<subsection id="H8B32C656521F4FF98747363B2C4F4F72"><enum>(a)</enum><header>Establishment and Maintenance of Individual Security Accounts</header><text></text> 
<paragraph id="H9B2F6EDBDC534585A337E65CEE9E5EA6"><enum>(1)</enum><header>In general</header><text>Title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>) is amended—</text> 
<subparagraph id="HCC9AC990267B4B57A298198391FE132B"><enum>(A)</enum><text>by inserting before section 201 the following:</text>

<part id="HA6784998DB6540F98C5452D65EE2CE34"><enum>A</enum><header>Insurance benefits</header></part><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HB7332B64197548EA99002D897E43C2A4"><enum>(B)</enum><text>by adding at the end the following:</text>

<part id="HC18B28F43F794BDD007BE638FB2C802"><enum>B</enum><header>Individual security system</header> 
<subpart id="HC15A4857934B439C00134F55C2BB9792"><enum>1</enum><header>Individual security accounts</header> 
<section id="H61012886C0714D0CBE001E4B01F6C19"><enum>251.</enum><header>Federally-administered individual security account</header> 
<subsection id="H5DED959892D44215851E61FBA95B38F7" display-inline="yes-display-inline"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="HFC16DAD4C92A4E399FE1361C27FFA7E"><enum>(1)</enum><header>In general</header><text>Within 30 days after crediting the first contribution under subsection (b) with respect to an eligible individual, the Commissioner of Social Security shall establish an individual security account for such individual in the Individual Security Fund. Each account shall be identified to its account holder by means of the account holder’s social security account number.</text></paragraph> 
<paragraph id="HAF4174D562B84E9FABA499D3F4D9FD49"><enum>(2)</enum><header>Eligible individual</header><text>For purposes of this part, the term <term>eligible individual</term> means any individual born after December 31, 1949. </text></paragraph></subsection> 
<subsection id="HDB0CD1DC2A764709B15E32A25CEAFF70" display-inline="no-display-inline"><enum>(b)</enum><header>Contributions</header> 
<paragraph id="HA70E87B4B86A4123A1A85DD3F32F84C"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall transfer from the Federal Old-Age and Survivors Insurance Trust Fund, for crediting by the Commissioner of Social Security to the individual security account of an eligible individual, an amount equal to the sum of any amount received by such Secretary on behalf of such individual under section 3101(a)(2) or 1401(a)(2) of the Internal Revenue Code of 1986.</text></paragraph> 
<paragraph id="HEB2EDC4443EC44DEB2A8D0E1ABF0037"><enum>(2)</enum><header>Other contributions</header><text>For provisions relating to additional contributions credited to individual security accounts, see sections 54(d) and 6402(l) of the Internal Revenue Code of 1986.</text></paragraph></subsection> 
<subsection id="H7E32E6EC160140DD8F451EFBF7640085"><enum>(c)</enum><header>Crediting Requirements</header><text>Except as otherwise provided in section 252, contributions under subsection (b) on behalf of an eligible individual shall be credited—</text> 
<paragraph id="H3ACA53D34CA44FCF8D3D0047E2589E69"><enum>(1)</enum><text>to the individual security account established for such individual under subsection (a); and</text></paragraph> 
<paragraph id="H016AE22B8A464576A8926FAA9FAFF6EE"><enum>(2)</enum><text>in accordance with the allocation in effect with respect to such individual under subsection (d).</text></paragraph></subsection> 
<subsection id="H65526CE3FD924BE985FFEFF35225C048"><enum>(d)</enum><header>Allocation and Other Designations</header> 
<paragraph id="H9F4CAF02EA404FD6A4F91B15A5F00063"><enum>(1)</enum><header>In general</header><text>The Commissioner of Social Security shall prescribe regulations in accordance with which any eligible individual who is employed or self-employed may designate—</text> 
<subparagraph id="H46981739B6BD4BF6AEB50448131656C9"><enum>(A)</enum><text>in the event that 2 or more investment options are available in the Individual Security Fund—</text> 
<clause id="HD65381CBE66F47ADB8F14B99B893C077"><enum>(i)</enum><text>the option or options to which such individual wishes to have such individual's contributions under subsection (b) credited; and</text></clause> 
<clause id="H0A1BB30AE23D4CD6ACE0E85779766098"><enum>(ii)</enum><text>if such individual designates more than 1 option under clause (i), how such individual wishes for those contributions to be allocated; and</text></clause></subparagraph> 
<subparagraph id="HDE82CB05636746EEA5DB6ED008560539"><enum>(B)</enum><text>the amount of wages or self-employment income such individual wishes to designate for purposes of section 3101(a)(2)(C) or 1401(a)(2)(C) of the Internal Revenue Code of 1986 (as applicable), if any.</text></subparagraph></paragraph> 
<paragraph id="H9654F72D1EF24C92A9C1898E99C3915F"><enum>(2)</enum><header>Default allocation</header><text>In the absence of a required designation under paragraph (1)(A), contributions on behalf of the individual involved shall be allocated in such manner as the Commissioner of Social Security shall prescribe, taking into account the competing objectives of maximizing returns on investments and minimizing the risk involved with such investments.</text></paragraph> 
<paragraph id="H89DFBD0BB0914F2AA0F4252E67E280AD"><enum>(3)</enum><header>Form of designation</header><text>Any designation under paragraph (1) shall be made in such manner and at such intervals as the Commissioner of Social Security may prescribe in order to ensure ease of administration and to avoid creating an undue burden on employers.</text></paragraph> 
<paragraph id="HCB2711201A6142AC003041A0B022A04D"><enum>(4)</enum><header>Special rule for 2007</header><text>Not later than December 31, 2007, any eligible individual who is employed or self-employed as of such date shall execute all designations required under paragraph (1).</text></paragraph></subsection> 
<subsection id="H368BD0AA76594C089C5D3CDAFDE647A2"><enum>(e)</enum><header>Periodic Statements to Account Holder</header> 
<paragraph id="HA1B9E8B6F2E546358F457549565BB8E1"><enum>(1)</enum><header>In general</header><text>The Individual Security Fund Board shall prescribe regulations under which each individual for whom an individual security account is maintained under this section shall be furnished with—</text> 
<subparagraph id="H0231E241C9384C11BAAEB2FD9FC6C6FE"><enum>(A)</enum><text>a periodic statement relating to the individual's account, including, for any reporting period as of the end of which the individual's account balance is at least equal to the minimum balance amount (within the meaning of section 252), clear and conspicuous notice to that effect;</text></subparagraph> 
<subparagraph id="HC884189CDA8E4BDE00677D8397D858B3"><enum>(B)</enum><text>a summary description of any investment options or other choices which may be available to such individual under this section or under section 252 (as applicable); and</text></subparagraph> 
<subparagraph id="H15DED0F29A2E472197C3885080BF6496"><enum>(C)</enum><text>any forms and information necessary to make a designation under subsection (d) or section 252 (as applicable).</text></subparagraph></paragraph> 
<paragraph id="HE2C2AE980DC0479E8434FD54B364BB05"><enum>(2)</enum><header>Informed decisionmaking</header><text>All information, materials, and other matter furnished under this subsection shall be furnished to the account holder at such times and in such manner as the Board considers appropriate in order to permit informed decisionmaking.</text></paragraph></subsection></section> 
<section id="H778EEDF12DEA4208A0EA6B81B21FD078"><enum>252.</enum><header>Privately-administered individual security account</header> 
<subsection id="HF4071E7C170B41590066003214E4BA5F" display-inline="yes-display-inline"><enum>(a)</enum><header>Definitions</header><text>For purposes of this part—</text> 
<paragraph id="HF3D56AC05FF94125008C4241ED9A6B5"><enum>(1)</enum><header>Minimum deposit amount</header> 
<subparagraph id="HB3125F48167C4B9CB3BD89CE2F084F93"><enum>(A)</enum><header>In general</header><text>The term <term>minimum deposit amount</term> means an amount equal to $7,500, as adjusted under subparagraph (B).</text></subparagraph> 
<subparagraph id="HEF7AB7F619B3493690AE25EAFB47264F"><enum>(B)</enum><header>Adjustment</header><text>The Secretary of the Treasury shall adjust annually (effective for periods beginning after December 2006) the dollar amount set forth in subparagraph (A) under procedures providing for adjustments in the same manner and to the same extent as adjustments are provided for under the procedures used to adjust benefit amounts under section 215(i)(2)(A), except that any amount so adjusted that is not a multiple of $10 shall be rounded to the nearest multiple of $10.</text></subparagraph></paragraph> 
<paragraph id="H423E85AB8C9E4D83B1D1F0C8FBA47FB2"><enum>(2)</enum><header>Federally-administered individual security account</header><text>The term <term>Federally-administered individual security account</term> means an individual security account maintained, in accordance with applicable provisions of this part, in the Individual Security Fund.</text></paragraph> 
<paragraph id="HD50899AA344B437CA0C9571268007EE9"><enum>(3)</enum><header>Privately-administered individual security account</header><text>The term <term>privately-administered individual security account</term> means an individual security account maintained, in accordance with applicable provisions of this part, by a certified institution.</text></paragraph> 
<paragraph id="HE27185B78AB54386B1023356C05B818"><enum>(4)</enum><header>Certified institution</header><text>The term <term>certified institution</term> refers to an investment firm, credit union, insurance company, or other certified institution under subpart 3.</text></paragraph></subsection> 
<subsection id="H873C577F807B4DB5913C263CF6231B91"><enum>(b)</enum><header>Option To Designate a Privately-Administered Individual Security Account</header> 
<paragraph id="H93622AD113734963986300694F2CEB92"><enum>(1)</enum><header>In general</header><text>Under regulations prescribed by the Individual Security Fund Board, whenever the balance in an individual's Federally-administered individual security account is at least equal to the minimum deposit amount, such individual shall be eligible to designate a privately-administered individual security account (established and maintained on such individual's behalf) to serve as such individual's individual security account under this part, in lieu of such individual's Federally-administered individual security account.</text></paragraph> 
<paragraph id="H82D035A9D06B4309A56E53126EF71FC7"><enum>(2)</enum><header>Effect of designation</header><text>If an individual makes a designation under paragraph (1)—</text> 
<subparagraph id="HA73CA395C2AF4BD8AF764170BEBAB1"><enum>(A)</enum><text>the entire balance in the individual's Federally-administered individual security account shall be promptly transferred to the privately-administered individual security account specified by such individual in such designation; and</text></subparagraph> 
<subparagraph id="H32992D658FE84B2985FF85B1E800BDC0"><enum>(B)</enum><text>that privately-administered individual security account shall, for all purposes, be treated as the electing individual's individual security account, subject to paragraph (4).</text></subparagraph></paragraph> 
<paragraph id="HF3AB709B935C4DB4BF61E20699455D7D"><enum>(3)</enum><header>Regulatory management of private investment</header><text>A designation under this subsection shall not be effective unless it is made in such time, form, and manner as the Individual Security Fund Board prescribes. The Individual Security Fund Board shall—</text> 
<subparagraph id="H761316B134D14321B0AE02A014068BC2" display-inline="no-display-inline"><enum>(A)</enum><text>maintain individual account records, and</text></subparagraph> 
<subparagraph id="H5024D667BC0B4420BC2265C3B1E76B1"><enum>(B)</enum><text>combine account transactions with certified institutions maintaining privately-administered individual security accounts in aggregate amounts, </text></subparagraph><continuation-text continuation-text-level="paragraph">in the same manner as is applicable with respect to records and account transactions with respect to Federally administered individual security accounts.</continuation-text></paragraph> 
<paragraph id="H46299880A09E4FE085BB8BE29DA71F64"><enum>(4)</enum><header>Subsequent designations</header><text>The Individual Security Fund Board shall provide by regulation opportunity for subsequent designation, from time to time, of another individual security account in lieu of the account previously designated under this section, subject to the following:</text> 
<subparagraph id="H2D290E4704614945A9EFD2E6053F46E8"><enum>(A)</enum><header>Options available</header><text>The account designated under this paragraph may be either within—</text> 
<clause id="H249C1C11E28C409BB2BC427C5E7742A2"><enum>(i)</enum><text>another certified institution, subject to subparagraph (B); or</text></clause> 
<clause id="H66775D7D61474C7F81FBA5E62CAC0075"><enum>(ii)</enum><text>the Individual Security Fund.</text></clause></subparagraph> 
<subparagraph id="HB80C028EAE994C8EB35DE526B869C00"><enum>(B)</enum><header>Minimum balance</header><text>In order to make a designation referred to in subparagraph (A)(i), the balance in the individual's individual security account must be at least equal to the minimum deposit amount. No minimum balance requirement under this subparagraph shall apply in the case of a designation referred to in subparagraph (A)(ii).</text></subparagraph> 
<subparagraph id="H41914985FDB84D31A7C2E2EA33B43AA"><enum>(C)</enum><header>Only 1 account permitted at any time</header><text>An individual may not, at any time, concurrently maintain—</text> 
<clause id="HCE3C56A0DD5E4EFAAB54429C2B4054DD"><enum>(i)</enum><text>a privately-administered individual security account with each of 2 or more certified institutions; or</text></clause> 
<clause id="HA92D58B867644D7194EA6BF5A3F1532"><enum>(ii)</enum><text>a privately-administered and a Federally-administered individual security account.</text></clause></subparagraph> 
<subparagraph id="HC59E1247875045DAAC8DBFE0C4ACC7F6"><enum>(D)</enum><header>Effect</header><text>A designation under this paragraph has (with respect to the individual's respective accounts, before and after such designation) the same effect as results following a designation under paragraph (2) (with respect to the Federally-administered and privately-administered accounts involved).</text></subparagraph></paragraph></subsection></section> 
<section id="H4F84BECAE3F14BDA83A2652332C5006B"><enum>253.</enum><header>Distributions from individual security accounts</header> 
<subsection id="H710F8486FB4E4673BCF42E9D4BE9153B" display-inline="yes-display-inline"><enum>(a)</enum><header>Date of Earliest Distribution</header><text>Except as provided in subsection (c), distributions may not be made from the Federally-administered or privately-administered individual security account of an eligible individual (as the case may be) before the earlier of—</text> 
<paragraph id="HF57364A1E03F4F029578B61F2203BB9"><enum>(1)</enum><text>the date the eligible individual attains normal retirement age, as determined under section 216 (or early retirement age, as so determined, if elected by such individual), or</text></paragraph> 
<paragraph id="H17DF32EA6D124FE481CC249BDAD52327"><enum>(2)</enum><text>the date on which funds in the eligible individual's account are sufficient to provide a monthly payment over the life expectancy of the eligible individual (determined under reasonable actuarial assumptions) which, when added to the eligible individual's monthly benefit under part A (if any), is at least equal to an amount equal to <fraction>1/12</fraction> of 185 percent of the poverty line (as defined in section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>) as in effect on such date for an individual) and adjusted annually thereafter by the CPI increase percentage determined under section 215(i).</text></paragraph></subsection> 
<subsection id="HAA6E465125334D0CBE6F6ECE356EB35D"><enum>(b)</enum><header>Forms of Distribution</header> 
<paragraph id="H034ACC594E9044429FDE94C3C367AA02"><enum>(1)</enum><header>Required monthly payments</header><text>Except as provided in paragraph (2), beginning as of the date distributions begin to be made in accordance with subsection (a), the balance in the individual security account available to provide monthly payments not in excess of the amount described in subsection (a)(2) shall be paid, as elected by the account holder (in such form and manner as shall be prescribed in regulations of the Individual Security Fund Board or the Securities and Exchange Commission, as applicable), by means of the purchase of annuities or equal monthly payments over the life expectancy of the eligible individual (determined under reasonable actuarial assumptions) in accordance with requirements (which shall be provided in regulations of the Board or Commission, as applicable) similar to the requirements applicable to payments of benefits under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H7644985F4CCF4F0BBF5E3C4F17827FF5"><enum>(2)</enum><header>Payment of excess funds</header><text>To the extent funds remain in an eligible individual's Federally-administered or privately-administered individual security account (as the case may be) after the application of paragraph (1) and to the extent not inconsistent with the provisions of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, such funds shall be payable to the eligible individual in such manner and in such amounts as determined by the eligible individual.</text></paragraph></subsection> 
<subsection id="H56A7EC46DACE40998C2DF31F9409F79C"><enum>(c)</enum><header>Distribution in the event of death before the date of initial distribution</header><text>If the eligible individual dies before the date determined under subsection (a), the balance in such individual's individual security account shall be distributed to the individual's heirs under rules established by the Individual Security Fund Board or the Securities and Exchange Commission, as applicable.</text></subsection></section></subpart> 
<subpart id="H0C14751177D64278B69D44E4009DF872"><enum>2</enum><header>Individual security fund; individual security fund board</header> 
