<official-title display="yes">To amend title 18, United States Code, to strengthen protections for law enforcement officers and the public by providing criminal penalties for the fraudulent acquisition or unauthorized disclosure of phone records.</official-title>

<section id="H4F7EE5A0E9FF46AEA39E66CFFA3F34C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telephone Records and Privacy Protection Act of 2006</short-title></quote>.</text> </section> 
<section id="H58D96715E7FF4C52B600A200F65C54D3"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="HB170D524FA4E44ABA88E07F0097C0303"><enum>(1)</enum><text>telephone records can be of great use to criminals because the information contained in call logs may include a wealth of personal data;</text></paragraph> 
<paragraph id="H0CEEFDAD98AA4680AFE0929E0700BBBB"><enum>(2)</enum><text>call logs may reveal the names of telephone users’ doctors, public and private relationships, business associates, and more;</text></paragraph> 
<paragraph id="H351ACF53D654464A8E08B29414AE5AA"><enum>(3)</enum><text>call logs are typically maintained for the exclusive use of phone companies, their authorized agents, and authorized consumers;</text></paragraph> 
<paragraph id="HF211B62A9E7C4C9C81749E7B3916DA6B"><enum>(4)</enum><text>telephone records have been obtained without the knowledge or consent of consumers through the use of a number of fraudulent methods and devices that include—</text> 
<subparagraph id="H4C302C4C2ED04A08909C53B33F720064"><enum>(A)</enum><text>telephone company employees selling data to unauthorized data brokers;</text></subparagraph> 
<subparagraph id="HA72B43233B824F01BA8242BF005E42DA"><enum>(B)</enum><text><quote>pretexting</quote>, whereby a data broker or other person represents that they are an authorized consumer and convinces an agent of the telephone company to release the data; or</text></subparagraph> 
<subparagraph id="H78CB4F14DD8740FBAFF5B74456879EF0"><enum>(C)</enum><text>gaining unauthorized Internet access to account data by improperly activating a consumer’s account management features on a phone company’s webpage or contracting with an Internet-based data broker who trafficks in such records; and</text></subparagraph></paragraph> 
<paragraph id="H61F3C1EB820A4EC0A5A714402508C0A1"><enum>(5)</enum><text>the unauthorized disclosure of telephone records not only assaults individual privacy but, in some instances, may further acts of domestic violence or stalking, compromise the personal safety of law enforcement officers, their families, victims of crime, witnesses, or confidential informants, and undermine the integrity of law enforcement investigations.</text></paragraph></section> 
<section id="H712DA20F81494E71899D23FBE94B5E5E"><enum>3.</enum><header>Fraud and related activity in connection with obtaining confidential phone records information of a covered entity</header> 
<subsection id="H27A818F72EBE40A0954F23C15256A319"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/1038">section 1038</external-xref> the following:</text> 
<quoted-block display-inline="no-display-inline" id="HEEE6CE589EE04E6AA35C2521836EBC94" style="USC"> 
<section id="HB9B998C5A1064BCEA444587B9BBC6964"><enum>1039.</enum><header>Fraud and related activity in connection with obtaining confidential phone records information of a covered entity</header> 
<subsection id="H552F1DE89462438AAC1894A4444DFD67"><enum>(a)</enum><header>Criminal violation</header><text display-inline="yes-display-inline">Whoever, in interstate or foreign commerce, knowingly and intentionally obtains, or attempts to obtain, confidential phone records information of a covered entity, by—</text> 
<paragraph id="H479D3ACD92C2482C85053BE58E003809"><enum>(1)</enum><text>making false or fraudulent statements or representations to an employee of a covered entity;</text></paragraph> 
<paragraph id="H061C4F913C6B49CB9DC55EB057EA779C"><enum>(2)</enum><text display-inline="yes-display-inline">making such false or fraudulent statements or representations to a customer of a covered entity;</text></paragraph> 
<paragraph id="H05D8416746194F8FB83CEEAD19D7BF3D"><enum>(3)</enum><text>providing a document to a covered entity knowing that such document is false or fraudulent; or</text></paragraph> 
<paragraph id="HE2516243782A42CC99F576AA07F3FE88"><enum>(4)</enum><text display-inline="yes-display-inline">accessing customer accounts of a covered entity via the Internet, or by means of conduct that violates section 1030 of this title, without prior authorization from the customer to whom such confidential phone records information relates;</text></paragraph><continuation-text continuation-text-level="subsection">shall be fined under this title, imprisoned for not more than 10 years, or both.</continuation-text></subsection> 
