<section id="H9B840C4BFC524BF8A952AF8DDCC428AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act shall be cited as the <quote>Student Achievement and Successful Schools Act of 2005</quote>.</text></section> 
<section id="HBC90AEDA8E294F9E89FE24E3BA584E64"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H5CF986554981446EAFD5DE67E639DF3"><enum>(1)</enum><text display-inline="yes-display-inline">Access to a high quality public education for all children is essential to a fully functioning democracy.</text></paragraph> 
<paragraph id="H698DC8F98A7E455C816D495FF9D3CDC5"><enum>(2)</enum><text>Primary responsibility for the operation, quality, and governance of the public schools of the United States lies with State and local governments. </text></paragraph> 
<paragraph id="HF668F7C6277C4B4098B6F3FCA66BE129"><enum>(3)</enum><text display-inline="yes-display-inline">Bipartisan reviews of the No Child Left Behind Act of 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/110">Public Law 107–110</external-xref>; 115 Stat. 1425) have suggested that granting States flexibility to meet the goals of the law will result in better student successes, more accountability, a stronger democracy, and a more robust economy. </text></paragraph> 
<paragraph id="H7776CCBE687E4F6400564B5FB389B9A8"><enum>(4)</enum><text>More than 30 States are considering legislation requesting the Federal Government to provide waivers or other means of flexibility, calling for additional money to cover mandates required under the No Child Left Behind Act of 2001, prohibiting a State from spending State funds to comply with such mandates, or requiring that a State will comply only in areas fully funded by the Federal Government, or fully opting-out of the mandates required under the No Child Left Behind Act of 2001. </text></paragraph> 
<paragraph id="H92F9D6218FB8481EA100E09B008DACEC"><enum>(5)</enum><text>States have been financially penalized, amounting to a total of nearly $1,300,000, for not meeting the Federal requirements. These fines are in addition to education cuts sustained at the Federal, State, and local levels.</text></paragraph> 
<paragraph id="HD7100A124FDD4902A655C098277963A4"><enum>(6)</enum><text display-inline="yes-display-inline">School districts across the country have rejected or reallocated funding under part A of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) to avoid costly sanctions associated with failing to make adequate yearly progress under such Act. </text></paragraph> 
<paragraph id="H7FDF840044D94965833918E42FBC948E"><enum>(7)</enum><text display-inline="yes-display-inline">States, school districts, education advocacy groups, and schools have filed lawsuits in response to the No Child Left Behind Act of 2001, including lawsuits filed by school districts in Michigan, Vermont, Texas, California, and Connecticut, the National Education Association, and the California League of United Latin American Citizens. Several States, school districts, education advocacy groups, and schools are considering joining in or filing their own litigation and have questioned the constitutionality of the No Child Left Behind Act of 2001.</text></paragraph> 
<paragraph id="HF429259D2F7C4C39967B9497A9B786C6"><enum>(8)</enum><text>The Department of Education has recognized the flaws in the No Child Left Behind Act of 2001 and has issued several changes to the regulations promulgated pursuant to such Act.</text></paragraph> 
<paragraph id="HC12D4D3A579F472695D892F40790D9F3"><enum>(9)</enum><text display-inline="yes-display-inline">Since being signed into law, schools have been consistently underfunded from what was promised by Congress in the No Child Left Behind Act of 2001.</text></paragraph> 
<paragraph id="H5040D9981B7B48238200888DF15C04C5"><enum>(10)</enum><text display-inline="yes-display-inline">All children should have the opportunity to succeed with a high quality, public education.</text></paragraph></section> 
<section id="H897E9B82EC3D4401B52DBE84F1CA2F00"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H9BB63CAB86A94623B5BE86FE4F8354F" commented="no"><enum>(1)</enum><text>full funding should be provided to schools to allow them to satisfy Federal mandates required under the No Child Left Behind Act of 2001; and</text></paragraph> 
<paragraph id="H60CEA4A184AE4F4BA75C9555D74B9500"><enum>(2)</enum><text display-inline="yes-display-inline">States and school districts should have the necessary flexibility in implementing the No Child Left Behind Act of 2001 to ensure that all students are successful and achieve all of the goals of the law.</text></paragraph></section> 
<section id="HD4E9403D995C40E689AE7033873B78B5"><enum>4.</enum><header>Adequate yearly progress</header> 
