<legis-type>A BILL</legis-type> 
<official-title>To amend the Internal Revenue Code of 1986 to extend the financing for Superfund for purposes of cleanup activities with respect to Hurricanes Katrina and Rita, and for other purposes.</official-title>

<section id="HC2031B109E084B0BA33E67CE92B01B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Superfund for Hurricane Accountability and Recovery Act of 2005</short-title></quote>.</text></section> 
<section id="H73044363A57A45B0B42578AB634DD031"><enum>2.</enum><header>Findings</header> <text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="HAE495208A5E24E6A9074609791B0CF6C"><enum>(1)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 established a Federal Superfund trust fund for the purpose of hazardous substance remediation at sites across the Nation;</text></paragraph> 
<paragraph id="HE7F473760FD8484EA91176D279415750"><enum>(2)</enum><text>the release of hazardous substances threatens and impairs public health, community infrastructure, the economy, and social well being;</text></paragraph> 
<paragraph id="HAB07750A078547D6AEC7988DB9399ED1"><enum>(3)</enum><text>the Environmental Protection Agency has evaluated more than 45,900 sites and placed 1,540 Superfund sites on the National Priorities List;</text></paragraph> 
<paragraph id="H287F181278B44899924F4F14ED6176F5"><enum>(4)</enum><text>more than 70,000,000 Americans live within 4 miles of a Superfund site;</text></paragraph> 
<paragraph id="H392156E1A51D4B349C33D69D160206B3"><enum>(5)</enum><text>the expiration of the crude oil, chemical feedstock, and corporate taxes in 1995 has contributed to a funding shortfall that prevented numerous Superfund sites from receiving new construction funding in fiscal years 2004 and 2005 and slowed the pace of existing cleanups; </text></paragraph> 
<paragraph id="H17523DF79D274E0A907CF802E6840024"><enum>(6)</enum><text>delayed and slowed Superfund cleanup actions magnify public health risks and increase total remediation costs; </text></paragraph> 
<paragraph id="H53E669B18BC740C0B91D7CE5106E2B37"><enum>(7)</enum><text>the reestablishment of the Superfund tax would have no effect on the liability under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 of responsible parties or potentially responsible parties for hazardous substance releases;</text></paragraph> 
<paragraph id="H037F77A992804886BCE9AECD96D0E746"><enum>(8)</enum><text>Hurricanes Katrina and Rita caused unprecedented environmental damage in the Gulf Coast States of Alabama, Louisiana, Mississippi, and Texas;</text></paragraph> 
<paragraph id="HD66815192B25481DBCF90083DDD70242"><enum>(9)</enum><text>Hurricanes Katrina and Rita caused significant new releases of hazardous substances and also damaged, threatened, or otherwise impaired the integrity of 54 sites listed on the National Priorities List and other facilities producing, manufacturing, storing, or releasing hazardous substances;</text></paragraph> 
<paragraph id="H252EDE60C803433EAC66ABDEAE08BE7D"><enum>(10)</enum><text>released hazardous substances must be removed, remediated, and otherwise cleaned up to mitigate environmental damage and to protect public health;</text></paragraph> 
<paragraph id="H717CB6AFE8374B01B3005B81961788EF"><enum>(11)</enum><text>the current and future removal, remediation, and cleanup efforts in Hurricane-affected areas will incur significant costs; and</text></paragraph> 
<paragraph id="H27EB6EA932444AA9960014484EB98C48"><enum>(12)</enum><text>the costs incurred to remove, remediate, and otherwise clean up hazardous substances, in the Hurricane-impacted areas of the Gulf Coast and nationwide, are most equitably borne by the parties responsible for the manufacture, production, use, storage, and release of such substances.</text> </paragraph></section> 
<section id="HE5E2437AA5434B1F8936A0FAF87C1782"><enum>3.</enum><header>Superfund taxes</header> 
<subsection id="H9CA3E76795E542BE9D174BD1AF16DEFA"><enum>(a)</enum><header>Permanent extension</header> 
