<official-title>To amend the Terrorism Risk Insurance Act of 2002 to establish a Commission on Terrorism Risk Insurance, and for other purposes.</official-title>

<section id="H0FF502EDE7184DF5A478BA40A6C748B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commission on Terrorism Risk Insurance Act of 2005</short-title></quote>.</text></section> 
<section id="H4AFB0165AD194DE19919AF38B53A32"><enum>2.</enum><header>Establishment of Commission on Terrorism Risk Insurance</header><text display-inline="no-display-inline">Title I of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended by adding at the end the following new section:</text>

<section id="H06F9D180AF1C4128BD65564B02E439B1"><enum>109.</enum><header>Commission on Terrorism Risk Insurance</header> 
<subsection id="H8B8AF1E7E9CC4970B8971E8B956498DB"><enum>(a)</enum><header>In general</header><text>There is hereby established the Commission on Terrorism Risk Insurance (in this section referred to as the <quote>Commission</quote>).</text></subsection> 
<subsection id="H82BE56611D2A4A419CECD93435664FF7"><enum>(b)</enum><header>Membership</header> 
<paragraph id="HA5C552AEB7094AC78956EF4160F834C"><enum>(1)</enum><text>The Commission shall consist of 11 members, as follows:</text> 
<subparagraph id="HA198D0DADE504E4CA0EE17EC7C6F1240"><enum>(A)</enum><text>The Secretary of the Treasury or the Secretary’s designee.</text></subparagraph> 
<subparagraph id="H8C3C91E7AD0B475391C695B0E6356BA0"><enum>(B)</enum><text>One State insurance commissioner designated by the members of the NAIC.</text></subparagraph> 
<subparagraph id="HE1ACEE7F67D34E5CBF5F2536E78B2735"><enum>(C)</enum><text>Nine members appointed by the President, who shall be—</text> 
<clause id="H3CB9A3E66781402881210868494791F8"><enum>(i)</enum><text display-inline="yes-display-inline">a representative of State legislatively created workers' compensation funds;</text></clause> 
<clause id="HEE2001C0E1DC4774966934552047172C"><enum>(ii)</enum><text>a representative of property and casualty insurers with direct written premium of $1,000,000,000 or less;</text></clause> 
<clause id="H1362886BE04B4E39ADD01F6004EABCE"><enum>(iii)</enum><text>a representative of property and casualty insurers with direct written premium of more than $1,000,000,000;</text></clause> 
<clause id="H388D89D4BF234762B9A19E2B7C5F626E"><enum>(iv)</enum><text>a representative of multiline insurers;</text></clause> 
<clause id="H7D0E2B422D13492780F9DBED07FBDC9B"><enum>(v)</enum><text>a representative of independent insurance agents;</text></clause> 
<clause id="H1DB41E97EC6C4CB2B1B9E76F467D4251"><enum>(vi)</enum><text>a representative of insurance brokers;</text></clause> 
<clause id="H69C1B4EA7F704E48A1E6C4285DFB2204"><enum>(vii)</enum><text>a policyholder representative;</text></clause> 
<clause id="H21CEB57BD1BF4A2B9D5C4F64DA0001F7"><enum>(viii)</enum><text display-inline="yes-display-inline">a representative of the survivors of the victims of the attacks of September 11, 2001; and</text></clause> 
<clause id="HF5B7BB394210481E85EB738399528CBB"><enum>(ix)</enum><text display-inline="yes-display-inline">a representative of the reinsurance industry.</text></clause></subparagraph></paragraph> 
<paragraph id="H977F340C16B4456DBB5FBFA9FA01DA44"><enum>(2)</enum><header>Secretary</header><text>The Program Director of the Terrorism Risk Insurance Act shall serve as Secretary of the Commission. The Secretary of the Commission shall determine the manner in which the Commission shall operate, including funding and staffing.</text></paragraph></subsection> 
<subsection id="HBD7F8DAD502B404D864BF29BC7E66362" display-inline="no-display-inline"><enum>(c)</enum><header>Duties</header> 
<paragraph id="H1139FB77F33F4CB8AB8248883B809E25"><enum>(1)</enum><header>In general</header><text>The Commission shall identify and make recommendations regarding—</text> 
<subparagraph id="H56A09363919D48338CF6B224232E434"><enum>(A)</enum><text>possible actions to encourage, facilitate, and sustain provision by the private insurance industry in the United States of affordable coverage for losses due to an act or acts of terrorism;</text></subparagraph> 
<subparagraph id="HEAA98D8698D54A3C99002E56C9B6A3A3"><enum>(B)</enum><text>possible actions or mechanisms to sustain or supplement the ability of the insurance industry in the United States to cover losses resulting from acts of terrorism in the event that—</text> 
<clause id="H9DFCAA35A9E047499BB02B5FBF04A497"><enum>(i)</enum><text>such losses jeopardize the capital and surplus of the insurance industry in the United States as a whole; or</text></clause> 
<clause id="H22799B49C5CB47C7939200B08027B45"><enum>(ii)</enum><text>other consequences from such acts occur, as determined by the Commission, that may significantly affect the ability of the insurance industry in the United States to independently cover such losses; and</text></clause></subparagraph> 
<subparagraph id="H65781463C8D24E0293FCC259709DB000"><enum>(C)</enum><text>significantly reducing the expected Federal role over time in any continuing Federal terrorism risk insurance program.</text></subparagraph></paragraph> 
<paragraph id="HE91D7AB739A2411C831408690031AFAB" display-inline="no-display-inline"><enum>(2)</enum><header>Evaluations</header><text>In identifying and making the recommendations required under paragraph (1), the Commission shall specifically evaluate the utility and viability of risk-sharing mechanisms under which insurers voluntarily reinsure terrorism losses between and among themselves that are not subject to reimbursement under section 103, a Federally created or mandated reinsurance facility, empowering such a facility to issue pre-event financing bonds, post-event financing bonds, assessments, single or multiple pooling arrangements, and other risk sharing arrangements to accomplish, in whole or in part, the specified objectives.</text></paragraph> 