<section id="HD63E0111E63147768D07F1F768FDA5F9"><enum>261.</enum><header>Individual security fund</header><text display-inline="yes-display-inline">There shall be established and maintained in the Treasury of the United States an Individual Security Fund in the same manner as the Thrift Savings Fund under sections 8437 (excluding paragraphs (4) and (5) of subsection (c) thereof), 8438, and 8439 of title 5, United States Code.</text></section> 
<section id="HEEDA40200CE7407B873D664C04079467"><enum>262.</enum><header>Individual security fund board</header> 
<subsection id="HAC8CBAEC5CB2479F8F80ECE441D0070" display-inline="yes-display-inline"><enum>(a)</enum><header>Establishment</header><text>There shall be established and maintained in the Social Security Administration an Individual Security Fund Board in the same manner as the Federal Retirement Thrift Investment Board under subchapter VII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code.</text></subsection> 
<subsection id="HD9C6149A16F14DBBBDC84C544D4FA7DF"><enum>(b)</enum><header>Specific investment and reporting duties</header><text>The Individual Security Fund Board shall manage and report on the activities of the Individual Security Fund and on Federally-administered individual security accounts in the same manner as the Federal Retirement Thrift Investment Board manages and reports on the Thrift Savings Fund and the individual accounts of such Fund under subchapter VII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code.</text></subsection> 
<subsection id="H823D7BF0A68A402982BC7E1D13FFCBC3"><enum>(c)</enum><header>Budgetary treatment of individual security fund and accounts</header><text>The receipts and disbursements of the Individual Security Fund and any accounts within such Fund shall not be included in the totals of the budget of the United States Government as submitted by the President or of the congressional budget and shall be exempt from any general budget limitation imposed by statute on expenditures and net lending (budget outlays) of the United States Government.</text></subsection> 
<subsection id="HB74837D2052643CD86FB4B5D35BA853"><enum>(d)</enum><header>Executive Director</header><text>The Board shall appoint an Executive Director, without regard to the provisions of law governing appointments in the competitive service. The Executive Director shall receive the same compensation, and shall have, with respect to the Individual Security Fund and accounts within such Fund, the same duties and responsibilities, as does the Executive Director (appointed under <external-xref legal-doc="usc" parsable-cite="usc/5/8474">section 8474(a)</external-xref> of title 5, United States Code) with respect to the Thrift Savings Fund and accounts within such Fund.</text></subsection></section></subpart> 
<subpart id="H8D7356D7016B4E248201337F46AEDE12"><enum>3</enum><header>Certified institutions</header> 
<section id="HA533E1C841474906B0D1FEDEE0FCBC97"><enum>271.</enum><header>Certification of institutions by securities and exchange commission</header> 
<subsection id="H1303A81B1E934095A2A051BC8CCA8C85" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text>For purposes of this part, any institution that is engaged, in a fiduciary capacity, in the business of maintaining accounts for individuals for purposes of investment may apply to the Securities and Exchange Commission (in such form and manner as the Commission shall by regulation require) for certification under this subpart.</text></subsection> 
<subsection id="H1BA8EE426C494427994343C027003FD3"><enum>(b)</enum><header>Review requirements</header><text>In reviewing any application for certification under this subpart and determining whether to approve the application for certification, the Commission shall consider the following factors:</text> 
<paragraph id="H4B91901B727E4141ADEB41ABF3617FF9"><enum>(1)</enum><text>The financial history and condition of the institution.</text></paragraph> 
<paragraph id="H5E6FF9FA884943D2B6A9EC94CD808C41"><enum>(2)</enum><text>The adequacy of the institution's capital structure.</text></paragraph> 
<paragraph id="H677575C0EE0F4A06956D6FFCD2FAF7AB"><enum>(3)</enum><text>The future earnings prospects of the institution.</text></paragraph> 
<paragraph id="H7EB651D057B44D9FB58F696863253DA"><enum>(4)</enum><text>The general character and fitness of the management of the institution.</text></paragraph> 
<paragraph id="H248CAF89354F401EAE276572AC1FF163"><enum>(5)</enum><text>The convenience and needs of individuals who are account holders with respect to personal retirement accounts for which the institution is to serve as trustee.</text></paragraph> 
<paragraph id="H99C527C4B17A4A09893557CDE8142DE7"><enum>(6)</enum><text>Whether the institution's corporate powers are consistent with the purposes of this part.</text></paragraph> 
<paragraph id="H4AA7CB52A6B54FCF9F740017B71286ED"><enum>(7)</enum><text>The institution's disclosure policies, including with respect to its administrative fees, investment policies, and investment activities.</text></paragraph> 
<paragraph id="H2085A67AD95B451B882CE89FCFF193A2"><enum>(8)</enum><text>The appropriateness of—</text> 
<subparagraph id="H62DE14650AFF4450A469F895158B01C5"><enum>(A)</enum><text>the fund or funds that such institution proposes to offer for purposes of this part, and</text></subparagraph> 
<subparagraph id="H845BC8EC003B4063BBF443673B81F83"><enum>(B)</enum><text>the criteria by which such institution will make future decisions regarding the selection of new funds or the making of any other modifications in the investment options offered by such institution for purposes of this part, as determined based on guidelines established by the Commission for purposes of this paragraph.</text></subparagraph></paragraph></subsection> 
<subsection id="H04714EAF0AFD4A25BC8DAB264820292"><enum>(c)</enum><header>Notice of denial of application for certification</header><text>If the Commission votes to deny any application for certification by any institution, the Commission shall promptly notify the institution of the denial of such application, giving specific reasons in writing for the Commission's determination with reference to the factors described in subsection (b).</text></subsection> 
<subsection id="HDCE08CAF3C774E95843B1EF31FF3722E"><enum>(d)</enum><header>Nondelegation requirement</header><text>The authority of the Commission to make any determination to deny any application under this section may not be delegated by the Commission.</text></subsection></section> 
<section id="H6FDE5EAB00A8489E82527502D8B04CCB"><enum>272.</enum><header>Revocation of certification</header> 
<subsection id="H8D978B42DFA44F66B5CF9015DEFBCE94" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text>The Securities and Exchange Commission shall prescribe regulations in accordance with which the certified status of an institution may be voluntarily or involuntarily revoked.</text></subsection> 
<subsection id="H14F6C096923043A6A54C0056DCDEC267"><enum>(b)</enum><header>Judicial review</header><text>Any party to any involuntary revocation proceeding under this section to which an institution is a party may obtain a review of any order served pursuant to this section by the filing in the court of appeals of the United States for the circuit in which the home office of the institution is located, or in the United States Court of Appeals for the District of Columbia Circuit, within 30 days after the date of service of such order, a written petition praying that the order of the Commission be modified, terminated, or set aside. A copy of such petition shall be forthwith transmitted by the clerk of the court to the Commission, and thereupon the Commission shall file in the court the record in the proceeding, as provided in <external-xref legal-doc="usc" parsable-cite="usc/28/2112">section 2112</external-xref> of title 28, United States Code. Upon the filing of such petition, such court shall have jurisdiction, which upon the filing of the record shall be exclusive, to affirm, modify, terminate, or set aside, in whole or in part, the order of the Commission. Review of such proceedings shall be had as provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code. The judgment and decree of the court shall be final, except that the judgment and decree shall be subject to review by the Supreme Court upon certiorari, as provided in <external-xref legal-doc="usc" parsable-cite="usc/28/1254">section 1254</external-xref> of title 28, United States Code. The commencement of proceedings for judicial review under this subsection shall not, unless specifically ordered by the court, operate as a stay of any order issued by the Commission.</text></subsection></section> 
<section id="H7E318CF909004BF5AC7E305059B5FEB1"><enum>273.</enum><header>Fiduciary duties</header> 
<subsection id="H14059FB3900848FDB549F77400F41653" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text>In the case of a privately-administered individual security account which does not form part of an individual account plan covered under part 4 of subtitle B of title I of the Employee Retirement Income Security Act of 1974, rules similar to the rules of such part 4 applicable to individual account plans covered under such part 4 shall apply with respect to a privately-administered individual security account and the terms of any arrangement under which such account is maintained.</text></subsection> 
<subsection id="H69CEC4C1D8444452949DFBA953BE5288"><enum>(b)</enum><header>General requirements</header><text>In applying under subsection (a) the rules of part 4 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 in the case of a privately-administered individual security account, references in such part to the Secretary of Labor shall be deemed to be references to the Securities and Exchange Commission, references in such part to a participants or beneficiary in connection with an individual account plan covered under such part shall be deemed to be references to the account holder with respect to the privately-administered individual security account, and references in such part to the plan administrator or plan sponsor in connection with an individual account plan covered under such part shall be deemed to be references to the trustee of the privately-administered individual security account.</text></subsection> 
<subsection id="HBF005B71A7E84FA29EDE9DA875642E73"><enum>(c)</enum><header>Limitation on liability</header><text>Any account holder who issues an instruction to the trustee of the account directing an investment of funds held in the account shall sign an acknowledgement prescribed by the Securities and Exchange Commission which states that the account holder understands that an investment of any amount in the account is made at the account holder's risk, that the account holder is not protected by the Government or by the trustee against any loss on such investment, and that a return on such investment is not guaranteed by the Government or by the trustee. Notwithstanding the preceding provisions of this section and any other provision of Federal or State law, the trustee of a privately-administered individual security account shall not be liable for losses suffered in connection with any investment of assets held in the account unless it is shown by clear and convincing evidence that the trustee did not act in the manner in which a reasonable trustee would act under the circumstances then prevailing in evaluating the risk and reward properties of the investment option involved.</text></subsection></section></subpart> 
<subpart id="HEA22104047BE403880EA7475578030AB"><enum>4</enum><header>Enforcement</header> 
<section id="H686DD3E9998B48F689DEFA22E0BD47F0"><enum>281.</enum><header>Cause of action</header><text display-inline="yes-display-inline">The account holder with respect to a privately-administered individual security account who is adversely affected by an act or practice of any party (other than the Securities and Exchange Commission, the Social Security Administration, the Department of the Treasury, or any officer or employee of any of the foregoing) in violation of any provision of this part, may bring an action—</text> 
<paragraph id="H6017CEBD931E4496949C68F8316D567F"><enum>(1)</enum><text>to enjoin such act or practice, or</text></paragraph> 
<paragraph id="HEB9B0E6B672C449DB830C8B3D4C2BF2"><enum>(2)</enum><text>to obtain other appropriate equitable relief (A) to redress such violation or (B) to enforce such provision.</text></paragraph></section> 
<section id="HFB51BDF90F1047A28158B0FFE5F744A6"><enum>282.</enum><header>Jurisdiction and venue</header><text display-inline="yes-display-inline">Civil actions under this subpart may be brought in the district courts of the United States in the district where the privately-administered individual security account is administered, where the violation took place, or where a defendant resides or may be found, and process may be served in any district where a defendant resides or may be found. The district courts of the United State shall have jurisdiction, without regard to the amount in controversy or the citizenship of the parties, to grant the relief provided for in section 281 in any action.</text></section> 
<section id="HAA82CC9AF2934B58BF3057541DF5878E"><enum>283.</enum><header>Right of securities and exchange commission to intervene</header><text display-inline="yes-display-inline">A copy of the complaint or notice of appeal in any action under this subpart shall be served upon the Securities and Exchange Commission by certified mail. The Commission shall each have the right to intervene in any action.</text></section> 
<section id="HFBFF378D8CE7485D008B6172E5A14768"><enum>284.</enum><header>Awards of costs and expenses</header><text display-inline="yes-display-inline">In any action brought under this subpart, the court in its discretion may award all or a portion of the costs and expenses incurred in connection with such action, including reasonable attorney's fees, to any party who prevails or substantially prevails in such action.</text></section> 
<section id="H82D4EF98CF5B462791A182DE95435F00"><enum>285.</enum><header>Limitation on actions</header> 
<subsection id="H5CA63032392B4D84B62335457E75C3ED" display-inline="yes-display-inline"><enum>(a)</enum><header>In General</header><text>Except as provided in subsection (c), an action under this subpart may not be brought after the later of—</text> 
<paragraph id="H92E0279D0A944CCD929E2CDF19F51D87"><enum>(1)</enum><text>6 years after the date on which the cause of action arose, or</text></paragraph> 
<paragraph id="HF71FEA4947334347BDDD118C4C5236AF"><enum>(2)</enum><text>3 years after the applicable date specified in subsection (b).</text></paragraph></subsection> 
<subsection id="HACB0BC451E5B43488FA04E5992376DC"><enum>(b)</enum><header>Applicable date</header><text>The applicable date specified in this subsection is the earliest date on which the plaintiff acquired or should have acquired actual knowledge of the existence of such cause of action.</text></subsection> 
<subsection id="HC03A1F0181484F2E9F62B513741E1F7C"><enum>(c)</enum><header>Cases of fraud or concealment</header><text>In the case of fraud or concealment, the period described in subsection (a)(2) shall be extended to 6 years after the applicable date specified in subsection (b).</text></subsection></section> 
<section id="H5045746FDDF4462586AC6C0903D7F5B6"><enum>286.</enum><header>Penalty for failure to timely provide required information</header><text display-inline="yes-display-inline">The Securities and Exchange Commission may assess a penalty, payable to it, against any person who fails to provide any notice or other material information required under this part or any regulations prescribed under this part within the applicable time limit specified therein. Such penalty shall not exceed $1,000 for each day for which such failure continues.</text></section> 
<section id="H08BE6AA98710467BB182656B98C6DE6"><enum>287.</enum><header>Actions by securities and exchange commission</header><text display-inline="yes-display-inline">If any person is assessed under this subpart and fails to pay the assessment when due, or any person otherwise fails to meet any requirement of this part, the Securities and Exchange Commission may bring a civil action in any district court of the United States within the jurisdiction of which such person's assets are located or in which such person resides or is found for the recovery of the amount of the assessment or for appropriate equitable relief to redress the violation or enforce the provisions of this part, and process may be served in any other district. The district courts of the United States shall have jurisdiction over actions brought under this section by the Commission without regard to the amount in controversy.</text></section> 
<section id="H1EB6D9FD14DC4CC09DF1A1B554F015DE"><enum>288.</enum><header>Criminal penalty for fraud or intentional misrepresentation in connection with investment options</header><text display-inline="yes-display-inline">Any person who makes, or causes to be made, a statement or representation of a material fact for use in selecting an investment option that the person knows or should know is false or misleading or knows or should know omits a material fact or makes such a statement with knowing disregard for the truth shall upon conviction be fined not more than $500,000 or imprisoned for not more than 5 years, or both.</text></section></subpart></part><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H751C51C21AC24FBBBF21D3CAEA23F3E"><enum>(2)</enum><header>Authorization for funding of initial costs</header><text>There are authorized to be appropriated to the Individual Security Fund Board, for each of fiscal years 2006 and 2007, such sums as may be necessary to pay for the expenses incurred during such fiscal year in the administration of part B of title II of the Social Security Act during such fiscal year.</text></paragraph></subsection> 
<subsection id="HC9B43810B8154033A18B5C23474BFCC"><enum>(b)</enum><header>Modification of FICA Rates</header> 
<paragraph id="H6C19BA1C264C44E8AC00655D30120276"><enum>(1)</enum><header>Employees</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/3101">Section 3101(a)</external-xref> of the Internal Revenue Code of 1986 (relating to tax on employees) is amended to read as follows:</text>

