<section id="H18D8EB3479184B67B34978FFC510BB20" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deceptive Practices and Voter Intimidation Prevention Act of 2005</short-title></quote>.</text></section> 
<section commented="no" id="HD4BD705768E14580ABEEFF99EA08D59"><enum>2.</enum><header>Deceptive practices in elections</header> 
<subsection commented="no" id="HE91B806D81FF47D6B48D5E89142DE672"><enum>(a)</enum><header>Civil action</header> 
<paragraph commented="no" id="HDB1B0F40986F42878157E56DB1C370AA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (b) of section 2004 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1971">42 U.S.C. 1971(b)</external-xref>) is amended—</text> 
<subparagraph commented="no" id="H18F3524641DC4E679C1608453CD9C9AD"><enum>(A)</enum><text>by striking <quote>No person</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H12DE7342CA5647209D113E712CE1F688" style="OLC"> 
<paragraph commented="no" id="H3F1A8324513F4266BE4B6882E5F28FC1"><enum>(1)</enum><text>No person</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph> 
<subparagraph commented="no" id="HF2F26EF5042B401F8B7FACB278742653"><enum>(B)</enum><text>by inserting at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="HD38D2631536C4F65A635BB13F74DA393" style="OLC"> 
<paragraph commented="no" id="H5CD3F724CB474CEEA8AB75FE5A36FBB"><enum>(2)</enum><text>No person, whether acting under color of law or otherwise, shall knowingly deceive any other person regarding—</text> 
<subparagraph commented="no" id="HD4D2D142767B418A89D33C52AF2B497C"><enum>(A)</enum><text>the time, place, or manner of conducting a general, primary, run-off, or special election for the office of President, Vice President, presidential elector, Member of the Senate, Member of the House of Representatives, or Delegate or Resident Commissioner to the Congress; or</text></subparagraph> 
<subparagraph commented="no" id="H76F15E7244954F04BE8D6BCDB79C0EA"><enum>(B)</enum><text>the qualifications for or restrictions on voter eligibility for any election described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph commented="no" id="H00B38FDD674444A9B763C1FEFA96EF13"><enum>(2)</enum><header>Private right of action</header> 
<subparagraph commented="no" id="H013B0F806C744B60824543D1EA2E6593"><enum>(A)</enum><header>In general</header><text>Subsection (c) of section 2004 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1971">42 U.S.C. 1971(c)</external-xref>) is amended—</text> 
<clause commented="no" display-inline="no-display-inline" id="HD44C77B0C30A4F6CA9F69DCC58CEFBF8"><enum>(i)</enum><text>by striking <quote>Whenever any person</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H1D1ADA2690B34602993DC6EF14BEDA00" style="OLC"> 
<paragraph commented="no" display-inline="no-display-inline" id="H5380BC5F97DD41DDAA62003D9F49B020"><enum>(1)</enum><text>Whenever any person</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause> 
<clause commented="no" display-inline="no-display-inline" id="HAA8A4A64D4944C9A9FD291900E361BB"><enum>(ii)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H2BF7E573970045D28800DFEB8CE584F4" style="OLC"> 
<paragraph commented="no" display-inline="no-display-inline" id="HA64F2837285D4ADAA324B1416365D68"><enum>(2)</enum><text>Any person aggrieved by a violation of subsection (b)(2) may institute a civil action or other proper proceeding for preventive relief, including an application in a United States district court for a permanent or temporary injunction, restraining order, or other order.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4BF94D07D83A4FD591377CE0925D61E8"><enum>(B)</enum><header>Conforming amendments</header> 
<clause commented="no" id="HAEB6E572366D49B1A95E3982938C7943"><enum>(i)</enum><text>Subsection (e) of section 2004 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1971">42 U.S.C. 1971(e)</external-xref>) is amended by striking <quote>subsection (c)</quote> and inserting <quote>subsection (c)(1)</quote>.</text></clause> 
<clause commented="no" id="H43DAFAE2B8D14BCE80B990A461BD5070"><enum>(ii)</enum><text>Subsection (g) of section 2004 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1971">42 U.S.C. 1971(g)</external-xref>) is amended by striking <quote>subsection (c)</quote> and inserting <quote>subsection (c)(1)</quote>.</text></clause></subparagraph></paragraph></subsection> 
