<section id="HB3651038D86B42DB9CD642BABAE11F36" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fuel Security and Consumer Choice Act</short-title></quote>.</text></section>

<subsection id="H6800DC1A54974E2500F94108A59DDC4"><enum>(a)</enum><header>Requirement</header> 
<paragraph id="H966C67A9EC94430FAC71EFC77F3E52A"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">Chapter 329</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/32902">section 32902</external-xref> the following:</text>

<section id="HE96B20CFDB8746BD95D5B6FB5CC03AD"><enum>32902A.</enum><header>Requirement to manufacture dual fueled automobiles</header> 
<subsection id="H680778471C2142DB87B27ECC17EA43C6"><enum>(a)</enum><header>Requirement</header> 
<paragraph id="HD125B49EE09F49EB87D37CA8607E7EB3"><enum>(1)</enum><header>In general</header><text>Each manufacturer of new automobiles that are capable of operating on gasoline or diesel fuel shall ensure that the percentage of such automobiles, manufactured in any model year beginning not less than 18 months after the date of enactment of this section and distributed in commerce for sale in the United States, which are dual fueled automobiles is equal to not less than the applicable percentage set forth in the following table:</text>

<paragraph id="H6022FDD4ABE8452F8DFF08E77FE4B0"><enum>(2)</enum><header>Model years</header><text>For purposes of the table under paragraph (1)—</text> 
<subparagraph id="H174B46A3D76F468A9CA23E3E56283E19"><enum>(A)</enum><text>the term <quote>year 1</quote> means the first model year beginning not less than 18 months after the date of enactment of this section;</text></subparagraph> 
<subparagraph id="H857BDDBC8A8943C48159783FF820175"><enum>(B)</enum><text>the term <quote>year 2</quote> means the model year immediately following the model year described in subparagraph (A);</text></subparagraph> 
<subparagraph id="H874589AE370D46D88632EA5B8587FCDF"><enum>(C)</enum><text>the term <quote>year 3</quote> means the model year immediately following the model year described in subparagraph (B);</text></subparagraph> 
<subparagraph id="HF52D735543C44733B1BA1E2710DA0996"><enum>(D)</enum><text>the term <quote>year 4</quote> means the model year immediately following the model year described in subparagraph (C);</text></subparagraph> 
<subparagraph id="HCDA12ED4AED14563B922F2BC9BA22800"><enum>(E)</enum><text>the term <quote>year 5</quote> means the model year immediately following the model year described in subparagraph (D);</text></subparagraph> 
<subparagraph id="H111F6FE7374B48358DE7D57E18F9F852"><enum>(F)</enum><text>the term <quote>year 6</quote> means the model year immediately following the model year described in subparagraph (E);</text></subparagraph> 
<subparagraph id="H718C7DF419734481AABBD65C9EC296BC"><enum>(G)</enum><text>the term <quote>year 7</quote> means the model year immediately following the model year described in subparagraph (F);</text></subparagraph> 
<subparagraph id="H0263D9E4435443CD84593F9F1CF53F60"><enum>(H)</enum><text>the term <quote>year 8</quote> means the model year immediately following the model year described in subparagraph (G);</text></subparagraph> 
<subparagraph id="H40904D1F77F9417BBB46FF9403125BEF"><enum>(I)</enum><text>the term <quote>year 9</quote> means the model year immediately following the model year described in subparagraph (H); and</text></subparagraph> 
<subparagraph id="HBA85446E37674B989440F6A5C8EB7DE"><enum>(J)</enum><text>the term <quote>year 10</quote> means the model year immediately following the model year described in subparagraph (I).</text></subparagraph></paragraph></subsection> 
<subsection id="H8128B4B7547A40C2AF8B2BAAA547F9D"><enum>(b)</enum><header>Production credits for exceeding flexible fuel automobile production requirement</header> 
<paragraph id="H53496B0C32194BD8A2CBFE747C34A7AA"><enum>(1)</enum><header>Earning and period for applying credits</header><text>If the number of dual fueled automobiles manufactured by a manufacturer in a particular model year exceeds the number required under subsection (a), the manufacturer earns credits under this section, which may be applied to any of the 3 consecutive model years immediately after the model year for which the credits are earned.</text></paragraph> 
<paragraph id="H39012BFA78C84060948D59D78939DAD4"><enum>(2)</enum><header>Trading credits</header><text>A manufacturer that has earned credits under paragraph (1) may sell credits to another manufacturer to enable the purchaser to meet the requirement under subsection (a).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE6AE609F41444309BCAEB1BA12E09BE"><enum>(2)</enum><header>Technical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">chapter 329</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/32902">section 32902</external-xref> the following:</text>

