<section id="HF11D0B7FA179403DBBE61C540034D5D3"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to make further progress towards the achievement of the Nation’s water quality goals by establishing and providing funding for a clean water trust fund, which will provide for increased investment in critical water infrastructure, improvements in technology and management, greater funding for critical regional programs, and increased attention to fishable uses.</text></section> 
<section id="HD0140BF4D8B841ABB7E34E1DF0541BFB"><enum>3.</enum><header>Amendment of <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name></header><text display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>).</text></section> 
<title id="H6634DD50601D4BFCBEE748C34D9997A2"><enum>I</enum><header>TECHNICAL AND MANAGEMENT ASSISTANCE</header> 
<section id="HA367D5EE1EA542ADA3BB3B3DBF10811B"><enum>101.</enum><header>Technical assistance</header> 
<subsection id="H5A333A4E9F5B48B58BED93308E0B1DB"><enum>(a)</enum><header>Technical Assistance for Rural and Small Treatment Works</header><text>Section 104(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(b)</external-xref>) is amended—</text> 
<paragraph id="HB09546C7B5A54DC2B621726BC6AE6FD2"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (6);</text></paragraph> 
<paragraph id="HBFE446904E35409882D4F3D3573D8473"><enum>(2)</enum><text>by striking the period at the end of paragraph (7) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H7CB38B6347FD4D99AF7F00726946F799"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="HFDEFC00DFABF4FAC918F15E4C1151F37"><enum>(8)</enum><text>make grants to nonprofit organizations—</text> 
<subparagraph id="H48B88F003BB44F6D80F8895CC3AF3CF"><enum>(A)</enum><text>to provide technical assistance to rural and small municipalities for the purpose of assisting, in consultation with the State in which the assistance is provided, such municipalities in the planning, developing, and acquisition of financing for wastewater infrastructure assistance;</text></subparagraph> 
<subparagraph id="H6CE4ACBDDFA0470D88BF69313179E00"><enum>(B)</enum><text>to capitalize revolving loan funds for the purpose of providing loans, in consultation with the State in which the assistance is provided, to rural and small municipalities for predevelopment costs associated with wastewater infrastructure projects or short-term costs incurred for equipment replacement that is not part of regular operation and maintenance activities for existing wastewater systems, subject to the conditions that any loan from the fund will be made at a below market interest rate, for a term not to exceed 10 years, and in an amount not to exceed $100,000 and that all loan repayments will be credited to the fund;</text></subparagraph> 
<subparagraph id="H05F397254B8B4739002F453196BBD568"><enum>(C)</enum><text>to provide technical assistance and training for rural and small publicly owned treatment works and decentralized wastewater treatment systems to enable such treatment works and systems to protect water quality and achieve and maintain compliance with the requirements of this Act; and</text></subparagraph> 
<subparagraph id="HBECE5450450B4A3DB4A9152533EF09D"><enum>(D)</enum><text>to disseminate information to rural and small municipalities and municipalities that meet the affordability criteria established under section 603(i) by the State in which the municipality is located with respect to planning, design, construction, and operation of publicly owned treatment works and decentralized wastewater treatment systems.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9AF74C32CAF2430283A3F45160D6C0AE"><enum>(b)</enum><header>Authorization of Appropriations</header><text>Section 104(u) (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(u)</external-xref>) is amended—</text> 
<paragraph id="H8444C54A7CCA44F8845543389E8E7E39"><enum>(1)</enum><text>by striking <quote>and (6)</quote> and inserting <quote>(6)</quote>; and</text></paragraph> 
<paragraph id="H2E9FE9EEF69E404FAB39183827ACCB6"><enum>(2)</enum><text>by inserting before the period at the end the following: <quote>; (7) not to exceed $50,000,000 from the Clean Water Trust Fund established by section 701 for each of fiscal years 2006 through 2010 for carrying out subsection (b)(8), except that not more than one-third of such amount may be used in a fiscal year for carrying out subsection (b)(8)(B); and (8) not to exceed $295,000,000 from the Clean Water Trust Fund for each of fiscal years 2006 through 2010 for carrying out subsection (b)(3).</quote>.</text></paragraph></subsection> 
<subsection id="H8052D6D9C50C40E4896BAA84D27E4820"><enum>(c)</enum><header>Competitive Procedures for Awarding Grants</header><text>Section 104 (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(b)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H2EE817D346574C01822C851953100000"> 
<subsection id="H21F312C7AF8B4C0B83D8EB0802755428"><enum>(w)</enum><header>Competitive Procedures for Awarding Grants</header><text>The Administrator shall establish procedures that, to the maximum extent practicable, promote competition and openness in the award of grants to nonprofit private agencies, institutions, and organizations under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HEE879D3B0CD94B0C847D5C5F32B300C7"><enum>102.</enum><header>National Center for Utility Management</header><text display-inline="no-display-inline">Section 104 (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254</external-xref>) is further amended by adding at the end the following:</text>

