<official-title>To amend the Nuclear Waste Policy Act of 1982 to require commercial nuclear utilities to transfer spent nuclear fuel pools into spent nuclear fuel dry casks and convey to the Secretary of Energy title to all spent nuclear fuel thus safely stored. </official-title>

<section id="H433F6459D96F40DCBF63DE004D50EAB8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Spent Nuclear Fuel On-Site Storage Security Act of 2005</short-title></quote>.</text></section> 
<section id="H0F0298ECB19742D7B54D75255713CBC2"><enum>2.</enum><header>Dry cask storage of spent nuclear fuel</header> 
<subsection id="H6A2B9053659B492E88232E52B297E336"><enum>(a)</enum><header>In general</header><text>Title I of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10121">42 U.S.C. 10121 et seq.</external-xref>) is amended by adding at the end the following:</text>

<subtitle id="H0A9D1BF9B0334051B3264269C675FFA9"><enum>I</enum><header>Dry Cask Storage of Spent Nuclear Fuel</header> 
<section id="HAC67B14D818B40E7991B00E2FCA32FC3"><enum>185.</enum><header>Dry cask storage of spent nuclear fuel</header> 
<subsection id="H906CC09D989A4593B0E80AEC85B754"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HFA6C1D305F6E41C387EE05DF43010364"><enum>(1)</enum><header>Contractor</header><text>The term <term>contractor</term> means a person that holds a contract under section 302(a).</text></paragraph> 
<paragraph id="H4857515DA63F4B6AB212615D9D076DD9"><enum>(2)</enum><header>Spent nuclear fuel pool</header><text>The term <term>spent nuclear fuel pool</term> means a water-filled container in which spent nuclear fuel rods are stored.</text></paragraph> 
<paragraph id="H951DBDBA457B430A9008FCB027304237"><enum>(3)</enum><header>Spent nuclear fuel dry cask</header><text>The term <term>spent nuclear fuel dry cask</term> means the container, and all the components and systems associated with the container, in which spent nuclear fuel is stored at a Commission-licensed independent spent fuel storage facility located at the power reactor site. The design of any such spent nuclear fuel dry cask shall be approved by the Commission.</text></paragraph></subsection> 
<subsection id="HC5C15A40A9F6408086795380E5AEE583"><enum>(b)</enum><header>Transfer of spent nuclear fuel</header> 
<paragraph id="H3AA555CB8B704C4EA6826F06567FA04F"><enum>(1)</enum><header>In general</header><text>A contractor shall transfer spent nuclear fuel from spent nuclear fuel pools to spent nuclear fuel dry casks at a Commission-licensed independent spent fuel storage facility located at the power reactor site.</text></paragraph> 
<paragraph id="H0D62E1BEA890488895D3C45963F4B0B"><enum>(2)</enum><header>Spent nuclear fuel stored as of date of enactment</header><text>A contractor shall complete the transfer of all spent nuclear fuel that is stored in spent nuclear fuel pools as of the date of enactment of this subsection not later than 6 years after the date of enactment of this subsection.</text></paragraph> 
<paragraph id="H6EA2BAD28CE84D918601DBCE65423D46"><enum>(3)</enum><header>Spent nuclear fuel stored after date of enactment</header><text>A contractor shall complete the transfer of any spent nuclear fuel that is stored in a spent nuclear fuel pool after the date of enactment of this subsection not later than 6 years after the date on which the spent nuclear fuel is discharged from the reactor.</text></paragraph> 
<paragraph id="H866BEEDC2D5A4B2197001C43DB9578C5"><enum>(4)</enum><header>Inadequate funds</header><text>If funds are not available to complete a transfer under paragraph (2) or (3), the contractor may apply to the Commission to extend the deadline for the transfer to be completed.</text></paragraph></subsection> 
<subsection id="HC3E74F3CF40B4F5AA558443C20B3875C"><enum>(c)</enum><header>Funding</header><text>The Secretary shall make grants to compensate a contractor for expenses incurred in carrying out subsection (b), including costs associated with—</text> 
<paragraph id="H03A40B763C3343B08E7D3F98E6F0000"><enum>(1)</enum><text>licensing and construction of an independent spent fuel storage facility located at the power reactor site;</text></paragraph> 
