<official-title>To require certain reports with respect to the energy efficiency design performance of new Federal buildings.</official-title>

<section id="H8483040474B441729135BD3BB3D0D154" section-type="section-one"><enum>1.</enum><header>Federal building performance standards</header><text display-inline="no-display-inline">Section 305(a)(3)(C) of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6834">42 U.S.C. 6834(a)(3)(C)</external-xref>) is amended—</text> 
<paragraph id="H415596C9B67A497698485509F24655D"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of clause (i);</text></paragraph> 
<paragraph id="HD4928BBFDA0D4BF38500EAAF6FA362A4"><enum>(2)</enum><text>by striking the period at the end of clause (ii) and inserting a semicolon; and</text></paragraph> 
<paragraph id="H4B5E91DFA5F44745A34EFA5FA9010801"><enum>(3)</enum><text>by adding at the end the following new clauses:</text> 
<quoted-block style="OLC" id="H062D1C6D64EB403EA0DD93BDFC163650" display-inline="no-display-inline"> 
<clause id="H9F18F19B11D849C49D224C5B5200BFDF" indent="up2"><enum>(iii)</enum><text>18 months after completion of a new Federal building, a report—</text>
<subclause id="H53CD8479392A407391B7A0D112630275"><enum>(I)</enum><text display-inline="yes-display-inline">outlining the building’s performance in achieving the original energy efficiency design goals of the building (as specified by the architect or builder);</text></subclause>
<subclause id="H47F2365F675F4C8EA143CE6D21FC00C3"><enum>(II)</enum><text>in the case of a failure to meet those goals, a description of the reasons for the failure as well as the corrective actions, such as recommissioning for optimal performance, to be taken to achieve or exceed the design goals; and</text></subclause>
<subclause id="HBF4C429B68E04E5CAA25DFEC012F48FC"><enum>(III)</enum><text>stating how performance was measured or estimated and an estimate of additional energy costs to be incurred by not meeting the design requirements of this section; and</text></subclause></clause>
<clause id="HCAA19CD9466A4E16B5511FF7AD20A1F1" indent="up2"><enum>(iv)</enum><text>if a building fails to achieve design goals, a second report to the Congress assessing the building’s performance after corrective actions have been taken, which shall also state any reasons for the failure to continue to meet the performance requirements of this section.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
