<official-title>To amend title 38, United States Code, to provide housing loan benefits for the purchase of residential cooperative apartment units. </official-title>

<section id="HC34A28D830764AFDACD7F427C590DB70" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Housing Fairness Act of 2005</short-title></quote>.</text></section> 
<section id="HF6038331ADA64A4D94B51F41E66626EA"><enum>2.</enum><header>Residential cooperative housing units</header> 
<subsection id="H7BCD8D82FE3245599052DF9BA3D6DE4C"><enum>(a)</enum><header>Housing benefits for cooperative apartment units</header> <text><external-xref legal-doc="usc" parsable-cite="usc/38/3710">Section 3710(a)</external-xref> of title 38, United States Code, is amended by inserting after paragraph (11) the following new paragraph:</text> 
<quoted-block style="OLC" id="HC9972E068E8241BC982B357C1B25ACE2" display-inline="no-display-inline"> 
<paragraph id="HFDE3500E1F7B4F12902EE86810AC0059"><enum>(12)</enum><text>To purchase stock or membership in a development, project or structure of a cooperative housing corporation in accordance with subsection (h).</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H41B5A211726344A09680599B772F05AF"><enum>(b)</enum><header>Conditions of housing benefits for cooperative apartment units</header><text>Section 3710 of such title is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HD7D01D4E78D14ED882C25CB4ACB91E2E" display-inline="no-display-inline"> 
<subsection id="HC844C76241C3444FA48E6D96F500CADE"><enum>(h)(1)</enum><text>A loan may not be guaranteed under subsection (a)(12) unless the following conditions are met:</text> 
<paragraph id="H77892028DD9444B685A574D951328976"><enum>(A)</enum><text>The development, project or structure of the cooperative housing corporation complies with such criteria as the Secretary prescribes in regulations.</text></paragraph> 
<paragraph id="HD9D655A381494A95B10094FC16CC1B2B"><enum>(B)</enum><text>The dwelling unit, that the purchase of stock or membership in the development, project or structure of the cooperative housing corporation entitles the purchaser to occupy, is a one-family residential unit.</text></paragraph></subsection> 
<subsection id="HACBA96BB929E446EA9AFA2B806374F32"><enum>(2)</enum><text>For the purposes of this subsection, the term <quote>cooperative housing corporation</quote> has the same meaning given such term by <external-xref legal-doc="usc" parsable-cite="usc/26/216">section 216(b)(1)</external-xref> of the Internal Revenue Code of 1986.</text></subsection> 
<subsection id="H54E4958B5F94435799CAE8101F18FABB"><enum>(3)</enum><text>For the purposes of applying the term <quote>value of the property</quote> to a loan guaranteed under subsection (a)(12), such term means the appraised value of the stock or membership entitling the purchaser to the permanent occupancy of the dwelling unit in the development, project or structure of the cooperative housing corporation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
