<legis-type>A BILL</legis-type> 
<official-title>To require the approval of a Foreign Intelligence Surveillance Court judge or designated United States Magistrate Judge for the issuance of a national security letter, to require the Attorney General to submit semiannual reports on national security letters, and for other purposes.</official-title>

<section id="H9953FD0F10884D3EAF27D2F00399624" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Security Letter Judicial and Congressional Oversight Act</short-title></quote>. </text></section> 
<section id="HDD4B3FE002DC4E6198DB2C4D004CA8B8"><enum>2.</enum><header>Foreign Intelligence Surveillance Court judge or United States Magistrate Judge approval of national security letters</header> 
<subsection id="H42BB6A93D6504C29A56B06BE0026D498"><enum>(a)</enum><header>Review of national security letter requests</header> 
<paragraph id="HAA03B58E8BCA464383B8BAAB046352CC"><enum>(1)</enum><header>In general</header><text>No national security letter shall issue unless a Foreign Intelligence Surveillance Court judge or a designated United States Magistrate Judge finds that—</text> 
<subparagraph id="HB83DBD589BA24E8E9DA6F0B1E54FA1C7"><enum>(A)</enum><text>the information sought is relevant to an authorized investigation to protect against international terrorism or clandestine intelligence activities;</text></subparagraph> 
<subparagraph id="HD8BBEEF634D94D40B772DB0332D6617"><enum>(B)</enum><text>such an investigation of a United States person is not conducted solely upon the basis of activities protected by the first amendment to the Constitution of the United States; and</text></subparagraph> 
<subparagraph id="HD4A872CB56EE4DFFB4CBDCA319419EBA" commented="no"><enum>(C)</enum><text>there are specific and articulable facts giving reason to believe that the information sought pertains to a foreign power or an agent of a foreign power (as those terms are defined in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>)).</text></subparagraph></paragraph> 
<paragraph id="H8DE4878529DF4C47A1A2BF7D83219E6E"><enum>(2)</enum><header>Electronic filing</header><text>The court established by section 103(a) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) shall establish an electronic system for the submission of documents and other information relating to proceedings under paragraph (1) and for the issuance of orders relating to national security letters under paragraph (1).</text></paragraph></subsection> 
<subsection id="H8E548FCE5EC14E7EA0EB8243CD3E4552"><enum>(b)</enum><header>Sense of Congress regarding challenges to nondisclosure requirements of national security letters</header><text display-inline="yes-display-inline">It is the sense of Congress that in the case of a challenge to a nondisclosure requirement of a national security letter, a certification by the Attorney General or other appropriate head or deputy head of a department, agency, or instrumentality of the Federal Government that disclosure of such national security letter may endanger the national security of the United States or interfere with diplomatic relations—</text> 
<paragraph id="HFF331EFEE9614FD2B25CB4BCEB9ED05E"><enum>(1)</enum><text>should not be considered conclusive evidence that such disclosure would endanger the national security of the United States or interfere with diplomatic relations; and</text></paragraph> 
<paragraph id="H3C6824A485D64A1800963E2DF1CD9B8B"><enum>(2)</enum><text display-inline="yes-display-inline">should be considered a rebuttable presumption that such disclosure would endanger the national security of the United States or interfere with diplomatic relations.</text></paragraph></subsection> 
<subsection id="HBA4ADB79E7E2451CB7C6E442CE3C57E6"><enum>(c)</enum><header>Minimization procedures</header><text display-inline="yes-display-inline">The Attorney General shall establish minimization and destruction procedures to ensure that information obtained pursuant to a national security letter regarding persons that are no longer of interest in an authorized investigation is destroyed.</text></subsection> 
<subsection id="H0953C7A64B96402FA27E84465D22EBB6"><enum>(d)</enum><header>Report</header><text>The Attorney General shall, semiannually, submit to the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives and the Select Committee on Intelligence and the Committee on the Judiciary of the Senate a report containing—</text> 
<paragraph id="HFFF420357F7C46FFAF7C6824A496DB1E"><enum>(1)</enum><text>the total number of national security letters issued during the preceding six months, in unclassified form;</text></paragraph> 
<paragraph id="HC78B91A3AD624F698626DA2150300296"><enum>(2)</enum><text>for each of subparagraphs (A) through (E) of subsection (f)(3), the total number of national security letters issued during the preceding six months under the authority of each such subparagraph;</text></paragraph> 
