<legis-type>A BILL</legis-type> 
<official-title>To amend the Public Health Service Act and Employee Retirement Income Security Act of 1974 to require that group and individual health insurance coverage and group health plans provide coverage for annual screening mammography for women 40 years of age or older if the coverage or plans include coverage for diagnostic mammography.</official-title>

<section section-type="section-one" id="H50D8AC1056274232B1A26900BEF8F5E6" display-inline="no-display-inline"><enum>1.</enum><header>Short title; findings</header> 
<subsection id="HD79FA73BF14042DBA18CF299A2423FC"><enum>(a)</enum><header>Short Title</header><text>This Act may be cited as the <quote><short-title>Mammogram Availability Act of 2005</short-title></quote>.</text></subsection> 
<subsection id="H7837E8DA8BA24F208441A1E4ED005673"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H00DF7D77368B452EBC318D94B06978B6"><enum>(1)</enum><text>An estimated 211,000 women will have been diagnosed with breast cancer and an estimated 40,000 women will have died from breast cancer during 2005.</text></paragraph> 
<paragraph id="H2F0DC4825E6942298E50A060186CE8A7"><enum>(2)</enum><text>Breast cancer is the second leading cause of death for women in the United States and is the leading cause of death for women between the ages of 40 and 49 in the United States.</text></paragraph> 
<paragraph id="HF1CC60C1924C49CC00602541F9E6E955"><enum>(3)</enum><text>Breast cancer death rates were reduced by 24 percent from 1990 to 2000.</text></paragraph> 
<paragraph id="H2E6D7503FEEB42AA9B70804C45B20185"><enum>(4)</enum><text>A study sponsored by the National Cancer Institute and published on October 27, 2005, concluded that up to 65 percent of the reduction in the number of breast cancer deaths was directly attributable to screening mammography.</text></paragraph> 
<paragraph id="H36A6F004A56049BCA48F0900422872A"><enum>(5)</enum><text>An expert panel convened by the National Institutes of Health’s National Cancer Institute recommended on February 21, 2002, that women between the ages of 40 and 49 should be screened every one to two years with mammography.</text></paragraph> 
<paragraph id="H54307FF6D14B4880938490B318C59FC8"><enum>(6)</enum><text>The American Cancer Society recommends that women over the age of 40 receive an annual mammogram.</text></paragraph></subsection></section> 
<section id="H334EC2F003E14BF6BC4B7EC005DD2BD0"><enum>2.</enum><header>Coverage of annual screening mammography under group health plans</header> 
<subsection id="H7388FF08B3BF4682BAB1CE62A9BD0005"><enum>(a)</enum><header><act-name parsable-cite="PHSA">Public Health Service Act</act-name> Amendments</header> 
<paragraph id="H100657C330A342A900DBEE1E68C28637"><enum>(1)</enum><text>Subpart 2 of part A of title XXVII of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> is amended by adding at the end the following new section:</text> 
<quoted-block style="OLC" act-name="Public Health Service Act" id="H52D73C6436A94B23BAF42F99FBBA14C0"> 
<section id="HA12E98947FD04A10A2BEE3F6E39F3B2"><enum>2707.</enum><header>Standards relating to benefits for screening mammography</header> 
<subsection id="H1B2CA17BDC914BBA917DB9DF7F97DB00"><enum>(a)</enum><header>Requirements for Coverage of Annual Screening Mammography</header> 
<paragraph id="H216B423C30EE40529834421113006872"><enum>(1)</enum><header>In general</header><text>A group health plan, and a health insurance issuer offering group health insurance coverage, that provides coverage for diagnostic mammography for any woman who is 40 years of age or older shall provide coverage for annual screening mammography for such a woman under terms and conditions that are not less favorable than the terms and conditions for coverage of diagnostic mammography.</text></paragraph> 
<paragraph id="HEDA2B47BA66D411380F0F0396683C609"><enum>(2)</enum><header>Diagnostic and screening mammography defined</header><text>For purposes of this section—</text> 
<subparagraph id="HF9D8575D1C3D4B61ADD3291564A9DCB3"><enum>(A)</enum><text>The term <term>diagnostic mammography</term> means a radiologic procedure that is medically necessary for the purpose of diagnosing breast cancer and includes a physician’s interpretation of the results of the procedure.</text></subparagraph> 
<subparagraph id="H17D5EE0A4D394C18B8EB327DDA55492"><enum>(B)</enum><text>The term <term>screening mammography</term> means a radiologic procedure provided to a woman for the purpose of early detection of breast cancer and includes a physician’s interpretation of the results of the procedure.</text></subparagraph></paragraph></subsection> 
