<official-title>To amend title XIX of the Social Security Act to provide for an on-going cost-of-living increase in the Medicaid disproportionate share hospital (DSH) allotments for States.</official-title>

<section id="H14B9325DF96A46B900EAED4FEA713010" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disproportionate Share Hospital Assistance Act of 2005</short-title></quote>. </text></section> 
<section id="H763D8EA4F8B34150966EA8D54F07D800"><enum>2.</enum><header>Annual CPI increase in Medicaid DSH allotments</header> 
<subsection id="H9F1E9407253B49B28DABEEC484B5CE81"><enum>(a)</enum><header>In general</header><text>Section 1923(f)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-4">42 U.S.C. 1396r–4(f)(3)</external-xref>) is amended—</text> 
<paragraph id="H28BECDB951EE4A6DAFB7B2022220E701"><enum>(1)</enum><text>in subparagraph (C)—</text> 
<subparagraph id="HE9F98AC775C44C469660A7C6999C0292"><enum>(A)</enum><text>by amending the heading to read as follows: <quote><header-in-text level="subparagraph" style="OLC">State DSH allotments for fiscal year 2004 and thereafter</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="H9E458632EFE3477CACDF766814A00029"><enum>(B)</enum><text>by striking <quote>and</quote> at the end of clause (i);</text></subparagraph> 
<subparagraph id="HCC71261B77734229863B2E2C2D37F248"><enum>(C)</enum><text>by amending clause (ii) to read as follows:</text> 
<quoted-block style="OLC" id="HF879797BC98743BFA51B9032C340A8B4" display-inline="no-display-inline"> 
<clause id="HEC1CCA1C0589416A96C133011B28108"><enum>(ii)</enum><text display-inline="yes-display-inline">for fiscal year 2005 and for fiscal year 2006 is equal to the DSH allotment for the State for fiscal year 2004 under this paragraph, notwithstanding subparagraph (B); and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H15FFB5B1CE4C48A8A4EB1FEB1E281351"><enum>(D)</enum><text>by adding at the end the following new clause:</text>

<clause id="H13BCA9786078481895DFA97111944853"><enum>(iii)</enum><text display-inline="yes-display-inline">for each succeeding fiscal year is equal to the DSH allotment for the State for the previous fiscal year increased by the percentage change in the consumer price index for all urban consumers (all items; U.S. city average) for the previous fiscal year.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H5BCF69C5A3CD47FD9113B2F67C002EE0"><enum>(2)</enum><text>by striking subparagraph (D).</text></paragraph></subsection> 
<subsection id="H6981E20F692A47038CF5872EDBECDCDB"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to allotments for fiscal years beginning with fiscal year 2007.</text> </subsection></section>
