<legis-type>A BILL</legis-type> 
<official-title>To establish a uniform appointment process and term of service for the Architect of the Capitol, the Comptroller General, and the Librarian of Congress, to prohibit the annual amount of payment of compensation to such officers to exceed the annual salary of a Member of Congress, and for other purposes.</official-title>

<section id="H04F07B71D04D43BD87E6515271A4BD97" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Legislative Branch Officer Appointment Act of 2005</short-title></quote>.</text></section> 
<section id="H9A8B483E5B2B4FFEA8B81CF09E95A3A5"><enum>2.</enum><header>Architect of the Capitol</header> 
<subsection id="H5A21ABCC9ECF434481763C8C53FD29D6"><enum>(a)</enum><header>Appointment and Term of Service</header> 
<paragraph id="H34192646013C4424A1664B97BC05CF10"><enum>(1)</enum><header>Appointment</header><text>The Architect of the Capitol shall be appointed jointly by the Speaker of the House of Representatives, the Majority Leader of the Senate, and the Minority Leaders of the House of Representatives and Senate.</text></paragraph> 
<paragraph id="HF3D89A7796FC411D91BE6DE6F2EA8BF"><enum>(2)</enum><header>Term of Service</header><text>The Architect of the Capitol shall be appointed for a term of 10 years, and may be reappointed for additional terms.</text></paragraph> 
<paragraph id="H18E6F12A9BAD46709E91F5323C004989"><enum>(3)</enum><header>Conforming Amendment</header><text>Section 319 of the Legislative Branch Appropriations Act, 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/1801">2 U.S.C. 1801</external-xref>) is repealed.</text></paragraph> 
<paragraph id="H5E18B0C3F28344D7BEE0617E8BD6A86F"><enum>(4)</enum><header>Effective Date</header><text>This subsection shall apply with respect to appointments made on or after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H51405BF1416A4D5689A37C354759B773"><enum>(b)</enum><header>Limit on Total Annual Amount of Compensation</header> 
<paragraph id="H39E8DE21320E4E2085AE088CA5C6860"><enum>(1)</enum><header>Limit</header><text>Section 1(1) of <external-xref legal-doc="public-law" parsable-cite="pl/96/146">Public Law 96–146</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/2/1802">2 U.S.C. 1802</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H2818A8254C9F4839BEB08EE5681D00A1" display-inline="no-display-inline"> 
<paragraph id="HF1E566387B214635941184008DB83895"><enum>(1)</enum><text display-inline="yes-display-inline">the compensation of the Architect of the Capitol shall be at an annual rate which is equal to the higher of the annual salary for the Sergeant at Arms of the House of Representatives or the annual salary for the Sergeant at Arms of the Senate, and the total amount of compensation paid to the Architect of the Capitol in any year, including salary and any other payments (but excluding the value of any retirement, health, or other benefits), may not exceed the annual rate of pay for a Member of Congress for the year, and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA0AB37EFCA4B4C90B12597B272F93D49"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply with respect to compensation paid for any period beginning on or after the date of the enactment of this Act.</text></paragraph></subsection></section>

<subsection id="H9EB1FE4300194F119D681F22C383F813"><enum>(a)</enum><header>Appointment and Term of Service</header> 
<paragraph id="H13EE3F69582B4A528875669659EAEBF8"><enum>(1)</enum><header>Appointment</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/703">Section 703(a)</external-xref> of title 31, United States Code, is amended to read as follows: </text>

<subsection id="H5879458E90BA4047BB8088B49471B9F7"><enum>(a)</enum><text>The Comptroller General shall be appointed jointly by the Speaker of the House of Representatives, the Majority Leader of the Senate, and the Minority Leaders of the House of Representatives and Senate.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HCD9C424270804CFBAD1D009DB0E95D7B"><enum>(2)</enum><header>Term of service</header><text>Section 703(b) of such title is amended by striking <quote>15 years</quote> and inserting <quote>10 years</quote>.</text></paragraph> 
<paragraph id="H3F698DC576A143EA8C534019DECB72B8"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply with respect to appointments made, and to individuals first appointed, on or after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HBA55D064C28E4758A5E773761C3F8D18"><enum>(b)</enum><header>Limit on Total Annual Amount of Compensation</header> 
<paragraph id="H5CC32D9E45684423B4DE64F4DB0067AB"><enum>(1)</enum><header>Limit</header><text>Section 703(f) of such title is amended—</text> 
<subparagraph id="H3810436F3BEB40BEABAEF37BF2BFE6D8"><enum>(A)</enum><text>by striking <quote>(f) The annual rate</quote> and inserting <quote>(f)(1) The annual rate</quote>;</text></subparagraph> 
<subparagraph id="H2FB38B3E938F4DBA896BDEB6D6BB95C5"><enum>(B)</enum><text>by striking <quote>(1)</quote> and <quote>(2)</quote> and inserting <quote>(A)</quote> and <quote>(B)</quote>; and</text></subparagraph> 
<subparagraph id="H10B2FE4DAE8843A5A253C0E830FA8B4F"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HA747B1DD7E5945B18FB41F9FA4CD0EE"><enum>(2)</enum><text>Notwithstanding any other provision of law, the total amount of compensation paid to the Comptroller General in any year, including salary and any other payments (but excluding the value of any retirement, health, or other benefits), may not exceed the annual rate of pay for a Member of Congress for the year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>