<subparagraph id="HC0888C686A28452E83DCCFF4BA12AC97"><enum>(B)</enum><header>Individuals covered under part B of title II of the Social Security Act</header> 
<clause id="H051942769A0C4AE199003FBA1799CC4B"><enum>(i)</enum><header>In general</header><text>In addition to other taxes, there is hereby imposed on the income of every part B eligible individual a tax equal to the applicable percentage of the wages received by such individual with respect to employment.</text></clause> 
<clause id="H8CA59868971744708131E4FA3C00DCB8"><enum>(ii)</enum><header>Applicable percentage</header><text>For purposes of clause (i), the term <term>applicable percentage</term> means the excess of 6.2 percent, over</text> 
<subclause id="H9C1C0286F75E4ADEBF69AE62EABF53B"><enum>(I)</enum><text>3 percent, in the case of the first $10,000 of such wages received in the calendar year, and</text></subclause> 
<subclause id="H228CC9A995D641EA82A9B8798DA1A5AA"><enum>(II)</enum><text>2 percent, in the case of any additional such wages received in the calendar year.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HB6BD274F169048EFA838DF048502BAC0"><enum>(2)</enum><header>Contribution of OASDI tax reduction to individual security accounts</header><text>In addition to other taxes, there is hereby imposed on the income of every part B eligible individual for the calendar year an individual security account contribution equal to the sum of—</text> 
<subparagraph id="H4FA36A70F5DD43EDB6347DF1B9788E00"><enum>(A)</enum><text>3 percent of so much of the wages as does not exceed the first $10,000 received in such calendar year by such individual with respect to employment,</text></subparagraph> 
<subparagraph id="H2FF9C1DBC4D44411A295CF60CC29FA66"><enum>(B)</enum><text>2 percent of the excess of—</text>

