<official-title>To establish the Gulf Deregulation Commission.</official-title>

<section id="HED3B218FF8F6418684C676C8CF4797E3" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be referred to as the <quote>Gulf Deregulation Act</quote>. </text></section> 
<section id="H2DD27777CACE4B5F9F27844F00F24630"><enum>2.</enum><header>Establishment of Commission; duties</header> 
<subsection id="H25A2E5F40D9F45BE00FEDB03D05E3D7"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established a Commission to be known as the <quote>Gulf Deregulation Commission</quote> (in this Act referred to as the <quote>Commission</quote>.</text></subsection> 
<subsection id="H33B8566352EA4B7AA8AFFCE3A6EBABB7"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the Commission shall be—</text> 
<paragraph id="HEF97FF1180414B2CBA447200246D66AF"><enum>(1)</enum><text>to identify Federal, State, and local regulations that have the effect of impeding recovery and relief efforts in hurricane disaster areas; and</text></paragraph> 
<paragraph id="H22B064A499EA4724AF524E045CD3E139"><enum>(2)</enum><text>to recommend the temporary suspension of such regulations in accordance with section 6.</text></paragraph></subsection> 
<subsection id="H77F5545A0517424396B6486673294B20"><enum>(c)</enum><header>Consultation</header><text>The Commission shall carry out the duties under subsection (b) in consultation with appropriate Federal, State, and local officials and members of the private sector.</text></subsection> 
<subsection id="HDFF782DFE1054D2280AAE9E8114C6F24"><enum>(d)</enum><header>Hurricane disaster area</header><text>In this Act, the term <quote>hurricane disaster area</quote> means an area in which the President declared the existence of a major disaster under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>)—</text> 
<paragraph id="H094BA81E420748119301F45B3FB00F1"><enum>(1)</enum><text>before September 14, 2005, by reason of Hurricane Katrina; or</text></paragraph> 
<paragraph id="HFB9A6F17A38148F79249E3B31907D0BC"><enum>(2)</enum><text>before October 6, 2005, by reason of Hurricane Rita.</text></paragraph></subsection></section> 
<section id="HEDDDB63861454D4394313F548970D5A"><enum>3.</enum><header>Membership</header> 
<subsection id="HE6AE3E51362347C5B41B3C1B792DA748"><enum>(a)</enum><header>Appointment</header><text>The Commission shall be composed of 12 members appointed by the President, by and with the advice and consent of the Senate.</text></subsection> 
<subsection id="H2AB0DD9FAD87404400BDD87617B4BA00"><enum>(b)</enum><header>Qualifications</header><text>Members of the Commission shall be representatives from Federal, State, and local government agencies and the private sector who have expertise in regulatory and economic development service.</text></subsection> 
<subsection id="HBF9F10E8EEEB48AFBF447541123274F7"><enum>(c)</enum><header>Term</header><text>Each member shall be appointed for the life of the Commission.</text></subsection> 
<subsection id="H341D417D855E41D5A8EC7BB9D8DFBA09"><enum>(d)</enum><header>Vacancies</header><text display-inline="yes-display-inline">A vacancy in the Commission shall be filled in the manner in which the original appointment was made.</text></subsection> 
<subsection id="H75F6A3095A7F4A58A8788700AD279D61"><enum>(e)</enum><header>Deadline for appointments</header><text>Appointments under this subsection shall be made not later than 10 days after the date of the enactment of this Act.</text></subsection> 
<subsection id="H236AE8D7712C4363954CF35542A100D9"><enum>(f)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The Chairperson of the Commission shall be designated by the President at the time of appointment.</text></subsection> 
<subsection id="H1685604217484D6BB6A999000038E3A2"><enum>(g)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum but a lesser number may hold hearings.</text></subsection> 
<subsection id="H27C0105D387544C2A604CED165AD30B0"><enum>(h)</enum><header>Meetings</header><text>The Commission shall meet at least monthly at the call of the Chairperson.</text></subsection></section> 
<section id="HCA6921250C7447FBA4425DFB60856584"><enum>4.</enum><header>Staff</header> 
<subsection id="HE70FF2C732934A67BB8BAE001E97DC12"><enum>(a)</enum><header>Staff</header><text>The Chairperson may appoint and fix the pay of additional personnel as the Chairperson considers appropriate.</text></subsection> 