<subsection commented="no" id="HCC0CF7F5DD814CBBBBB82E2B5600B04B"><enum>(b)</enum><header>Criminal penalty</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/594">Section 594</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph commented="no" id="H6F2275214BBA48C3BFC11952FCF4C18C"><enum>(1)</enum><text>by striking <quote>Whoever</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H8AE47740BAC84CAAB4C0E34CBC5B2F14" style="OLC"> 
<subsection commented="no" id="H46771C6C54F5475986349213A53D3099"><enum>(a)</enum><header>Intimidation</header><text>Whoever</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph commented="no" id="H5DB7EAEFAC134195A1CAD87DFC8C6F29"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H92D87EB426B640C499B8759FC000B1C5" style="OLC"> 
<subsection commented="no" id="H919AF38AAEC14F2700ABED336A0007F"><enum>(b)</enum><header>Deceptive acts</header> 
<paragraph commented="no" id="HA37941FA22794434AA6DB62F8E62E2A7"><enum>(1)</enum><header>Prohibition</header> 
<subparagraph commented="no" id="H23F12F277E874CFAAA6CBCF5626B62CF"><enum>(A)</enum><header>In general</header><text>It shall be unlawful for any person to knowingly deceive another person regarding the time, place, or manner of an election described in subparagraph (B), or the qualifications for or restrictions on voter eligibility for any such election, with the intent to prevent such person from exercising the right to vote in such election.</text></subparagraph> 
<subparagraph commented="no" id="H9673B53545B543AAA5EA1EED821C7591"><enum>(B)</enum><header>Election</header><text>An election described in this subparagraph is any general, primary, run-off, or special election for the office of President, Vice President, presidential elector, Member of the Senate, Member of the House of Representatives, or Delegate or Resident Commissioner to the Congress.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HD2872ADEA75646EA863DFD007DD7CCAC"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined not more than $100,000, imprisoned not more than 1 year, or both.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HD94B082D5EC04C3882357D83B484B74C"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H02488D17CE9E43A08500817B549B5D03"><enum>3.</enum><header>Reporting false election information</header> 
<subsection commented="no" display-inline="no-display-inline" id="HF420CB134C304A1C80009C948DDF6463"><enum>(a)</enum><header>In general</header><text>Any person may report to the Assistant Attorney General of the Civil Rights Division of the Department of Justice, or the designee of such Assistant Attorney General, any act of deception regarding—</text> 
<paragraph commented="no" id="H791D60742BD543BBB7A3DA1BD2641F31"><enum>(1)</enum><text>the time, place, or manner of conducting a general, primary, run-off, or special election for Federal office; or</text></paragraph> 
<paragraph commented="no" id="HE70D607AE0AF4246B285AED7C3D31238"><enum>(2)</enum><text>the qualifications for or restrictions on voter eligibility for any general, primary, run-off, or special election for Federal office.</text></paragraph></subsection> 
<subsection commented="no" id="H215985BB22C24DBCAAB88E1B7D8685F5"><enum>(b)</enum><header>Corrective action</header><text></text> 
<paragraph commented="no" id="H2F662572371741828D88F85C92A0535C"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), not later than 48 hours after receiving a report under subsection (a), the Assistant Attorney General shall investigate such report and, if the Assistant Attorney General determines that an act of deception described in subsection (a) occurred, shall—</text> 
<subparagraph commented="no" id="HC538E87E72EE46F2AE21CF4D9C48D07E"><enum>(A)</enum><text>undertake all effective measures necessary to provide correct information to voters affected by the deception, and</text></subparagraph> 
<subparagraph commented="no" id="HFC774F4BF3154B21BFC211EBA22BA39"><enum>(B)</enum><text>refer the matter to the appropriate Federal and State authorities for criminal prosecution.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H52850BD376564D91B2BCEE04002708D5"><enum>(2)</enum><header>Reports within 72 hours of an election</header><text>If a report under subsection (a) is received within 72 hours before the election described in such subsection, the Assistant Attorney General shall immediately investigate such report and, if the Assistant Attorney General determines that an act of deception described in subsection (a) occurred, shall immediately undertake all effective measures necessary to provide correct information to voters affected by the deception and shall immediately refer the matter to the appropriate Federal and State authorities for criminal prosecution.</text></paragraph> 
