E447A71C"><enum>(2)</enum><text>in paragraph (3), as so redesignated, by inserting <quote>or the Federal District Court of American Samoa</quote> after <quote>Guam</quote>. </text></paragraph></subsection> 
<subsection id="HD4DD8F6911D14DFEAEC100AFAFCE000"><enum>(j)</enum><header>Court of appeals for the Federal circuit</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/1295">Section 1295(a)</external-xref> of title 28, United States Code, is amended in paragraphs (1) and (2)—</text> 
<paragraph id="H8041EDD9E9AB47BBA07CEE968EE23500"><enum>(1)</enum><text>by striking <quote>the United States District Court for the District of the Canal Zone</quote>; and</text></paragraph> 
<paragraph id="H5BC233341AD04B81839636BED694187"><enum>(2)</enum><text>by inserting <quote>the Federal District Court of American Samoa,</quote> after <quote>the District Court of Guam,</quote>.</text></paragraph></subsection> 
<subsection id="H79DEA08C2FE04B60A2F8FBB2A113F74B"><enum>(k)</enum><header>Representation of certain defendants</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3006A">Section 3006A(j)</external-xref> of title 18, United States Code, is amended by inserting <quote>the Federal District Court of American Samoa,</quote> after <quote>the District Court of the Northern Mariana Islands,</quote>.</text></subsection></section> 
<section id="H4FF57EB82315440D94EED08C9795008D"><enum>6.</enum><header>Definition</header><text display-inline="no-display-inline">For purposes of this Act, the term <quote>American Samoa</quote> includes Swains Island and Rose Island. </text></section> 
<section id="H41FA481078244242A47B712300BA2836" commented="no"><enum>7.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect at the end of the 90-day period beginning on the date of the enactment of this Act.</text></section>
