<official-title>To amend the National Trails System Act relating to the statute of limitations that applies to certain claims.</official-title>

<section id="H74075F35C882402B92D037F1B384E5BA" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Easement Owners Fair Compensation Claims Act of 2005</short-title></quote>.</text></section> 
<section id="H010A13B23FE542ACB4C2A1F680001853"><enum>2.</enum><header>Claims against United States for interim use of rights-of-way</header> 
<subsection id="HAFE7DABC3B7C4C73B84C7D002ECFFA8"><enum>(a)</enum><header>Amendment to National Trails System Act</header><text>Section 8(d) of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1247">16 U.S.C. 1247(d)</external-xref>) is amended—</text> 
<paragraph id="HCB59752611B54589BD44F3C441C0847B"><enum>(1)</enum><text>by striking <quote>The Secretary of Transportation</quote> and inserting <quote>(1) The Secretary of Transportation</quote>; and</text></paragraph> 
<paragraph id="H2A5E3A940392493BAED783BEEA368533"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H2E7DA3FEF8B840E0BEDB732F2BB400C4" display-inline="no-display-inline"> 
<paragraph id="HE620BE23F9F8463C8ECC488BA2009F6B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In any action brought against the United States, by the owner of property that is subject to a railroad right-of-way and to interim use described in paragraph (1), for damages sustained by reason of paragraph (1), the claim for damages shall not be deemed to first accrue for purposes of the limitations period prescribed by <external-xref legal-doc="usc" parsable-cite="usc/28/2501">section 2501</external-xref> of title 28, United States Code, before the date on which—</text> 
<subparagraph id="H2D60E81B5026498E8D9357CEC86EC00"><enum>(A)</enum><text>the State, political subdivision, or qualified private organization has, by written agreement, assumed full responsibility for such right-of-way and interim use under paragraph (1); and</text></subparagraph> 
<subparagraph id="H970AAF504E644D5698B8B2DB27EFC8D"><enum>(B)</enum><text>the railroad has in writing conveyed an interest in such right of way to such State, political subdivision, or qualified private organization, by donation, transfer, lease, sale, or otherwise.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4E11748F29F94D17BBA37DE216AF4FB8"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="H4CD410461DE14A0E82394B1FAD5597F6"><enum>(1)</enum><header>In general</header><text>The amendments made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to any civil action pending on, or commenced on or after, such date of enactment.</text></paragraph> 
<paragraph id="H54B315AD6FA64BE3A3C6F8CD84D7E50"><enum>(2)</enum><header>Prior orders vacated upon request</header><text display-inline="yes-display-inline">Any order that—</text> 
<subparagraph id="HEBD05D18A8F24A8B9F3707BB63FA285E"><enum>(A)</enum><text>was entered, before the date of the enactment of this Act, by a court in a case pending on such date of enactment, and</text></subparagraph> 
<subparagraph id="HC061C6A5B3DF452491FF65B36082B61E"><enum>(B)</enum><text>is inconsistent with the amendments made by subsection (a),</text></subparagraph><continuation-text continuation-text-level="paragraph">shall be vacated by the court if, not later than 1 year after such date of enactment, a party to the case or the party’s successor in interest files with the court a request for such relief.</continuation-text></paragraph></subsection> 
<subsection id="H7E7730D76CF44E948CDE4CEFBB15A0FE"><enum>(c)</enum><header>Review by Court of Federal Claims</header> 
<paragraph id="H6B4D5602EC5A49898D5E55058B5C42E4"><enum>(1)</enum><header>Review of certain claims</header><text>Notwithstanding any other provision of law, the United States Court of Federal Claims shall review on the merits, without regard to the defense of res judicata or collateral estoppel, any claim that—</text> 
<subparagraph id="HF2554CA3D8064E3B877F98F7EB00B969"><enum>(A)</enum><text display-inline="yes-display-inline">was brought against the United States, by the owner of property that is subject to a railroad right-of-way and to interim use described in paragraph (1) of section 8(d) of the National Trails System Act, for damages sustained by reason of such section 8(d),</text></subparagraph> 
<subparagraph id="H8B385C4520A94D028272B3F6D5972315"><enum>(B)</enum><text>was dismissed, before the enactment of this Act, for not being brought within the time period provided under <external-xref legal-doc="usc" parsable-cite="usc/28/2501">section 2501</external-xref> of title 28, United States Code, and</text></subparagraph> 
<subparagraph id="H48FDA828E8584399A3E3E93F7118BF61"><enum>(C)</enum><text>would have been considered to have been brought in a timely manner if the amendments made by subsection (a) had been in effect when the claim was brought,</text></subparagraph><continuation-text continuation-text-level="paragraph">if the claimant applies to the court for such review not later than 60 days after the date of the enactment of this Act.</continuation-text></paragraph> 
<paragraph id="H05B87FFC10A841E8A61E82A09D1E7DD7"><enum>(2)</enum><header>Action by the court</header><text display-inline="yes-display-inline">In reviewing a claim under paragraph (1), the Court of Federal Claims shall receive and consider any additional evidence, including oral testimony, that any party may wish to provide on the issue of a taking of property without due process of law, and shall determine the issues de novo.</text></paragraph></subsection></section>