<subsection id="H9AD5593CC1A8438391F9F043C77457D0"><enum>(x)</enum><header>Establishment of a national center for utility management</header> 
<paragraph id="HBA5659EAC45E4A03BD5EB83714F89EDD"><enum>(1)</enum><header>Grant</header><text>The Administrator may make a grant to an appropriate nonprofit organization to establish a National Center for Utility Management for the purpose of promoting improved management of public wastewater utilities, including the use of best management practices with respect to comprehensive asset management, worker training and flexibility, information systems, financial planning, and financial reporting.</text></paragraph> 
<paragraph id="H8A872DA4E05F4FFCB1F3D007CA4B545"><enum>(2)</enum><header>Functions</header><text>The functions of the National Center for Utility Management shall include, at a minimum, the following:</text> 
<subparagraph id="H5F0D853578E14B4FABCB18A618AB9C41"><enum>(A)</enum><text>Developing best practices for utility management.</text></subparagraph> 
<subparagraph id="H13B0620A63524EA2BEFB3B16F83C4115"><enum>(B)</enum><text>Coordinating relevant studies and development activities conducted at university-based training and technical assistance centers.</text></subparagraph> 
<subparagraph id="HF1131DE28CC6468FA98B8025EBC42637"><enum>(C)</enum><text>Coordinating ongoing and planned initiatives to promote best practices for utility management within and across the wastewater program.</text></subparagraph> 
<subparagraph id="H805E90349D9644008DDDB47D66502CB6"><enum>(D)</enum><text>Exploring opportunities to take advantage of best management practices and informational materials developed by other agencies (including the Office of Asset Management in the Federal Highway Administration).</text></subparagraph> 
<subparagraph id="H95369D9A7F9B4D82871449EE2C9F2788"><enum>(E)</enum><text>Strengthening efforts to educate utilities and local government leaders about the optimal use of best practices for utility management, through handbooks, software, workshops, the establishment of a website, and other steps to assure that wastewater utilities, regardless of size, have easy access to information about best practices for utility management.</text></subparagraph> 
<subparagraph id="H5D2005B61F76489F83515517E2F47C00"><enum>(F)</enum><text>In undertaking these functions, providing appropriate attention to the needs and circumstances of utilities that serve not more than 20,000 users and are located in a rural area.</text></subparagraph></paragraph> 
<paragraph id="HDE1D64266491421EACDDE9EA903B424C"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated from the Clean Water Trust Fund established by section 701 $5,000,000 for each of fiscal years 2006 through 2010 to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="H06C7B2D5B93646E087B5577ED91D2118"><enum>103.</enum><header>State management assistance</header><text display-inline="no-display-inline">Section 106(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1256">33 U.S.C. 1256(a)</external-xref>) is amended—</text> 
<paragraph id="H0C03C6AE7F994CC1A0B2A4008321A6B2"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (1); and</text></paragraph> 
<paragraph id="HCE7229EDCFA349979DBF3466D2178C84"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text>

<section id="HD4D8E8775CEB49AC933B69F5EA24094"><enum>104.</enum><header>Watershed pilot projects</header> 
<subsection id="H858B9FEDC69C47B88EFD46B160682CA"><enum>(a)</enum><header>Section redesignation</header><text>The second section 121 (<external-xref legal-doc="usc" parsable-cite="usc/33/1274">33 U.S.C. 1274</external-xref>) relating to watershed pilot projects is redesignated as section 122.</text></subsection> 
<subsection id="HDC33BAF6E25A4A74B9009ED43FF3F43F"><enum>(b)</enum><header>Pilot Projects</header><text>Section 122 (as so redesignated) is amended—</text> 
<paragraph id="HCF7F4893A5D2438A913D90424C3F4B67"><enum>(1)</enum><text>in the section heading by striking <quote><header-in-text>wet weather</header-in-text></quote>;</text></paragraph> 
<paragraph id="HC27A1FBE9BFA4EAC94A858ACE5C37143"><enum>(2)</enum><text>in the matter preceding paragraph (1) of subsection (a) by striking <quote>wet weather discharge</quote>;</text></paragraph>

<paragraph id="HECD8A27B25D84AADB81428AEF49E0030"><enum>(1)</enum><header>Maximum amount of grant</header><text>The maximum amount of a grant for a project or activity under subsection (a)(7) may not exceed 65 percent of the cost of the project or activity, as determined by the Administrator.</text></paragraph> 
<paragraph id="H375FB2E35B644CCFA653ECE7521B1CCF"><enum>(2)</enum><header>Administrative expenses</header><text>Not more than 4 percent of the amount of any grant made subsection (a)(7) may be used to pay administrative expenses in connection with the project or activity for which the grant is made.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title>

