<section id="H8B70C532A7674931999C1E8F5E482170" section-type="section-one"><enum>1.</enum><header>Metering of energy use</header><text display-inline="no-display-inline">Section 543(e)(1) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253(e)(1)</external-xref>) is amended to read as follows:</text>

<paragraph id="H3AFB82526FFA4A048F2909C404E8B9A0"><enum>(1)</enum><header>Deadlines</header> 
<subparagraph id="HA318A32DB3934177BD75FAC4A600C22B" display-inline="yes-display-inline"><enum>(A)</enum><text>By October 1, 2012, in accordance with guidelines established by the Secretary under paragraph (2), all Federal buildings shall, for the purposes of efficient use of energy and reduction in the cost of energy used in such buildings, be metered. Each agency shall use, to the maximum extent practicable, advanced meters or advanced metering devices for electricity, primary fuels, including natural gas and petroleum-based fuels, steam, and chilled water, that provide data at least daily and that measure at least hourly consumption of electricity in the Federal buildings of the agency. Such data shall be incorporated into existing Federal energy tracking systems and made available to Federal facility managers. </text></subparagraph> 
<subparagraph id="H180C500BE0DB43628377E18E14C17916" indent="up1"><enum>(B)</enum><text>By October 1, 2008, metering meeting the requirements of subparagraph (A) shall apply to—</text> 
<clause id="HAD404BE9BF3B41758B115CDCC426000"><enum>(i)</enum><text>buildings on which construction commenced after the date of enactment of this Act; </text></clause> 
<clause id="H352DFF7C7423474EAA5C37A2A5CCA663"><enum>(ii)</enum><text>existing buildings with more than 100,000 square feet of enclosed space; and </text></clause> 
<clause id="H57DF1D1756F24F5784FC931D0186B351"><enum>(iii)</enum><text>existing buildings that use large amounts of energy per square foot such as process energy facilities, health care facilities, and data centers. </text></clause></subparagraph> 
<subparagraph id="HA12E1CF8280D458D8C0096880013EDCF" indent="up1"><enum>(C)</enum><text>The Secretary shall include in the guidelines under paragraph (2) criteria for determining which buildings and facilities are subject to subparagraph (B)(iii). </text></subparagraph> 
<subparagraph id="H1C1B07158CE14BB9A616BE64655F22B6" indent="up1"><enum>(D)</enum><text>The Secretary shall provide for a 6 month extension of the deadline under subparagraph (B) based on cost-justification criteria, as determined by Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H1CE48A86DB544093A4F1BE96EB543BAB"><enum>2.</enum><header>Annual report</header><text display-inline="no-display-inline">Section 548(a)(1) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8258">42 U.S.C. 8258(a)(1)</external-xref>) is amended by inserting <quote>, including progress reports on the installation and utilization of meters in Federal buildings</quote> after <quote>established by section 543</quote>.</text></section>
<section id="H712A147492A54C0192A26F6DF7141124"><enum>3.</enum><header>Amendment of guidelines</header><text display-inline="no-display-inline">Section 543(e)(2)(A) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253(e)(2)(A)</external-xref>) is amended by inserting <quote>or any substantive amendment thereto</quote> after <quote>date of enactment of this subsection</quote>. </text></section>