<subsection id="HF7D14456D599461EA796E700AAF0E68D"><enum>(b)</enum><header>Activities to promote the use of certain alternative fuels</header><text>The Secretary of Transportation shall carry out activities to promote the use of fuel mixtures containing gasoline or diesel fuel and 1 or more alternative fuels, including a mixture containing at least 85 percent of methanol, denatured ethanol, and other alcohols by volume with gasoline or other fuels, to power automobiles in the United States.</text></subsection></section> 
<section id="HFBAE1A3CB16F423C9B4B1399BA6005F"><enum>3.</enum><header>Manufacturing incentives for dual fueled automobiles</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/32905">Section 32905(b)</external-xref> of title 49, United States Code, is amended—</text> 
<paragraph id="HEE9D106D829B44F8AA3757222D6F315E"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text></paragraph> 
<paragraph id="H6A829D827B6B4787A686C846AD44AD7C"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> before <quote>Except</quote>;</text></paragraph> 
<paragraph id="H7873C46F1EB24235BE1127C2A732B310"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>model years 1993–2010</quote> and inserting <quote>model year 1993 through the first model year beginning not less than 18 months after the date of enactment of the <short-title>Fuel Security and Consumer Choice Act</short-title></quote>; and</text></paragraph> 
<paragraph id="H52C7FAAE74064DD09C64F6B29EE8348D"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<paragraph id="H59EF1AD1BBE0415B9D2538F1AD90E3CE"><enum>(2)</enum><text>Except as provided in paragraph (5) of this subsection, subsection (d) of this section, or section 32904(a)(2) of this title, the Administrator shall measure the fuel economy for each model of dual fueled automobiles manufactured by a manufacturer in the first model year beginning not less than 30 months after the date of enactment of the <short-title>Fuel Security and Consumer Choice Act</short-title> by dividing 1.0 by the sum of—</text> 
<subparagraph id="HA777049CFD924BD1A6D8E85957F798A0"><enum>(A)</enum><text>0.7 divided by the fuel economy measured under section 32904(c) of this title when operating the model on gasoline or diesel fuel; and</text></subparagraph> 
<subparagraph id="H35721D780AA84CFC96C131801CFE49F0"><enum>(B)</enum><text>0.3 divided by the fuel economy measured under subsection (a) when operating the model on alternative fuel.</text></subparagraph></paragraph> 
<paragraph id="H2857CF996DCC4065B9BCB5C787743EE6"><enum>(3)</enum><text>Except as provided in paragraph (5) of this subsection, subsection (d) of this section, or section 32904(a)(2) of this title, the Administrator shall measure the fuel economy for each model of dual fueled automobiles manufactured by a manufacturer in the first model year beginning not less than 42 months after the date of enactment of the <short-title>Fuel Security and Consumer Choice Act</short-title> by dividing 1.0 by the sum of—</text> 
<subparagraph id="H274AB4588D44450AB2C7F4D0002F449"><enum>(A)</enum><text>0.9 divided by the fuel economy measured under section 32904(c) of this title when operating the model on gasoline or diesel fuel; and</text></subparagraph> 
<subparagraph id="H0663FBE1B6094084BB907B47163DA288"><enum>(B)</enum><text>0.1 divided by the fuel economy measured under subsection (a) when operating the model on alternative fuel.</text></subparagraph></paragraph> 
<paragraph id="H4F3291EB639349008848FD546200E1BB"><enum>(4)</enum><text>Except as provided in subsection (d) of this section, or section 32904(a)(2) of this title, the Administrator shall measure the fuel economy for each model of dual fueled automobiles manufactured by a manufacturer in each model year beginning not less than 54 months after the date of enactment of the <short-title>Fuel Security and Consumer Choice Act</short-title> in accordance with section 32904(c) of this title.</text></paragraph> 
<paragraph id="HE1317BD9BDDB41EA92026B22B236C26"><enum>(5)</enum><text>Notwithstanding paragraphs (2) through (4) of this subsection, the fuel economy for all dual fueled automobiles manufactured to comply with the requirements under section 32902A(a) of this title, including automobiles for which dual fueled automobile credits have been used or traded under section 32902A(b) of this title, shall be measured in accordance with section 32904(c) of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