<paragraph id="HD733E21C34644D9DBD0027D3E2EF05C5"><enum>(3)</enum><header>Requirement</header><text>A project meets the requirement of this paragraph if the purpose of the project is to accomplish the objectives, goals, and policies of this Act by addressing an adverse environmental condition existing on the date of enactment of this paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subparagraph id="H529BF5CE8C4041558C7D9CEB1E1C6135"><enum>(A)</enum><text>has studied and evaluated the cost and effectiveness of innovative and alternative processes, materials, and techniques for carrying out the proposed project or activity for which assistance is sought under this title, and has selected, to the extent practicable, a project or activity that more efficiently uses energy and natural and financial resources or provides greater environmental benefits; and</text></subparagraph> 
<subparagraph id="H7D3FDC530F2F4E7984BCCAC53BC87E61"><enum>(B)</enum><text>has considered the cost and effectiveness of alternative management and financing approaches (including, as appropriate, rate structures, issuance of bonds, restructuring, regional alternatives, consolidation, and public-private partnerships) for carrying out a project or activity for which assistance is sought under this title, taking into account the cost of operating and maintaining the project or activity over its life, as well as the cost of constructing the project or activity;</text></subparagraph></paragraph> 
<paragraph id="HAC270F9D9FE14168929400B903B43922"><enum>(14)</enum><text>the State will use at least 15 percent of the amount of each capitalization grant received by the State under this title after September 30, 2007, to provide assistance to municipalities of fewer than 20,000 individuals that meet the affordability criteria established by the State under section 603(i)(2) for activities included on the State’s priority list established under section 603(g), to the extent that there are sufficient applications for such assistance;</text></paragraph> 
<paragraph id="HD5C5017B9C024092A22043A614DAA8B"><enum>(15)</enum><text>treatment works eligible under section 603(c)(1) that will be constructed in whole or in part with funds directly made available by capitalization grants under this title and section 205(m) will meet the requirements of, or otherwise be treated (as determined by the Governor of the State) under sections 204(b)(1), 211, 218, and 511(c)(1) in the same manner as treatment works constructed with assistance under title II of this Act; and</text></paragraph> 
<paragraph id="H861F606B851D4FF4974B3E3B4B147C98"><enum>(16)</enum><text>contracts and subcontracts to be carried out using funds under this title for program management, construction management, planning studies, feasibility studies, architectural services, preliminary engineering, design, engineering, surveying, mapping, and related services shall be awarded in the same manner as contracts for architectural and engineering services are awarded under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/11">chapter 11</external-xref> of title 40, United States Code, or an equivalent qualifications-based method of selection (as determined by the Governor of the State).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H837B5E312ADB4348BB153CC688B0086"><enum>303.</enum><header>Water pollution control revolving loan funds</header> 
<subsection id="HD9E6E3C7109A4583885CFB044F33988"><enum>(a)</enum><header>Projects and Activities Eligible for Assistance</header><text>Section 603(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>) is amended to read as follows:</text>

<paragraph id="H24BAA83944C0425E94FEAB3DC1D07FDA"><enum>(4)</enum><text>for the implementation of lake protection programs and projects under section 314;</text></paragraph> 
<paragraph id="H885A758646044B309FEB031F60000EA"><enum>(5)</enum><text>for repair or replacement of decentralized wastewater treatment systems that treat domestic sewage;</text></paragraph> 
<paragraph id="HF00F71DF76314A5B8779459470DA08F8"><enum>(6)</enum><text>for measures to manage or reduce municipal stormwater runoff;</text></paragraph> 
<paragraph id="H3E7F60B7BBB142EF9F07D4DAFBB05D88"><enum>(7)</enum><text>to any public entity for a water conservation project or activity the primary purpose of which is the protection, preservation, or enhancement of water quality, including—</text> 
<subparagraph id="HCE71EB9F43E4419FBFF7915DDDD20273"><enum>(A)</enum><text>piping or lining an irrigation canal;</text></subparagraph> 
<subparagraph id="HAF8D3A6A067749B58CE5008659B840F9"><enum>(B)</enum><text display-inline="yes-display-inline">recovery or recycling of wastewater or runoff from irrigation;</text></subparagraph> 
<subparagraph id="H24C4377AB5CC4D73B337DDF6FAFA9654"><enum>(C)</enum><text> irrigation scheduling;</text></subparagraph> 
<subparagraph id="H27DAD2D9B737434AAAEC08A837220879"><enum>(D)</enum><text>measurement or metering of water use;</text></subparagraph> 
<subparagraph id="HD615A956F85E4C839573C342C4F7FD93"><enum>(E)</enum><text> installation of water conservation measures by public utilities;</text></subparagraph> 
<subparagraph id="H046D3F3087494976A8132FE3DC8F01A6"><enum>(F)</enum><text>improving on-field irrigation efficiency; or</text></subparagraph> 
<subparagraph id="H5D05DAD681E84502AE3D9D78000061FA"><enum>(G)</enum><text>measures to enable customers to make more efficient use of treated water.</text></subparagraph></paragraph> 
<paragraph id="HFA71C790269445058F7E3940FDB6554F"><enum>(8)</enum><text>for measures to increase the security of publicly owned treatment works; and</text></paragraph> 
<paragraph id="H6F3DE2BC6B3D433A899906CD215B2B0"><enum>(9)</enum><text>for the development and implementation of watershed projects meeting the criteria set forth in section 122.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H88D90EA335BE48B1806F5C563B55DD53"><enum>(b)</enum><header>Extended Repayment Period</header><text>Section 603(d)(1) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)(1)</external-xref>) is amended—</text> 
<paragraph id="HF10ADA22FB634E1793988FFBBBB8C4AA"><enum>(1)</enum><text>in subparagraph (A) by striking <quote>20 years</quote> and inserting <quote>the lesser of 30 years or the design life of the project to be financed with the proceeds of the loan</quote>; and</text></paragraph>