<subsection id="H9A54354B34454438A58E3812A294E5FC"><enum>(a)</enum><header>In general</header><text>Subpart 1 of part A of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>) is amended—</text> 
<paragraph id="H36801E2E7A3F4EE8BF53377C04E9EA38"><enum>(1)</enum><text>in section 1111(b)(2)—</text> 
<subparagraph id="H766DFFF534F2446FBB612600242D5F00"><enum>(A)</enum><text>in subparagraph (C), by striking <quote><quote>Adequate</quote></quote> and inserting <quote>Except as provided in subparagraph (N), <quote>adequate</quote></quote>;</text></subparagraph> 
<subparagraph id="H7CFF6EE37E06417AAEA40936B018603C"><enum>(B)</enum><text>in subparagraph (F), by striking <quote>12 years</quote> and inserting <quote>16 years</quote>;</text></subparagraph> 
<subparagraph id="HBE1A64B2BF374954B8EA959306A7CD8"><enum>(C)</enum><text>in subparagraph (I)—</text> 
<clause id="HA9B674A339F44D05AFB0F164C6D57E26"><enum>(i)</enum><text>by striking <quote>subparagraph (C)(v) must meet or exceed the objectives</quote> and inserting <quote>subparagraph (C)(v), subject to subparagraph (M), must meet or exceed the objectives</quote>; and</text></clause> 
<clause id="H17FF0EA5BECF4247B90022416100E5B"><enum>(ii)</enum><text>by striking <quote>subparagraph (C)(v) does not meet those objectives</quote> and inserting <quote>subparagraph (C)(v), subject to subparagraph (M), does not meet those objectives</quote>;</text></clause></subparagraph> 
<subparagraph id="H131F92CBBE2248BB9713C601257966CF"><enum>(D)</enum><text>by adding after subparagraph (K) the following new subparagraphs:</text> 
<quoted-block style="OLC" id="H5B03A1BAC37C478BACB18491F2E63548" display-inline="no-display-inline"> 
<subparagraph id="HD8F84E0F251D402982F5C782DEC34EC6"><enum>(L)</enum><header>Special rule</header><text display-inline="yes-display-inline">A State may allow the exclusion of one or more students from the calculation used to determine whether a school makes adequate yearly progress under this paragraph based on special circumstances identified by the Secretary affecting individual students, including—</text> 
<clause id="H72D946FE35364898AA07332379908143"><enum>(i)</enum><text>emergency medical conditions;</text> </clause> 
<clause id="HF3DEE89B34BA4182A2CC5C6B1FDA1E89"><enum>(ii)</enum><text>exceptional or uncontrollable circumstances, such as a natural disaster or an incident of school violence; or</text></clause> 
<clause id="HEB9960D0F81544C482E14073E6CC801"><enum>(iii)</enum><text>an unusual pattern of attendance as determined by the State educational agency, provided that the local educational agency in which the student is enrolled is implementing a plan to increase participation in the assessments described in paragraph (3).</text></clause></subparagraph> 
<subparagraph id="H865681A0E02140A1895DD18F8CA27181"><enum>(M)</enum><header>Single count of students</header><text>In meeting the definition of adequate yearly progress under subparagraph (C), a State may allow students counted in two or more groups described in subparagraph (C)(v)(II) to be counted as an equal fraction of one for each such group.</text></subparagraph> 
<subparagraph id="H1FA27894AB2349B0A4EC2E66E2268987" commented="no"><enum>(N)</enum><header>Other measures of adequate yearly progress</header><text>Notwithstanding any other provision of this paragraph, a State may establish an alternative definition of adequate yearly progress, subject to approval by the Secretary under subsection (e) (except that such approval shall not apply as such definition applies to students with disabilities and limited English proficient students). Nothing in this subparagraph shall be construed as requiring a State that establishes an approved alternative definition of adequate yearly progress under this subparagraph to satisfy the requirements of adequate yearly progress defined in subparagraph (C). Such alternative definition may—</text> 
<clause id="HB9D55FCEC07248A6A979131B55DC077" commented="no"><enum>(i)</enum><text>include measures of student achievement over a period of time (such as a value added accountability system) or the progress of some or all of the groups of students described in subparagraph (C)(v) to the next higher level of achievement described under subclauses (II) and (III) of paragraph (1)(D)(ii) as a factor in determining whether a school, local educational agency, or State has made adequate yearly progress, as described in this paragraph; or</text></clause> 
<clause id="HA308D8DDAF2A4D77930408909FB2652E" commented="no"><enum>(ii)</enum><text>use the measures of performance and progress described in subparagraph (A) as the sole basis for determining whether the State, its local educational agencies, or schools have met adequate yearly progress, provided—</text> 
