<section id="HF0204CF2A1534CEB9CAA9EAE4B33AF36" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Corporate Accountability Act of 2004</short-title></quote>.</text></section> 
<section id="H5815D010F7B84BCEACAFB6BBFE17F47D"><enum>2.</enum><header>Excise tax on termination of retiree prescription drug coverage</header> 
<subsection id="HBD9D32C7415E4BF7A2FB8C52BDA71401"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/47">Chapter 47</external-xref> of the Internal Revenue Code of 1986 (relating to certain group health plans) is amended by adding at the end the following new section:</text>

<section id="H0B34858E4CC14DC4A798A2E5B35FE09E"><enum>5000A.</enum><header>Termination of retiree prescription drug coverage</header> 
<subsection id="H1C5393CB96D646E19FE9F6994D6C0910"><enum>(a)</enum><header>In general</header><text>There is hereby imposed on any employer or employee organization that contributes to a group health plan (as defined in section 5000(b)) a tax on the termination of the provision of prescription drug benefits to any qualified retiree under the plan.</text></subsection> 
<subsection id="HFF3D95844733432AB6F07D59D48D708C"><enum>(b)</enum><header>Rate of tax</header><text>The rate of tax imposed under the section is—</text> 
<paragraph id="H5AB144FA18344B759B87FC306173DB4E"><enum>(1)</enum><text>$750 in the case of a qualified retiree with self-only prescription drug coverage under the plan (determined at the time of the termination of benefits), and</text></paragraph> 
<paragraph id="H48405620063747F6B161C21B05C9055B"><enum>(2)</enum><text>$1,500 in the case of any other qualified retiree.</text></paragraph></subsection> 
<subsection id="HC2F77C80A65B4FAB8DB83BE4D61C587C"><enum>(c)</enum><header>Qualified retiree</header><text>For purposes of this section, the term <term>qualified retiree</term> means any former employee of the employer—</text> 
<paragraph id="H5EE00ADC46E94982B16BDDB1EB4FDE35"><enum>(1)</enum><text>who attained age 65 before the termination of benefits referred to in subsection (a), and</text></paragraph> 
<paragraph id="H93C28B27F6C948DE9EB68400CC4E5182"><enum>(2)</enum><text>whose employment with the employer terminated before the date of the enactment of this section.</text></paragraph></subsection> 
<subsection id="H53CB0D6BC9A2464A9C4F2EA313241FD9"><enum>(d)</enum><header>Regulations</header><text>The Secretary may issue regulations to carry out the purposes of this section, including regulations with respect to the meaning of the terms <term>termination</term> and <term>prescription drug benefits</term>.</text></subsection> 
<subsection id="H1A3440A50EAA4CB695148524537CFCD4"><enum>(e)</enum><header>Transfers to medicare prescription drug account</header><text>The Secretary shall from time to time transfer from the general fund of the Treasury to the Medicare Prescription Drug Account in the Federal Supplementary Medical Insurance Trust Fund amounts equal to the taxes imposed under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H52CBEBB4D6364822B03C9DAE2DB9CCBC"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended by adding at the end the following new item:</text>

<toc-entry level="section">Sec. 5000A. Termination of retiree prescription drug coverage</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAFF0F736EFCA4692B5D79C7B372EADB9"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to terminations of benefits which take effect on or after the date of the enactment of this Act.</text> </subsection></section>