<subsection id="HDDBFB2FC562E4747AC8F5912DFC53C89"><enum>(b)</enum><header>Prohibition on sale or transfer of confidential phone records information</header> 
<paragraph id="H54BAF4C84B124B9597BD708836E6258B"><enum>(1)</enum><text display-inline="yes-display-inline">Except as otherwise permitted by applicable law, whoever, in interstate or foreign commerce, knowingly and intentionally sells or transfers, or attempts to sell or transfer, confidential phone records information of a covered entity, without prior authorization from the customer to whom such confidential phone records information relates, or knowing or having reason to know such information was obtained fraudulently, shall be fined under this title, imprisoned not more than 10 years, or both.</text></paragraph> 
<paragraph id="H88115DA7D5124CE2BC07864FFCE1DB3E"><enum>(2)</enum><text>For purposes of this subsection, the exceptions specified in section 222(d) of the Communications Act of 1934 shall apply for the use of confidential phone records information by any covered entity, as defined in subsection (h).</text></paragraph></subsection> 
<subsection id="HA1A8CB3874D14F109F712D53E31D0888"><enum>(c)</enum><header>Prohibition on purchase or receipt of confidential phone records information</header> 
<paragraph id="H2DD646E6525D4D4DBFE71904109DEC85"><enum>(1)</enum><text>Except as otherwise permitted by applicable law, whoever, in interstate or foreign commerce, knowingly and intentionally purchases or receives, or attempts to purchase or receive, confidential phone records information of a covered entity, without prior authorization from the customer to whom such confidential phone records information relates, or knowing or having reason to know such information was obtained fraudulently, shall be fined under this title, imprisoned not more than 10 years, or both.</text></paragraph> 
<paragraph id="HAE1515A188784F9B8B95790010FE0069"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the exceptions specified in section 222(d) of the Communications Act of 1934 shall apply for the use of confidential phone records information by any covered entity, as defined in subsection (h).</text></paragraph></subsection> 
<subsection id="H6DCA2D5DC5A746A98E74D54DAA783B79"><enum>(d)</enum><header>Enhanced penalties for aggravated cases</header><text display-inline="yes-display-inline">Whoever violates, or attempts to violate, subsection (a), (b), or (c) while violating another law of the United States or as part of a pattern of any illegal activity involving more than $100,000, or more than 50 customers of a covered entity, in a 12-month period shall, in addition to the penalties provided for in such subsection, be fined twice the amount provided in subsection (b)(3) or (c)(3) (as the case may be) of section 3571 of this title, imprisoned for not more than 5 years, or both.</text></subsection> 
<subsection id="H6118E6E675F74A48B4B77F7900FDF651"><enum>(e)</enum><header>Enhanced penalties for use of information in furtherance of certain criminal offenses</header> 
<paragraph id="H55683FFDB733434C817C1CFF57F9C678"><enum>(1)</enum><text>Whoever, violates, or attempts to violate, subsection (a), (b), or (c) knowing that such information may be used in furtherance of, or with the intent to commit, an offense described in section 2261, 2261A, 2262, or any other crime of violence shall, in addition to the penalties provided for in such subsection, be fined under this title and imprisoned not more than 5 years.</text></paragraph> 
<paragraph id="HC0813A319AB7415EB0005E93E99BD5E"><enum>(2)</enum><text display-inline="yes-display-inline">Whoever, violates, or attempts to violate, subsection (a), (b), or (c) knowing that such information may be used in furtherance of, or with the intent to commit, an offense under section 111, 115, 1114, 1503, 1512, 1513, or to intimidate, threaten, harass, injure, or kill any Federal, State, or local law enforcement officer shall, in addition to the penalties provided for in such subsection, be fined under this title and imprisoned not more than 5 years.</text></paragraph></subsection> 
<subsection id="H24370B71A0014E40ABA331BA6EB43AA"><enum>(f)</enum><header>Extraterritorial jurisdiction</header><text>There is extraterritorial jurisdiction over an offense under this section.</text></subsection> 