<subclause id="H8CB90D08896D411D9800959414EF20CC" commented="no"><enum>(I)</enum><text>the primary goal of such definition is that all students in each group described in subparagraph (C)(v) meet or exceed the proficient level of academic achievement, established by the State, not later than 16 years after the end of the 2001–2002 school year; and</text></subclause> 
<subclause id="H264F4C322FA543BD82962B8B7856EE22" commented="no"><enum>(II)</enum><text>such definition includes intermediate goals, as required under subparagraph (H).</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H1D31E176A3874E3B9212073B73BE82DB"><enum>(2)</enum><text>in section 1116(c)(10)—</text> 
<subparagraph id="HE28D8299636D4EC18822DC637BFEBA73"><enum>(A)</enum><text>by amending subparagraph (B)(ii) to read as follows:</text> 
<quoted-block style="OLC" id="H020076049ECE427AA3F9193E34C028A6" display-inline="no-display-inline"> 
<clause id="HC6D4C10DE7D245B6B2A5386720072A6"><enum>(ii)</enum><text>shall take corrective action with respect to a local educational agency—</text> 
<subclause id="H6E733B62BF52410F8F521395408C4B21"><enum>(I)</enum><text>that fails to make adequate yearly progress, as defined by the State, in the same subject and averaged across all grades and in at least one grade span (as determined by the State) for a group described in section 1111(b)(2)(C)(v) by the end of the second full school year after the identification of such agency under paragraph (3); and</text></subclause> 
<subclause id="HC6712127A28042FA9426AAD972003D51"><enum>(II)</enum><text>whose total number of students (who are members of a group described in section 1111(b)(2)(C)(v)) who did not meet or exceed the proficient level of academic achievement exceed 35 percent of all students enrolled in a school in such agency who took the assessment in such subject and averaged across all grades; and</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H2A6D93B93573470F83E155D6F9D38722"><enum>(B)</enum><text>by amending subparagraph (F) to read as follows:</text> 
<quoted-block style="OLC" id="HF08D814EC08D4E22BCBA7FFED730086" display-inline="no-display-inline"> 
<subparagraph id="H2836D173263E4219AE62911E615E93C3"><enum>(F)</enum><header>Delay</header><text>Notwithstanding subparagraph (B)(ii), a State educational agency may delay, for a period not to exceed 1 year, implementation of corrective action under this paragraph if the local educational agency makes adequate yearly progress for 1 year or its failure to make adequate yearly progress is due to—</text> 
<clause id="H099738A4D341432E99C9A1FF8D920902"><enum>(i)</enum><text>exceptional or uncontrollable circumstances, such as a natural disaster;</text></clause> 
<clause id="H83EE49C56FFF4A28A4F6EEDE4CBE8D1B"><enum>(ii)</enum><text>a precipitous and unforeseen decline in the financial resources of the local educational agency; or</text></clause> 
<clause id="H42B260DE82804B81B10024966305F1B8"><enum>(iii)</enum><text>a sudden or significant increase in the number or percentage of students represented by any group described in section 1111(b)(2)(C)(v).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H755E76C7F7724145BE8912C07FDBBC29"><enum>(b)</enum><header>Grants for administrative costs</header><text>In addition to funds that are already available for this purpose, the Secretary of Education shall allocate Federal funds to pay for administrative costs associated with demonstrating achievement of adequate yearly progress in accordance with subsections (a) and (c).</text></subsection> 
<subsection id="H1C88A67331B24CF491290469ECE000DC"><enum>(c)</enum><header>Effective dates</header> 
<paragraph id="H1D9E1E82AC2546ACAB1B5D57B0184C2F"><enum>(1)</enum><header>Amendments</header><text>The amendments made by this section shall take effect and apply as if they had been made by the No Child Left Behind Act of 2001.</text></paragraph> 
<paragraph id="H88888864B9AF4377B734072763EBBAFB"><enum>(2)</enum><header>Regulations</header><text>The Secretary of Education shall enforce any regulations that the Secretary has promulgated on or after the date of the enactment of the No Child Left Behind Act of 2001 as if such regulations had been promulgated on such date.</text></paragraph></subsection></section> 
<section id="H5FB1A5BF71F04ECC81EA2B639E006C42"><enum>5.</enum><header>Measuring student achievement through longitudinal growth</header> 
<subsection id="H040D84DCE53D48ED87C21AAEFD9BBEE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1111(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)</external-xref>) is amended—</text> 
<paragraph id="HDBA3B281899F4487BC363E96F3C20019"><enum>(1)</enum><text>in paragraph (2)—</text> 
