<official-title>To amend the Elementary and Secondary Education Act of 1965 to extend the deadline by which State educational agencies and local educational agencies are required to ensure that an educator is highly qualified in order to account for the educator’s applicable period of military service.</official-title>

<section id="H5E3496E1C28A49B0B20600F063CD772D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Educators in Military Service Act of 2005</short-title></quote>.</text></section> 
<section id="HEF0A19DF8603474492C7FDA37264023F"><enum>2.</enum><header>Teachers who served in the Armed Forces</header> 
<subsection id="HC1BBA9236E8E4DC6B995A09C3417B2D9"><enum>(a)</enum><header>Teachers generally</header><text display-inline="yes-display-inline">Subsection (a) of section 1119 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6319">20 U.S.C. 6319</external-xref>) is amended—</text> 
<paragraph id="H90F8BC4704A04386BE84FE03A4D9FE7F"><enum>(1)</enum><text>in paragraph (2)—</text> 
<subparagraph id="HBCB62768B3D24A04850874C8CF89E2C0"><enum>(A)</enum><text>in the matter before subparagraph (A), by inserting <quote>subject to paragraph (4),</quote> after <quote>plan described in section 1111,</quote>;</text></subparagraph> 
<subparagraph id="H734CDCF1CDD343FAA2FBECA469F2AFA0"><enum>(B)</enum><text>in subparagraph (A), by inserting <quote>subject to paragraph (4),</quote> before <quote>shall include</quote>;</text></subparagraph></paragraph> 
<paragraph id="H314B31392A264B218D00FD3B32E939C6"><enum>(2)</enum><text>in paragraph (3), by striking <quote>As part of the plan</quote> and inserting <quote>Subject to paragraph (4), as part of the plan</quote>; and</text></paragraph> 
<paragraph id="H830AF1B38D0C4882B9DEB1C700F1FB96"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="HB1AAAD647CC5408AAA08D8006E7421C6"><enum>(4)</enum><header>Teachers serving in the military</header> 
<subparagraph id="H64653F3758F64D4B8F804B18C2F21C8F"><enum>(A)</enum><header>Extension</header><text display-inline="yes-display-inline">The date by which a State educational agency is required under paragraph (2) to ensure that all teachers teaching in core academic subjects within the State are highly qualified (the end of the 2005–2006 school year), and the date by which a local educational agency is required under paragraph (3) to ensure that all teachers teaching within the school district served by the agency are highly qualified (the end of the 2005–2006 school year), shall be extended to the date determined under subparagraph (C) with respect to eligible teachers described in subparagraph (B).</text></subparagraph> 
<subparagraph id="H12682EA8B6CF45D38B0061BE4585B210"><enum>(B)</enum><header>Eligible teacher</header><text>For purposes of this paragraph, the term <term>eligible teacher</term> means an individual who—</text> 
<clause id="HDD78D07AEA9948FD836E29008FD171B0"><enum>(i)</enum><text>is or has been a public elementary school or secondary school teacher and is not described in subsection (a)(1); and</text></clause> 
<clause id="HE93EE4FA3A3042C6B7C04995A5007280"><enum>(ii)</enum><text>is on active duty as a member of the Armed Forces, or is on full-time duty as a member of the National Guard of a State under an order to State active duty under title 32, United States Code, or under State law, on or after January 8, 2002.</text></clause></subparagraph> 
<subparagraph id="H29E44A128229489399446DF03F19E21C"><enum>(C)</enum><header>Determination of date</header><text>The date determined under this subparagraph is the later of the following:</text> 
<clause id="H739F3F95A414492F9CB1710816C3E94"><enum>(i)</enum><text>The first day of the first school year beginning on or after the date determined by extending the deadline described in subparagraph (A) for a period equal to the number of days in the teacher’s applicable period of military service.</text></clause> 
