<section id="H5CE672D999274C87B5E8B2812014C04C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hope for Homeless Kids Act of 2005</short-title></quote>.</text></section> 
<section id="HDF45A008D9D3479AA9B373C379BF98EA" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Assistance for homeless youth</header> 
<subsection id="H3871E2B26A744B1B8EBE29E6C5B43496"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Education shall provide assistance to local educational agencies serving homeless children and youths displaced by Hurricane Katrina, Rita, or Wilma, consistent with section 723 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11433">42 U.S.C. 11433</external-xref>), including identification, enrollment assistance, assessment and school placement assistance, transportation, coordination of school services, supplies, referrals for health, mental health, and other needs.</text></subsection> 
<subsection id="H6A06D04083514874856C83B3636B3D7C"><enum>(b)</enum><header>Exception and distribution of funds</header> 
<paragraph id="HDE9D5D9D2521438CB55808A834CCAE9"><enum>(1)</enum><header>Exception</header><text>For purposes of providing assistance under subsection (a), subsections (c) and (e)(1) of section 722 and subsections (b) and (c) of section 723 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11432">42 U.S.C. 11432(c)</external-xref> and (e)(1), 11433(b) and (c)) shall not apply.</text></paragraph> 
<paragraph id="H4C393E1A3EDC47C683DEA4A2794371EB"><enum>(2)</enum><header>Disbursement</header><text>The Secretary of Education shall disburse funding provided under subsection (a) to State educational agencies based on demonstrated need, as determined by the Secretary, and such State educational agencies shall distribute funds available under subsection (c) to local educational agencies based on demonstrated need, for the purposes of carrying out section 723 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11433">42 U.S.C. 11433</external-xref>).</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC1DE9597CD994A5DB3BA16CF30B1D8D6"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $50,000,000.</text></subsection></section>