<subparagraph id="HCCED556D8B86418D8661859020815196"><enum>(A)</enum><text>in subparagraph (A)—</text> 
<clause id="H8F9A5B9EAE1D4E969108F5F256746B31"><enum>(i)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="HDF5C17A3AA54444F002E75D2B9ABAFFB"><enum>(ii)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause> 
<clause id="H5208384EFE8E45ADA16D501228AFDCD8"><enum>(iii)</enum><text>by adding at the end the following new clause:</text> 
<quoted-block style="OLC" id="HFEF17A12C30C4116A88EC20045E1BAC2" display-inline="no-display-inline"> 
<clause id="HA7DD3AD627154566937110D5003ED796"><enum>(iv)</enum><text>include information relating to approved providers of supplemental educational services under section 1116(e).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H19A2F3DF7C734F4FA4D644AF8491CDCF"><enum>(B)</enum><text>in subparagraph (C)—</text> 
<clause id="H9EEBD38764AC4F11A9C6A53D3DB293F4"><enum>(i)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="H858A3BA04FB3496B8155E913DE6B6745"><enum>(ii)</enum><text>in clause (vii), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause> 
<clause id="HD98CA4A2F01947A3A57FB625450033EA"><enum>(iii)</enum><text>by adding at the end the following new clause:</text> 
<quoted-block style="OLC" id="H92D7DA0442F445C8B1E839360000CB6C" display-inline="no-display-inline"> 
<clause id="H5B6530E1887D41FA8BBC39631877BDCA"><enum>(viii)</enum><text>at the State’s discretion, measures the progress of public elementary schools, secondary schools, and local educational agencies by tracking the progress of individual students or cohorts of students on a longitudinal basis in lieu of, or in addition to, comparing the proficiency of a class of students with the proficiency of earlier classes of students.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph> 
<paragraph id="HBD7B2BD15FD14B4B00EF1D75F5B8CE00"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HF46C5598444E4B77B504F22F55EC7B65" display-inline="no-display-inline"> 
<paragraph id="HC57B0C74508F48CF9B7800006D6960D7"><enum>(11)</enum><header>Longitudinal progress of transferring students</header> 
<subparagraph id="HF0EC516BDB0C454AAEBCA499AD91C2A7"><enum>(A)</enum><header>In general</header><text>If a State chooses to measure adequate yearly progress on a longitudinal basis in accordance with paragraph (2)(C)(viii), the State may exclude from such measurement of progress at a school any student who transferred to that school at the beginning of or during the school year involved.</text></subparagraph> 
<subparagraph id="HC5D584D38EC44BD98313B2675026B107"><enum>(B)</enum><header>Students who frequently transfer</header><text>The Secretary by regulation—</text> 
<clause id="H1309EFF3C61E4862BF876756EDB64DE5"><enum>(i)</enum><text>shall ensure that a State choosing to measure adequate yearly progress on a longitudinal basis has in effect a system for measuring the progress of students who frequently transfer among schools; and</text></clause> 
<clause id="H77D0901B1BCF4C0E84085CC0E8146F74"><enum>(ii)</enum><text>in the case of a student who attends three or more schools in any five-year period, shall provide for the sharing of school records.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H59A150DE81674135B04D1E11DDDD8689"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect and apply beginning with the first academic year that begins after the date of the enactment of this Act.</text></subsection></section> 
<section id="HC91E18F27C7F49AEAB25027961C1DBDE"><enum>6.</enum><header>Supplemental educational services</header> 
<subsection id="HCC0080A17021414D8E3F05064350F082"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1116(e) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(e)</external-xref>) is amended—</text> 
<paragraph id="H514B049F67FA4B7EA79FE9C953156807"><enum>(1)</enum><text>in paragraph (4)—</text> 
<subparagraph id="H03A2A0DAA78442DA8B035B22B81ECA06"><enum>(A)</enum><text>in subparagraph (B), by inserting <quote>(developed through continuous consultation with local educational agencies in the State)</quote> after <quote>objective criteria</quote>;</text></subparagraph> 
<subparagraph id="HFBCE1C468C1D47928CEEA5553B50F538"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>; and</quote> at the end;</text></subparagraph> 
<subparagraph id="H555748E2C81F4CBFAC8357DB0300B4C6"><enum>(C)</enum><text>in subparagraph (E), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H844EDC60833645F8A81974571CBFF806"><enum>(D)</enum><text>by adding after subparagraph (E) the following new subparagraph:</text> 
<quoted-block style="OLC" id="HB87327C79BCB48C88DE5BD2FF6CF0507" display-inline="no-display-inline"> 