<subsection id="H435415DB75234477B2123E47FD65FC7E"><enum>(b)</enum><header>Protections</header><text>A group health plan, and a health insurance issuer offering group health insurance coverage in connection with a group health plan, may not—</text> 
<paragraph id="HAC8C05E5576B4731B944A4B6B9845F3E"><enum>(1)</enum><text>deny coverage for annual screening mammography on the basis that the coverage is not medically necessary or on the basis that the screening mammography is not pursuant to a referral, consent, or recommendation by any health care provider;</text></paragraph> 
<paragraph id="H0058B0CD114443B09E772100CA7E46EB"><enum>(2)</enum><text>deny to a woman eligibility, or continued eligibility, to enroll or to renew coverage under the terms of the plan, solely for the purpose of avoiding the requirements of this section;</text></paragraph> 
<paragraph id="H19A0EAC91A7F4F46A3ECD1F0C63DC936"><enum>(3)</enum><text>provide monetary payments or rebates to women to encourage such women to accept less than the minimum protections available under this section;</text></paragraph> 
<paragraph id="H88DE9ED5AB2847A882BB24E497EF7C49"><enum>(4)</enum><text>penalize or otherwise reduce or limit the reimbursement of an attending provider because such provider provided care to an individual participant or beneficiary in accordance with this section; or</text></paragraph> 
<paragraph id="HD2914BE0D4584A4ABB30C9F0D7160086"><enum>(5)</enum><text>provide incentives (monetary or otherwise) to an attending provider to induce such provider to provide care to an individual participant or beneficiary in a manner inconsistent with this section.</text></paragraph></subsection> 
<subsection id="H0CF70BF12D3241C5B6D0FE4783A9005F"><enum>(c)</enum><header>Rules of Construction</header> 
<paragraph id="H16F1CC6458CD43D4AFC189221C4769B9"><enum>(1)</enum><text>Nothing in this section shall be construed to require a woman who is a participant or beneficiary to undergo annual screening mammography.</text></paragraph> 
<paragraph id="H7723414C85494200AEC000997C2707F2"><enum>(2)</enum><text>This section shall not apply with respect to any group health plan, or any group health insurance coverage offered by a health insurance issuer, which does not provide benefits for diagnostic mammography.</text></paragraph> 
<paragraph id="HABE168EFB06D4A7A0082A3FCF8B1E77"><enum>(3)</enum><text>Nothing in this section shall be construed as preventing a group health plan or issuer from imposing deductibles, coinsurance, or other cost-sharing in relation to benefits for screening mammography under the plan (or under health insurance coverage offered in connection with a group health plan), except that such coinsurance or other cost-sharing for any portion may not be greater than such coinsurance or cost-sharing that is otherwise applicable with respect to benefits for diagnostic mammography.</text></paragraph> 
<paragraph id="H6FC439AA97BD4A8493AB61C99FCB5803"><enum>(4)</enum><text>Women between the ages of 40 and 49 should (but are not required to) consult with appropriate health care practitioners before undergoing screening mammography, but nothing in this section shall be construed as requiring the approval of a health care practitioner before a woman undergoes an annual screening mammography.</text></paragraph></subsection> 
<subsection id="HD27A89B3E8DC4F6EAE2C55DB4EE4C7E"><enum>(d)</enum><header>Notice</header><text>A group health plan under this part shall comply with the notice requirement under section 714(d) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> with respect to the requirements of this section as if such section applied to such plan.</text></subsection> 
<subsection id="H44BF911FBFAC4BC99E1F94049F88B373"><enum>(e)</enum><header>Level and Type of Reimbursements</header><text>Nothing in this section shall be construed to prevent a group health plan or a health insurance issuer offering group health insurance coverage from negotiating the level and type of reimbursement with a provider for care provided in accordance with this section.</text></subsection> 
<subsection id="H7CDC976C178F4C089B68AAE3A68A62C"><enum>(f)</enum><header>Preemption; Exception for Health Insurance Coverage in Certain States</header> 
<paragraph id="H0C52FF00B96F405F88F2C83FF2737477"><enum>(1)</enum><header>In general</header><text>The requirements of this section shall not apply with respect to health insurance coverage if there is a State law (as defined in section 2723(d)(1)) for a State that regulates such coverage, that requires coverage to be provided for annual screening mammography for women who are 40 years of age or older and that provides at least the protections described in subsection (b).</text></paragraph> 
