<official-title>To amend the Atomic Energy Act of 1954 and the Energy Reorganization Act of 1974 to strengthen security at sensitive nuclear facilities.</official-title>

<section section-type="section-one" id="H78A7AD4819B04ECDAAD8EFF34FB42977" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Security Act of 2005</short-title></quote>.</text></section> 
<section id="H646B5CE555CE4B84AB4075004E02945E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 11 of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>) is amended—</text> 
<paragraph id="H6698C35F6710437DB699CABF20CFA16"><enum>(1)</enum><text>by redesignating subsection jj. as subsection ii.; and</text></paragraph> 
<paragraph id="H9FD8D4B7EA2D497FAABB066F64740000"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H8E750B82C1744552A9FB51E95CE1C9D0" style="other" other-style="nuclear"> 
<subsection id="H972AB33781634170A8D4A2E134D9800"><enum>jj.</enum><header>Design Basis Threat</header><text>The term <quote>design basis threat</quote> means the design basis threat established by the Commission under <external-xref legal-doc="regulation" parsable-cite="cfr/10/73.1">section 73.1</external-xref> of title 10, Code of Federal Regulations (or any successor regulation developed under section 170C).</text></subsection>
<subsection id="HD537241756284A90A7006964174538B2"><enum>kk.</enum><header>Sensitive Nuclear Facility</header><text>The term <term>sensitive nuclear facility</term> means—</text> 
<paragraph id="H8C28DCF973DE45DEB8B673DA52FD4930"><enum>(1)</enum><text>a commercial nuclear power plant and associated spent fuel storage facility;</text></paragraph> 
<paragraph id="HCABE77CC38254D9E932BBFF0A82FE3E6"><enum>(2)</enum><text>a decommissioned nuclear power plant and associated spent fuel storage facility;</text></paragraph> 
<paragraph id="H8E259CD34BF6432A8BEAF919D677B791"><enum>(3)</enum><text>a category I fuel cycle facility;</text></paragraph> 
<paragraph id="HD841CDBEC98044C7A59F2B3223F2B84D"><enum>(4)</enum><text>a gaseous diffusion plant; and</text></paragraph> 
<paragraph id="H893DFDDE19D241FEBD002E007D1CEE8B"><enum>(5)</enum><text>any other facility licensed by the Commission, or used in the conduct of an activity licensed by the Commission, that the Commission determines should be treated as a sensitive nuclear facility under section 170C.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H80DA54760E0F4E79B3BFFE7690239FD6"><enum>3.</enum><header>Nuclear security</header> 
<subsection id="H7D233E387FD24CF0BCD15C7CE5A7F6EE"><enum>(a)</enum><header>In general</header><text>Chapter 14 of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2201">42 U.S.C. 2201 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H965B642B3DB5419E8C8B08801D51B4F7"><enum>170C.</enum><header>Protection of sensitive nuclear facilities against the Design Basis Threat</header> 
<subsection id="H17BA977790DC4597A0E687E24CE9821"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H60ED91AD772140A1BD9ED1C0467ED38B"><enum>(1)</enum><header>Nuclear security force</header><text>The term <term>nuclear security force</term> means the nuclear security force established under subsection (b)(1).</text></paragraph> 
<paragraph id="HF6C5C67B453947689E6CFAB0817187EB"><enum>(2)</enum><header>Fund</header><text>The term <term>Fund</term> means the Nuclear Security Fund established under subsection (e).</text></paragraph> 
<paragraph id="H8079F2B459344F6193A6B0F4246BE8EC"><enum>(3)</enum><header>Qualification standard</header><text>The term <term>qualification standard</term> means a qualification standard established under subsection (d)(2)(A).</text></paragraph> 
<paragraph id="HCC9F07CD129C444CB05F6C911BF80694"><enum>(4)</enum><header>Security plan</header><text>The term <term>security plan</term> means a security plan developed under subsection (b)(2).</text></paragraph></subsection> 
<subsection id="HD9FFA38E0A4F4C5C94BF2300AF394CFE"><enum>(b)</enum><header>Nuclear security</header><text>The Commission shall—</text> 
<paragraph id="H68BA618847AD42FCABD7B5617253F74D"><enum>(1)</enum><text>establish a nuclear security force, the members of which shall be employees of the Commission, to provide for the security of all sensitive nuclear facilities against the design basis threat; and</text></paragraph> 
