<official-title>To increase the use and research of sustainable building design technology, and for other purposes.</official-title>

<section id="H0B98E47EF83B4933AFC5FE4097B3007C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>High-Performance Buildings Act of 2005</short-title></quote>.</text></section> 
<section id="H819E567FF4454EC2B231189085004B8B"><enum>2.</enum><header>Including sustainable development in housing strategy</header><text display-inline="no-display-inline">Section 105(b) of the Cranston-Gonzalez National Affordable Housing Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12705">42 U.S.C. 12705(b)</external-xref>) is amended—</text> 
<paragraph id="HA38AF8DE9CF1406595886C89572F147D"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (19);</text></paragraph> 
<paragraph id="H4ADAF45C2CB94EC09097850090343C98"><enum>(2)</enum><text>by striking the period at the end of paragraph (20) and inserting <quote>; and</quote>;</text></paragraph> 
<paragraph id="H53B56F7909CF4C8CB28F93517371D1A2"><enum>(3)</enum><text>and by inserting after paragraph (20) the following:</text> 
<quoted-block style="OLC" id="H55E0AEE136204C85A3451844D6FF7F47" display-inline="no-display-inline"> 
<paragraph id="HB4D926BBB6B645F1B6441128BB81C280"><enum>(21)</enum><text>describe the jurisdiction’s strategies to encourage sustainable development for affordable housing, as measured by—</text> 
<subparagraph id="H7BBEC682920B40929745EDD74523547"><enum>(A)</enum><text>greater energy efficiency;</text></subparagraph> 
<subparagraph id="H7DB1162543514D8981964D5EE0D3016E"><enum>(B)</enum><text>increased conservation and reuse of resources;</text></subparagraph> 
<subparagraph id="H8F0DDB73499F4FACADFED253AE50213C"><enum>(C)</enum><text>more effective use of existing infrastructure; and</text></subparagraph> 
<subparagraph id="HD41E95F7166548089DB580D761AEE3E0"><enum>(D)</enum><text>such other criteria as the Secretary determines are in accordance with the purposes of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HCC21FBA49DC942DA9900A6E49DB7D05B"><enum>3.</enum><header>Grant program to increase sustainable low-income community development capacity</header> 
<subsection id="H51B48E917C6945A6BB648900A49CE4D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development may make grants to nonprofit organizations to use for any of the following purposes:</text> 
<paragraph id="H04A089ECCDC144AFB34B031F59012C19"><enum>(1)</enum><text>Training, educating, supporting, or advising an eligible community development organization in improving energy efficiency, resource conservation and reuse, and effective use of existing infrastructure in affordable housing and economic development activities in low-income communities.</text></paragraph> 
<paragraph id="HAB350E2516364BD7A32833D0D47F786"><enum>(2)</enum><text>Providing loans, grants, or predevelopment assistance to eligible community development organizations to carry out energy efficiency improvements, resource conservation and reuse, and effective use of existing infrastructure in affordable housing and economic development activities in low-income communities.</text></paragraph> 
<paragraph id="HACCB951DE0A5410F00BB421445D22251"><enum>(3)</enum><text>Such other purposes as the Secretary determines are in accordance with the purposes of this subsection.</text></paragraph></subsection> 
<subsection id="H4ED4C6DAE9684EDBB1EDF3BBEF554DE"><enum>(b)</enum><header>Application requirement</header><text>To be eligible for a grant under this section, a nonprofit organization shall prepare and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> 
<subsection id="H52CB06453BF54D7EB1A8FED92C3760DD" commented="no"><enum>(c)</enum><header>Matching requirement</header><text>A grant made under this section may not exceed the amount that the nonprofit organization receiving the grant certifies, to the Secretary, will be provided (in cash or in kind) from non-governmental sources to carry out the purposes for which the grant is made.</text></subsection> 
<subsection id="H8BA74966CB234647882932106FD9A000"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H946CF4ED41B54E408246BD9F554C173F"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>nonprofit organization</term> has the meaning given such term in section 104 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12704">42 U.S.C. 12704</external-xref>).</text> </paragraph> 