<paragraph id="H817E8EB498724C2CB737D72960042FF5"><enum>(3)</enum><text display-inline="yes-display-inline">for each of subparagraphs (A) through (E) of subsection (f)(3), the total number of national security letters issued during the preceding six months under the authority of each such subparagraph for United States persons;</text></paragraph> 
<paragraph id="H7F971D916F324A9AB2D27E3B7361CEDD"><enum>(4)</enum><text display-inline="yes-display-inline">for each of subparagraphs (A) through (E) of subsection (f)(3), the total number of national security letters issued during the preceding six months under the authority of each such subparagraph for non-United States persons;</text></paragraph> 
<paragraph id="H72811E62B1CC43869ED9CC919CD29F5F"><enum>(5)</enum><text>a description of the minimization procedures adopted by the Attorney General pursuant to subsection (c), including any changes to minimization procedures previously adopted by the Attorney General;</text></paragraph> 
<paragraph id="HAF1705627C6348C4B7131E2D7B09C2E0"><enum>(6)</enum><text>a summary of the challenges made by recipients of national security letters in court;</text></paragraph> 
<paragraph id="HE708378E1F734FC383722602A248E6CB"><enum>(7)</enum><text>a description of the extent to which information obtained with national security letters has aided investigations and an explanation of how such information has aided such investigations; and</text></paragraph> 
<paragraph id="H6F4527B5C67B4D86A4E500901B4507A2"><enum>(8)</enum><text>a description of the extent to which information obtained with national security letters has aided prosecutions and an explanation of how such information has been used in or aided such prosecutions.</text></paragraph></subsection> 
<subsection id="HFA6FBDDD2F4C4860B8DEE475B57B02EB"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HA96C934F469B4EC0009C77239800B4D"><enum>(1)</enum><header>Foreign Intelligence Surveillance Court judge</header><text display-inline="yes-display-inline">The term <quote>Foreign Intelligence Surveillance Court judge</quote> means a judge of the court established by section 103(a) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1803 (a)).</text></paragraph> 
<paragraph id="H8C7D28B2C6AD4DBF85B3DDE29FA7D"><enum>(2)</enum><header>Designated United States Magistrate Judge</header><text display-inline="yes-display-inline">The term <quote>designated United States Magistrate Judge</quote> means, for each district court of the United States, a United States Magistrate Judge under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/43">chapter 43</external-xref> of title 28, United States Code, who is—</text> 
<subparagraph id="H29B32E32995A4331A26389008044735D"><enum>(A)</enum><text>the Chief United States Magistrate Judge of such district court; or</text></subparagraph> 
<subparagraph id="HA16D7FDF5162456FAD3094D290A63D00"><enum>(B)</enum><text>if a Chief United States Magistrate Judge has not been designated in such district court, another United States Magistrate Judge of such district court that is publicly designated by the Chief Justice of the United States to have the power to hear applications and grant orders for the issuance of national security letters under section 2.</text></subparagraph></paragraph> 
<paragraph id="H1701F8AC98794462002B6B015C443C03"><enum>(3)</enum><header>National security letter</header><text display-inline="yes-display-inline">The term <quote>national security letter</quote> means a request for information under—</text> 
<subparagraph id="HD8D8D04906444BC194ADFE12079DCBC"><enum>(A)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/2709">section 2709(b)</external-xref> of title 18, United States Code;</text></subparagraph> 
<subparagraph id="H55229B95D2244D5D88A49B8E35EC7220"><enum>(B)</enum><text>section 1114(a)(5)(A) of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414(a)(5)(A)</external-xref>);</text></subparagraph> 
<subparagraph id="H5C3E98EAB8EB4D04ADF225919460E74"><enum>(C)</enum><text>subsections (a) or (b) of section 626 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u(a)</external-xref>, 1681u(b));</text></subparagraph> 
<subparagraph id="H802548A401D14D6C8BCF6D29EB646660"><enum>(D)</enum><text display-inline="yes-display-inline">section 627(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v(a)</external-xref>); or</text></subparagraph> 
<subparagraph id="HF4C65F1D2CDE4844BB4EB3264C429B8D"><enum>(E)</enum><text>section 802(a) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/436">50 U.S.C. 436(a)</external-xref>).</text></subparagraph></paragraph></subsection></section>