<subparagraph id="H6D58FEF27F8340028DB6098D344F00D2"><enum>(C)</enum><text>so much of such wages (not to exceed $5,000) as is designated by the individual in the same manner as described in section 251(d) of the Social Security Act.</text></subparagraph></paragraph> 
<paragraph id="H2851C9CF75A24DDB9DC75B4E749F2975"><enum>(3)</enum><header>Inflation adjustments</header> 
<subparagraph id="HEB78958BB97C4518B803618681A85190"><enum>(A)</enum><header>In general</header><text>In the case of any calendar year beginning after 2006, the $10,000 amount in paragraphs (1) and (2) shall be increased by an amount equal to—</text>

<subparagraph id="H3EA95CD0DE8A4F43A18FD42F0923FE6C"><enum>(B)</enum><header>Designated contributions</header><text>In the case of any calendar year beginning after 2006, the $5,000 amount in paragraph (2)(C) shall be increased by an amount equal to—</text>

<clause id="H540654BDF51C40C480F9EE2D620874F9"><enum>(ii)</enum><text>the percentage increase (if any) for such year determined under section 215(i) of the Social Security Act.</text></clause></subparagraph> 
<subparagraph id="H10D8AE31B8ED402FAE152F2B884EC0DD"><enum>(C)</enum><header>Rounding</header><text>If any dollar amount after being increased under subparagraph (A) or (B) is not a multiple of $10, such dollar amount shall be rounded to the nearest multiple of $10.</text></subparagraph></paragraph> 
<paragraph id="HF7AB3F31D5F94591A77C60DF27EC8403"><enum>(4)</enum><header>Definitions</header><text>For purposes of this subsection—</text> 
<subparagraph id="H7551419DA9964FAC9DDFD928BE6B0526"><enum>(A)</enum><header>Wages</header><text>The term <term>wages</term> shall have the meaning given to such term by section 3121(a).</text></subparagraph> 
<subparagraph id="HDC91C6302DBC4D48BFD180641CB7F03B"><enum>(B)</enum><header>Employment</header><text>The term <term>employment</term> shall have the meaning given to such term by section 3121(b).</text></subparagraph> 
<subparagraph id="HD3A5D71BE1D044C9931E95BAC6266DF4"><enum>(C)</enum><header>Wage increase percentage</header><text>The term <term>wage increase percentage</term>, with respect to a calendar year, means the percentage increase which would become effective under section 215(i)(2) of the Social Security Act for such year if such increase were determined as described in section 215(i)(5)(A)(i) of such Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H02CF25A23960463C8C2DEB47F84D133"><enum>(2)</enum><header>Self-employed</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/1401">Section 1401(a)</external-xref> of the Internal Revenue Code of 1986 (relating to tax on self-employment income) is amended to read as follows:</text>

<subparagraph id="HF69296BCB76C48E7B219BD2B67723B86"><enum>(A)</enum><header>Individuals covered under part A of the Social Security Act</header><text>In addition to other taxes, there shall be imposed for each taxable year, on the self-employment income of every individual who is not a part B eligible individual for the calendar year ending with or during such taxable year, a tax equal to 12.40 percent of the amount of the self-employment income for such taxable year.</text></subparagraph> 
<subparagraph id="H60A8CA2A299B422DBEBC8D7330E07544"><enum>(B)</enum><header>Individuals covered under part B of title II of the Social Security Act</header> 
<clause id="H71E4A2BC40BB46D692D07B20204B34C8"><enum>(i)</enum><header>In general</header><text>In addition to other taxes, there is hereby imposed for each taxable year, on the self-employment income of every part B eligible individual, a tax equal to the applicable percentage of the amount of the self-employment income for such taxable year.</text></clause> 
<clause id="H1BED986AA7AE4683A9946CDE3F40001F"><enum>(ii)</enum><header>Applicable percentage</header><text>For purposes of clause (i), the term <term>applicable percentage</term> means the excess of 12.4 percent, over</text> 
<subclause id="H2E4FA3F527B64DABA2603408D704B770"><enum>(I)</enum><text>3 percent, in the case of the first $10,000 of self-employment income received in the calendar year, and</text></subclause> 
<subclause id="H81D930CAC8424119BE5070EB919EFA27"><enum>(II)</enum><text>2 percent, in the case of any additional self-employment income received in the calendar year.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H80C78D782F9F4236A2C8E8BC80776718"><enum>(2)</enum><header>Contribution of OASDI tax reduction to individual security accounts</header><text>In addition to other taxes, there is hereby imposed for each taxable year, on the self-employment income of every part B eligible individual for the calendar year, an individual security account contribution equal to the sum of—</text> 
<subparagraph id="H4B903B4098AA4AB1ABEB63BEFFE550B0"><enum>(A)</enum><text>3 percent of self-employment income as does not exceed the first $10,000 of such income derived during the taxable year by such individual,</text></subparagraph> 
<subparagraph id="H101CD3899B9E4ECFAE084724E9844096"><enum>(B)</enum><text>2 percent of self-employment income in the case of any additional self-employment income derived by such individual during the taxable year, and</text></subparagraph> 
<subparagraph id="HCF71F050F5B345CAA817CD8DF25EB177"><enum>(C)</enum><text>so much of such self-employment income (not to exceed $5,000) as is designated by the individual in the same manner as described in section 251(d) of the Social Security Act.</text></subparagraph></paragraph> 
<paragraph id="H8A18400BF65344EF9E75A9D0000004B"><enum>(3)</enum><header>Inflation adjustments</header> 
<subparagraph id="HF4AD0E657CEE49D0829481D6A41DF900"><enum>(A)</enum><header>In general</header><text>In the case of any calendar year beginning after 2006, the $10,000 amount in paragraphs (1) and (2) shall be increased by an amount equal to—</text>

<subparagraph id="HB955253EE6A34099848DE21D126FBD99"><enum>(B)</enum><header>Designated contributions</header><text>In the case of any calendar year beginning after 2006, the $5,000 amount in paragraph (2)(C) shall be increased by an amount equal to—</text>