<clause id="H650FD7B8264945CD88AEE14EE44E44C"><enum>(i)</enum><text>an inventory of critical assets that are a part of that portion of the treatment works;</text></clause> 
<clause id="H77E5AC26532D4C9BA7CE60D3455499DD"><enum>(ii)</enum><text>an evaluation of the condition and performance of inventoried assets or asset groupings; and</text></clause> 
<clause id="H7029D470222E4DBBA746F267042BD3C9"><enum>(iii)</enum><text>a plan for maintaining, repairing, and, as necessary, replacing that portion of the treatment works and a plan for funding such activities.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H56C6C028ECCD448BB3D483C03BEAE03E"><enum>(d)</enum><header>Expenses of administering the state fund</header><text>Section 603(d)(7) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)(7)</external-xref>) is amended by inserting before the period at the end the following: <quote>, $400,000 per year, or <fraction>1/5</fraction> percent per year of the current valuation of the fund, whichever amount is greatest, plus the amount of any fees collected by the State for such purpose regardless of the source</quote>.</text></subsection> 
<subsection id="H1158E361B778421F951033F8E2F6B08D"><enum>(e)</enum><header>Types of assistance</header><text>Section 603(d) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)</external-xref>) is amended—</text>

<paragraph id="HB50C57196F7E48E0BE8E30FAE49FC59"><enum>(9)</enum><text display-inline="yes-display-inline">to make grants to States for high priority partnership projects under section 608 on the condition that the requirements of paragraph (1)(E) are met in the case of any grant by a State for the repair, replacement, or expansion of a treatment works.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HC878890102B147C787E68F5C2BF6F3E1"><enum>(f)</enum><header>Affordability criteria</header><text>Section 603 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H1FE58DDE116E43E79657EA2B00B56019"><enum>(i)</enum><header>Affordability criteria</header> 
<paragraph id="HAB0D17D91F384307BD6F9CC769550017"><enum>(1)</enum><header>Establishment</header><text>On or before September 30, 2007, and after providing notice and an opportunity for public comment, a State shall establish affordability criteria to assist in identifying municipalities that would experience a significant hardship raising the revenue necessary to finance a project or activity eligible for assistance under section 603(c)(1) if additional subsidization is not provided. Such criteria shall be based on income data, population trends, and other data determined relevant by the State.</text></paragraph> 
<paragraph id="H879A3FBF213E4B4B81FC694C4525C4C2"><enum>(2)</enum><header>Existing criteria</header><text>If a State has previously established, after providing notice and an opportunity for public comment, affordability criteria that meet the requirements of paragraph (1), the State may use the criteria for the purposes of this subsection. For purposes of this Act, any such criteria shall be treated as affordability criteria established under this paragraph.</text></paragraph> 
<paragraph id="H3274752592BB49BC87BFEA02D26694D5"><enum>(3)</enum><header>Information to assist states</header><text>The Administrator may publish information to assist States in establishing affordability criteria under paragraph (1).</text></paragraph> 
<paragraph id="H7485896CA3054F9090C03C4FF3035FA3"><enum>(4)</enum><header>Priority</header><text>A State may give priority to a recipient for a project or activity eligible for funding under section 603(c)(1) if the recipient meets the State’s affordability criteria.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="HD2C2583A6C224DA188BE4E1F65C74653"><enum>(a)</enum><header>In General</header><text>Section 604(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384(a)</external-xref>) is amended to read as follows:</text>

<paragraph id="H28396F78C24D458B9D44266E8EA117D3"><enum>(1)</enum><header>Fiscal years 2006 and 2007</header><text>Sums appropriated to carry out this title for each of fiscal years 2006 and 2007 shall be allotted by the Administrator in accordance with the formula used to allot sums appropriated to carry out this title for fiscal year 2005.</text></paragraph> 
<paragraph id="H073807F1A66F498181CA1D8EC61D6899"><enum>(2)</enum><header>Fiscal year 2008 and thereafter</header><text>Sums appropriated to carry out this title for fiscal year 2008 and each fiscal year thereafter shall be allotted by the Administrator as follows:</text> 
<subparagraph id="HE499F4F060164F2684FC18AC07F9D09"><enum>(A)</enum><text>Amounts that do not exceed $1,350,000,000 shall be allotted in accordance with the formula described in paragraph (1).</text></subparagraph>

<subsection id="H68CE453C14F04281AC9B604900003123"><enum>(b)</enum><header>Planning Assistance</header><text>Section 604(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384(b)</external-xref>) is amended by striking <quote>1 percent</quote> and inserting <quote>2 percent</quote>.</text></subsection> 
<subsection id="H1E00996FCBEF447F97F204B6F3C96FB6"><enum>(c)</enum><header>Formula</header><text>Section 604 (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384</external-xref>) is amended by adding at the end the following:</text>

<section id="H3D6FB53B3DBC4592A7EA6021AEA8E200"><enum>305.</enum><header>Intended use plan</header> 
<subsection id="H46496934C24B488F00DC78DC2D30F46F"><enum>(a)</enum><header>Integrated Priority List</header><text>Section 603(g) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(g)</external-xref>) is amended to read as follows:</text>