<subsection id="H700BF828DC60481CA7004101ED265000"><enum>(b)</enum><header>Staff of Federal agencies</header><text>Upon the request of the Commission, the head of any Federal department or agency may detail, on a reimbursable basis, any of the personnel of that department or agency to the Commission to assist it in carrying out its duties under this Act.</text></subsection></section> 
<section id="HC419DFB086B24E97BCCF4E8DB093BFB4"><enum>5.</enum><header>Reports; termination</header> 
<subsection id="H103B1744D82A4664AF705484DC86F67C"><enum>(a)</enum><header>Interim report</header><text>Not later than 30 days after members of the Commission are appointed under section 3, the Commission shall submit to the President, Congress, and the legislature of the State and local government of each hurricane disaster area a report containing its preliminary recommendations.</text></subsection> 
<subsection id="HA463657276E74A9E857246B421B6E050"><enum>(b)</enum><header>Final report</header><text>Not later than 90 days after submitting the interim report under subsection (a), the Commission shall submit to the President and Congress a final report.</text></subsection> 
<subsection id="HC00FF6D2217D4E9192395DD900AEC790"><enum>(c)</enum><header>Termination</header><text>The Commission shall terminate 10 days after submitting its final report pursuant to subsection (b).</text></subsection></section> 
<section id="HC718201BBB3E4E81B600199B24C9F935" commented="no"><enum>6.</enum><header>Suspension of Federal regulations</header> 
<subsection id="H6BE2DFCD5C8041D093C07488E1499C8D" commented="no"><enum>(a)</enum><header>Authority to recommend suspension</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Commission shall have the authority to recommend the suspension, for a period not to exceed 18 months, of any Federal regulation, or part thereof, that it determines—</text> 
<paragraph id="HE1C0666D1D3F4559B6D55EC3653C8B6D" commented="no"><enum>(1)</enum><text>impedes the reconstruction and recovery of any hurricane disaster area; and</text></paragraph> 
<paragraph id="H5549F18712EF4A349204A9537145DA97" commented="no"><enum>(2)</enum><text>imposes a restriction or mandate on public-sector, private-sector, or nonprofit activity.</text></paragraph></subsection> 
<subsection id="H659D72F267EC4D8B8BB880C43C035E59"><enum>(b)</enum><header>Suspension of regulations</header><text>Except as provided in section 7—</text> 
<paragraph id="H16AF1A545DE6476C95D745FC34076B4B"><enum>(1)</enum><text>upon receipt of the final report required under section 5(b), the President shall suspend any Federal regulation recommended for suspension by the Commission for the period recommended by the Commission in accordance with subsection (a); and</text></paragraph> 
<paragraph id="H4A5FCA5C7F27426095FD7C78AD1446A"><enum>(2)</enum><text display-inline="yes-display-inline">a Federal regulation recommended to be suspended by the Commission shall be suspended upon the expiration of the 20-day period beginning on the date on which Congress receives the final report required under section 5(b).</text></paragraph></subsection></section> 
<section id="HFAFCC8ED76F34D6BBF3C50E8C4A2C49D"><enum>7.</enum><header>Congressional disapproval of Commission recommendations</header> 
<subsection id="H1DB596FFF6DA442ABD006529B0E281EC"><enum>(a)</enum><header>Adoption of joint resolution</header><text>If, before the end of the 20-day period beginning on the date on which Congress receives the final report required under section 5(b), Congress adopts a joint resolution expressing disapproval of the recommendations made by the Commission in the report, the President shall not suspend any regulation under section 6 pursuant the recommendations contained in the report.</text></subsection> 
<subsection id="ID727ABC73522C40E99A4A4169D5719A92"> <enum>(b)</enum> <header>Terms of the Resolution</header> <text>For purposes of this section, the term <term>joint resolution</term> means only a joint resolution which is introduced within the 20-day period beginning on the date on which the Commission transmits the final report to the Congress under section 5(b), and—</text> 
<paragraph id="IDCE4EAA1D55F44082B5888537EAE2B54D"> <enum>(1)</enum> <text>which does not have a preamble;</text> </paragraph> 
<paragraph id="ID55C29E510A4243E9B13104B294481004"> <enum>(2)</enum> <text>the matter after the resolving clause of which is as follows: <quote>That Congress disapproves the recommendations of the Gulf Deregulation Commission as submitted by the President on __________</quote>, the blank space being filled in with the appropriate date; and</text> </paragraph> 