<paragraph id="H437885C8C18E46BA8EB55D5F31D3F"><enum>(1)</enum><header>Excise taxes</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/4611">Section 4611(e)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text>

<subsection id="H7C19287DB5BF409CBF1C69FE484F66F9"><enum>(e)</enum><header>Application of hazardous substance Superfund financing rate</header><text>The Hazardous Substance Superfund financing rate under this section shall apply after December 31, 1986, and before January 1, 1996, and after the date of the enactment of this subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7CB716F097034F67BB9E2615DC6C7DC"><enum>(2)</enum><header>Corporate environmental income tax</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/59A">Section 59A(e)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text>

<subsection id="HCF1E7FAF0D94493A836562E3EED83E00"><enum>(e)</enum><header>Application of tax</header><text>The tax imposed by this section shall apply to taxable years beginning after December 31, 1986, and before January 1, 1996, and to taxable years beginning after the date of the enactment of this subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H0D850C6005554D339D37A6D9B6E3B3C0"><enum>(3)</enum><header>Technical amendments</header> 
<subparagraph id="H35DD375486A1485B8C1E27890056D2C"><enum>(A)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/4611">Section 4611(b)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> 
<clause id="HA0610BB568244D55B22FA79215A9F8E7"><enum>(i)</enum><text>by striking <quote>or exported from</quote> in paragraph (1)(A),</text></clause> 
<clause id="H93A29DDEE14441D2826265C500327617"><enum>(ii)</enum><text>by striking <quote>or exportation</quote> in paragraph (1)(B), and</text></clause> 
<clause id="H62628FA5535E47FAA2217DFB2FC8B796"><enum>(iii)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">and exportation</header-in-text></quote> in the heading.</text></clause></subparagraph> 
<subparagraph id="HCAE2E1EAA0EA4BF98D961F0700DA83E3"><enum>(B)</enum><text>Section 4611(d)(3) of such Code is amended—</text> 
<clause id="H6063FC5B4B1341D4AB5868F52F5C5849"><enum>(i)</enum><text>by striking <quote>or exporting the crude oil, as the case may be</quote> in the text and inserting <quote>the crude oil</quote>, and</text></clause> 
<clause id="HEC6EDA0DBCD14144BEE213FE784FCEF3"><enum>(ii)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">or exports</header-in-text></quote> in the heading.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H35310B245D2C4B3FA45EDA353F71E632"><enum>(b)</enum><header>Temporary tax increase for cleanup required by reason of Hurricanes Katrina and Rita</header> 
<paragraph id="H4B4B3420D4514A4891ADC882277795B6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (c) of section 4611 of such Code is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HD6F896ADBBBB4594AA8B76C7F0A95BAC" display-inline="no-display-inline"> 
<paragraph id="H47C00714C81F420A9127F013BD153953"><enum>(3)</enum><header>Temporary rate increase to fund Hurricanes Katrina and Rita toxic waste cleanup</header><text>During the period beginning on January 1, 2006, and ending on December 31, 2008, the rate of tax specified by subparagraph (A) of paragraph (2) shall be increased by the amount equal to 50 percent of such rate.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H1EDE470F205B4639B8213BC8D7C8F9F7"><enum>(2)</enum><header>Certain chemicals and imported substances</header><text>Section 4661 of such Code (relating to imposition of tax on certain chemicals) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H976B7B7F2E4B49679BDED44C186C31D6" display-inline="no-display-inline"> 
