<section id="HEA4A230FA9FA4410868376D3F200C9EF" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Airport Noise Curfew Act of 2005</short-title></quote>.</text></section>
<section id="H8D59BB3369E0479E82D1BD4132801161"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline"> There is established a commission to be known as the <quote>Airport Noise Curfew Commission</quote> (in this Act referred to as the <quote>Commission</quote>).</text></section>
<section id="H0D0F6D9EE05B455A8FF7BCAD079EF021"><enum>3.</enum><header>Duties of Commission</header><text display-inline="no-display-inline"> The Commission shall study and make recommendations to Congress regarding the establishment of curfews on nonmilitary aircraft operations over populated areas of the United States during normal sleeping hours.</text></section>
<section id="H470FB7E808DE45C1000109FE7FAFA5B6"><enum>4.</enum><header>Membership</header>
<subsection id="H4F61BBED3E804AA095D7EA988C3DE7EC"><enum>(a)</enum><header>Number and appointment</header><text>The Commission shall be composed of 9 members as follows:</text>
<paragraph id="H6647CBD94AC840C99FC3259E31E91036"><enum>(1)</enum><text>4 members appointed by the Speaker of the House of Representatives.</text></paragraph>
<paragraph id="H69F3B0F3507442A3ADB39CDAF22BB14B"><enum>(2)</enum><text>3 members appointed by the President pro tempore of the Senate.</text></paragraph>
<paragraph id="H99A9AA72B13B4D02BE974C59EEB929D"><enum>(3)</enum><text>The Administrator of the Environmental Protection Agency (or the Administrator's designee).</text></paragraph>
<paragraph id="H64A5417674974E1CA77F56FA883134AF"><enum>(4)</enum><text>The Administrator of the Federal Aviation Administration (or the Administrator's designee).</text></paragraph></subsection>
<subsection id="H64B4D90FA9F84DF9B1593BCA29A3131C"><enum>(b)</enum><header>Qualifications</header><text>One of the members appointed under each of subsections (a)(1) and (a)(2) shall be a representative of the aviation industry. The other members appointed under such subsections shall be private citizens not involved in the aviation industry.</text></subsection>
<subsection id="H451D9976BC13401FB5E9A37667008D2D"><enum>(c)</enum><header>Chairperson</header><text>The Chairperson of the Commission shall be elected by the members from among the members appointed under subsections (a)(1) and (a)(2) who are private citizens not involved in the aviation industry.</text></subsection>
<subsection id="HF8A1FB3643554B338179951DFCA52ED8"><enum>(d)</enum><header>Vacancies</header><text>A vacancy in the Commission shall be filled in the manner in which the original appointment was made.</text></subsection>
<subsection id="H3345D9DED84A45979C2EE9DBFF67F6F"><enum>(e)</enum><header>Basic Pay</header><text></text>
<paragraph id="HD403ECDE6B1A42EA8DF850CB22251549"><enum>(1)</enum><header>Rates of pay</header><text>To the extent or in the amounts provided in advance in appropriation Acts and except as provided in paragraph (2), members of the Commission shall each be entitled to receive the daily equivalent of the annual rate of basic pay in effect for grade GS–18 of the General Schedule for each day (including travel time) during which they are engaged in the actual performance of duties vested in the Commission.</text></paragraph>
<paragraph id="HFF6AFE901CC44F52AC8E7284D903D500"><enum>(2)</enum><header>Prohibition of compensation of federal employees</header><text>Members of the Commission who are full-time officers or employees of the United States may not receive additional pay, allowances, or benefits by reason of their service on the Commission.</text></paragraph></subsection>
<subsection id="H538713E42BCC4D3681382436FB3BFDE9"><enum>(f)</enum><header>Travel expenses</header><text>Each member shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection></section>
<section id="H61659F33CAC14689BBE2BE9C2D7777B4"><enum>5.</enum><header>Staff of Commission</header>
<subsection id="HCBD0EA4286D0427D968CD99CA632C1F"><enum>(a)</enum><header>Staff</header><text>Subject to rules prescribed by the Commission, the Chairperson may appoint and fix the pay of such personnel as the Chairperson considers appropriate.</text></subsection>
<subsection id="H0539015EFAE742A68C5C42B400727693"><enum>(b)</enum><header>Applicability of certain civil service laws</header><text>The staff of the Commission may be appointed without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and may be paid without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates.</text></subsection>
<subsection id="H6D1690F8115844CC8BEAD23D76ECCF35"><enum>(c)</enum><header>Experts and consultants</header><text>Subject to rules prescribed by the Commission, the Chairperson may procure temporary and intermittent services to the same extent as is authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5, United States Code, but at rates for individuals not to exceed the daily equivalent of the annual rate of basic pay in effect for grade GS–18 of the General Schedule.</text></subsection>
<subsection id="H32018C25AE664DBA00FB27AAA0D63C"><enum>(d)</enum><header>Staff of Federal agencies</header><text>Upon request of the Commission, the head of any Federal department or agency may detail, on a reimbursable basis, any of the personnel of that department or agency to the Commission to assist it in carrying out its duties under this Act.</text></subsection></section>
<section id="H6635A789A1F64B0E806B004BEF376521"><enum>6.</enum><header>Powers of Commission</header>
<subsection id="H3CF6B2119046493199761551FCE45317"><enum>(a)</enum><header>Hearings and sessions</header><text>The Commission may, for the purpose of carrying out its duties and functions under this Act, hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence, as the Commission considers appropriate.</text></subsection>
<subsection id="H23496711D22E4D3D94998EFE670137C6"><enum>(b)</enum><header>Powers of members and agents</header><text>Any member or agent of the Commission may, if authorized by the Commission, take any action which the Commission is authorized to take by this Act.</text></subsection>
<subsection id="H921100337AEE4F1BBDFD9CD8148568F0"><enum>(c)</enum><header>Obtaining official data</header><text>The Commission may secure directly from any Federal department or agency information necessary to enable it to carry out its duties and functions. Upon request of the Chairperson of the Commission, the head of such department or agency shall furnish such information to the Commission.</text></subsection>
<subsection id="H050F087EAC1542C7B9301DFAF38B841D"><enum>(d)</enum><header>Mails</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other Federal departments and agencies.</text></subsection>
<subsection id="H98B98A594704413181B00C92868836E"><enum>(e)</enum><header>Administrative support services</header><text>Upon the request of the Commission, the Administrator of General Services shall provide to the Commission, on a reimbursable basis, the administrative support services necessary for the Commission to carry out its responsibilities under this Act.</text></subsection>
<subsection id="H855D46974C844B9A92FB82ECBEB2EFD"><enum>(f)</enum><header>Subpoena power</header><text>The Commission may issue subpoenas requiring the attendance and testimony of witnesses and the production of any evidence relating to any matter which the Commission is empowered to investigate by this Act. The attendance of witnesses and the production of evidence may be required from any place within the United States at any designated place of hearing within the United States.</text></subsection></section>
<section id="H887C6AB8AD9E4CE3AC1878F76C2FEEBA"><enum>7.</enum><header>Report</header><text display-inline="no-display-inline"> Not later than 6 months after the date of enactment of this Act, the Commission shall transmit to Congress a report on its findings and recommendations.</text></section>
<section id="H5E5577EF441842B7B7A79B985FF98BDD"><enum>8.</enum><header>Termination</header><text display-inline="no-display-inline"> The Commission shall terminate on the date of transmission of its report under section 7.</text></section>