<subsection id="H260A6DA0659549628B8FA153A951E4AE"><enum>(c)</enum><header>Equalization of Retirement Annuity</header> 
<paragraph id="HE1AD3C8D02234C06B49C0063A7A9D8FD"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/772">Section 772</external-xref> of title 31, United States Code, is repealed.</text></paragraph> 
<paragraph id="H1792B9FDC2694319A595162B8E515306"><enum>(2)</enum><header>Conforming amendments</header><text>Title 31, United States Code, is amended as follows:</text> 
<subparagraph id="HFBBC4AE38FC84AB5A2A8D392C2E7B486"><enum>(A)</enum><text>In section 735(a), by striking <quote>772, 775(a) and (d)</quote> and inserting <quote>or 775(b)</quote>.</text></subparagraph> 
<subparagraph id="H54FECA7364B54E65B7A7A1331636E27C"><enum>(B)</enum><text>In the second sentence of section 773(a), by striking <quote>or if an election is made</quote> and all that follows and inserting a period.</text></subparagraph> 
<subparagraph id="H4D645CF9348C4D6AB9512536D8F7C824"><enum>(C)</enum><text>In section 774(b)(2), by striking <quote>or while receiving an annuity under section 772 of this title</quote>.</text></subparagraph> 
<subparagraph id="H6C61A63F90A844028CA4285571AA154B"><enum>(D)</enum><text>In section 775—</text>

<subsection id="H0895ECD93F6F4465AE54AD7E57AEF4BC"><enum>(a)</enum><header>Appointment and Term of Service</header> 
<paragraph id="HF056475E83AC400D90D32025BEEA85E4"><enum>(1)</enum><header>Appointment; rules and regulations</header><text>The Librarian of Congress shall be appointed jointly by the Speaker of the House of Representatives, the Majority Leader of the Senate, and the Minority Leaders of the House of Representatives and Senate. The Librarian shall make rules and regulations for the government of the Library of Congress.</text></paragraph> 
<paragraph id="H238BD0882BC14923BC23081BE7CC1F8C"><enum>(2)</enum><header>Term of service</header><text display-inline="yes-display-inline">The Librarian of Congress shall be appointed for a term of 10 years, and may be reappointed for additional terms.</text></paragraph> 
<paragraph id="H70EB9C3B506A4EF700BA6EAFA6005C72"><enum>(3)</enum><header>Conforming amendment</header><text>The first paragraph under the heading <quote>Library of Congress</quote> in the first section of the Act entitled <quote>An Act making appropriations for the legislative, executive, and judicial expenses of the Government for fiscal year ending June thirtieth, eighteen hundred and ninety-eight, and for other purposes</quote>, approved February 19, 1897 (29 Stat. 546; <external-xref legal-doc="usc" parsable-cite="usc/2/136">2 U.S.C. 136</external-xref>), is repealed.</text></paragraph> 
<paragraph id="H66222D11D6FF4CE0B800994E4824DC86"><enum>(4)</enum><header>Effective date</header><text>This subsection and the amendments made by this subsection shall apply with respect to appointments made on or after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HAA0F6269D69E49DEA1281BE905B34CC4"><enum>(b)</enum><header>Limit on Total Annual Amount of Compensation</header> 
<paragraph id="HF02E02F0B31C40398B0843D0C690DCDA"><enum>(1)</enum><header>Limit</header><text>Section 904 of the Supplemental Appropriations Act, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/2/136a-2">2 U.S.C. 136a–2</external-xref>) is amended—</text> 
<subparagraph id="H9DC5DD2846AF435990EB34EEE62BD582"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (1);</text></subparagraph> 
<subparagraph id="HCF0DE7E68054461A83142666F0B423F0"><enum>(B)</enum><text>by striking the period at the end of paragraph (2) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HB03F2B2FC82C44D08317865CEC5FCEBB"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>
