<section id="H5C676260A8BB4A0C87406BDEB1518FB" section-type="section-one"><enum>1.</enum><header>Prohibition on lobbying by former Members of Congress</header> 
<subsection id="HFDE9CDA1E39A4DD2A4B10061A3A0E6D4"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/207">Section 207(e)</external-xref> of title 18, United States Code, is amended by striking paragraph (1) and inserting the following:</text>

<paragraph id="HD1FB3C9E132C4DD59043007E2F121F00"><enum>(1)</enum><header>Members of Congress and elected officers</header> 
<subparagraph id="H740AC04441BB4E64A56B96899719AF00"><enum>(A)</enum><header>Members of Congress</header> 
<clause id="H13B0701AEDD64E63AEF54BDF54D12992" display-inline="yes-display-inline"><enum>(i)</enum><text>Any person who is a Member of Congress and who, after that person leaves office, knowingly makes, with the intent to influence, any communication to or appearance before any of the persons described in clause (ii), on behalf of any other person (except the United States) in connection with any matter on which such former Member of Congress seeks action by a Member, officer, or employee of either House of Congress, in his or her official capacity, shall be punished as provided in <external-xref legal-doc="usc" parsable-cite="usc/18/216">section 216</external-xref> of this title.</text></clause> 
<clause id="HB4EF276A57BD49F2B9B64FBC889672F4" indent="up1"><enum>(ii)</enum><text>The persons referred to in clause (i) with respect to appearances or communications by a former Member of Congress are any Member, officer, or employee of either House of Congress, and any employee of any other legislative office of the Congress.</text></clause></subparagraph> 
<subparagraph id="H81F060C3DC4047E68FE9E3ED3BBAE01" display-inline="no-display-inline"><enum>(B)</enum><header>Elected officers</header> 
<clause id="H85971F6FCC814E88857BA3148999776E" display-inline="yes-display-inline"><enum>(i)</enum><text>Any person who is an elected officer of either House of Congress and who, within 1 year after that person leaves office, knowingly makes, with the intent to influence, any communication to or appearance before any of the persons described in clause (ii), on behalf of any other person (except the United States) in connection with any matter on which such former Member of Congress or elected officer seeks action by a Member, officer, or employee of either House of Congress, in his or her official capacity, shall be punished as provided in <external-xref legal-doc="usc" parsable-cite="usc/18/216">section 216</external-xref> of this title.</text></clause> 
<clause id="HED73F71BAD9A4EF5A2005BFAF3CB3B22" indent="up1"><enum>(ii)</enum><text>The persons referred to in clause (i) with respect to appearances or communications by a former elected officer are any Member, officer, or employee of the House of Congress in which the elected officer served.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF461249AF14148C38399DFA8C840083"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a)—</text> 
<paragraph id="HDC5B5136C9E5458EBE446C69317EAC12"><enum>(1)</enum><text>shall apply only to persons whose service as a Member of Congress terminates on or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="H67A72A73948D46F39D9855B5E36EE07B"><enum>(2)</enum><text>shall apply to elected officers of either House of Congress as if such amendment were in effect on the day before such date of enactment.</text> </paragraph></subsection></section>