<subparagraph id="HE326FAA919EC40BCA3DD9C00105BEB80"><enum>(F)</enum><text>develop procedures by which a local educational agency may—</text> 
<clause id="H9EE47031A1104CE7A42FE63CC1E8F44F"><enum>(i)</enum><text>present complaints and documentation of such complaints to the State educational agency regarding the qualifications, operation, or evaluation of approved providers or of potential providers seeking such approval; and</text></clause> 
<clause id="HF6588F3ADBF9460A94BA9F8F983B5D9D"><enum>(ii)</enum><text>demonstrate to the State educational agency that a provider should not be authorized to provide supplemental services, as described in this subsection, to any school or schools under the jurisdiction of such local educational agency.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HAE697F31B6EE4F8FAA7B34A2E6E0964D"><enum>(2)</enum><text>by redesignating paragraph (12) as paragraph (13);</text></paragraph> 
<paragraph id="H5C6690B4FBDD4E76A1BD97BB500E03E"><enum>(3)</enum><text>by inserting after paragraph (11) the following new paragraph:</text> 
<quoted-block style="OLC" id="H7D334AB986D944099B1FD7F1F64E1D78" display-inline="no-display-inline"> 
<paragraph id="HB80657DA5C2B41F783212132BC446B5"><enum>(12)</enum><header>Local educational agencies as providers</header><text>Nothing in this section shall be construed to prohibit a local educational agency that has failed to make adequate yearly progress or is in improvement, corrective action, or restructuring status pursuant to subsection (c) from providing supplemental services, solely due to such failure. In developing and applying objective criteria under paragraph (4)(B) and withdrawing approval for providers under paragraph (4)(D), a State educational agency may not consider whether a local educational agency made adequate yearly progress or its status under subsection (c).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8BC20F61D4E547A6814419CDE2E57C4"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (13), as redesignated by paragraph (2) of this subsection—</text> 
<subparagraph id="HC5FDE94B9E094ACDAFC529AF6B9CAE09"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>who did not meet or exceed the proficient level of academic achievement in the yearly student academic assessments required under section 1111 for the child’s grade level to meet the State’s student academic achievement standards</quote> before the semicolon; and</text></subparagraph> 
<subparagraph id="H23DD5BFAEFA34C74924D17971DA27E83"><enum>(B)</enum><text>in subparagraph (B)—</text> 
<clause id="H70293ECA6C13426892AC552F2454D039"><enum>(i)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="HF3FB18DE7A204B5CB4944EA7AC0872A4"><enum>(ii)</enum><text>by adding at the end the following new clause:</text>

<subsection id="H0278D2388A4B4C65815DC7F7733200C7"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect and apply beginning with the first academic year that begins after the date of the enactment of this Act.</text></subsection></section> 
<section id="HF7FB717F259440978223D970C1E88F2"><enum>7.</enum><header>Highly qualified teachers</header> 
<subsection id="H35F7BE8F563B415A904537EE25F1825E"><enum>(a)</enum><header>Extension of deadline to satisfy requirements</header><text display-inline="yes-display-inline">Section 1119(d) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6319">20 U.S.C. 6319(d)</external-xref>) is amended by striking <quote>not later than 4 years after the date of enactment</quote> and inserting <quote>not later than the end of the 2005–2006 school year,</quote>. </text></subsection> 
<subsection id="H34C4B6227E654DB88DD260D5EFD82FBD"><enum>(b)</enum><header>High Objective Uniform State Standard of Evaluation</header><text>Section 9101(23)(C)(ii)(III) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(23)(C)(ii)(III)</external-xref>) is amended by inserting <quote>including a streamlined process under which teachers of multiple subjects may demonstrate competency in each individual subject</quote> before the semicolon.</text></subsection> 
<subsection id="H73998629E2BA4DC2ADA037ABBFABC44F"><enum>(c)</enum><header>Grants for paraprofessional training</header><text>In addition to funds that are already available for this purpose, the Secretary of Education shall allocate Federal funds to pay for paraprofessional training under subsections (c) and (d) of section 1119 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6319">20 U.S.C. 6319</external-xref>).</text></subsection></section> 
<section id="H663803BC3C8D43468740D5C46949AC09"><enum>8.</enum><header>Performance bonuses</header> 