<paragraph id="H53D8D875041740EF00B005B1D873BE4C"><enum>(4)</enum><header>Definition</header><text>For purposes of this subsection, the term <term>wage increase percentage</term>, with respect to a calendar year, means the percentage increase which would become effective under section 215(i)(2) of the Social Security Act in such year if such increase were determined as described in section 215(i)(5)(A)(i) of such Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="HEF9311DBFAF74AD19F2E00F510FBFD3"><enum>(2)</enum><text>50 percent of the designated wages of such individual for the taxable year,</text></paragraph> 
<paragraph id="H7B7496D6D3AD4D508700A74C98E7DBFF"><enum>(3)</enum><text>50 percent of the designated self-employment income of such individual for the taxable year, plus</text></paragraph> 
<paragraph id="HD56D42E303A042FFB5283524EF627100"><enum>(4)</enum><text>50 percent of the designated earned income credit. </text></paragraph></subsection> 
<subsection id="H6E4B8DF571824BAFA0BB009D60ADC8B7"><enum>(b)</enum><header>Limitations</header> 
<paragraph id="H8AD7C3FB314941A791B7A4CE1F455188"><enum>(1)</enum><header>Amount</header><text>The amount determined under paragraphs (2) and (3) of subsection (a) with respect to such individual for any taxable year may not exceed the excess (if any) of—</text> 
<subparagraph id="H38171CB95F244F79B4D87BED4C66F912"><enum>(A)</enum><text>$600, over</text></subparagraph> 
<subparagraph id="H6ED0CE576C5C430DBC96A7C4924BF3C0"><enum>(B)</enum><text>the sum of the amounts received by the Secretary on behalf of such individual under subparagraphs (A) and (B) of section 3101(a)(2) and subparagraphs (A) and (B) of 1401(a)(2) for the taxable year.</text></subparagraph></paragraph> 
<paragraph id="H6B7F35E061F24FD3A5691F24D15FCE46"><enum>(2)</enum><header>Failure to make voluntary contributions</header><text>In the case of a part B eligible individual with respect to whom the amount of wages designated under section 3101(a)(2)(C) plus the amount self-employment income designated under section 1401(a)(2)(C) for the taxable year is zero, the credit to which such individual is entitled under this section shall be equal to zero.</text></paragraph></subsection> 
<subsection id="HFA466763F692494FADDB9506FFBFE8D"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="HDD20881FE2914C198E9ECCFDA63EB886"><enum>(1)</enum><header>Part B eligible individual</header><text>The term <term>part B eligible individual</term> means, for any calendar year, an individual who is an eligible individual (as defined in section 251(a)(2) of the Social Security Act) for such calendar year.</text></paragraph> 
<paragraph id="H5643DF63B77F4C4E9E0038ABA4E64456"><enum>(2)</enum><header>Designated wages</header><text>The term <term>designated wages</term> means with respect to any taxable year the amount designated under section 3101(a)(2)(C).</text></paragraph> 
<paragraph id="H055FAA56EE84417786E545892240FACB"><enum>(3)</enum><header>Designated self-employment income</header><text>The term <term>designated self-employment income</term> means with respect to any taxable year the amount designated under section 1401(a)(2)(C) for such taxable year.</text></paragraph> 
<paragraph id="HF352C2C0A54E4D90A6513244B8E77F0"><enum>(4)</enum><header>Designated earned income credit</header><text>The term <term>designated earned income credit</term> means the amount of the credit allowed under section 32 for the taxable year that is designated by the part B eligible individual in the same manner as described in section 251(d) of the Social Security Act.</text></paragraph></subsection> 
<subsection id="H52FAE7E4950B4C86A2B081F1FCBB001C"><enum>(d)</enum><header>Credit Used Only for Individual Security Account</header><text>For purposes of this title, the credit allowed under this section with respect to any part B eligible individual—</text> 
<paragraph id="H120A6F6A56834AC7B1A849EA5451E889"><enum>(1)</enum><text>shall not be treated as a credit allowed under this part, but</text></paragraph> 
<paragraph id="H58AC636B77EE49ACA77C871BF2065FC"><enum>(2)</enum><text>shall be treated as an overpayment of tax under section 6401(b)(3) which may, in accordance with section 6402(l), only be transferred to an individual security account established under part B of title II of the Social Security Act with respect to such individual.</text></paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC8A89A4E159C4A8B99F6F63715FE04E"><enum>(2)</enum><header>Contribution of EITC amounts to individual security accounts</header><text>Section 32 of such Code (relating to earned income) is amended by adding at the end the following new subsection:</text>

<paragraph id="HD8FD7F9A81A940299F04B9D000CDBFBF"><enum>(1)</enum><header>In general</header><text>An eligible part B individual who is allowed a credit under this section may designate all or a portion of such credit as a contribution to the individual security account established on behalf of such individual.</text></paragraph> 
<paragraph id="H058DC6F92F564CC19706A480F966C9CE"><enum>(2)</enum><header>Credit used only for individual security account</header><text>For purposes of this title, the amount designated under paragraph (1) with respect to any part B individual—</text> 
<subparagraph id="H4D19AB149CA141989D641EBC847760DB"><enum>(A)</enum><text>shall not be treated as a credit allowed under this section, but</text></subparagraph> 
<subparagraph id="H3E75C2D95DF44A8D828E824564DADC5"><enum>(B)</enum><text>shall be treated as an overpayment of tax under section 6401(b)(3) which may, in accordance with section 6402(l), only be transferred to an individual security account established under part B of title II of the Social Security Act with respect to such individual.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD301AE45F5474D3C836FE4B75CE53C7B"><enum>(3)</enum><header>Contribution of credited amounts to individual security account</header> 
<subparagraph id="H04D88A49BB614A64B9E7D1201D92B8F9"><enum>(A)</enum><header>Credited amounts treated as overpayment of tax</header><text>Subsection (b) of section 6401 (relating to excessive credits) is amended by adding at the end the following new paragraph:</text>

<subparagraph id="H7DBD29B9BCF24241A27D39002CEC4372"><enum>(B)</enum><header>Section 32 designated earned income credit contribution</header><text>The amount of the earned income credit designated as a contribution to an individual security account under section 32(n) for the taxable year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H7E8622A85DF747888024D26416FD384"><enum>(B)</enum><header>Transfer of credit amount to individual security account</header><text>Section 6402 of such Code (relating to authority to make credits or refunds) is amended by adding at the end the following new subsection:</text>

<subsection id="HA7DE98A3F6D54F4BB9344F6E70977079"><enum>(l)</enum><header>Overpayments attributable to individual security account credit</header><text>In the case of any overpayment described in section 6401(b)(3) with respect to any individual, the Secretary shall transfer for crediting by the Commissioner of Social Security to the individual security account of an such individual, an amount equal to the amount of such overpayment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H672A407B7BF440749960178100A8F63C"><enum>(4)</enum><header>Notice to EITC recipients of matching contributions to individual security accounts</header><text>In connection with information and tax forms relating to the credit allowed under <external-xref legal-doc="usc" parsable-cite="usc/26/32">section 32</external-xref> of the Internal Revenue Code of 1986, the Secretary of the Treasury shall provide notice of the availability of matching contributions pursuant to section 54 of such Code (as added by subsection (a) of this section) to individual security accounts under part B of title II of the Social Security Act.</text></paragraph> 
<paragraph id="H68243BCB6C284C31B7086456674EDEA"><enum>(5)</enum><header>Conforming amendments</header> 
<subparagraph id="H3205FE464A78492AAB5501BF8E526E15"><enum>(A)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/31/1324">Section 1324(b)(2)</external-xref> of title 31, United States Code, is amended by inserting before the period at the end <quote>, or enacted by the <short-title>Bipartisan Retirement Security Act of 2005</short-title></quote>.</text></subparagraph> 
<subparagraph id="HE0DDD5D376784C939165564DB8EB99FF"><enum>(B)</enum><text>The table of subparts for part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new item: </text>