<paragraph id="H1E049AA67D3140420000BB2551323D3"><enum>(2)</enum><text>construction and delivery of spent nuclear fuel dry casks;</text></paragraph> 
<paragraph id="HE52C8DC634B3499D8C3DE7382C9200E2"><enum>(3)</enum><text>transfers of spent nuclear fuel;</text></paragraph> 
<paragraph id="H320125BACB4F4023A4E95BDF99123FC"><enum>(4)</enum><text>documentation relating to the transfers;</text></paragraph> 
<paragraph id="H1631D54B3C2A4C92A3DEFEC00DE1018"><enum>(5)</enum><text>security; and</text></paragraph> 
<paragraph id="HCFF35AFB70B74B7DA9ABEFE3304984E"><enum>(6)</enum><text>hardening.</text></paragraph></subsection> 
<subsection id="H6EAD4AA4633B4CD483FB9F8B5CCE0415"><enum>(d)</enum><header>Conveyance of title</header> 
<paragraph id="H5005C748F40E429BBC3528C0E6628900"><enum>(1)</enum><header>Determination</header><text>Not later than 30 days after the transfer of spent nuclear fuel from a spent nuclear fuel pool to a spent nuclear fuel dry cask, the Commission shall determine whether the contractor carried out the transfer in full compliance with regulations promulgated by the Commission.</text></paragraph> 
<paragraph id="H9D4AA390E099487790232C266C596F8C"><enum>(2)</enum><header>Noncompliance</header><text>If the Commission determines that any technical standard or compliance provision under the regulations was not complied with, the Commission shall—</text> 
<subparagraph id="H5D9ACC91CC894550AF7C269F19EF878C"><enum>(A)</enum><text>notify the contractor; and</text></subparagraph> 
<subparagraph id="HDDB08F99CBE74149A1E1E34CFB5E136"><enum>(B)</enum><text>take such actions as are necessary to obtain full compliance.</text></subparagraph></paragraph> 
<paragraph id="HFA0DA8ABB0814F2BB8F6C7AED9B105FF"><enum>(3)</enum><header>Certification and conveyance of title</header><text>When the Commission determines that the contractor has fully complied with the regulations—</text> 
<subparagraph id="H724247C0AFDC4F1A92001FD68B828DCF"><enum>(A)</enum><text>the Commission shall certify that safe transfer has been accomplished; and</text></subparagraph> 
<subparagraph id="H47938934F5DF4C73BB54F004B9348644"><enum>(B)</enum><text>the Secretary shall accept the conveyance of title to the spent nuclear fuel dry cask (including the contents of the cask) from the contractor.</text></subparagraph></paragraph> 
<paragraph id="H6766B5697D7348ED898E01A03517A113"><enum>(4)</enum><header>Responsibility</header><text>A conveyance of title under paragraph (3)(B) shall confer on the Secretary full responsibility (including financial responsibility) for the possession, stewardship, maintenance, and monitoring of all spent nuclear fuel transferred to the Secretary.</text></paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFF44281F1979427D96C6CE525E8F5D06"><enum>(b)</enum><header>Funding</header><text>Section 302(d) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(d)</external-xref>) is amended—</text> 
<paragraph id="H9ACD73B24DA34FE999560200B5C28C54"><enum>(1)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HACE247D9928D40C999DFC7000027C7E"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HD4B6A700F973486F9620D431B7B3E7BE"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="H7AFF1A141BDB4B70B1B8C3FA84FF97"><enum>(7)</enum><text>the provision of grants under section 185(d).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HA5C0C7D03081457FA062EC671F8600F9"><enum>3.</enum><header>Immediate conveyance of title to spent nuclear fuel previously certified to be in compliance</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary of Energy shall accept the conveyance of title to all spent nuclear fuel with respect to which, before the date of enactment of this Act, the Nuclear Regulatory Commission has certified that a contractor under section 302 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222</external-xref>) has completed transfer to spent nuclear fuel dry casks in compliance with applicable regulations in effect as of the date of transfer.</text> </section>