<subsection id="H6ABA3EE30AEE42BCA592179B3FB91404"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Education shall make grants, in amounts determined appropriate by the Secretary, to eligible States to be used for non-administrative functions by schools that have closed achievement gaps by not less than ten percent between subgroups described in section 1111(b)(2)(C)(v)(II) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)(C)(v)(II)</external-xref>), as demonstrated to the satisfaction of the Secretary.</text></subsection> 
<subsection id="HFE45E0BB8AD84250A437B73DB1761E1"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $50,000,000 to carry out this section.</text></subsection></section> 
<section id="H8415AD2B31824699A37960F94930D00"><enum>9.</enum><header>Conditional implementation</header> 
<subsection id="HC1E90C0AD2B04E988DE800E735A31102"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1116 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H289465E7CEDE4D7CA772AE3CE0BDF1" display-inline="no-display-inline"> 
<subsection id="H50AE3C3361D24AD08560CEA600378324"><enum>(i)</enum><header>Conditional implementation</header><text>Notwithstanding any other provision of this section, a State educational agency, local educational agency, or school, as applicable, may defer the requirements of subsections (b)(7) and (b)(8) and subsection (c)(7) and (c)(10) in any fiscal year in which the amount appropriated under section 1002(a) of this Act and section 611(i) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1411">42 U.S.C. 1411(i)</external-xref>) does not equal or exceed the amount authorized under such section for such fiscal year. For purposes of determining the amounts referred to in the preceding sentence for fiscal year 2008 and subsequent fiscal years, the amount authorized to be appropriated under section 1002(a) of this Act in each such fiscal year shall be $2,500,000,000 more than the amount for the preceding fiscal year. Such determination shall only apply for the purposes of this subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HED1634BED4B1428FA177E4B4070330DE"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall take effect beginning with the first fiscal year beginning after the date of the enactment of this Act.</text></subsection></section> 
<section id="HA4835B6D07C5462091089DC5F07BF3E2"><enum>10.</enum><header>Study by GAO</header> 
<subsection id="H977E501DECE9465FB0F68BC25477328"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States shall conduct a study to—</text> 
<paragraph id="HC7BB75B19D904AB8B226D72CABDBE14"><enum>(1)</enum><text>determine whether increases in Federal elementary and secondary education funding since the date of the enactment of the No Child Left Behind Act of 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/110">Public Law 107–110</external-xref>; 115 Stat. 1425) are sufficient to cover the costs of Federal requirements mandated by that Act;</text></paragraph> 
<paragraph id="HBC05097129E74D7AA5527F03A105CB9F"><enum>(2)</enum><text>identify the costliest provisions of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>);</text></paragraph> 
<paragraph id="H6B6206B3EE8A4381BB20E8FCAB5DCAB0"><enum>(3)</enum><text display-inline="yes-display-inline">identify cuts to programs and activities made by schools in order to implement requirements mandated by the No Child Left Behind Act of 2001;</text></paragraph> 
<paragraph id="HF18788A1FF6044B2B792F9EEC5758627"><enum>(4)</enum><text>determine—</text> 
<subparagraph id="HA59756EBF0464466B5BAE3C525E9D474"><enum>(A)</enum><text>the amount of Federal funds provided to implement the requirements of the Elementary and Secondary Education Act of 1965 disaggregated by the percentages of such funds used to implement each such requirement; and</text></subparagraph> 
<subparagraph id="HE4A12CD63E6B421893609600F2385627"><enum>(B)</enum><text>the percentage of State costs to implement such requirements in each such area;</text></subparagraph></paragraph> 
<paragraph id="HD0C79349B31B40CFAB92EEFAC1448686"><enum>(5)</enum><text>determine the cost of aligning elementary and secondary curricula to comply with the requirements of the Elementary and Secondary Education Act of 1965;</text></paragraph> 
<paragraph id="H32829337EE414B9197FB18808795DB3D"><enum>(6)</enum><text>determine the cost of calculating adequate yearly progress; and</text></paragraph> 
<paragraph id="H7EC46FFB17684F669F49BEDC343E9F72"><enum>(7)</enum><text>determine the costs of student assessments under the Elementary and Secondary Education Act of 1965.</text></paragraph></subsection> 
<subsection id="H4DB6D04C3E82457992A90000D39892E8"><enum>(b)</enum><header>Report</header><text>Not later than 120 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report containing the results of the study conducted under this section.</text> </subsection></section>