<section id="HD76FE5C07B4A45E3AEF3A71DFB8C3B1"><enum>530A.</enum><header>Individual Security Fund and Federally-administered individual security accounts</header><text display-inline="no-display-inline">The Individual Security Fund established under section 261 of the <act-name parsable-cite="SSA">Social Security Act</act-name> shall be exempt from taxation under this subtitle.</text></section> 
<section id="H919947A4F4994596A7593C9DB1C0D383"><enum>530B.</enum><header>Individual security accounts</header> 
<subsection id="HB706047B2A384E068FCBEE7064E6ABB9"><enum>(a)</enum><header>In general</header><text>For purposes of this section, the term <term>individual security account</term> means a Federally-administered individual security account and a privately-administered security account.</text></subsection> 
<subsection id="H8CDB4C31CFD544E69361DAD4CFB62314"><enum>(b)</enum><header>Individual security accounts defined</header><text>For purposes of subsection (a)—</text> 
<paragraph id="H1457CBCCC4724F9FA09140C20458F688"><enum>(1)</enum><header>Federally-administered security account</header><text>The term <term>Federally-administered individual security account</term> means the account established under section 251 of the <act-name parsable-cite="SSA">Social Security Act</act-name>.</text></paragraph> 
<paragraph id="HD456C09858DE4191BC80B28429ADFF8E"><enum>(2)</enum><header>Privately-administered security account</header><text>The term <term>privately-administered individual security account</term> means a trust created or organized in the United States exclusively for the benefit of an individual or his beneficiaries, but only if the written governing instrument creating the trust meets the following requirements:</text> 
<subparagraph id="H0F1AF145DF284908ABF1419F3B1FB10"><enum>(A)</enum><text>Except in the case of rollover contributions from another individual security account of such individual—</text> 
<clause id="H858BEB926AAA4E8086791BC0708FAAC9"><enum>(i)</enum><text>no contribution will be accepted unless it is in cash,</text></clause> 
<clause id="H853D57DEB5B04367B55272E5E313019"><enum>(ii)</enum><text>contributions will not be accepted for the taxable year in excess of the sum of—</text> 
<subclause id="H5C18D453F0C645FA8E8D902DAA00CB14"><enum>(I)</enum><text>the amounts collected with respect to such beneficiary under sections 3101(a)(2) and 1401(a)(2), and</text></subclause> 
<subclause id="H3C0C71B3740F44C5AEAE783117C3A837"><enum>(II)</enum><text>the amounts transferred to such account under section 6402(l), and</text></subclause></clause> 
<clause id="H989D91C811C24508B3CA67E755A7ED1"><enum>(iii)</enum><text>any contributions with respect to an account holder which are not accepted pursuant to this paragraph are promptly refunded directly to the account holder.</text></clause></subparagraph> 
<subparagraph id="H424A767D657748E095B53251EE111D2C"><enum>(B)</enum><text>The trustee is an institution which is certified under subpart 3 of part B of title II of the <act-name parsable-cite="SSA">Social Security Act</act-name>.</text></subparagraph> 
<subparagraph id="HDDDF26848FE64309B69DA4669C93BA34"><enum>(C)</enum><text>No part of the trust funds will be invested in life insurance contracts.</text></subparagraph> 
<subparagraph id="H56818DEF65DA4BA2AD137EBCF8148FFB"><enum>(D)</enum><text>The interest of an individual in the balance in his account is nonforfeitable.</text></subparagraph> 
<subparagraph id="H865BB6A869584810A1694011D92E6314"><enum>(E)</enum><text>The assets of the trust will not be commingled with other property except in a common trust fund or common investment fund.</text></subparagraph></paragraph></subsection> 
<subsection id="HB435D58F8FBF48219E2755F91CF86EEB"><enum>(c)</enum><header>Contributions</header> 
<paragraph id="H2B61A3F7DA78484783B116FD9B75BC30"><enum>(1)</enum><header>In general</header><text>No deduction shall be allowed for contributions credited to an individual security account under part B of title II of the <act-name parsable-cite="SSA">Social Security Act</act-name> or amounts transferred to such account under section 6402(l).</text></paragraph> 
<paragraph id="H43C167676C4F45048C3921009D69C229"><enum>(2)</enum><header>Rollovers</header> 
<subparagraph id="H465A8ADF14434A1CB00728C27BBC1A4"><enum>(A)</enum><header>Rollover from privately-administered individual security account</header><text>The entire balance of an individual security account of the account holder may be rolled over to another individual security account of the account holder.</text></subparagraph> 
<subparagraph id="H3C0196D08A7743CE8EE6E2588DA445A3"><enum>(B)</enum><header>Rollover of inheritance</header><text>Any portion of a distribution to an heir from an individual security account made by reason of the death of the beneficiary of such account may be rolled over to the individual security account of the heir. </text></subparagraph></paragraph></subsection> 
<subsection id="H0203B35C28C74E2796D73EA481F2E06B"><enum>(d)</enum><header>Tax treatment of accounts</header> 
<paragraph id="HF8898F1114244357A35C5FE72831F6D6"><enum>(1)</enum><header>Exemption from tax</header><text>An individual security account is exempt from taxation under this subtitle unless such account has ceased to be an individual security account by reason of paragraph (2). Notwithstanding the preceding sentence, any such account is subject to the taxes imposed by section 511 (relating to imposition of tax on unrelated business income of charitable, etc. organizations).</text></paragraph> 
<paragraph id="H464FC29AF2424B2392EE41AEDDBF292"><enum>(2)</enum><header>Account terminations</header><text>Rules similar to the rules of paragraphs (2) and (4) of section 408(e) shall apply to privately-administered individual security accounts, and any amount treated as distributed under such rules shall be includible in gross income and shall not be treated as a social security benefit for purposes of section 86.</text></paragraph> 
<paragraph id="H30A9AE1B25D54C69BD141C008B6479A5"><enum>(3)</enum><header>Rollover contribution</header><text>An amount is described in this paragraph as a rollover contribution if it meets the requirements of subparagraphs (A) and (B).</text> 
<subparagraph id="H59E9EDCF69E54A60A5A22EF635C008E"><enum>(A)</enum><header>In general</header><text>The requirements of this subparagraph are met with respect to an amount paid or distributed from an individual security account to the account holder only if the entire amount in such account is received by the account holder and is paid into another individual security account for the benefit of such holder not later than the 60th day after the day on which the holder receives the payment or distribution.</text></subparagraph> 
<subparagraph id="H03DF4093BCEB49078B9DEBD39C32A6AA"><enum>(B)</enum><header>Limitation</header><text>This paragraph shall not apply to any amount described in subparagraph (A) received by an individual from a privately-administered individual security account if, at any time during the 1-year period ending on the day of such receipt, such individual received on 3 other occasions any other amount described in subparagraph (A) from an individual security account which was not includible in the individual’s gross income because of the application of this paragraph.</text></subparagraph></paragraph></subsection> 
<subsection id="H76D5C34926D64D21B845C85D3700D786"><enum>(e)</enum><header>Distributions</header> 
<paragraph id="H604B42A2B5C54322B4905BDF56CF2C10"><enum>(1)</enum><header>In general</header><text>The portion of any distribution from an individual security account under section 253 of the <act-name parsable-cite="SSA">Social Security Act</act-name> which is attributable to amounts contributed to such account under section 3101(a)(2) (other than subparagraph (C) thereof) and section 1401(a)(2) (other than subparagraph (C) thereof), together with earnings thereon, shall be includible in gross income as a social security benefit for purposes of section 86.</text></paragraph> 
<paragraph id="HA17822D46E3D4C4988CF69097DAD729F"><enum>(2)</enum><header>Voluntary contributions</header><text>The portion of any distribution from an individual security account under section 253 of the <act-name parsable-cite="SSA">Social Security Act</act-name> which is attributable to amounts contributed to such account under section 3101(a)(2)(C), section 1401(a)(2)(C), and section 6402(l), together with earnings thereon, shall not be includible in gross income.</text></paragraph> 
<paragraph id="HC4E1CD71A96F4C35B5F12FC5209F51F"><enum>(3)</enum><header>Period in which distributions must be made from account of decedent</header><text>In the case of amounts remaining in an individual security account from which distributions began before the death of the beneficiary, rules similar to the rules of section 401(a)(9)(B) shall apply to distributions of such remaining amounts.</text></paragraph> 
<paragraph id="H3CB74FD4F72148C7B3EA9E7E957784EB"><enum>(4)</enum><header>Rollovers</header><text>Paragraph (1) shall not apply to amounts rolled over under subsection (c)(2) in a direct transfer by the Commissioner of Social Security, under regulations which the Commissioner shall prescribe.</text></paragraph></subsection> 
<subsection id="HC2A3A1E2F18D478EB94642DE106F4C64"><enum>(f)</enum><header>Account beneficiary</header><text>For purposes of this section, the account beneficiary is the individual for whose benefit the individual security account is established.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H394B480449BB4BFA8B9DB87DB5DA2EB"><enum>(2)</enum><header>Clerical amendment</header><text>The table of parts for subchapter F of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding after the item relating to part VIII the following new item:</text>

<section id="H994C729C94234AB89F3B6F1D74EEF890"><enum>3.</enum><header>Minimum social security benefit</header><text display-inline="no-display-inline">Section 215 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HB6A1CB6A95B349CAB4F8CA85A75D23A8" display-inline="no-display-inline"><enum>(j)</enum><header>Minimum monthly insurance benefit</header> 
<paragraph id="H4811F9335F7545528FE1908D8E4818FC" display-inline="yes-display-inline"><enum>(1)</enum><text>Notwithstanding the preceding provisions of this section—</text> 
<subparagraph id="HE8029AA2DB314E8E86E2613CC6CF89F1" indent="up1"><enum>(A)</enum><text>the primary insurance amount of a qualified individual shall be equal to the greater of—</text> 
<clause id="H6173F6FCFEB34D1BAC0037F6A4454F29"><enum>(i)</enum><text>the primary insurance amount determined under this section (without regard to this subsection), or</text></clause> 
<clause id="H13378D64D26A4B65ACAA53B0260034F0"><enum>(ii)</enum><text><fraction>1/12</fraction> of the applicable percentage of the applicable amount, and</text></clause><continuation-text continuation-text-level="subparagraph">rounded, if not a multiple of $0.10, to the next lower multiple of $0.10, and thereafter increased as provided in subsection (i), and</continuation-text></subparagraph> 
<subparagraph id="H71C83983BE3B4E60BD7FBF800029C332" indent="up1"><enum>(B)</enum><text>any recomputation of the primary insurance amount of a qualified individual shall not result in a primary insurance amount less than the primary insurance amount as in effect immediately prior to such recomputation.</text></subparagraph></paragraph> 
<paragraph id="H30E86B5455B4437DAB2239177723B07B" indent="up1"><enum>(2)</enum><text>For purposes of this subsection—</text> 
<subparagraph id="H0898267140E746F68050BAB6DE3E062F"><enum>(A)</enum><text>The term <term>qualified individual</term> means an individual—</text> 
<clause id="H43FB5ACE60264D44AEBC86D5CBF09995"><enum>(i)</enum><text>who initially becomes eligible for old-age or disability insurance benefits, or dies (before becoming eligible for such benefits) for a month beginning after December 31, 2009, and</text></clause> 
<clause id="H4318AD925A3C4A89BC64A9724CDCBAC"><enum>(ii)</enum><text>who, in the case of any such individual other than an individual eligible for old-age insurance benefits, has quarters of coverage greater in number than the number of such individual’s elapsed years (as defined in subsection (a)(1)(C)(ii)).</text></clause></subparagraph> 
<subparagraph id="H5111A042A3484767B6F5AD645B460088"><enum>(B)</enum><text>The term <term>applicable amount</term> means, in connection with an individual—</text> 
<clause id="H2A6E263A510A4E1B9469362E36F4C1D"><enum>(i)</enum><text>in any case in which the year of such individual’s initial eligibility is prior to 2014, $8,825, adjusted annually, for each year after 2003 and before the earlier of—</text> 
<subclause id="HC54F4F1C087748889BC565F0065E544" display-inline="no-display-inline"><enum>(I)</enum><text>the year of the individual’s initial eligibility, or</text></subclause> 
<subclause id="H64B66C66B9334FB996C812325C076B5E"><enum>(II)</enum><text>2014,</text></subclause><continuation-text continuation-text-level="clause">by the CPI increase percentage determined under section 215(i) for such year, or</continuation-text></clause> 
<clause id="HA83EAF07E6BF4250B258015027CE24FC"><enum>(ii)</enum><text>in any case in which the year of such individual’s initial eligibility is after 2013, the dollar amount determined under clause (i) for 2013, multiplied by the percentage (rounded to the nearest one-tenth of 1 percent) by which the national average wage index (as defined in section 209(k)(1)) for the second year prior to the year of such individual’s initial eligibility exceeds such index for 2011.</text></clause></subparagraph> 
<subparagraph id="H474813A3580C4F06AF005B31A4E40E4"><enum>(C)</enum><text></text> 
<clause id="H25F4EEC6CB9D4387921F988383EB2BA4" display-inline="yes-display-inline"><enum>(i)</enum><text>In the case of a qualified individual described in subparagraph (A)(i), the term <term>applicable percentage</term> means the sum of—</text> 
<subclause id="H4B56701FBD53448B8880C2A6E0D20636"><enum>(I)</enum><text>the product derived by multiplying 2.0 percent by the number of such individual’s quarters of coverage in excess of 40, to the extent that the number of such quarters of coverage does not exceed 80, and</text></subclause> 
<subclause id="HE0BCD0761CD347498844FB60713485DF"><enum>(II)</enum><text>the product derived by multiplying 0.5 percent by the number of such individual’s quarters of coverage, to the extent that the number of such quarters of coverage is in excess of 80 but does not exceed 160.</text></subclause></clause> 
<clause id="H686A103E641C4EE8A8A05CA897F1235E" indent="up1"><enum>(ii)</enum><text>In the case of a qualified individual described in subparagraph (A)(ii), the term <term>applicable percentage</term> means the sum of—</text> 
<subclause id="HC8DB69E18E1E4F24814391DEDF89CD21" display-inline="no-display-inline"><enum>(I)</enum><text>the product derived by multiplying the higher pro-rated percentage increment by the number of such individual’s quarters of coverage, to the extent that the number of such quarters of coverage exceeds the number of such individual’s elapsed years (as defined in subsection (a)(10(C)(ii)) but does not exceed twice the number of such elapsed years, and</text></subclause> 
<subclause id="H96E661F94D7E4179A6111F3760F59B2D"><enum>(II)</enum><text>the product derived by multiplying the lower pro-rated percentage increment by the number of such individual’s quarters of coverage, to the extent that the number of such quarters of coverage exceeds twice the number of such elapsed years but does not exceed 4 times the number of such elapsed years.</text></subclause></clause> 
<clause id="HA221C84FED32418095DD56555737C9BB" indent="up1"><enum>(iii)</enum><text>For purposes of clause (ii)—</text> 
<subclause id="HC5B28C27C5354D2C9BAAEA8F377BD007" display-inline="no-display-inline"><enum>(I)</enum><text>the higher pro-rated percentage increment, in connection with the qualified individual, is the quotient obtained by dividing 80 percent by the number of the individual’s elapsed years, and</text></subclause> 
<subclause id="H9B4FD94E3F014CFBBBFD052F80B28B38"><enum>(II)</enum><text>the lower pro-rated percentage increment, in connection with the qualified individual, is the quotient obtained by dividing 40 percent by twice the number of the individual’s elapsed years,</text></subclause><continuation-text continuation-text-level="clause">each of which is rounded, if a multiple of 0.05 percent and not of 0.10 percent, to the next higher multiple of 0.10 percent, and in any other case to the next higher multiple of 0.10 percent.</continuation-text></clause></subparagraph></paragraph> 
<paragraph id="HAE9D0200CF244721B8489FAECFF7E41" indent="up1"><enum>(3)</enum><text>In the case of a qualified individual who becomes eligible for old-age or disability insurance benefits, or who dies (before becoming eligible to such benefits) in a year prior to 2014, in lieu of the amount otherwise determined under paragraph (1)(A)(ii), the amount provided under paragraph (1)(A)(ii) shall be deemed to be equal to the the product derived by multiplying such amount otherwise determined by the percentage set forth in the following table in connection with such year, rounded, if not a multiple of $0.10, to the next lower multiple of $0.10.</text>