<paragraph id="H0C441781F37E44CEA11F251042018046"><enum>(2)</enum><text>develop and implement a security plan for each sensitive nuclear facility to ensure the security of all sensitive nuclear facilities against the design basis threat.</text></paragraph></subsection> 
<subsection id="H4ACF64F52C0A42DCA187DE972E7C8ED"><enum>(c)</enum><header>Security plans</header> 
<paragraph id="H148C2F3597AE47E2928DEA5D15EC71F2"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this section, the Commission shall develop a security plan for each sensitive nuclear facility to ensure the protection of each sensitive nuclear facility against the design basis threat.</text></paragraph> 
<paragraph id="H7D526F909A584BAF9702B2A3E7CFAE69"><enum>(2)</enum><header>Elements of the plan</header><text>A security plan shall prescribe—</text> 
<subparagraph id="HD10A34196E8B4D59AAC7A58FC307C7BD"><enum>(A)</enum><text>the deployment of the nuclear security force, including—</text> 
<clause id="H9BE3E588B0C7438AB3CB6FDA59C5D72C"><enum>(i)</enum><text>numbers of the members of the nuclear security force at each sensitive nuclear facility;</text></clause> 
<clause id="HDCCD9DB0F5BE4EBA946619916D580250"><enum>(ii)</enum><text>tactics of the members of the nuclear security force at each sensitive nuclear facility; and</text></clause> 
<clause id="HC06B208988CC4647BE2C78CE895C1C57"><enum>(iii)</enum><text>capabilities of the members of the nuclear security force at each sensitive nuclear facility;</text></clause></subparagraph> 
<subparagraph id="H56FBB66A09FB437893BA678B0CB113"><enum>(B)</enum><text>other protective measures, including—</text> 
<clause id="H8428351DA8584B309026BE00BBD1095E"><enum>(i)</enum><text>designs of critical control systems at each sensitive nuclear facility;</text></clause> 
<clause id="H0FEC0D1F1FDF4574B8C1AD7969AC4900"><enum>(ii)</enum><text>restricted personnel access to each sensitive nuclear facility;</text></clause> 
<clause id="H6B6BF0B9BC1C487C811ED0F4B44F0476"><enum>(iii)</enum><text>perimeter site security, internal site security, and fire protection barriers;</text></clause> 
<clause id="H63DB9BC60C6C440590C38297E24F9C00"><enum>(iv)</enum><text>increases in protection for spent fuel storage areas;</text></clause> 
<clause id="H6B8D3B4376D34AB5BC3F8C3628BB097E"><enum>(v)</enum><text>placement of spent fuel in dry cask storage; and</text></clause> 
<clause id="H68958C9014BE42669EB1F3B76CB6DA05"><enum>(vi)</enum><text>background security checks for employees and prospective employees; and</text></clause></subparagraph> 
<subparagraph id="H7647A4ED44FC4BFE8B05BD0481E8E072"><enum>(C)</enum><text>a schedule for completing the requirements of the security plan not later than 18 months after the date of enactment of this section.</text></subparagraph></paragraph> 
<paragraph id="HCE961DD889824730AB888B1CDC0426FE"><enum>(3)</enum><header>Additional requirements</header><text>A holder of a license for a sensitive nuclear facility under section 103 or 104 or the State or local government in which a sensitive nuclear facility is located may petition the Commission for additional requirements in the security plan for the sensitive nuclear facility.</text></paragraph> 
<paragraph id="H9AF53C21BA0A4DF0BFD77685EC9CA73C"><enum>(4)</enum><header>Implementation of security plan</header><text>Not later than 270 days after the date of enactment of this section, the Commission, in consultation with a holder of a license for a sensitive nuclear facility under section 103 or 104, shall, by direct action of the Commission or by order requiring action by the licensee, implement the security plan for the sensitive nuclear facility in accordance with the schedule under paragraph (2)(C).</text></paragraph> 
<paragraph id="H38B930890182409BA59D610679019075"><enum>(5)</enum><header>Sufficiency of security plan</header><text>If at any time the Commission determines that the implementation of the requirements of the security plan for a sensitive nuclear facility is insufficient to ensure the security of the sensitive nuclear facility against the design basis threat, the Commission shall immediately submit to Congress and the President a classified report that—</text> 