<subsection id="H98986AADCD2743B8AE738CED535416EF"><enum>(g)</enum><header>Nonapplicability to law enforcement agencies</header><text>This section does not prohibit any lawfully authorized investigative, protective, or intelligence activity of a law enforcement agency of the United States, a State, or political subdivision of a State, or of an intelligence agency of the United States.</text></subsection> 
<subsection id="HA5380562DC554E19889C47009B1590B1"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H788A6E4555CB4C3296EBB1071751008D"><enum>(1)</enum><header>Confidential phone records information</header><text>The term <quote>confidential phone records information</quote> means information that—</text> 
<subparagraph id="H10203307DAC94349B69FE5D1D1BE4FAF"><enum>(A)</enum><text>relates to the quantity, technical configuration, type, destination, location, or amount of use of a service offered by a covered entity, subscribed to by any customer of that covered entity, and kept by or on behalf of that covered entity solely by virtue of the relationship between that covered entity and the customer;</text></subparagraph> 
<subparagraph id="HBDB512BBEA144B34B1417FD5E5E2A038"><enum>(B)</enum><text>is made available to a covered entity by a customer solely by virtue of the relationship between that covered entity and the customer; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H60A0F25CC3B9429E8C467540DDF650C6"><enum>(C)</enum><text display-inline="yes-display-inline">is contained in any bill, itemization, or account statement provided to a customer by or on behalf of a covered entity solely by virtue of the relationship between that covered entity and the customer.</text></subparagraph></paragraph> 
<paragraph id="H4612118AE8AE459DAE9B00619E51785D"><enum>(2)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote>—</text> 
<subparagraph id="HF5552B1D7E724A5C8249CF1A32EB4F9"><enum>(A)</enum><text>has the same meaning given the term <quote>telecommunications carrier</quote> in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE24CB093434D4BFBB89B09056302DE0"><enum>(B)</enum><text display-inline="yes-display-inline">includes any provider of IP-enabled voice service.</text></subparagraph></paragraph> 
<paragraph id="HB22E9490CDFE471BB0EA1300F362CE5"><enum>(3)</enum><header>Customer</header><text>The term <quote>customer</quote> means, with respect to a covered entity, any individual, partnership, association, joint stock company, trust, or corporation, or authorized representative of such customer, to whom the covered entity provides a product or service.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF42C68C2ADCC4FBFB2BA91B12BD4EA17"><enum>(4)</enum><header>IP-enabled voice service</header><text display-inline="yes-display-inline">The term <quote>IP-enabled voice service</quote> means the provision of real-time voice communications offered to the public, or such class of users as to be effectively available to the public, transmitted through customer premises equipment using TCP/IP protocol, or a successor protocol, (whether part of a bundle of services or separately) with interconnection capability such that the service can originate traffic to, or terminate traffic from, the public switched telephone network, or a successor network.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD78784F3E168471898D79E2F7FA2589C"><enum>(b)</enum><header>Chapter analysis</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18, United States Code, is amended by adding after the item relating to section 1038 the following:</text>

<section id="HBD49CB2A7DE94B7ABC88EA55987803F0"><enum>4.</enum><header>Sentencing guidelines</header> 
<subsection id="H969EF97406034DF7BDD3F7C8A4D852F"><enum>(a)</enum><header>Review and Amendment</header><text>Not later than 180 days after the date of enactment of this Act, the United States Sentencing Commission, pursuant to its authority under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994</external-xref> of title 28, United States Code, and in accordance with this section, shall review and, if appropriate, amend the Federal sentencing guidelines and policy statements applicable to persons convicted of any offense under <external-xref legal-doc="usc" parsable-cite="usc/18/1039">section 1039</external-xref> of title 18, United States Code.</text></subsection> 
<subsection id="HD253C9D41DB243E3B36145648D1B4800"><enum>(b)</enum><header>Authorization</header><text>The United States Sentencing Commission may amend the Federal sentencing guidelines in accordance with the procedures set forth in section 21(a) of the Sentencing Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/28/994">28 U.S.C. 994</external-xref> note) as though the authority under that section had not expired.</text></subsection></section>