<subparagraph id="HE7832B647B6649089FFD3C00F64CF4CC" display-inline="yes-display-inline"><enum>(A)</enum><text>In the case of an individual who is entitled to disability insurance benefits, such individual’s average indexed monthly earnings shall be equal to the quotient obtained by dividing—</text> 
<clause id="HC9A3E3709DF545F0A603F6B3FD3D1126" indent="up1"><enum>(i)</enum><text>the total (after adjustment under paragraph (3)) of his wages paid in, and self-employment income credited to, those of his computation base years (determined under paragraph (1)(C)(i)) which—</text> 
<subclause id="H41FA499A85114A2F9700775CAAAD4DA0"><enum>(I)</enum><text>are elapsed years (determined under paragraph (1)(C)(ii)),</text></subclause> 
<subclause id="HEF02EED3A3234AD6B2DC0F63D49AA7B"><enum>(II)</enum><text>occurred prior to his current period of disability, and</text></subclause> 
<subclause id="H8AE3478BECFE4724BE682D11BF9E2D48"><enum>(III)</enum><text>are equal in number to the reduced number determined under subparagraph (B),</text></subclause><continuation-text continuation-text-level="clause">for which the total of such individual’s wages and self-employment income, after adjustment under paragraph (3), is the largest, by</continuation-text></clause> 
<clause id="H26BA7E0898BD412100006D0091008B69" indent="up1"><enum>(ii)</enum><text>the product derived by multiplying—</text> 
<subclause id="HB2EC060A6F94414B998DC7B1F3792CF4" display-inline="no-display-inline"><enum>(I)</enum><text>the number of the individual’s elapsed years, by</text></subclause> 
<subclause id="H03DC014718224BC09D0042C37822457C"><enum>(II)</enum><text>12.</text></subclause></clause></subparagraph> 
<subparagraph id="HA01A17471C9847C0AC3BD6510800055C" indent="up1"><enum>(B)</enum><text>The reduced number of an individual’s elapsed years, determined under this subparagraph for purposes of subparagraph (A)(i)(III), is the number of such elapsed years, reduced by the number of years equal to one-fifth of such number of elapsed years (disregarding any resulting fractional part of a year), but not by more than 5 years.</text></subparagraph> 
<subparagraph id="HA466045ABFE4403E97E5959925FE01AD" indent="up1"><enum>(C)</enum> 
<clause id="H5373756777A04C0CA47249FB59468F7" display-inline="yes-display-inline"><enum>(i)</enum><text>This paragraph, once applicable with respect to any individual, shall continue to apply for purposes of determining such individual’s primary insurance amount for purposes of any subsequent eligibility for disability or old-age insurance benefits, unless, prior to the month in which such eligibility begins, there occurs a period of at least 12 consecutive months for which he was not entitled to a disability or an old-age insurance benefit.</text></clause> 
<clause id="H49F4EB74CBB4488BA27E8525B2F3BF2E" indent="up1"><enum>(ii)</enum><text>If an individual to which this paragraph applies is living with a child (of such individual or his or her spouse) under the age of 3 in any calendar year which is included in such individual’s elapsed years, but which is not disregarded pursuant to subparagraphs (A)(i) and (B) by reason of the reduction in the number of such individual’s elapsed years under subparagraph (B), the number by which the number of such elapsed years is reduced under subparagraph (B) shall be increased by one (up to a combined total not exceeding 3) for each such calendar year, except that—</text> 
<subclause id="HF14A203CCFBF48EFAE57D2D3183F4F25" display-inline="no-display-inline"><enum>(I)</enum><text>no calendar year shall be disregarded by reason of this clause (in determining elapsed years to be taken into account under subparagraph (A)(i)) unless the individual was living with such child substantially throughout the period in which the child was alive and under the age of 3 in such year and the individual had no earnings as described in section 203(f)(5) in such year,</text></subclause> 
<subclause id="H8F54F5CEBF774A4BAAA15BD401A4BD5"><enum>(II)</enum><text>the particular calendar years to be disregarded under this clause (in determining such elapsed years) shall be those years (not otherwise disregarded under subparagraph (B)) which, before the application of section 215(f), meet the conditions of subclause (I), and</text></subclause> 
<subclause id="H00D0DF0AE6A44D9BB052C0A3E40400EB"><enum>(III)</enum><text>this clause shall apply only to the extent that its application would not result in a lower primary insurance amount.</text></subclause></clause></subparagraph>

<paragraph id="H02792E21C6144DDC96201B87BE9CE4D9"><enum>(1)</enum><header>In general</header><text>Section 215(i)(1)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(i)(1)(D)</external-xref>) is amended to read as follows:</text>

<paragraph id="HB810127CB0D34E6EA4FE4BFFA6E68F"><enum>(4)</enum><header>Rules to apply only to computation of benefit amounts</header><text>The preceding provisions of this subsection shall apply only for purposes of determining the amount of benefits and not for purposes of determining—</text> 
<subparagraph id="H81D80AB31F1840BA97DC994BC61FDF99"><enum>(A)</enum><text>whether a threshold increase in the Consumer Price Index has been met, or</text></subparagraph>

<paragraph id="H940801389AE949308B0745F729779546"><enum>(5)</enum><header>Benefits to which subsection applies</header><text>For purposes of this subsection, the benefits described in this paragraph are—</text> 
<subparagraph id="H49522DA9227A4774957FBA9C35F37D59"><enum>(A)</enum><text>retired and retainer pay subject to adjustment under <external-xref legal-doc="usc" parsable-cite="usc/10/1401a">section 1401a</external-xref> of title 10, United States Code;</text></subparagraph> 
<subparagraph id="HE05097FF895A4742A3F9A2EF82C18CB7"><enum>(B)</enum><text>civil service retirement benefits under <external-xref legal-doc="usc" parsable-cite="usc/5/8340">section 8340</external-xref> of title 5, United States Code, foreign service retirement benefits under section 826 of the Foreign Service Act of 1980, Central Intelligence Agency retirement benefits under part J of the Central Intelligence Agency Retirement Act of 1964 for certain employees, and any other benefits under any similar provision under any retirement system for employees of the government of the United States;</text></subparagraph> 
<subparagraph id="H24AF6F91CE554BD8A2F009BD400A32D"><enum>(C)</enum><text>Federal workers' compensation under <external-xref legal-doc="usc" parsable-cite="usc/5/8146a">section 8146a</external-xref> of title 5, United States Code;</text></subparagraph> 
<subparagraph id="H3EA17EEF21DC4B75BAC43F5A700CE9C"><enum>(D)</enum><text>benefits under section 3(a), 4(a), or 4(f) of the Railroad Retirement Act of 1974; and</text></subparagraph> 
<subparagraph id="H168809E422AC4D1A9D40D441C297D646"><enum>(E)</enum><text>benefits and expenditure limits under title XVIII or XIX of the Social Security Act.</text></subparagraph></paragraph> 
<paragraph id="HA0D387C45F114444BF392EB031C21F16"><enum>(6)</enum><header>Benefit</header><text>For purposes of this section, the term <term>benefit</term> includes a payment.</text></paragraph></subsection> 
<subsection id="HC3F5F0F9790048B080DD076056FB4706"><enum>(d)</enum><header>Recapture to federal old-age and survivors insurance trust fund</header><text>Section 201 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref>) is amended by adding at the end the following new subsection:</text>

