<official-title>To amend title 5, United States Code, to deny Federal retirement benefits to Government officials convicted of certain crimes; to amend title 18, United States Code, to increase the penalties for certain corruption-related offenses; and for other purposes.</official-title>

<section id="H566D7BA5BD5F46A18E49198ED5001F61" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congressional Anti-Corruption Act of 2005</short-title></quote>. </text></section> 
<section id="H86C41AB0D52543F788B5C8504B005C00" section-type="subsequent-section"><enum>2.</enum><header>Forfeiture of retirement benefits</header> 
<subsection id="H870B5F2409DF45EDABAAF08795CABB55"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8312">Section 8312(a)</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H97BF94004FC4430ABCD0BD7F57901A4"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of paragraph (1), by striking the period at the end of paragraph (2) and inserting <quote>; or</quote>, and by inserting after paragraph (2) the following:</text> 
<quoted-block style="USC" id="H3235484AA48B4DDC8951515896D5D7C6" display-inline="no-display-inline"> 
<paragraph id="HB3222343D9254A89A6936DB2983FB3EC"><enum>(3) </enum><text>is convicted of an offense described in subsection (d).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H957152758F804F4FAECD65CCC62C86AD"><enum>(2)</enum><text>by striking <quote>and</quote> at the end of subparagraph (A), by striking the period at the end of subparagraph (B) and inserting <quote>; and</quote>, and by inserting after subparagraph (B) the following: </text>

<subparagraph id="H053F72E43537464A95FCC9C035CD03FC" indent="up1"><enum>(C)</enum><text>with respect to the offenses described in subsection (d), to the period after the date of conviction.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD40787AEBB814CCB9E3676E6B5A87FE2"><enum>(b)</enum><header>Offenses described</header><text>Section 8312 of such title 5 is amended by redesignating subsection (d) as subsection (e), and by inserting after subsection (c) the following:</text>

<subsection id="HEA01704399F74EF783106EB9638DC9C"><enum>(d)</enum> 
<paragraph id="H53C8D540DE8A460EA44C11F96F60C6DC" display-inline="yes-display-inline"><enum>(1)</enum><text>An offense described in this subsection is any offense which—</text> 
<subparagraph id="H93B55D85DD424E34A390CF6730423FAD" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">is within the purview of section 201(b), 216, 286, 641, 1341, 1343, 1951(a), 1952(a), or 1963 of title 18; and</text></subparagraph> 
<subparagraph id="HB1779AB10C8A449EB9854C4CB96003C1" indent="up1"><enum>(B)</enum><text>is committed by the individual (as referred to in subsection (a))—</text> 
<clause id="H403D5AFD910E460F88A0DA90B076BB02"><enum>(i)</enum><text>on or after the date of the enactment of this subsection; and</text></clause> 
<clause id="HFD6F8197C5784138BBD7CE8C586400BB"><enum>(ii)</enum><text>while a covered official.</text></clause></subparagraph> </paragraph> 
<paragraph id="H26FEF26D38964CE7A9B6722800756BC8" indent="up1"><enum>(2)</enum><text>For purposes of this subsection, the term <term>covered official</term> means the President, a Member of Congress (as defined by section 2106, including the Vice President, a Delegate to the House of Representatives, and the Resident Commissioner from Puerto Rico), and the head of an Executive department (as defined by section 101).</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H44BEC5A021BE4AA998D4F3099A82C1E" commented="no"><enum>(c)</enum><header>Definition of annuity</header><text>Section 8311(2) of such title 5 is amended (in the matter before subparagraph (A)) by striking <quote>benefit, but does not include</quote> and inserting <quote>benefit, and (to the extent that a conviction described in section 8312(a)(3) is involved) any monetary allowance payable to a former President or the widow of a former President under the Act of August 25, 1958 (<external-xref legal-doc="usc" parsable-cite="usc/3/102">3 U.S.C. 102</external-xref> note), but does not include</quote>. </text></subsection> 
<subsection id="H0F1A8B32DB284B589513A875ECAC00DD"><enum>(d)</enum><header>Absence from United States to avoid prosecution</header><text>Section 8313(a)(1) of such title 5 is amended by striking <quote>or</quote> at the end of subparagraph (A), by striking <quote>and</quote> at the end of subparagraph (B) and inserting <quote>or</quote>, and by adding at the end the following:</text>