<clause id="HC1C74505F7554E35B588B70032950690"><enum>(ii)</enum><text>If the teacher was enrolled in coursework or professional development that would have contributed toward the teacher becoming highly qualified and the teacher’s applicable period of military service interrupted such coursework or professional development, the last day of the next session of equivalent coursework or professional development that begins on or after the date determined by extending the deadline described in subparagraph (A) for a period equal to the number of days in the teacher’s applicable period of military service. </text> </clause></subparagraph> 
<subparagraph id="HDC3DE12248914B84B1AC756802B388E5"><enum>(D)</enum><header>Applicable period of military service</header><text>For purposes of this paragraph, the term <term>applicable period of military service</term> means, with respect to an eligible teacher, the period (or sum of periods) that interrupts the teacher’s employment as a public elementary school or secondary school teacher and during which the teacher is on active duty as a member of the Armed Forces or is on full-time duty as a member of the National Guard of a State under an order to State active duty under title 32, United States Code, or under State law—</text> 
<clause id="HE2EF0F51764B477785CC180041EC3E6D"><enum>(i)</enum><text>beginning on the later of—</text> 
<subclause id="HCA18D48577E140C491A271D35CFE4487"><enum>(I)</enum><text>January 8, 2002; or</text></subclause> 
<subclause id="H46DA2B26C8164EFA8526368653903C6F"><enum>(II)</enum><text>the date on which the teacher begins such period of active duty or full-time duty; and</text></subclause></clause> 
<clause id="HCFA37D9E2D854816AEDCA93954987416"><enum>(ii)</enum><text>ending on the earlier of—</text> 
<subclause id="H75F317E57B7F443E8125BAA89205B0E4"><enum>(I)</enum><text>the end of the 2005–2006 school year; or</text></subclause> 
<subclause id="H08FD1879A07C40CCA101D7003FF1C38D"><enum>(II)</enum><text>the date on which the teacher ceases any such active duty or full-time duty.</text></subclause></clause> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H2577E4CECD58484385228CB8CB340867"><enum>(b)</enum><header>New special education teachers</header><text>Clause (iii) of section 602(10)(D) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(10)(D)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H2D71F24799BC42E99E9CABB1048FE6E7" display-inline="no-display-inline"> 
<clause id="HE217C76AC3024230B459C9CAF4751FE0"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of a new special education teacher who teaches multiple subjects and who is highly qualified in mathematics, language arts, or science, demonstrate competence in the other core academic subjects in which the teacher teaches in the same manner as is required for an elementary, middle, or secondary school teacher under section 9101(23)(C)(ii) of such Act, which may include a single, high objective uniform State standard of evaluation covering multiple subjects—</text> 
<subclause id="H643DD49758314968A9AC80E175C7D570"><enum>(I)</enum><text>not later than 2 years after the date of employment; or</text></subclause> 
<subclause id="H32978ED8E2C048A2892C09C27000723D"><enum>(II)</enum><text>in the case of such a new special education teacher who begins a period during which the teacher is on active duty as a member of the Armed Forces or is on full-time duty as a member of the National Guard of a State under an order to State active duty under title 32, United States Code, or under State law, within 2 years of such date of employment as a special education teacher, not later than the end of the period that is 2 years plus the number of days of such active duty or full-time duty after such date of employment.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H1EE8F927BCDC4ECCA4365DFBAFF37DF1"><enum>3.</enum><header>Paraprofessionals who served in the Armed Forces</header> <text display-inline="no-display-inline">Subsection (d) of section 1119 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6319">20 U.S.C. 6319</external-xref>) is amended—</text> 
<paragraph id="H5D29898DD5CD46E181D213EAF042184B"><enum>(1)</enum><text>by striking <quote>Each local</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H7D5E49DBA1B940880009399BA0E994E1" display-inline="no-display-inline"> 
<paragraph id="H5D527F36000544B3A91167C00067A47D"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), each local</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB2AB53F326FD4CCEB658411B91F1F458"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H467A7FA7D647451594E4909BA18401FB" display-inline="no-display-inline"> 