<paragraph id="HEC91428C64B042EB83CF825B5F161976" commented="no"><enum>(2)</enum><header>Construction</header><text>Section 2723(a)(1) shall not be construed as superseding a State law described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H01843DEFF8934A92B2A1FEF3B3294E0"><enum>(2)</enum><text>Section 2723(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-23">42 U.S.C. 300gg–23(c)</external-xref>) is amended by striking <quote>section 2704</quote> and inserting <quote>sections 2704 and 2707</quote>.</text></paragraph></subsection> 
<subsection id="HB8381084DE9F4CCC82586200D35C005B"><enum>(b)</enum><header>ERISA Amendments</header> 
<paragraph id="H19E757B6B1ED420190A16F2B09A337CA"><enum>(1)</enum><text>Subpart B of part 7 of subtitle B of title I of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> is amended by adding at the end the following new section:</text>

<section id="H9BF8E50269DC409EBA808FAA6FB0713"><enum>714.</enum><header>Standards relating to benefits for screening mammography</header> 
<subsection id="HF53849E63C8D4C33935D55C8A9A45DA6"><enum>(a)</enum><header>Requirements for Coverage of Annual Screening Mammography</header> 
<paragraph id="H8B106334F5944D658E295B43C8FF9788"><enum>(1)</enum><header>In general</header><text>A group health plan, and a health insurance issuer offering group health insurance coverage, that provides coverage for diagnostic mammography for any woman who is 40 years of age or older shall provide coverage for annual screening mammography for such a woman under terms and conditions that are not less favorable than the terms and conditions for coverage of diagnostic mammography.</text></paragraph> 
<paragraph id="HAA5F3C379EE845EBB95EA498266F8D88"><enum>(2)</enum><header>Diagnostic and screening mammography defined</header><text>For purposes of this section—</text> 
<subparagraph id="H3D7E7591E3584982B485E3367243BF13"><enum>(A)</enum><text>The term <term>diagnostic mammography</term> means a radiologic procedure that is medically necessary for the purpose of diagnosing breast cancer and includes a physician’s interpretation of the results of the procedure.</text></subparagraph> 
<subparagraph id="H09CFE654D00140DFA5F43412CE422DD3"><enum>(B)</enum><text>The term <term>screening mammography</term> means a radiologic procedure provided to a woman for the purpose of early detection of breast cancer and includes a physician’s interpretation of the results of the procedure.</text></subparagraph></paragraph></subsection> 
<subsection id="H4462AE484D6D435F96F826083B63B31"><enum>(b)</enum><header>Protections</header><text>A group health plan, and a health insurance issuer offering group health insurance coverage in connection with a group health plan, may not—</text> 
<paragraph id="H3D0E9EFCB36841379DD33A2C1411059"><enum>(1)</enum><text>deny coverage described in subsection (a)(1) on the basis that the coverage is not medically necessary or on the basis that the screening mammography is not pursuant to a referral, consent, or recommendation by any health care provider;</text></paragraph> 
<paragraph id="H658427CA979745BDB1C54CC003FCABB"><enum>(2)</enum><text>deny to a woman eligibility, or continued eligibility, to enroll or to renew coverage under the terms of the plan, solely for the purpose of avoiding the requirements of this section;</text></paragraph> 
<paragraph id="H64BB33EA7CB6494DBABD1E120007B579"><enum>(3)</enum><text>provide monetary payments or rebates to women to encourage such women to accept less than the minimum protections available under this section;</text></paragraph> 
<paragraph id="H6338F80CE8474A73986EA51EA77D3F9B"><enum>(4)</enum><text>penalize or otherwise reduce or limit the reimbursement of an attending provider because such provider provided care to an individual participant or beneficiary in accordance with this section; or</text></paragraph> 
<paragraph id="H8626BCD0718648A398F09E562190418B"><enum>(5)</enum><text>provide incentives (monetary or otherwise) to an attending provider to induce such provider to provide care to an individual participant or beneficiary in a manner inconsistent with this section.</text></paragraph></subsection> 
<subsection id="H28377C47B7C9471A8BA4FE554363E0E6"><enum>(c)</enum><header>Rules of Construction</header> 
<paragraph id="HBF947E1EEAB8419C86D2002B91EF3DBB"><enum>(1)</enum><text>Nothing in this section shall be construed to require a woman who is a participant or beneficiary to undergo annual screening mammography.</text></paragraph> 
