<official-title>To establish a fair order of posting checks and deposits to prevent unjust enrichment of financial institutions from fees that accrue only by virtue of the order used by the institution for posting checks and deposits, and for other purposes.</official-title>

<section id="HBBE4B82EA152455DBD478FFC7784482C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Checking Fairness Act</short-title></quote>.</text></section> 
<section id="H7189B3E21DD9445E00327246814E7C5E"><enum>2.</enum><header>Fair order for posting checks</header> 
<subsection id="H102245086AC94FC386C7A88103FE5697"><enum>(a)</enum><header>Order of checks posted</header><text display-inline="yes-display-inline">Section 607 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4006">12 U.S.C. 4006</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H1406DF00A8664D0684F86430D2B786C6" display-inline="no-display-inline"> 
<subsection id="HB49158463DA6491DB58B31F353180115"><enum>(f)</enum><header>Numerical order of posting checks</header> 
<paragraph id="H999E709E50164EB0A3AE441B3C00B754"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), in the process of posting checks presented for payment against a checking account used primarily for personal, family, or household purposes after the close of any business day, the checks shall be posted by a depository institution against the account in the numerical order of the checks, beginning with the lowest number.</text></paragraph>
<paragraph id="H7EBACDAB3AE7479FA8DE3BA2E1F18"><enum>(2)</enum><header>Notice and customer consent for different posting order</header><text display-inline="yes-display-inline">A depository institution may alter the order required under paragraph (1) for posting checks against a checking account used primarily for personal, family, or household purposes only if—</text>
<subparagraph id="H44F89B3DEEC7452CA25FEC8605C8CF7F"><enum>(A)</enum><text>specific notice of the alternate posting order is given by the depository institution to the prospective accountholder verbally and in writing before the account is opened (using a document that is separate from the account application and any other document provided to the prospective accountholder in the process of opening the account) which fully describes the posting process and explains in clear and easy-to-understand language the possible consequences to the accountholder of the alternate posting order; and</text></subparagraph>
<subparagraph id="H8E10A2D978DB4E098CE239689629CD14"><enum>(B)</enum><text>the depository institution obtains from the accountholder, and retains in its records, a written acknowledgement of the receipt by the accountholder of the notice required under subparagraph (A) and the written consent of the accountholder for the use of the alternate posting order.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H398D34C1886A4F7EA20077A0C5B525B"><enum>(b)</enum><header>Credits required to be posted before debits</header><text display-inline="yes-display-inline">Section 607 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4006">12 U.S.C. 4006</external-xref>) is amended by inserting after subsection (f) (as added by subsection (a) of this section) the following new subsection:</text>

<subsection id="HF0411C6438014FB68C072F61C32EE5F0"><enum>(g)</enum><header>Order of posting debits and credits</header><text display-inline="yes-display-inline">In the process of posting credits and debits against a checking account used primarily for personal, family, or household purposes after the close of any business day, all deposits shall be credited by a depository institution to the account before debiting any check drawn on the account and presented for payment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H2488C724FCCE42BCAFE66F33F0D257E9"><enum>(c)</enum><header>Regulations</header><text>The Board of Governors of the Federal Reserve System shall—</text>
<paragraph id="H4EECD22D0C604723B9D364B4A452083D"><enum>(1)</enum><text>prescribe such regulations as may be necessary to implement the amendments made by subsection (a) and (b); and</text></paragraph>
<paragraph id="H9A740C6125774464A85D7B4328FA9634"><enum>(2)</enum><text>publish such regulations in final form before the end of the 180-day period beginning on the date of the enactment of this Act. </text> </paragraph></subsection></section>