<paragraph id="H03B6561711294D8084917877002EE000"><enum>(2)</enum><header>Paraprofessionals serving in the military</header> 
<subparagraph id="HFACBC2F35D244C05B09791282544C000"><enum>(A)</enum><header>Extension</header><text display-inline="yes-display-inline">The date by which a local educational agency is required under paragraph (1) to ensure that all paraprofessionals described in such paragraph satisfy the requirements of subsection (c) shall be extended to the date determined under subparagraph (C) with respect to eligible paraprofessionals described in subparagraph (B).</text></subparagraph> 
<subparagraph id="H820D08D05F514D1584A49164F299C83"><enum>(B)</enum><header>Eligible paraprofessional</header><text>For purposes of this paragraph, the term <term>eligible paraprofessional</term> means an individual who—</text> 
<clause id="H8FE03DDB24484018BCEFB8FE2748CD91"><enum>(i)</enum><text>is a paraprofessional described in paragraph (1); and</text></clause> 
<clause id="H89CD8A16BCFC4620ACCA3CCCA0E38D04"><enum>(ii)</enum><text>is on active duty as a member of the Armed Forces, or is on full-time duty as a member of the National Guard of a State under an order to State active duty under title 32, United States Code, or under State law, on or after January 8, 2002.</text></clause></subparagraph> 
<subparagraph id="HB7882B99324C4A95AF81E07035BF48B6"><enum>(C)</enum><header>Determination of date</header><text>The date determined under this subparagraph is the later of the following:</text> 
<clause id="H002907BCF6A04332838763665668D587"><enum>(i)</enum><text>The first day of the first school year beginning on or after the date determined by extending the deadline described in subparagraph (A) for a period equal to the number of days in the paraprofessional’s applicable period of military service.</text></clause> 
<clause id="H1285319D2DA141D08D87B85960221B08"><enum>(ii)</enum><text>If the paraprofessional was enrolled in coursework or professional development that would have contributed toward the paraprofessional becoming highly qualified and the paraprofessional’s applicable period of military service interrupted such coursework or professional development, the last day of the next session of equivalent coursework or professional development that begins on or after the date determined by extending the deadline described in subparagraph (A) for a period equal to the number of days in the paraprofessional’s applicable period of military service. </text> </clause></subparagraph> 
<subparagraph id="H73BC64E17A574A039D93932334ED2656"><enum>(D)</enum><header>Applicable period of military service</header><text>For purposes of this paragraph, the term <term>applicable period of military service</term> means, with respect to an eligible paraprofessional, the period (or sum of periods) that interrupts the paraprofessional’s employment in a public elementary school or secondary school and during which the paraprofessional is on active duty as a member of the Armed Forces or is on full-time duty as a member of the National Guard of a State under an order to State active duty under title 32, United States Code, or under State law—</text> 
<clause id="HCDCCD654450D492DA61EC3C6FEA26F76"><enum>(i)</enum><text>beginning on the later of—</text> 
<subclause id="HC80B462CFB9D4DAA9EECABD502719DDE"><enum>(I)</enum><text>January 8, 2002; or</text></subclause> 
<subclause id="HF8B126980DE44BF38C50C7EB18923482"><enum>(II)</enum><text>the date on which the paraprofessional begins such period of active duty or full-time duty; and</text></subclause></clause> 
<clause id="H72A4BAB5241142A1B0FC00EA82FE83FB"><enum>(ii)</enum><text>ending on the earlier of—</text> 
<subclause id="HD4EEDED4BEF746BA837B61FF427F0872"><enum>(I)</enum><text>the end of the 2005–2006 school year; or</text></subclause> 
<subclause id="HA133CE767375469B987B202B31002B04"><enum>(II)</enum><text>the date on which the paraprofessional ceases any such active duty or full-time duty.</text></subclause></clause> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