<subsection id="H242669FFECBC47D4ACD6070228FFEE3"><enum>(c)</enum><header>Temporary increase to fund Hurricanes Katrina and Rita toxic waste cleanup</header><text display-inline="yes-display-inline">During the period beginning on January 1, 2006, and ending on December 31, 2008, each amount of tax per ton with respect to a substance specified in subsection (b) shall be increased by an amount equal to 50 percent of such amount.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4874D6E5FCFF4112B47B4846C7B75EC4"><enum>(3)</enum><header>Temporary increase in corporate environmental income tax to fund Hurricanes Katrina and Rita toxic waste cleanup</header><text>Subsection (a) of section 59A of such Code (relating to imposition of tax) is amended by adding at the end the following flush sentence: <quote>In the case of taxable years beginning on or after January 1, 2006, and ending on or before December 31, 2008, the preceding sentence shall be applied by substituting <quote>0.18 percent</quote> for <quote>0.12 percent</quote>.</quote>.</text> </paragraph> 
<paragraph id="H4C488BBD071749A487CC3245FA712922"><enum>(4)</enum><header>Separate accounting for cleanup funds</header><text display-inline="yes-display-inline">Section 9507 of such Code (relating to Hazardous Substance Superfund) is amended by adding at the end the following new subsection:</text>

<subsection id="HDA49A3B816F64F8D86B000E654DDEEDC"><enum>(f)</enum><header>Establishment of Gulf Hurricanes cleanup account</header> 
<paragraph id="H0D4552C32DED479A85F6D594C5FBEF11"><enum>(1)</enum><header>Creation of account</header><text display-inline="yes-display-inline">There is established in the Hazardous Substance Superfund a separate account to be known as the <quote>Gulf Hurricanes Cleanup Account</quote> consisting of such amounts as may be transferred or credited to the Gulf Hurricanes Cleanup Account as provided in this subsection or section 9602(b).</text></paragraph> 
<paragraph id="H25F48AF52459456DBB42271DD99F558B"><enum>(2)</enum><header>Transfers to account</header><text display-inline="yes-display-inline">The Secretary shall transfer to the Gulf Hurricanes Cleanup Account from the amounts appropriated to Superfund under subsection (b) amounts equal to—</text> 
<subparagraph id="HA7BEB27DA1604DB6806B6EE92F24B9A3"><enum>(A)</enum><text>the increase in the tax imposed under section 59A by reason of the last sentence of subsection (a) thereof,</text></subparagraph> 
<subparagraph id="HEC0AFB1403314784BC26B218C60029B7"><enum>(B)</enum><text display-inline="yes-display-inline">the increase in the tax imposed under section 4611(c) by reason of paragraph (3) thereof,</text></subparagraph> 
<subparagraph id="HB02E7ECD736744248305C4EA9DEA6C46"><enum>(C)</enum><text display-inline="yes-display-inline">the increase in the tax imposed under section 4661 by reason of subsection (c) thereof, and</text></subparagraph> 
<subparagraph id="H709C7644DD5D4AC1BBA5F7B3013C5869"><enum>(D)</enum><text display-inline="yes-display-inline">the increase in the tax imposed under section 4671 by reason of the increase in tax under section 4661(c).</text></subparagraph></paragraph> 
<paragraph id="H4EB7AFAE6F564D0AAA578B50D5B72F28"><enum>(3)</enum><header>Expenditures from account</header><text display-inline="yes-display-inline">Amounts in the Gulf Hurricanes Cleanup Account shall be available, as provided by appropriation Acts, for making expenditures in accordance with section 4 of the <short-title>Superfund for Hurricane Accountability and Recovery Act of 2005</short-title>.</text></paragraph> 
<paragraph id="H3C22E66051E847D1B2268321635013A5"><enum>(4)</enum><header>Reversion of unexpended funds</header><text display-inline="yes-display-inline">Amounts remaining in the Gulf Hurricanes Cleanup Account shall revert to the Hazardous Substance Superfund on the date which is the later of—</text> 
<subparagraph id="H77852F6F236248228B0487AA87238B3B"><enum>(A)</enum><text>December 31, 2009, or</text></subparagraph> 
<subparagraph id="HFBACBB0F91D04E9F915EED71CE81DA04"><enum>(B)</enum><text display-inline="yes-display-inline">the date as of which the Administrator of the Environmental Protection Agency makes the determination under section 4 of such Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> 
<subsection id="H3723B178BF9142AA89FFAB8F812F7265"><enum>(c)</enum><header>Effective dates</header> 