<paragraph id="H9758B32D6FFD4B9887D1CC3400D40499"><enum>(2)</enum><text>This section shall not apply with respect to any group health plan, or any group health insurance coverage offered by a health insurance issuer, which does not provide benefits for diagnostic mammography.</text></paragraph> 
<paragraph id="HD4D48BDCA3BE40B8BF70ADBC4F3B1E0"><enum>(3)</enum><text>Nothing in this section shall be construed as preventing a group health plan or issuer from imposing deductibles, coinsurance, or other cost-sharing in relation to benefits for screening mammography under the plan (or under health insurance coverage offered in connection with a group health plan), except that such coinsurance or other cost-sharing for any portion may not be greater than such coinsurance or cost-sharing that is otherwise applicable with respect to benefits for diagnostic mammography.</text></paragraph> 
<paragraph id="HFFC309F93FAB401E908E2278A2A720EA"><enum>(4)</enum><text>Women between the ages of 40 and 49 should (but are not required to) consult with appropriate health care practitioners before undergoing screening mammography, but nothing in this section shall be construed as requiring the approval of a health care practitioner before a woman undergoes an annual screening mammography.</text></paragraph></subsection> 
<subsection id="H6CCF13AE6E8049F8B8104170ECD7B8A8"><enum>(d)</enum><header>Notice under Group Health Plan</header><text>The imposition of the requirements of this section shall be treated as a material modification in the terms of the summary plan described in section 102(a), for purposes of assuring notice of such requirements under the plan; except that the summary description required to be provided under the last sentence of section 104(b)(1) with respect to such modification shall be provided by not later than 60 days after the first day of the first plan year in which such requirements apply.</text></subsection> 
<subsection id="HD56A758F6E0C4F89BDB3E509BD0600C"><enum>(e)</enum><header>Level and Type of Reimbursements</header><text>Nothing in this section shall be construed to prevent a group health plan or a health insurance issuer offering group health insurance coverage from negotiating the level and type of reimbursement with a provider for care provided in accordance with this section.</text></subsection> 
<subsection id="H3F24E818144945C5BDC5E3D1EA6235C2"><enum>(f)</enum><header>Preemption; Exception for Health Insurance Coverage in Certain States</header> 
<paragraph id="H7A2D24D3ADD54940808F714827BBF35F"><enum>(1)</enum><header>In general</header><text>The requirements of this section shall not apply with respect to health insurance coverage if there is a State law (as defined in section 731(d)(1)) for a State that regulates such coverage, that requires coverage to be provided for annual screening mammography for women who are 40 years of age or older, and that provides at least the protections described in subsection (b).</text></paragraph> 
<paragraph id="HA60DEB65DE7240A18E5BF8CEBAF58BAB" commented="no"><enum>(2)</enum><header>Construction</header><text>Section 731(a)(1) shall not be construed as superseding a State law described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE835A6A4C4CE41B48B3B6F88007095B9"><enum>(2)</enum><text>Section 731(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1191">29 U.S.C. 1191(c)</external-xref>) is amended by striking <quote>section 711</quote> and inserting <quote>sections 711 and 714</quote>.</text></paragraph> 
<paragraph id="HC6D8909FAB3E4C4396EA7E012000E5F"><enum>(3)</enum><text>Section 732(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1191a">29 U.S.C. 1191a(a)</external-xref>) is amended by striking <quote>section 711</quote> and inserting <quote>sections 711 and 714</quote>.</text></paragraph> 
<paragraph id="H6346FA364DE14504998EF8C121DC43A3"><enum>(4)</enum><text>The table of contents in section 1 of such Act is amended by inserting after the item relating to section 713 the following new item:</text>

<toc-entry level="section">Sec. 714. Standards relating to benefits for screening mammography</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEB7059D1F97B4C41B95180B5F464727"><enum>(c)</enum><header>Effective Dates</header> 
<paragraph display-inline="yes-display-inline" id="H1F49F7FEBAA648E100AD7B6319A1B35D"><enum>(1)</enum><text>Subject to paragraph (2), the amendments made by this section shall apply with respect to group health plans (and health insurance coverage offered in connection with group health plans) for plan years beginning on or after 1 year after the date of the enactment of this Act.</text></paragraph> 