<subparagraph id="HB99A264D3FD14D16829C96006B807981"><enum>(A)</enum><text>identifies the vulnerability of the sensitive nuclear facility; and</text></subparagraph> 
<subparagraph id="H9252A23190D44735843F24817871B0A"><enum>(B)</enum><text>recommends actions by Federal, State, or local agencies to eliminate the vulnerability.</text></subparagraph></paragraph></subsection> 
<subsection id="H94FC5319A8A54775A571C211394DA08"><enum>(d)</enum><header>Nuclear security force</header> 
<paragraph id="H2A8BBA56310F426ABF4E2F3D8EAD6F3E"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this section, the Commission, in consultation with other Federal agencies, as appropriate, shall establish a program for the hiring and training of the nuclear security force.</text></paragraph> 
<paragraph id="H4C984366E0AE47EAA942DD6E0086C9BE"><enum>(2)</enum><header>Hiring</header> 
<subparagraph id="H029EF8DA4C1244C3920006C8E45697F5"><enum>(A)</enum><header>Qualification standards</header><text>Not later than 30 days after the date of enactment of this section, the Commission shall establish qualification standards that individuals shall be required to meet to be hired by the Commission as members of the nuclear security force.</text></subparagraph> 
<subparagraph id="HF97B6B07153542C7B1D2A87B5047BB8D"><enum>(B)</enum><header>Examination</header><text>The Commission shall develop and administer a nuclear security force personnel examination for use in determining the qualification of individuals seeking employment as members of the nuclear security force.</text></subparagraph> 
<subparagraph id="H7167045D051542450057EB3217939B97"><enum>(C)</enum><header>Criminal and security background checks</header><text>The Commission shall require that an individual to be hired as a member of the nuclear security force undergo a criminal and security background check.</text></subparagraph> 
<subparagraph id="HA1E0E33D46AB44B180EDE1D43FD85D68"><enum>(D)</enum><header>Disqualification of individuals who present national security risks</header><text>The Commission, in consultation with the heads of other Federal agencies, as appropriate, shall establish procedures, in addition to any background check conducted under subparagraph (B), to ensure that no individual who presents a threat to national security is employed as a member of the nuclear security force.</text></subparagraph></paragraph> 
<paragraph id="HE1D5A8A5AB8942548498684DA188E56E"><enum>(3)</enum><header>Annual proficiency review</header> 
<subparagraph id="HF238F90AABA14C8DBAA1C8CB3110FA90"><enum>(A)</enum><header>In general</header><text>The Commission shall provide that an annual evaluation of each member of the nuclear security force is conducted and documented.</text></subparagraph> 
<subparagraph id="HBEAF42389578465DBA651500AC5261CE"><enum>(B)</enum><header>Requirements for continuation</header><text>An individual employed as a member of the nuclear security force may not continue to be employed in that capacity unless the evaluation under subparagraph (A) demonstrates that the individual—</text> 
<clause id="H0558DADBBC8247B880DD216880E88A2"><enum>(i)</enum><text>continues to meet all qualification standards;</text></clause> 
<clause id="HA5FF1D585C2B4CB481F7A1F9495040A2"><enum>(ii)</enum><text>has a satisfactory record of performance and attention to duty; and</text></clause> 
<clause id="H169761E5B458450A0074693500648FB9"><enum>(iii)</enum><text>has the knowledge and skills necessary to vigilantly and effectively provide for the security of a sensitive nuclear facility against the design basis threat.</text></clause></subparagraph></paragraph> 
<paragraph id="H84AE04D9F0FB4EA589399705A5E8E2C2"><enum>(4)</enum><header>Training</header> 
<subparagraph id="HE794FAE286DD4A1782082CA80265F2DE"><enum>(A)</enum><header>In general</header><text>The Commission shall provide for the training of each member of the nuclear security force to ensure each member has the knowledge and skills necessary to provide for the security of a sensitive nuclear facility against the design basis threat.</text></subparagraph> 
<subparagraph id="HAC968F6BEBE9456F98C47D45DCC5CE43"><enum>(B)</enum><header>Training plan</header><text>Not later than 60 days after the date of enactment of this section, the Commission shall develop a plan for the training of members of the nuclear security force.</text></subparagraph> 
