<official-title>To amend the Internal Revenue Code of 1986 to make inapplicable the 10 percent additional tax on early distributions from certain pension plans of public safety employees.</official-title>

<section section-type="section-one" id="H57162B54A70B4114BB8B4B06004C55A9" display-inline="no-display-inline"><enum>1.</enum><header>Waiver of 10 percent early withdrawal penalty tax on certain distributions of pension plans for public safety employees</header>
<subsection id="H193D6D002E5C426E8B5C5937D593D516"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (t) of <external-xref legal-doc="usc" parsable-cite="usc/26/72">section 72</external-xref> of the Internal Revenue Code of 1986 (relating to 10-percent additional tax on early distributions from qualified retirement plans) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HEB4599D788F24480AE346000E1C96565"><enum>(10)</enum><header>Distributions to qualified public safety employees in governmental plans</header>
<subparagraph id="H996FB0290F0F47C10091EB5F7900DFFB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a distribution to a qualified public safety employee from a governmental plan (within the meaning of section 414(d)) which is a defined benefit plan, paragraph (2)(A)(v) shall be applied by substituting <quote>age 50</quote> for <quote>age 55</quote>.</text></subparagraph>
<subparagraph id="HBC77511FDFA44EFC00743BB4469335F7"><enum>(B)</enum><header>Qualified public safety employee</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <term>qualified public safety employee</term> means any employee of a State or political subdivision of a State who provides police protection, firefighting services, or emergency medical services for any area within the jurisdiction of such State or political subdivision.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H02DB2EB4ACE6451E90CD682BC229B911"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply to distributions after the date of the enactment of this Act.</text></subsection></section>