<paragraph indent="up1" id="H9456E5D9F7D64D69A2E454A3286391B3"><enum>(2)</enum> 
<subparagraph id="HE1B6DA3CF4D94AA2AFF841D144204E53" display-inline="yes-display-inline"><enum>(A)</enum><text>In the case of a group health plan maintained pursuant to 1 or more collective bargaining agreements between employee representatives and 1 or more employers ratified before the date of the enactment of this Act, the amendments made by this section shall not apply to plan years beginning before the later of—</text> 
<clause id="HABEFD998F3E440D583D2CC4544E61829"><enum>(i)</enum><text>the date on which the last collective bargaining agreements relating to the plan terminates (determined without regard to any extension thereof agreed to after the date of the enactment of this Act); or</text></clause> 
<clause id="H78424AEAFE234A1DAEC9AE0461A17AE"><enum>(ii)</enum><text>1 year after the date of the enactment of this Act.</text></clause></subparagraph> 
<subparagraph id="HC98153B0F81C480AB278C9577C6436D" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A)(i), any plan amendment made pursuant to a collective bargaining agreement relating to the plan which amends the plan solely to conform to any requirement added by this section shall not be treated as a termination of such collective bargaining agreement.</text></subparagraph> </paragraph></subsection></section> 
<section id="HD74AE8041290433A91218E6C895DC775"><enum>3.</enum><header>Coverage of annual screening mammography under individual health coverage</header> 
<subsection id="HEA2DB0B95E6847CBA65017F5B028F19E"><enum>(a)</enum><header>In General</header><text>Part B of title XXVII of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> is amended by inserting after section 2752 the following new section:</text>

<section id="H5F8B00B062A14365AC0985CBF1FA2D92"><enum>2753.</enum><header>Standards relating to benefits for screening mammography</header> 
<subsection id="HBF098F2FB0EB4016BC07AB42BDECF29B"><enum>(a)</enum><header>In General</header><text>The provisions of section 2707 (other than subsections (d) and (f)) shall apply to health insurance coverage offered by a health insurance issuer in the individual market in the same manner as it applies to health insurance coverage offered by a health insurance issuer in connection with a group health plan in the small or large group market.</text></subsection> 
<subsection id="H67BB2E74E0AD49BD99544929357CEBB"><enum>(b)</enum><header>Notice</header><text>A health insurance issuer under this part shall comply with the notice requirement under section 714(d) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> with respect to the requirements referred to in subsection (a) as if such section applied to such issuer and such issuer were a group health plan.</text></subsection> 
<subsection id="H1C78FAA691E84AAD8EB99C4A9697C98"><enum>(c)</enum><header>Preemption; Exception for Health Insurance Coverage in Certain States</header> 
<paragraph id="H881A2537840D42ECA37C6000BD2BF431"><enum>(1)</enum><header>In general</header><text>The requirements of this section shall not apply with respect to health insurance coverage if there is a State law (as defined in section 2723(d)(1)) for a State that regulates such coverage, that requires coverage in the individual health insurance market to be provided for annual screening mammography for women who are 40 years of age or older and that provides at least the protections described in section 2707(b) (as applied under subsection (a)).</text></paragraph> 
<paragraph id="H3EBECE610B454E8AB9979B25B9C88799"><enum>(2)</enum><header>Construction</header><text>Section 2762(a) shall not be construed as superseding a State law described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDF055E66F22E41C49837003CBA80200"><enum>(b)</enum><header>Conforming Amendment</header><text>Section 2762(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-63">42 U.S.C. 300gg–63(b)(2)</external-xref>) is amended by striking <quote>section 2751</quote> and inserting <quote>sections 2751 and 2753</quote>.</text></subsection> 
<subsection id="HA48524CE1F8E4867AAC6F3C20314ECE2"><enum>(c)</enum><header>Effective Date</header><text>The amendments made by this section shall apply with respect to health insurance coverage offered, sold, issued, or renewed in the individual market on or after the date that is 1 year after the date of the enactment of this Act.</text></subsection></section>