<paragraph id="IDB44151FB491E4E889710CA6C551E69E3"> <enum>(3)</enum> <text>the title of which is as follows: <quote>Joint resolution disapproving the recommendations of the Gulf Deregulation Commission.</quote>.</text> </paragraph> </subsection> 
<subsection id="IDA07D5D8FCDB84E7B8F2116E353E0B965"> <enum>(c)</enum> <header>Referral</header> <text display-inline="yes-display-inline">A resolution described in subsection (b) that is introduced in the House of Representatives shall be referred to the Committee on Government Reform of the House of Representatives. A resolution described in subsection (b) introduced in the Senate shall be referred to the Committee on Homeland Security and Governmental Affairs of the Senate.</text> </subsection> 
<subsection id="ID0DBA2E3BE1164E8EB70CD59A222CFDCA"> <enum>(d)</enum> <header>Discharge</header> <text>If the committee to which a resolution described in subsection (b) is referred has not reported such resolution (or an identical resolution) by the end of the 20-day period beginning on the date on which the Commission transmits the final report to the Congress under section 5(b), such committee shall be, at the end of such period, discharged from further consideration of such resolution, and such resolution shall be placed on the appropriate calendar of the House involved.</text> </subsection> 
<subsection id="ID1831AA331FAC4B7EA7450B585951FB94"> <enum>(e)</enum> <header>Consideration</header> 
<paragraph id="ID9C0FE8F497A44B65A97CB8BA22350986" display-inline="no-display-inline"> <enum>(1)</enum><header>Motion to consider</header> 
<subparagraph id="H5FD63953DD85481C9CDF46DA4F958F"><enum>(A)</enum><header>In general</header><text>On or after the third day after the date on which the committee to which such a resolution is referred has reported, or has been discharged (under subsection (d)) from further consideration of, such a resolution, it is in order (even though a previous motion to the same effect has been disagreed to) for any Member of the respective House to move to proceed to the consideration of the resolution. A Member may make the motion only on the day after the calendar day on which the Member announces to the House concerned the Member's intention to make the motion, except that, in the case of the House of Representatives, the motion may be made without such prior announcement if the motion is made by direction of the committee to which the resolution was referred.</text></subparagraph> 
<subparagraph id="HFCBFA90B47C64D51A539598C350076EF"><enum>(B)</enum><header>Waiver of points of order</header><text>All points of order against the resolution (and against consideration of the resolution) are waived.</text></subparagraph> 
<subparagraph id="H0EBA71391E774F74837CCE7218C5F2E"><enum>(C)</enum><header>Privilege</header><text>The motion is highly privileged in the House of Representatives and is privileged in the Senate and is not debatable.</text></subparagraph> 
<subparagraph id="HF03BC5514EFC40BE8C9D0084B7FC833F"><enum>(D)</enum><header>Not subject to certain motions</header><text>The motion is not subject to amendment, or to a motion to postpone, or to a motion to proceed to the consideration of other business.</text></subparagraph> 
<subparagraph id="HA0877079A0F64D329EB8C990241C4B4"><enum>(E)</enum><header>Motion to reconsider</header><text>A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order.</text></subparagraph> 
<subparagraph id="H392A429098A24493A583B61BAA5D6E70"><enum>(F)</enum><header>Motion to proceed to consideration</header><text>If a motion to proceed to the consideration of the resolution is agreed to, the respective House shall immediately proceed to consideration of the joint resolution without intervening motion, order, or other business, and the resolution shall remain the unfinished business of the respective House until disposed of.</text> </subparagraph></paragraph> 
<paragraph id="IDF4633E8C766446C1923CC202CDC556CC"> <enum>(2)</enum><header>Debate</header> <text>Debate on the resolution, and on all debatable motions and appeals in connection therewith, shall be limited to not more than 2 hours, which shall be divided equally between those favoring and those opposing the resolution. An amendment to the resolution is not in order. A motion further to limit debate is in order and not debatable. A motion to postpone, or a motion to proceed to the consideration of other business, or a motion to recommit the resolution is not in order. A motion to reconsider the vote by which the resolution is agreed to or disagreed to is not in order.</text> </paragraph> 