<subsection id="H870B66A77B5342C88B1CAAE6AFDDD286"><enum>(g)</enum><header>Priority List</header> 
<paragraph id="HC0AAF0C2BE6F4EAB8763CB21D7DCF03"><enum>(1)</enum><header>In general</header><text>For fiscal year 2008 and each fiscal year thereafter, a State shall establish or update a list of projects and activities for which assistance is sought from the State’s water pollution control revolving fund. Such projects and activities shall be listed in priority order based on the methodology established under paragraph (2). The State may provide financial assistance from the State’s water pollution control revolving fund only with respect to a project or activity included on such list. In the case of projects and activities eligible for assistance under section 603(c)(2), the State may include a category or subcategory of nonpoint sources of pollution on such list in lieu of a specific project or activity.</text></paragraph> 
<paragraph id="H32064884D89F40E2B1F98D5EBABEB325"><enum>(2)</enum><header>Methodology</header> 
<subparagraph id="HE29E80E6E61C47428EDFD9600D2C614"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this paragraph, and after providing notice and opportunity for public comment, each State (acting through the State’s water quality management agency and other appropriate agencies of the State) shall establish a methodology for developing a priority list under paragraph (1).</text></subparagraph> 
<subparagraph id="H75F8461F65F04372A761E4DECEBF810"><enum>(B)</enum><header>Priority for projects and activities that achieve greatest water quality improvement</header><text>In developing the methodology, the State shall seek to achieve the greatest degree of water quality improvement, taking into consideration the requirement of section 602(b)(5), section 603(i), and whether such water quality improvements would be realized without assistance under this title.</text></subparagraph> 
<subparagraph id="HAACD9175229C4ABCAB8CC45793E182B6"><enum>(C)</enum><header>Considerations in selecting projects and activities</header><text>In determining which projects and activities will achieve the greatest degree of water quality improvement, the State shall consider—</text> 
<clause id="HED253CAF09944454A9B411F9D53C631C"><enum>(i)</enum><text>information developed by the State under sections 303(d) and 305(b);</text></clause> 
<clause id="H6AE8E4798DBC4F69913F6301C501009C"><enum>(ii)</enum><text>the State’s continuing planning process developed under section 303(e);</text></clause> 
<clause id="HB85F956A8D204994BF5EC5D5D1108EAD"><enum>(iii)</enum><text>the State’s management program developed under section 319; and</text></clause> 
<clause id="H25833F96C7004CB2A2D7CEBE94E4E5E8"><enum>(iv)</enum><text>conservation and management plans developed under section 320.</text></clause></subparagraph> 
<subparagraph id="HFADD083A99914D73916DDDC918B1F9A1"><enum>(D)</enum><header>Nonpoint sources</header><text>For categories or subcategories of nonpoint sources of pollution that a State may include on its priority list under paragraph (1), the State may consider the cumulative water quality improvements associated with projects or activities in such categories or subcategories.</text></subparagraph> 
<subparagraph id="HF0C57026E2C34FE983B7390284A906D2"><enum>(E)</enum><header>Existing methodologies</header><text>If a State has previously developed, after providing notice and an opportunity for public comment, a methodology that meets the requirements of this paragraph, the State may use the methodology for the purposes of this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDCB7E1BA91C24D7099B9D7912196A3A"><enum>(b)</enum><header>Intended Use Plan</header><text>Section 606(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1386">33 U.S.C. 1386(c)</external-xref>) is amended—</text> 
<paragraph id="H2137ABF77788401FBBD3C0E67022707F"><enum>(1)</enum><text>in the matter preceding paragraph (1) by striking <quote>each State shall annually prepare</quote> and inserting <quote>each State (acting through the State’s water quality management agency and other appropriate agencies of the State) shall annually prepare and publish</quote>;</text></paragraph> 
<paragraph id="H36826860F5B741B2ABE702F9EAB0A85E"><enum>(2)</enum><text>by striking paragraph (1) and inserting the following:</text>

<subsection id="H036ADE4D3C65449EA45239743957D8CD"><enum>(c)</enum><header>Transitional Provision</header><text>Before completion of a priority list based on a methodology established under section 603(g) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (as amended by this section), a State shall continue to comply with the requirements of sections 603(g) and 606(c) of such Act, as in effect on the day before the date of enactment of this Act.</text></subsection></section> 
<section id="H2E0F94A89F054CBFB44623B09EA5BCB4"><enum>306.</enum><header>Federal oversight</header> 
<subsection id="H5BF696BA66A84F79831ECEC1A582305F"><enum>(a)</enum><header>Annual Report</header><text>Section 606(d) (<external-xref legal-doc="usc" parsable-cite="usc/33/1386">33 U.S.C. 1386(d)</external-xref>) is amended—</text> 
<paragraph id="HE5F5EB9460EE461A82FF668D52D4694"><enum>(1)</enum><text>by inserting <quote>or grant</quote> after <quote>loan</quote> each place it appears; and</text></paragraph> 
<paragraph id="H57720C0ED08B40869D9DE23EB5180011"><enum>(2)</enum><text> by inserting <quote>the eligible purpose under section 603(c) for which the assistance is provided,</quote> after <quote>loan amounts,</quote>.</text></paragraph></subsection> 
<subsection id="HF19BBA78163D4C8AB960A1694363B505"><enum>(b)</enum><header>Annual Federal Oversight Review</header><text>Section 606(e) (<external-xref legal-doc="usc" parsable-cite="usc/33/1386">33 U.S.C. 1386(e)</external-xref>) is amended—</text> 
<paragraph id="HDAB18FC7F41644AEA577D86C109CB100"><enum>(1)</enum><text>by inserting <quote>or the recipient of a grant under section 608</quote> after <quote>revolving fund</quote>; and</text></paragraph> 
<paragraph id="H64FA0653483C4ECEB0D9B0A2D8586CC2"><enum>(2)</enum><text>by inserting <quote>or grant</quote> after <quote>loan</quote>; and</text></paragraph> 
<paragraph id="H50F07F6A2C2046D9A40963CA358E6EE5"><enum>(3)</enum><text>by adding at the end the following: <quote>In carrying out an oversight review under this subsection, the Administrator may allow a State to certify, with supporting documentation, its compliance with the requirements of this title.</quote>.</text></paragraph></subsection></section> 
<section id="HFC625FB3C3B5428AAAC04BF400C4E9EF"><enum>307.</enum><header>Technical assistance</header><text display-inline="no-display-inline">Title VI (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381 et seq.</external-xref>) is amended—</text> 
<paragraph id="H77308B432FBB489E95139661219E2C9E"><enum>(1)</enum><text>by redesignating section 607 as section 609; and</text></paragraph> 
<paragraph id="H7828781AC7494ECD9155280018639358"><enum>(2)</enum><text>by inserting after section 606 the following:</text>

