<official-title>To clarify the status of retirement benefits provided by the Young Women’s Christian Association Retirement Fund under the benefit accrual standards of the Employee Retirement Income Security Act of 1974.</official-title>

<section id="HDE19B4375C824EB89C019EA48969593F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>YWCA Retirement Plan Preservation Act of 2005</short-title></quote>.</text></section> 
<section id="HEDBFC443F7AB41178922F0CD5114C67B"><enum>2.</enum><header>Clarification of age discrimination rules</header> 
<subsection id="H89ED66AA9BCF4B5DB930328496E27CB3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A pension plan described in subsection (b) shall not be treated as failing to meet the requirements of section 204(b)(1)(H)(i) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1054">29 U.S.C. 1054(b)(1)(H)(i)</external-xref>) or section 4(i)(1)(A) of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/623">29 U.S.C. 623(i)(1)(A)</external-xref>) merely because it may reasonably be expected that the period over which interest credits will be made to a participant’s accumulation account (or its equivalent) under the plan is longer for a younger participant. This subsection shall not apply to any plan if the rate of any pay credit or interest credit to such an account under the plan decreases by reason of the participant’s attainment of any age.</text></subsection> 
<subsection id="HBD473CDC8B6148A19E8D5CE7A878AE18"><enum>(b)</enum><header>Pension plan described</header><text display-inline="yes-display-inline">A pension plan described in this subsection is the defined benefit plan (as defined in section 3(35) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(35)</external-xref>) maintained as of December 6, 2005, by the Young Women’s Christian Association Retirement Fund, a corporation created by an Act of the State of New York which became law on April 12, 1924.</text></subsection></section> 
<section id="HF4BB6826FEFE418F923653E38F003DE6"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to periods beginning on or after the date of the enactment of this Act, except that such amendments shall apply in the case of any civil action brought on or after such date by one or more participants, beneficiaries, or fiduciaries against—</text> 
<paragraph id="H92C3B4A34C6B4E70BC672B8B3CA116A5"><enum>(1)</enum><text>the Young Women’s Christian Association Retirement Fund,</text></paragraph> 
<paragraph id="H74FAA60CED0B4A8AA71C9DA66FD1EC80"><enum>(2)</enum><text>any local association of the Young Women’s Christian Association of the United States of America (or any tax-exempt successor organization to a local association),</text></paragraph> 
<paragraph id="HC9A175F8948A41959E214DD77E49126E"><enum>(3)</enum><text>the Young Women’s Christian Association of the United States of America, or</text></paragraph> 
<paragraph id="H73CBBCD760614FE18464A075E033814F"><enum>(4)</enum><text display-inline="yes-display-inline">any trustee, director, or employee of any entity described in paragraph (1), (2), or (3),</text> </paragraph><continuation-text continuation-text-level="subsection">alleging a violation (of section 204(b)(1)(H) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1054">29 U.S.C. 1054(b)(1)(H)</external-xref>), section 4(i)(1)(A) of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/623">29 U.S.C. 623(i)(1)(A)</external-xref>), or both) occurring before, on, or after the date of the enactment of this Act.</continuation-text></section>