<paragraph id="H490E98F9DA084D37921591B053003F36"><enum>(1)</enum><header>Excise taxes</header><text>The amendments made by subsections (a) (other than paragraph (2) thereof) and (b) (other than paragraph (3) thereof shall take effect on the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H3102A3526C3E41768D49BCCA8E9E3DB"><enum>(2)</enum><header>Income tax</header><text>The amendments made by subsections (a)(2) and (b)(3) shall apply to taxable years beginning after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H963C4DD79FE24825BBDFF361186B85DB"><enum>4.</enum><header>Expenditures from trust fund</header><text display-inline="no-display-inline">Amounts in the Gulf Hurricanes Cleanup Account established under subsection (f) of <external-xref legal-doc="usc" parsable-cite="usc/26/9507">section 9507</external-xref> of the Internal Revenue Code of 1986 shall be used only for making expenditures in accordance with subsection (c) of such section with respect to sites where hazardous substance releases or threatened releases have been caused or exacerbated by Hurricane Katrina or Hurricane Rita until such time as the Administrator of the Environmental Protection Agency determines by rule that no response actions are necessary to protect human health and the environment with respect to such sites. Before initiating a rulemaking under this section, the Administrator shall notify the Congress of the intention to initiate the rulemaking.</text></section> 
<section id="H9DA78D7CB32F4F2DB78B85211181B711"><enum>5.</enum><header>Cleanup reports</header> 
<subsection id="HA6860817671C4A47A063BDEAE28EFCF"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator of the Environmental Protection Agency shall transmit to Congress a report on the progress of cleanup activities with respect to Hurricanes Katrina and Rita.</text></subsection> 
<subsection id="H09D1E7CEF1374225BBC6CD90A1D7CC4"><enum>(b)</enum><header>Contents of report</header><text display-inline="yes-display-inline">Each report required by subsection (a) shall specify the following:</text> 
<paragraph id="H2BD2CB928636430ABBAFC1DF48852DBC"><enum>(1)</enum><text>The number of full-time equivalent personnel of the Environmental Protection Agency allocated to such cleanup activities.</text></paragraph> 
<paragraph id="HA7A1AFF5315C4C248B7E18E16493CD9C"><enum>(2)</enum><text>The persons to whom major contracts are awarded for such cleanup activities and the amount of such contracts.</text></paragraph> 
<paragraph id="H0C263A09477F4FDC979B86223C577900"><enum>(3)</enum><text display-inline="yes-display-inline">The number and location of contaminated sites that have been identified.</text></paragraph> 
<paragraph id="HAEA31A5925DF406B9DA2A91511697100"><enum>(4)</enum><text>The number of sites with the following stages of the cleanup process complete: site identification and investigation, remedial investigation/feasibility study, remedial selection, remedial design, and remedial construction.</text></paragraph> 
<paragraph id="H667D8E61D1BF43F7B8F5B2E0503EB721"><enum>(5)</enum><text>For each identified site referred to in paragraph (3)—</text> 
<subparagraph id="HBAA8811D9979462DAD3ED4A223E9E1D1"><enum>(A)</enum><text>the type of contaminants discovered;</text></subparagraph> 
<subparagraph id="H33A27373ECD24AD09FED6D55DBEB8D"><enum>(B)</enum><text>the extent of contamination in soil, surface water, and groundwater;</text></subparagraph> 
<subparagraph id="H5A666EBA73204A730082BE3F6765F164"><enum>(C)</enum><text>the number of emergency removals conducted;</text></subparagraph> 
<subparagraph id="H004D34632CE14B039608BC233B01D335"><enum>(D)</enum><text>the number of long-term remedial actions implemented or planned;</text></subparagraph> 
<subparagraph id="H513765A6B0ED42649BA080204D7C56C1"><enum>(E)</enum><text>the annual expenditure of funds for all necessary response actions;</text></subparagraph> 
<subparagraph id="H4A6E35E3C621448B9E083F13E1C24DD3"><enum>(F)</enum><text>the estimated costs of completing all necessary response actions; and</text></subparagraph> 
<subparagraph id="HC3EBD439E43F4D70B015DCB0FF3256F"><enum>(G)</enum><text>the estimated date of completion of all necessary response actions.</text></subparagraph></paragraph></subsection></section>
