<legis-type>A BILL</legis-type> 
<official-title>To amend title 23, United States Code, relating to the use of high occupancy vehicle lanes by hybrid vehicles.</official-title>

<section id="H885F4D15D31541D3A2E716A65FDC3FD" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hybrid Vehicle HOV Access Act</short-title></quote>.</text></section> 
<section id="H485272493BB7487C9464CBA654A4679"><enum>2.</enum><header>HYBRID VEHICLE EXCEPTION</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/102">Section 102(a)</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H603AB5AE0F9B4802B81596C8502C07C3" display-inline="no-display-inline"> 
<paragraph id="HD3A295CDE2144711B752CA231365B245"><enum>(3)</enum><header>Exception for low-emission hybrid vehicles</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), a State may permit a vehicle with fewer than 2 occupants to operate in high occupancy vehicle lanes if—</text> 
<subparagraph id="HDCA6A3CD354A42EAB0B5037CD5436392"><enum>(A)</enum><text>such vehicle is a hybrid vehicle; and</text></subparagraph> 
<subparagraph id="H3E719FCE17A44BBD93C832A3CC94A314"><enum>(B)</enum><text>the State establishes, after the date of enactment of this paragraph, requirements for identifying vehicles that are hybrid vehicles and labeling such vehicles as hybrid vehicles.</text></subparagraph></paragraph> 
<paragraph id="H76585E77E5CF4C438468629C49EC5C78"><enum>(4)</enum><header>Hybrid vehicle defined</header><text>For purposes of this subsection, the term <quote>hybrid vehicle</quote> means a motor vehicle (as such term is defined in section 164(a))—</text> 
<subparagraph id="HC1B3434299824988813062C74F269393"><enum>(A)</enum><text>which draws propulsion energy from onboard sources of stored energy which are both—</text> 
<clause id="HF29455E47F384D6DB567E789480550C"><enum>(i)</enum><text>an internal combustion or heat engine using combustible fuel; and</text></clause> 
<clause id="H93F5603F67764C8DA7B5EB002906EF02"><enum>(ii)</enum><text> a rechargeable energy storage system;</text></clause></subparagraph> 
<subparagraph id="HA7AF9E8B32BF4BFABFF2C200A5368B60"><enum>(B)</enum><text>which, in the case of a passenger automobile or light truck—</text> 
<clause id="H16FA811C4F4E47B487E400991351BB00"><enum>(i)</enum><text> for 2002 and later model vehicles, has received a certificate of conformity under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) and meets or exceeds the equivalent qualifying California low emission vehicle standard under section 243(e)(2) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7583">42 U.S.C. 7583(c)(2)</external-xref>) for that make and model year; and </text></clause> 
<clause id="H543CC14A020C43CC91CA7CEDE495DFBC"><enum>(ii)</enum><text>for 2004 and later model vehicles, has received a certificate that such vehicle meets or exceeds the Bin 5 Tier II emission level established in regulations prescribed by the Administrator of the Environmental Protection Agency under section 202(i) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521(i)</external-xref>) or as meeting a California Air Resources Board emission standard that is at least as stringent for that make and model year vehicle, and meets any additional Environmental Protection Agency or California Air Resources Board emissions category or other requirements identified by the Agency or the Board, as the case may be; </text></clause></subparagraph> 
<subparagraph id="H3E8B63D50C8E4400ADF95FF61422A2F8" display-inline="no-display-inline"><enum>(C)</enum> 
<clause id="HB3E16E5FBA66495AB22E6BEC5D539BD9" display-inline="yes-display-inline"><enum>(i)</enum><text>which has been certified by the Administrator of the Environmental Protection Agency to have a 45-mile-per-gallon or greater fuel economy highway rating; or</text></clause></subparagraph> 
<subparagraph id="HBF4463E0050241DA9DDBA9ED02F8CD18" display-inline="no-display-inline"><enum>(ii)</enum><text> which meets any additional requirements, restrictions, or conditions that the State establishes before, on, or after the date of enactment of this paragraph; and</text></subparagraph> 
<subparagraph id="HC08CBE2CAB9F4A3DAAEEFAE3741EB33D" display-inline="no-display-inline"><enum>(D)</enum><text> which is made by a manufacturer.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H9A688859010B44CEAA05100018426C4E"><enum>3.</enum><header>Termination</header><text display-inline="no-display-inline">Effective December 31, 2010, paragraphs (3) and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/102">section 102(a)</external-xref> of title 23, United States, are repealed.</text></section>