<section id="HE36856353C6546B4B7DEC4FB5D9178A8"><enum>607.</enum><header>Technical assistance</header> 
<subsection id="H36EA5B3B531E47D2BB92294D82CDFD29"><enum>(a)</enum><header>Simplified Procedures</header><text>Not later than 1 year after the date of enactment of this section, the Administrator shall assist the States in establishing simplified procedures for treatment works to obtain assistance under this title.</text></subsection> 
<subsection id="HE34997CF25E044B3BCB49DA3AA2CF9F0"><enum>(b)</enum><header>Publication of Manual</header><text>Not later than 2 years after the date of the enactment of this section, and after providing notice and opportunity for public comment, the Administrator shall publish a manual to assist treatment works in obtaining assistance under this title and publish in the Federal Register notice of the availability of the manual.</text></subsection> 
<subsection id="H37284D0ADD664FF2ACE57860FD0060E5"><enum>(c)</enum><header>Assistance for Improving the Management of Water Quality Infrastructure and Increasing Cost-Effectiveness of Infrastructure Improvements</header><text>At the request of any State, the Administrator shall assist in the development of criteria for a State to determine compliance with the conditions of funding assistance established under section 602(b)(13).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H7475F819B2434758A9C3A5F95C347F1F"><enum>308.</enum><header>High priority partnership grants</header> <text display-inline="no-display-inline">Title VI of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381 et seq.</external-xref>) is further amended by inserting after section 607 (as inserted by section 307 of this Act) the following:</text> 
<quoted-block style="OLC" id="HB9C5D33E1D0D48BBB7D865DE930018CF" display-inline="no-display-inline"> 
<section id="HA6D4CE9753854C03A7785BD10004000"><enum>608.</enum><header>High priority partnership grants</header> 
<subsection id="H1355283A9AD74DA2A085B6EC0175C930"><enum>(a)</enum><header>Establishment of program</header><text>The Administrator is authorized to make grants to States for the purpose of providing grants to entities eligible for assistance under section 603(c) for projects and activities that are eligible under section 603(c) based on the selection criteria in subsection (b).</text></subsection> 
<subsection id="H40C362A96FE94F3EBDEF8288D0C8FF9C"><enum>(b)</enum><header>Criteria</header><text>In selecting from among applications for grants under this section, a State shall give priority, to the maximum extent practicable, to projects and activities that—</text> 
<paragraph id="HE83DD2F500E94CE9A96487F7BA64B0AF"><enum>(1)</enum><text>address the most serious water pollution problems;</text></paragraph> 
<paragraph id="H222A4A38C4DA4E3B9EFAAC109B29B62B"><enum>(2)</enum><text>are necessary to ensure compliance with the requirements of this Act; or</text></paragraph> 
<paragraph id="H37C0419558B1482E95F4AF518ADE4F0"><enum>(3)</enum><text>benefit communities with the greatest need (determined on the basis of affordability criteria established by the State under section 603(i)).</text></paragraph></subsection> 
<subsection id="H8B9CDD7A51C84114831600EB003E8D14"><enum>(c)</enum><header>Federal share</header><text>The amount of Federal funds granted by a State for a project or activity under this section may not exceed 65 percent of the cost of the project or activity.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HFA2440790D3F407AB9B597EE2BDCA810"><enum>309.</enum><header>Authorization of appropriations from the Clean Water Trust Fund</header> <text display-inline="no-display-inline">Title VI (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381 et seq.</external-xref>) is further amended by adding at the end the following:</text>

<section id="H608CAC564D4C4E87A229A36E61C62978"><enum>610.</enum><header>Authorization of appropriations from Clean Water Trust Fund</header><text display-inline="no-display-inline">There is authorized to be appropriated from the Clean Water Trust Fund established by section 701 $6,000,000,000 for grants to States under section 601(a) for each of fiscal years 2006 through 2010, of which the first $1,500,000,000 shall be available only for the purpose of providing assistance under paragraphs (1) through (8) of section 603(d). The remainder of the amount made available under this section for a fiscal year shall be available for grants for high priority partnerships under section 608 for such fiscal year.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </title>