<paragraph commented="no" id="HC7F78C1A871E4DBE865BC733270600DE"><enum>(3)</enum><header>Regulations</header> 
<subparagraph commented="no" id="H8ED8AB20FAA34AB085F10061FEC09174"><enum>(A)</enum><header>In general</header><text>The Attorney General shall promulgate regulations regarding the methods and means of corrective actions to be taken under paragraphs (1) and (2). Such regulations shall be developed in consultation with the Election Assistance Commission, civil rights organizations, voting rights groups, State election officials, voter protection groups, and other interested community organizations.</text></subparagraph> 
<subparagraph commented="no" id="HE6985F317AC949BFA01C7BF60569FFE1"><enum>(B)</enum><header>Study</header> 
<clause commented="no" id="HF50B0569AC514921A13CFAD2F446C1E9"><enum>(i)</enum><header>In general</header><text>The Attorney General, in consultation with the Federal Communications Commission and the Election Assistance Commission, shall conduct a study on the feasibility of providing the corrective information under paragraphs (1) and (2) through public service announcements, the emergency alert system, or other forms of public broadcast.</text></clause> 
<clause commented="no" id="H9FA6E7EC50E84E4DB233C397CCAD7B09"><enum>(ii)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Attorney General shall submit to Congress a report detailing the results of the study conducted under clause (i).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HB213C3C91B74434A84BE2C47A456F86B"><enum>(c)</enum><header>Reports to Congress</header> 
<paragraph id="HB4C0C784C3BE476EAE7E26014EA309C8"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after any primary, general, or run-off election for Federal office, the Attorney General shall submit to the appropriate committees of Congress a report compiling and detailing any allegations of deceptive practices submitted pursuant to subsection (a) and relating to such election.</text></paragraph> 
<paragraph id="H3114A93283B04FD1A45636B6BEF03DEB"><enum>(2)</enum><header>Contents</header> 
<subparagraph id="H0486F9F75A464AA690A354A027BEB4A5"><enum>(A)</enum><header>In general</header><text>Each report submitted under paragraph (1) shall include—</text> 
<clause id="H86AFD92E79D44F4B9DAAF7CC1DC44EA5"><enum>(i)</enum><text>detailed information on specific allegations of deceptive tactics;</text></clause> 
<clause id="H6E4AA7EF8FDA4300B5B307F2F34C51BD"><enum>(ii)</enum><text>any corrective actions taken in response to such allegations;</text></clause> 
<clause id="H7C0BCE77CB1D4E3CB9BB55C8480037FC"><enum>(iii)</enum><text>the effectiveness of any such corrective actions;</text></clause> 
<clause id="H38F6B770F4474DA4B3BDA91C95E2009C"><enum>(iv)</enum><text>any suit instituted under section 2004(b)(2) of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1971">42 U.S.C. 1971(b)(2)</external-xref>) in connection with such allegations;</text></clause> 
<clause id="H508FBE65818948DCAB50E5B08C49A655"><enum>(v)</enum><text>statistical compilations of how many allegations were made and of what type;</text></clause> 
<clause id="H532670B8C8F544D395F3834D6BE70F4"><enum>(vi)</enum><text>the geographic locations of and the populations affected by the alleged deceptive information; and</text></clause> 
<clause id="H5842B3C12BB84E7ABBDEBC97A7AD474B"><enum>(vii)</enum><text>the status of the investigations of such allegations.</text></clause></subparagraph> 
<subparagraph id="H08F715B0FAB447C6B11F719641551098"><enum>(B)</enum><header>Exception</header><text>The Attorney General may withhold any information that the Attorney General determines would unduly interfere with an on-going investigation.</text></subparagraph></paragraph> 
<paragraph id="H5FD5EAF01AB24798A23C4F4B4223902B"><enum>(3)</enum><header>Report made public</header><text>The Attorney General shall make the report required under paragraph (1) publicly available through the Internet and other appropriate means.</text></paragraph></subsection> 
<subsection commented="no" id="H82E06B8315834B039715EFA067B34CFE"><enum>(d)</enum><header>Federal office</header><text>For purposes of this section, the term <term>Federal office</term> means the office of President, Vice President, presidential elector, Member of the Senate, Member of the House of Representatives, or Delegate or Resident Commissioner to the Congress.</text></subsection> 
<subsection commented="no" id="H843C6786294A4FB1B81EBBBBB598D00"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General such sums as may be necessary to carry out this section.</text></subsection></section>
