<section id="H0DE5E4CC95944748968373CD3BB5A975" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Group Home Community Notification Act of 2005</short-title></quote>.</text></section> 
<section id="HF8F1871657DD4E71AB7974552F604CBD"><enum>2.</enum><header>Community notice and hearings</header> 
<subsection id="HB64C4D6342BF4925BFE719F8D7F41B9C"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">It shall be unlawful for any Federally assisted non-profit that intends to place a group home in a locality to refuse or fail to comply with all State and local laws for the placement of such a group home in that locality, including laws requiring public notification, reporting requirements, and hearings on the matter. Any individual who participates in such a hearing shall be immune from suit based on a claim of discrimination against the disabled for any communication made in the course of such participation.</text></subsection> 
<subsection id="HE833014C3D41429CA8C54F29D6C2B2E"><enum>(b)</enum><header>Definitions</header><text>In this Act:</text> 
<paragraph id="HCEC60451CE7949EAA271605467358100"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>Federally assisted non-profit</quote> means a not for profit private entity who receives Federal financial assistance;</text></paragraph> 
<paragraph id="H96E9123960944913AA912343B5021FEF"><enum>(2)</enum><text>the term Federal financial assistance has the meaning given that term for the purposes of title VI of the Civil Rights Act of 1964;</text></paragraph> 
<paragraph id="H27A89CC8B9C942BAAA2901E87800F18" display-inline="no-display-inline"><enum>(3)</enum><text>the term <quote>disability</quote> has the meaning given that term for the purposes of the Americans with Disabilities Act of 1990; and</text></paragraph> 
<paragraph id="H5966B1446B824D598FED305CA25EEA4"><enum>(4)</enum><text display-inline="yes-display-inline">the term <quote>group home</quote> has the meaning given that term by the relevant State or local authority.</text> </paragraph></subsection></section>