<paragraph id="H899519FD163A40E4A98B5C63CA7CB5FD" display-inline="no-display-inline"><enum>(3)</enum><header>Redevelopment assessment</header><text display-inline="yes-display-inline">The Commission shall also evaluate whether or not coverage under the Program under this Act is necessary to permit redevelopment at the sites of any previous acts of terrorism. If the Commission determines that the market will not provide for renewal of, or generation of new, insurance contracts necessary to permit such redevelopment, the Commission shall recommend coverage under the Program under this Act, or a variation of such Program, that will facilitate the completion of such a redevelopment project.</text></paragraph> 
<paragraph id="H415FA823C0ED47DE9255B2DDCBAA265B"><enum>(4)</enum><header>Report</header> 
<subparagraph id="H50154D0FC63540E08E9F5781E36ED171"><enum>(A)</enum><header>In general</header><text>Not later than the date determined under subparagraph (B), the Commission shall submit a report to the Secretary and the Congress that—</text> 
<clause id="HD0CFC71936424B16805676632FCEC600"><enum>(i)</enum><text>evaluates and makes recommendations regarding whether there is a need for a Federal terrorism risk insurance program and, if so, makes a specific, detailed recommendation for the replacement of the Program, including specific, detailed recommendations for the creation of a terrorism reinsurance facility or facilities or single or multiple pooling arrangements, or both; and</text></clause> 
<clause id="H06AFF2DC2519428E9C7688C361D2CE78"><enum>(ii)</enum><text>includes the evaluation, determination, and any recommendation required under paragraph (3).</text></clause></subparagraph> 
<subparagraph id="HDA1D125EB49A405E88CF81B32BE953C4"><enum>(B)</enum><header>Timing</header><text>The date determined under this subparagraph is—</text> 
<clause id="HD8A8DE2C43C441DCB89BDC726781E964"><enum>(i)</enum><text>except as provided in clause (ii), the date that occurs 6 months after the date of the enactment of this Act; or</text></clause> 
<clause id="H9B94BBDD10864AB5AF170122C2FE6825"><enum>(ii)</enum><text display-inline="yes-display-inline">the date of such termination of the Program (as so extended), if, before the the date under clause (i), the date of the termination of the Program under this Act is extended to a date that occurs after such date under clause (i) .</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H065AEE1E76C04F398B3D004B7FA4C2D2"><enum>3.</enum><header>Extension of program to provide for redevelopment of previous terrorism sites</header><text display-inline="no-display-inline">Section 108(a) of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended—</text> 
<paragraph id="HB66FF32B11634468B7011436E9122291"><enum>(1)</enum><text>by striking <quote>(a) <header-in-text level="subsection" style="OLC">Termination of program.</header-in-text>—The Program</quote> and inserting the following: </text> 
<quoted-block style="OLC" id="H87222E49D1024E17952CE8981C5659CB" display-inline="no-display-inline"> 
<subsection id="H8A497DBC984644C4B6934BC9CA60ACBF"><enum>(a)</enum><header>Termination of program</header> 
<paragraph id="H779A81E6EC7847D380AC11EC57829275"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Program</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6C57F11764BC4AEAA7FC51A5490092F4"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text> 
<quoted-block style="OLC" id="H5E73E9E9392F4922B6CC56E1DB50D5BE" display-inline="no-display-inline"> 
<paragraph id="H8693CF3BD99349AA80250638F85789DF"><enum>(2)</enum><header>Extension of program to provide for redevelopment of previous terrorism sites</header><text display-inline="yes-display-inline">If the Commission determines in the report submitted to the Secretary pursuant to section 109(c)(4) that the market will not provide for renewal of, or generation of new, insurance contracts necessary to permit redevelopment at the site of a previous act of terrorism, the Program shall remain in effect as provided under paragraph (3) and the Secretary shall immediately take such action as may be necessary to extend the Program in accordance with paragraph (3) and the recommendations of the Commission set forth in such report.</text></paragraph> 
<paragraph id="H5D03292C15D243EB82339838D0AA283E"><enum>(3)</enum><header>Scope of extended program</header><text>If the Program is extended pursuant to paragraph (2), the Program—</text> 
<subparagraph id="H33A31C93D2834ADCA6823B8EC4CD8E05"><enum>(A)</enum><text display-inline="yes-display-inline">shall provide coverage, during such extension, only with respect to insured losses under property and casualty insurance coverage (including builder’s risk policies) as the Secretary determines is appropriate and in accordance with the recommendations in the report of the Commission under section 109(c)(4), to permit redevelopment at the site of a previous act or terrorism; and</text></subparagraph> 
<subparagraph id="HD9DAFEB3F65F4D1893894BB19778A12B"><enum>(B)</enum><text>shall remain in effect as provided under subparagraph (A) only with respect to any contracts for such property and casualty insurance in connection with such redevelopment that are issued on or before December 31, 2008.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H1A7C251D9B704AA2A8A6BC6B3E78BD9D"><enum>4.</enum><header>Coverage of domestic terrorism</header><text display-inline="no-display-inline">Section 102(1)(A)(iv) of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended by striking <quote>acting on behalf of any foreign person or foreign interest,</quote>. </text> </section>