<section id="H3307E2EA16C9498E9FF13DCE228490EE"><enum>401.</enum><header>Establishment of Clean Water Trust Fund</header><text display-inline="no-display-inline">The Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H4B82C7E903314E5F8DDDD7B1D8E09EE9"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Clean Water Trust Fund</quote>.</text></subsection> 
<subsection id="HF5B9902677364B8A99FD407B50E700"><enum>(b)</enum><header>Transfers to the trust fund</header><text>There are hereby appropriated to the Clean Water Trust Fund amounts equivalent to fees collected and deposited in the Fund under section 702.</text></subsection> 
<subsection id="H83C903B9888B49B7A9A2BC4D6900CF32"><enum>(c)</enum><header>Expenditures from the trust fund</header><text>Amounts in the Trust Fund are available, as provided by appropriations acts, for—</text> 
<paragraph id="H6211BC0AE3A24C338E1E568D8E268238"><enum>(1)</enum><text>water pollution reduction and control activities under section 104(b)(3);</text></paragraph> 
<paragraph id="H7B0BB50702D64C11BF442EB2BEC834C8"><enum>(2)</enum><text>the technical assistance for small rural communities program under section 104(b)(8);</text></paragraph> 
<paragraph id="H0EDE2474D13C42E096C076A8AE00D33F"><enum>(3)</enum><text>the National Center for Utility Management program under section 104(x);</text></paragraph> 
<paragraph id="HF17BC9BB03154795A8BACA006E7E75EA"><enum>(4)</enum><text>grants for State management assistance under section 106(a);</text></paragraph> 
<paragraph id="H84CC7966ADDB4C448C3B15A9F2C70076"><enum>(5)</enum><text>carrying out section 122, relating to watershed pilot projects;</text></paragraph> 
<paragraph id="H14B91DA82CFF4BB0AAB0A79FB092B832"><enum>(6)</enum><text>critical regional waters under section 123;</text></paragraph> 
<paragraph id="HCEFB57C25776410A83893DE86C4EA9EB"><enum>(7)</enum><text>carrying out section 220 relating to alternative water source projects;</text></paragraph>