<paragraph id="HE277054D779A4107B02BB9B611FB924"><enum>(2)</enum><text>The term <term>eligible community development organization</term> means—</text> 
<subparagraph id="HF204177EF45249778DB754E3529EA8AD"><enum>(A)</enum><text display-inline="yes-display-inline">a unit of general local government (as defined in section 104 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12704">42 U.S.C. 12704</external-xref>);</text></subparagraph> 
<subparagraph id="HB83D895B2AB44D7187811585ACFD373D"><enum>(B)</enum><text display-inline="yes-display-inline">a community housing development organization (as defined in section 104 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12704">42 U.S.C. 12704</external-xref>); or</text></subparagraph> 
<subparagraph id="H7B6EC742F1E944D4B29BDC804232DE47"><enum>(C)</enum><text>a tribal government (as defined in section 421 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/658">2 U.S.C. 658</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H8B531CF2243C477FA6561B7EED2296E2"><enum>(3)</enum><text>The term <term>low-income community</term> means a census tract in which 50 percent or more of the households have an income which is less than 80 percent of the greater of—</text> 
<subparagraph id="H6A0C9FEAACCD4BF5ACC00C48FFD100"><enum>(A)</enum><text>the area median gross income for such year for the area in which such census tract is located; or</text></subparagraph> 
<subparagraph id="H58E8164EF04B4FB6A5C9241063DB97BD"><enum>(B)</enum><text>the median gross income for such year for the State in which such census tract is located.</text></subparagraph></paragraph></subsection> 
<subsection id="H3D9DDA66615D4ED0844662CD0006D841"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary to carry out this section $10,000,000 for each of fiscal years 2007 through 2011.</text></subsection></section> 
<section id="H8BD38F90E84841788F002E34E31E91A3" commented="no"><enum>4.</enum><header>Sustainable building institute</header><text display-inline="no-display-inline">The National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1861">42 U.S.C. 1861 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HC8387EEAD51240F587B7EF491D6258A1" display-inline="no-display-inline"> 
<section id="H01CF28C747BC451E8DFDE746CADFF25C"><enum>17.</enum><header>Sustainable building institute</header> 
<subsection id="HD4702D6E4B404DD6A269AF049B161033"><enum>(a)</enum><header>Establishment</header><text>There is established within the Foundation a Sustainable Building Institute (hereinafter in this section referred to as the <quote>Institute</quote>).</text></subsection> 
<subsection id="HEDF57A31E38F4AE0B71D29EA002EC79E"><enum>(b)</enum><header>Duties and functions</header> 
<paragraph id="H7421C6F97B2746C79D93DF2411B6CDB"><enum>(1)</enum><header>Undertaking and supporting research and other activities</header><text>The Institute shall undertake, or support through providing grants, loans, or other forms of assistance—</text> 
<subparagraph id="HD89957F74F3D4CED85DB0037406DE464"><enum>(A)</enum><text>research regarding the relationships among indoor environmental quality, human health, and human productivity; and</text></subparagraph> 
<subparagraph id="HE68F79F3A10B4F128EDD2E1CE0B392FB"><enum>(B)</enum><text>research, development, and commercial application of energy efficiency and renewable energy technologies for buildings, including—</text> 
<clause id="H37C28A7A29D641EF90B4DD977BD34FBB"><enum>(i)</enum><text>water heating systems and lighting systems;</text></clause> 
<clause id="H3FD7798E2277409885B1D425EC620053"><enum>(ii)</enum><text>building insulation technology;</text></clause> 
<clause id="HAEDED35DCF104695A757FAABCBD4DF93"><enum>(iii)</enum><text>technology and methods for improving the cost effectiveness of fuel cells; and</text></clause> 
<clause id="H8592716AB46F42A59E832ECAEC878145"><enum>(iv)</enum><text>technology and methods for reducing the installation costs of solar photovoltaic energy systems.</text></clause></subparagraph></paragraph> 
<paragraph id="H4F8711D63E61466CABA7DAD680E34DB1"><enum>(2)</enum><header>Consultation to avoid duplication</header><text>The Institute shall consult with other Federal agencies to avoid duplication of activities authorized under this subsection.</text></paragraph> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></section>