<subparagraph id="H90C5DF3416DE465DB16335027489BD42"><enum>(C)</enum><text>after the date of the enactment of subsection (d) of section 8312, for an offense described in such subsection; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4B789284DDFD480294B39DC254BF7016"><enum>(e)</enum><header>Nonaccrual of interest on refunds</header><text>Section 8316(b) of such title 5 is amended by striking <quote>or</quote> at the end of paragraph (1), by striking the period at the end of paragraph (2) and inserting <quote>; or</quote>, and by adding at the end the following: </text>

<paragraph id="H83E4F7933E38415EA140A6B1955573D2"><enum>(3)</enum><text>if the individual was convicted of an offense described in section 8312(d), for the period after the conviction.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HA3E0A58AA36B45C3A024B545FBF0488" section-type="subsequent-section" display-inline="no-display-inline"><enum>3.</enum><header>Increased penalties for certain corruption-related offenses</header><text display-inline="no-display-inline">Title 18, United States Code, is amended—</text> 
<paragraph id="H5137B3A079804A8BB5750082B5EEDE00"><enum>(1)</enum><text>in section 201(b), by striking <quote>fifteen years</quote> and inserting <quote>30 years</quote>;</text></paragraph> 
<paragraph id="HCBFAAD6E5EAE48FEA036758175282B62"><enum>(2)</enum><text>in section 216—</text> 
<subparagraph id="HB23BFFF5CE81419F82C4291D40CD24B8"><enum>(A)</enum><text>in subsection (a)(1), by striking <quote>one year</quote> and inserting <quote>two years</quote>; and</text></subparagraph> 
<subparagraph id="H82417DC7FCF54132871CE497DFFA8BC5"><enum>(B)</enum><text>in subsection (a)(2), by striking <quote>five years</quote> and inserting <quote>10 years</quote>;</text></subparagraph></paragraph> 
<paragraph id="HC54E4CE8DCF643928FB1C3FA63C1EFC7"><enum>(3)</enum><text>in section 286, by striking <quote>ten years</quote> and inserting <quote>20 years</quote>;</text></paragraph> 
<paragraph id="HFE36AB86F5A146F2A8231C14E5670057"><enum>(4)</enum><text>in section 641—</text> 
<subparagraph id="H61E7B709E2D44160AD95395F9800EFC4"><enum>(A)</enum><text>by striking <quote>ten years</quote> and inserting <quote>20 years</quote>; and</text></subparagraph> 
<subparagraph id="HD38463D3CB274F5AA892E800702F8D09"><enum>(B)</enum><text>by striking <quote>one year</quote> and inserting <quote>two years</quote>;</text></subparagraph></paragraph>

<section id="HD22760A1F33C4C8089C15DB7CF00684E"><enum>4.</enum><header>Disqualification to act as lobbyist</header> 
<subsection id="HD0F536A5378E446D8F26A9E7603E49F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A person convicted of any offense under a provision of law listed in subsection (b) is disqualified for life from acting as a lobbyist (as defined in the Lobbying Disclosure Act of 1995).</text></subsection> 
<subsection id="HBE1FA855D6994A89AC88A76E216B85CF"><enum>(b)</enum><header>Disqualifying offenses</header><text>The offenses referred to under subsection (a) are any violations of any of the following sections of title 18, United States Code: 201(b), 216, 286, 641, 1341, 1343, 1951(a), 1952(a), and 1963.</text></subsection> </section>