<subparagraph id="H700E37E25A50481DBF335F99F6359CBE"><enum>(C)</enum><header>Use of other agencies</header><text>The Commission may enter into a memorandum of understanding or other arrangement with any other Federal agency with appropriate law enforcement responsibilities, to provide personnel, resources, or other forms of assistance in the training of members of the nuclear security force.</text></subparagraph></paragraph></subsection> 
<subsection id="H56C9B67E736A4F59848F112801565294"><enum>(e)</enum><header>Nuclear Security Fund</header> 
<paragraph id="H01C61D912C094B4FAA37181FCCE256A7"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Nuclear Security Fund</quote>, which shall be used by the Commission to administer programs under this section to provide for the security of sensitive nuclear facilities.</text></paragraph> 
<paragraph id="HF918C6918FD14B388E798230E2CB753E"><enum>(2)</enum><header>Deposits in the Fund</header><text>The Commission shall deposit in the Fund—</text> 
<subparagraph id="H0B153CA357F5493D9E6410C77BEC7EC"><enum>(A)</enum><text>the amount of fees collected under paragraph (5); and</text></subparagraph> 
<subparagraph id="HD2907D34AF4C436581078D8374C43342"><enum>(B)</enum><text>amounts appropriated under subsection (f).</text></subparagraph></paragraph> 
<paragraph id="H2C53B41040BB4EC9A6C0001674FADF10"><enum>(3)</enum><header>Investment of amounts</header> 
<subparagraph id="H67816374E6EA43B495C3232F4991D301"><enum>(A)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such portion of the Fund as is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals. Investments may be made only in interest-bearing obligations of the United States.</text></subparagraph> 
<subparagraph id="HA3283FDF9DD64002885894C88BFC2E3"><enum>(B)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under subparagraph (A), obligations may be acquired—</text> 
<clause id="HEDBC9C8BEDAD4B719631626114B9011E"><enum>(i)</enum><text>on original issue at the issue price; or</text></clause> 
<clause id="HA4EA7BA6CE3E4250918C0073E2F006DC"><enum>(ii)</enum><text>by purchase of outstanding obligations at the market price.</text></clause></subparagraph> 
<subparagraph id="HB499EEDE232445E3B62700FB0886E7B"><enum>(C)</enum><header>Sale of obligations</header><text>Any obligation acquired by the Fund may be sold by the Secretary of the Treasury at the market price.</text></subparagraph> 
<subparagraph id="H6C2CB60EA3FA4A35ADA0887223E477B"><enum>(D)</enum><header>Credits to Fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></subparagraph></paragraph> 
<paragraph id="H31EDE84AF57C443CA23BF5864F2B2601"><enum>(4)</enum><header>Use of amounts in the Fund</header><text>The Commission shall use amounts in the Fund to pay the costs of—</text> 
<subparagraph id="H0F1DD5E3C4F7494080A6586992A77400"><enum>(A)</enum><text>salaries, training, and other expenses of the nuclear security force; and</text></subparagraph> 
<subparagraph id="H6940ED1B32A54976B1AA7CC0F6CCB9D1"><enum>(B)</enum><text>developing and implementing security plans.</text></subparagraph></paragraph> 
<paragraph id="H8124EDBCEA044B78988C30E3472E4C27"><enum>(5)</enum><header>Fee</header><text>To ensure that adequate amounts are available to provide assistance under paragraph (4), the Commission shall assess licensees a fee in an amount determined by the Commission.</text></paragraph></subsection> 
<subsection id="HDF7E026BF36E4C209D9EC03EB8F9EB8C"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H55C0E95CD0404B8192CC2DBF3480F2AA"><enum>(b)</enum><header>Implementation</header><text>The Commission shall complete the full implementation of the amendment made by subsection (a) as soon as practicable after the date of enactment of this Act, but in no event later than 270 days after the date of enactment of this Act.</text></subsection> 
<subsection id="H471C070F7DF54D608F1114F735AF3CE7"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of contents for chapter 14 of the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (42 U.S.C. prec. 2011) is amended by adding at the end the following:</text>