<paragraph id="HED2B8D9CFE144A62AC5F0035AE75F27C"><enum>(9)</enum><text>grants to States under section 601;</text></paragraph> 
<paragraph id="H7E1A3BB2145541D5996730008C000859"><enum>(10)</enum><text>grants for fisheries habitat protection, restoration, and enhancement under section 501 of the Clean Water Trust Act of 2005; and</text></paragraph> 
<paragraph id="H3D64ED776C374692AD67A1008C50852C"><enum>(11)</enum><text>grants for wetlands restoration under section 502 of the Clean Water Trust Act of 2005.</text></paragraph> </subsection> 
<subsection id="H9E31614450114ACD846542B7F10377DE"><enum>(d)</enum><header>Budgetary treatment of the fund</header><text>Notwithstanding any other provision of law, the receipts and disbursements of the Clean Water Trust Fund—</text> 
<paragraph id="H0F4CC150EAF74EFE9BE5005BF600D926"><enum>(1)</enum><text>shall not be counted as new budget authority, outlays, receipts, or deficit or surplus for purposes of—</text> 
<subparagraph id="H527B36F84FC540C4BBDB90A8DEF32972"><enum>(A)</enum><text>the budget of the United States submitted by the President; or</text></subparagraph> 
<subparagraph id="HD9FACE5D29624B1F96C46D486723195C"><enum>(B)</enum><text>the congressional budget (including allocations of budget authority and outlays provided therein); and</text></subparagraph> </paragraph> 
<paragraph id="H86F40D7C4C3D47349DDC9BA001B57660"><enum>(2)</enum><text>shall be exempt from any general budget limitation imposed by statute on expenditures and net lending (budget outlays) of the United States Government.</text></paragraph></subsection></section> 
<section id="H73451738F67445A2974181D016FEBC81" commented="no"><enum>702.</enum><header>Revenue</header><text display-inline="no-display-inline">[The Administrator shall submit to Congress for consideration, within 180 days of enactment of this section, an equitable system of user fees to fund this title.]</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section></title> 
<title id="H1F80BE21641A4C74929850797E44B8B4"><enum>V</enum><header>Fisheries</header> 
<section id="HF16C8252E4264B249013A1551734F46D"><enum>501.</enum><header>Fisheries habitat protection, restoration, and enhancement grants</header> 
<subsection id="H82247FC9DFBD4839804C028B6C9E8F23"><enum>(a)</enum><header>Grants</header><text>The Administrator of the Environmental Protection Agency is authorized to make grants to any State (as defined in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>), municipality, intermunicipal or interstate agency, nonprofit organization, or institution of higher education for the purpose of assisting in the protection, preservation, and restoration of fresh water, estuarine, and marine fisheries habitat and uses and for the enhancement of access within a watershed for fisheries uses.</text></subsection> 
<subsection id="H8C69D51313D14E78881217A1D6A41B88"><enum>(b)</enum><header>Watershed plans</header><text>Activities to be funded shall be based on a comprehensive assessment and plan for the watershed. All funded activities must directly support the described plan, and grant funds must be used in accordance with the plan.</text></subsection> 
<subsection id="H9280B6A0461B4388947500309182EB05"><enum>(c)</enum><header>Limitations</header> 
<paragraph id="H5943C3BC964D4106004E8F8BD107AB00"><enum>(1)</enum><header>Maximum amount</header><text>The maximum amount of a grant under this section for any activity may not exceed 65 percent of the cost of the activity, as determined by the Administrator.</text></paragraph> 
<paragraph id="HBDF5B140257145CC991DFF00C33D1CC4"><enum>(2)</enum><header>Administrative expenses</header><text>Not more than 4 percent of the amount of any grant made under this section may be used to pay administrative expenses in connection with the activity for which the grant is made.</text></paragraph></subsection> 
<subsection id="HBC57A56083074D7EB5BF009226867462"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator from the Clean Water Trust Fund $250,000,000 for each of fiscal years 2006 through 2010 to carry out this section.</text></subsection></section> 
<section id="HF5DA37E51650407C879F5CE2ADA9172E"><enum>502.</enum><header>State wetlands restoration grants</header> 
<subsection id="H6C79B70E5EF141E0A5482107E5FE00C1"><enum>(a)</enum><header>Grants to states</header><text>The Administrator of the Environmental Protection Agency is authorized to make grants of up to $2,000,000 to each State (as defined in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>)) for fiscal years 2006 through 2010 to carry out this section.</text></subsection> 
<subsection id="H0D360C4313A1437897702396A186B3F2"><enum>(b)</enum><header>Wetland restoration project defined</header><text>For the purposes of this section, a <quote>wetland restoration project</quote> means an activity to improve wetland functions, including the filtration of surface and ground water, the mitigation of flooding, and the enhancement of wildlife habitat.</text></subsection> 
<subsection id="H1E507DC549B643F3AFA33DADC56039C"><enum>(c)</enum><header>Project grants</header> 
<paragraph id="H6B2D0A9FA439421484F37CEFC2D8D3D2"><enum>(1)</enum><header>Distribution of funds</header><text>A State receiving a grant under this section shall distribute funds received under the grant for wetland restoration projects to appropriate State, municipal, intermunicipal, and interstate agencies, nonprofit organizations, and institutions of higher education that have expertise in wetlands restoration.</text></paragraph> 
<paragraph id="H005229B2760146DBBF1BE6B8FE0610FB"><enum>(2)</enum><header>Maximum amount</header><text>The maximum amount of grants under this section for any project may not exceed $500,000 in a fiscal year and 65 percent of the cost of the project, as determined by the Administrator.</text></paragraph></subsection> 
<subsection id="HCD39D98FA9FE464783E04759AADE14EC"><enum>(d)</enum><header>Project administration</header><text>A State receiving a grant under this section may use up to 4 percent of the funds received under the grant for administrative expenses in carrying out this section.</text></subsection> 
<subsection id="H1E308637F71D47B4949F8861EFFAFBD"><enum>(e)</enum><header>Reporting</header><text>Each State receiving a grant under this section shall provide annually to the Administrator a summary of the wetland restoration projects funded under this section.</text></subsection> 
<subsection id="H28DCB49288B94649A669A6ECA3F2A468"><enum>(f)</enum><header>Authorization</header><text>There is authorized to be appropriated to the Administrator from the Clean Water Trust Fund $112,000,000 for each of fiscal years 2006 through 2010 to carry out this section.</text></subsection></section></title>

<section id="H2164EB52F3924D0D8CEE21FD43F41892"><enum>601.</enum><header>Definition of treatment works</header><text display-inline="no-display-inline">Section 502 (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H2A4DB6DBF5074C5E8161C7FA6D36C617"><enum>(a)</enum><header>Reservation of funds</header><text display-inline="yes-display-inline">Section 518(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1377">33 U.S.C. 1377(c)</external-xref>) is amended—</text> 
<paragraph id="H42ED4B97FDFD466D95458764E23682D4"><enum>(1)</enum><text>by striking <quote>The Administrator</quote> and inserting the following:</text>

<subparagraph id="H9647F3E8FD884FD583E5FF71B3BE561B"><enum>(B)</enum><text>former Indian reservations in Oklahoma (as determined by the Secretary of the Interior); and</text></subparagraph> 
<subparagraph id="H65917171A0A84B9E9CF88CD29526A5D"><enum>(C)</enum><text>Native villages (as defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD6417DB03C32499D9DACDF3B4DB5CA21"><enum>(b)</enum><header>Eligibility of Indian Tribes</header><text display-inline="yes-display-inline">Section 518(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1377">33 U.S.C. 1377(e)</external-xref>) is amended by striking <quote>and 406</quote> and inserting <quote>406, and 608</quote>.</text></subsection></section> 
<section id="HDE96A8DA0B5E440CAAC0F58C00E04999"><enum>603.</enum><header>Private property not affected</header><text display-inline="no-display-inline">Nothing in this Act affects the rights of private property owners or may be construed to provide any Federal, State, or local entity with authority to restrict the use of, encumber, or take private property.</text></section></title>
