<official-title>To direct the Secretary of Homeland Security to establish a database of small businesses for purposes of consultation by Federal agencies prior to awarding contracts relating to declared emergencies.</official-title>

<section id="H2164C518B4554524A0DA8DEFB12DDFEA" section-type="section-one"><enum>1.</enum><header>Establishment and consultation of small business database by Secretary of Homeland Security</header> 
<subsection id="H8C96DE523D26476F80001FD08B8C67E6"><enum>(a)</enum><header>Establishment and consultation</header><text>Title V of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/311">6 U.S.C. 311 et seq.</external-xref>) is amended—</text> 
<paragraph id="HEB2DEF1BDE2440EDAEDBED4F7BC065"><enum>(1)</enum><text>by redesignating the second section 510 as section 511; and</text></paragraph> 
<paragraph id="H76AC6F4E06D04652B62B9955007125F4"><enum>(2)</enum><text>by adding at the end the following new section:</text>

<section id="H5B8846CC84174283B0DB00C4C4E1B82F"><enum>512.</enum><header>Small business database for Federal contracting related to major disasters and emergency assistance activities: establishment and consultation</header> 
<subsection id="H4F00F535A3DA464985C34B2C152DD5D"><enum>(a)</enum><header>Establishment of database</header><text>The Secretary, acting through the Director of the Federal Emergency Management Agency, shall establish and maintain a database of small business concerns.</text></subsection> 
<subsection id="H547DD93C2FF842939F59E3C86CAEA00"><enum>(b)</enum><header>Included information</header><text>The database under subsection (a) shall include the following information about each small business concern:</text> 
<paragraph id="H0CF1DBEFB13342D8B09D36C403A4103F"><enum>(1)</enum><text>The name of the small business concern.</text></paragraph> 
<paragraph id="H686E8312780346F49773C92BCF052094"><enum>(2)</enum><text>The location of the small business concern.</text></paragraph> 
<paragraph id="H4D65DFC20048417EACAB5EBB79E60A2"><enum>(3)</enum><text>The area served by the small business concern.</text></paragraph> 
<paragraph id="H9C8392F17D004BEF88F8E7624738A24E"><enum>(4)</enum><text>The type of good or service provided by the small business concern.</text></paragraph> 
<paragraph id="H96AD2B7EFB294CAEB9EC89E8B80655E3"><enum>(5)</enum><text display-inline="yes-display-inline">Whether the small business concern is—</text> 
<subparagraph id="H0CF41BC60D75419E93CE9E22742F3307"><enum>(A)</enum><text>a small business concern owned and controlled by socially and economically disadvantaged individuals;</text></subparagraph> 
<subparagraph id="HA9E94F042CCA41EE91FF9C00F25DC4DB"><enum>(B)</enum><text>a small business concern owned and controlled by women; or</text></subparagraph> 
<subparagraph id="HD65ED78C7A2F4BC09CD200E1431F6E46"><enum>(C)</enum><text>a small business concern owned and controlled by service-disabled veterans.</text></subparagraph></paragraph></subsection> 
<subsection id="HB30DFE7550B94D9194E1A52CBB2757A4"><enum>(c)</enum><header>Source of information</header> 
<paragraph id="H427A9E35D732457FB81EB3A28110C979"><enum>(1)</enum><header>Submission</header><text>Information maintained in the database shall be submitted on a voluntary basis by small business concerns.</text></paragraph> 
<paragraph id="H304D056B9885431688B9B834DC4200C7"><enum>(2)</enum><header>Attestation</header><text>Each small business concern submitting information to the database shall submit—</text> 
<subparagraph id="HCDE2381442FE43EFA14DF5F2D32B3EB"><enum>(A)</enum><text>an attestation that the information submitted is true; and</text></subparagraph> 
<subparagraph id="H7A67FB6307D341599D5E16CD5C9CA636"><enum>(B)</enum><text>documentation supporting such attestation.</text></subparagraph></paragraph> 
<paragraph id="HA087A0FEA3BD41028F082162739C6691"><enum>(3)</enum><header>Verification</header><text>The Secretary shall verify only that the documentation submitted by each small business concern supports the information submitted by that small business concern.</text></paragraph> 
<paragraph id="H3EB2B5960F7040C5AEB38364E4C12C15"><enum>(4)</enum><header>Enforcement penalties for misrepresentation</header><text display-inline="yes-display-inline">Any concern that is determined by the Secretary to have misrepresented the status of that concern as a small business concern owned and controlled by socially and economically disadvantaged individuals, a small business concern owned and controlled by women, or a small business concern owned and controlled by service-disabled veterans for purposes of this subsection shall be subject to—</text></paragraph> 
<paragraph id="HC741530FB28642F297B3A99CD3520BE"><enum>(5)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/1001">section 1001</external-xref> of title 18; and</text></paragraph> 
<paragraph id="H61F48363E3A641A3AACB2282BFE1C2F7"><enum>(6)</enum><text>sections 3729 through 3733 of title 31.</text></paragraph></subsection> 
<subsection id="H2AE8BFCB7D8145AD8D552D23B9E51919" commented="no"><enum>(d)</enum><header>Availability of database</header><text>The database shall be made generally available on the Internet website of the Department.</text></subsection> 
<subsection id="H8E192D633E4645450000BDDB7B2182F1"><enum>(e)</enum><header>Consultation of database</header> 
<paragraph id="HEA330D5F979943D5942979FA004E00B"><enum>(1)</enum><header>Consultation required</header><text>Before awarding a Federal contract for a disaster-related activity a Federal agency shall consult the database established under this section.</text></paragraph> 
<paragraph id="H3486D034029846B6B4C2B5322D54B71B"><enum>(2)</enum><header>Disaster-related activity defined</header><text>For purposes of this subsection, a disaster-related activity is an activity undertaken by reason of an event that is declared an emergency or a disaster by the President pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></paragraph></subsection> 
<subsection id="H702B87BF2CC941E28FDE4B27C638B963"><enum>(f)</enum><header>Definitions</header><text>For purposes of this section, the terms <quote>small business concern</quote>, <quote>small business concern owned and controlled by socially and economically disadvantaged individuals</quote>, <quote>small business concern owned and controlled by women</quote>, and <quote>small business concern owned and controlled by service-disabled veterans</quote> shall have the meanings given those terms under the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H43EBEBF7E686448D9E7300E3C8974E63"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by adding after the items relating to section 509 the following:</text>

<toc-entry level="section">Sec. 512. Small business database for Federal contracting related to declared emergencies: establishment and consultation</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5363F2F6B5544D7793B023A6D42E00CB"><enum>(c)</enum><header>Effective date</header><text>The Secretary shall establish the database required under section 512 of the Homeland Security Act of 2002 (as added by subsection (a)) not later than the date that is 60 days after the date of the enactment of this Act.</text> </subsection></section>