<paragraph id="ID281B8B586B3249F79218253DB99FFDD9"> <enum>(3)</enum><header>Final passage</header> <text>Immediately following the conclusion of the debate on a resolution described in subsection (b) and a single quorum call at the conclusion of the debate if requested in accordance with the rules of the appropriate House, the vote on final passage of the resolution shall occur.</text> </paragraph> 
<paragraph id="IDFC63E089BD8C49D482586BD2CEE9B13C"> <enum>(4)</enum><header>Appeals from decisions of the Chair</header> <text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate or the House of Representatives, as the case may be, to the procedure relating to a resolution described in subsection (b) shall be decided without debate.</text> </paragraph> </subsection> 
<subsection id="IDC17F36C4E0C84C9EA374E0DE08088A4D"> <enum>(f)</enum> <header>Consideration by Other House</header> 
<paragraph id="IDBCF8D32B29DD45A0A4BA378DE4892197" display-inline="no-display-inline"> <enum>(1)</enum><header>Applicable procedures</header> <text>If, before the passage by one House of a resolution of that House described in subsection (b), that House receives from the other House a resolution described in subsection (b), then the following procedures shall apply:</text> 
<subparagraph id="ID27B20521E23740BD8F3DDBD0E6B6F2DE"> <enum>(A)</enum><header>Referral and consideration</header> <text>The resolution of the other House shall not be referred to a committee and may not be considered in the House receiving it except in the case of final passage as provided in subparagraph (B)(ii).</text> </subparagraph> 
<subparagraph id="IDB851F1B0ED664565896AA385AA12C835"> <enum>(B)</enum><header>Other procedures</header> <text>With respect to a resolution described in subsection (b) of the House receiving the resolution—</text> 
<clause id="IDCD56D954BD4D40728D148C56D53AE039"> <enum>(i)</enum> <text>the procedure in that House shall be the same as if no resolution had been received from the other House; but</text> </clause> 
<clause id="ID0B0E9B7C67824F579A29FFF0863A7875"> <enum>(ii)</enum> <text>the vote on final passage shall be on the resolution of the other House.</text> </clause> </subparagraph> </paragraph> 
<paragraph id="ID3EB6BA2167884E458218A3208FB31156"> <enum>(2)</enum><header>Disposition</header> <text>Upon disposition of the resolution received from the other House, it shall no longer be in order to consider the resolution that originated in the receiving House.</text> </paragraph> </subsection> 
<subsection id="IDF5BB3D53AE54444D9C825EA96A9BCD55"> <enum>(g)</enum> <header>Rules of the Senate and House</header> <text>This section is enacted by Congress—</text> 
<paragraph id="IDEB7BC9EE47204F8B84C595281887892F"> <enum>(1)</enum> <text>as an exercise of the rulemaking power of the Senate and House of Representatives, respectively, and as such it is deemed a part of the rules of each House, respectively, but applicable only with respect to the procedure to be followed in that House in the case of a resolution described in subsection (b), and it supersedes other rules only to the extent that it is inconsistent with such rules; and</text> </paragraph> 
<paragraph id="ID32C791617D754B7AA060485A16565C4F"> <enum>(2)</enum> <text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text> </paragraph> </subsection></section> 
<section id="HC6D9F48C798B4F88A187F69C26A900C2" commented="no"><enum>8.</enum><header>Reinstatement of regulations</header> 
<subsection id="H7A34823532CA4FFAA829CE82B9F2335"><enum>(a)</enum><header>Reinstatement</header><text>A regulation suspended pursuant to section 6 may be reinstated by the head of the department or agency responsible for administering the regulation pursuant to a determination that the benefits of reinstating such regulation outweigh the costs. Such determination shall be subject to direction from or reversal by the President.</text></subsection> 
<subsection id="H899C6B841A694C39BD9F15F50F39C89"><enum>(b)</enum><header>Administrative Procedure</header><text>The reinstatement of a regulation under this subsection shall be made in accordance with subchapter II of chapter 5 and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code and with any other relevant provision of law, including any Executive Order, that applies to the issuance of regulations.</text></subsection></section>