<paragraph id="H340C90C57F55416A8EAFF84E12D4C371"><enum>(2)</enum><text>by redesignating clause (iii) as clause (iv);</text></paragraph>

<subsection id="HF7651ED4FBD14848B7CBBF9073937FE7"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to individuals becoming eligible for old-age insurance benefits or disability insurance benefits, or dying (before becoming eligible for such benefits), after 2005.</text></subsection></section> 
<section id="H52A3510606084AA7890558BF28006178"><enum>9.</enum><header>Adjustment to benefit formula factors</header><text display-inline="no-display-inline">Section 215(a)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(a)(1)(B)</external-xref>) (as amended by section 8) is amended further—</text> 
<paragraph id="H29B1BF8280214B92AC71C65D4F132B85"><enum>(1)</enum><text>by redesignating clause (iv) as clause (vii); and</text></paragraph> 
<paragraph id="H1A4094E166FB4A50B7F9E800407C7BD4"><enum>(2)</enum><text>by inserting after clause (iii) the following:</text>

<clause id="HC9102C9E716C4A5FB68670B6773480A6" indent="up3"><enum>(iv)</enum><text>For an individual who initially becomes eligible for old-age insurance benefits, or who dies (before becoming eligible for such benefits or disability insurance benefits), in any calendar year after 2011, each of the amounts otherwise established for purposes of subclauses (I), (II), (III), and (IV) of subparagraph (A)(i) under this subparagraph shall be substituted with the product derived by successively multiplying, once for each year of the factoring period for such individual—</text> 
<subclause id="HBE4562D56C5348B98F1CE94451909B46"><enum>(I)</enum><text>such amount (after applying this clause for earlier years of the factoring period), by</text></subclause> 
<subclause id="H51F21EFEA17E46E7805D79D1C4D0635F"><enum>(II)</enum><text>the designated factor for such year.</text></subclause></clause> 
<clause id="H27B24CD328A64F2983E3C8B4609F2E5B" indent="up3"><enum>(v)</enum><text>For purposes of clause (iii), the term <term>factoring period</term> means, for an individual, the period beginning with 2012 and ending with the earlier of—</text> 
<subclause id="H7A360F411C2F4E4C9B3172D6686C45ED"><enum>(I)</enum><text>the year of the individual's initial eligibility or death, or</text></subclause> 
<subclause id="H03A13A5B33C648E9B119F5209801AF58"><enum>(II)</enum><text>2060.</text></subclause></clause> 
<clause id="H5D8FD3E33CD1438EB31711E62E5BCA61" indent="up3"><enum>(vi)</enum><text>For purposes of clause (iii), the term <term>designated factor</term> means—</text>

<section id="H49CB22F2212E4552B0C885F98908F5DD"><enum>10.</enum><header>Modification to PIA formula to reflect changes to life expectancy</header> 
<subsection id="H54A7F6BD549E4952A8591D304CCDCE2D"><enum>(a)</enum><header>In general</header><text>Section 215(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(a)(1)(B)</external-xref>) is amended by redesignating subparagraph (C) and (D) as subparagraphs (D) and (E), respectively, and by inserting after subparagraph (B) the following new subparagraph:</text>

<subparagraph id="HC14AB747988A4C83A1261DCAC2CAB00" indent="up2"><enum>(C)</enum><text></text> 
<clause id="H0116D8BB45B34CBBB0D29477E2C23E95" display-inline="yes-display-inline"><enum>(i)</enum><text>For individuals who initially become eligible for old-age insurance benefits (or who die before becoming eligible for such benefits) in any calendar year after 2011, the primary insurance amount computed under this paragraph shall be the product derived by multiplying such amount as computed under the preceding subparagraphs of this paragraph by the life expectancy ratio for such calendar year.</text></clause> 
<clause id="H4D4EEF0BB2C94D8D81DC3CE84B08CAF4" indent="up1"><enum>(ii)</enum><text>The Commissioner of Social Security, using generally accepted actuarial principles, shall determine and publish in the Federal Register on or before November 1 of each calendar year the life expectancy ratio for the following calendar year.</text></clause> 
<clause id="H6B1E0DA71B874241BD7449D0E119D571" indent="up1"><enum>(iii)</enum><text>For purposes of clause (ii), the life expectancy ratio for any calendar year is the ratio of—</text> 
<subclause id="HAC94A3B16DDD42A6A4655C3CE0A4C57"><enum>(I)</enum><text>the period life expectancy of an individual attaining age 62 on January 1, 2008, to</text></subclause> 
<subclause id="H42A9CDC5538A4E2EB797A78800A67C30"><enum>(II)</enum><text>the period life expectancy of an individual attaining age 62 on January 1 of the third calendar year preceding the calendar year in which the determination under clause (ii) is made.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC6C7D2C73E5F4BE3A2A8EA37AEC94F8"><enum>(b)</enum><header>Study of the effect of increases in life expectancy</header><text></text> 
<paragraph id="H93CA39715ABA4A9E9DA8A35C3EC15279"><enum>(1)</enum><header>Study plan</header><text>Not later than December 15, 2006, the Commissioner of Social Security shall submit to Congress a detailed study plan for evaluating the effects of increases in life expectancy on the expected level of retirement income from social security, pensions, and other sources. The study plan shall include a description of the methodology, data, and funding that will be required in order to provide to the Congress not later than February 15, 2008—</text> 
<subparagraph id="H31D0C93CC7E64472A5D800219B26EFA1"><enum>(A)</enum><text>an evaluation of trends in mortality and their relationship to trends in health status, among individuals approaching eligibility for old-age insurance benefits under title II of the Social Security Act;</text></subparagraph> 
<subparagraph id="HA30326B080954C36005CD80030A97676"><enum>(B)</enum><text>an evaluation of trends in labor force participation among individuals approaching eligibility for such benefits and among individuals receiving such benefits, and of the factors that influence the choice between retirement and participation in the labor force;</text></subparagraph> 
<subparagraph id="HFF9D7933C6504FEE91E114BE170034FE"><enum>(C)</enum><text>an evaluation of changes, if any, in the disability insurance program under title II of the Social Security Act that would reduce the impact of changes in the retirement income of workers in poor health or physically demanding occupations;</text></subparagraph> 
<subparagraph id="H721864DBF1EE4B218E118F5599F0006B"><enum>(D)</enum><text>an evaluation of the methodology used to develop projections for trends in mortality, health status, and labor force participation among individuals approaching eligibility for old-age insurance benefits and among individuals receiving such benefits; and</text></subparagraph> 
<subparagraph id="H68416FA6219C43D68900D119BBF2DEE"><enum>(E)</enum><text>an evaluation of such other matters as the Commissioner deems appropriate for evaluating the effects of increases in life expectancy.</text></subparagraph></paragraph> 
<paragraph id="H515BD0C657224115AF7075912225813E"><enum>(2)</enum><header>Report on results of study</header><text>Not later than February 15, 2008, the Commissioner of Social Security shall provide to the Congress an evaluation of the implications of the trends studied under paragraph (1), along with recommendations, if any, of the extent to which the conclusions of such evaluations indicate that projected increases in life expectancy require modification in the disability insurance program under title II of the Social Security Act and other income support programs.</text></paragraph></subsection></section> 
<section id="HF975CFB200684EF281678034E69CD97D"><enum>11.</enum><header>Treatment of disabled beneficiaries</header><text display-inline="no-display-inline">Section 215(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block id="H70E3F074430D4847B42F28DA99D4A452"> 
<paragraph id="H47E341557C3744A5B010D4FCEC2CC52E" indent="up1"><enum>(8)</enum><text></text> 
<subparagraph id="H03D690661E654117817D211CBA6937E3" display-inline="yes-display-inline"><enum>(A)</enum><text>Notwithstanding the preceding provisions of this subsection, in the case of an individual who has or has had a period of disability and becomes entitled to old-age insurance benefits under section 202(a) (or dies) in or after 2006, the primary insurance amount of such individual shall be the sum of—</text> 
<clause id="HF99A336F70FA46BC94CD8E3EF324E600" indent="up1"><enum>(i)</enum><text>the amount determined under subparagraph (B), and</text></clause> 
<clause id="H25BA69369FB74BBCB8263BEA00B0D762" indent="up1"><enum>(ii)</enum><text>the product derived by multiplying—</text> 
<subclause id="H12499FD8CB5A4CB0959C9FC791EEB694"><enum>(I)</enum><text>the excess of the amount determined under subparagraph (C) over the amount determined under subparagraph (B), by</text></subclause> 
<subclause id="H6F669DB52060414F94444647234EE53D"><enum>(II)</enum><text>the adjustment factor for such individual determined under subparagraph (D).</text></subclause></clause></subparagraph> 
<subparagraph id="H1E10912502314D1C88A58E1759B68406" indent="up1"><enum>(B)</enum><text>The amount determined under this subparagraph is the amount of such individual's primary insurance amount as determined under this section without regard to this paragraph.</text></subparagraph> 
<subparagraph id="HC1DE089B25B84F3EAB055146AA00C568" indent="up1"><enum>(C)</enum><text>The amount determined under this subparagraph is the amount of such individual's primary insurance amount as determined under this section as in effect with respect to individuals becoming eligible for old-age or disability insurance benefits under section 202(a) in 2004.</text></subparagraph> 
<subparagraph id="H4DE65CCDE7F1423200632C0018514BD1" indent="up1"><enum>(D)</enum> 
<clause id="HB67E66FFF8B140889FB5927263535B86" display-inline="yes-display-inline"><enum>(i)</enum><text>Subject to clause (ii), the adjustment factor determined under this subparagraph for any individual is the ratio (not greater than 1) of—</text> 
<subclause id="H1077E4E1CDAA4DACAB00C994335DF0C4" indent="up1"><enum>(I)</enum><text>the number of months, ending after the date on which such individual has attained age 22 and preceding the earlier of such individual's first month of entitlement to old-age insurance benefits under section 202(a) or the month of such individual's death, which occurred during a period of disability of such individual, to</text></subclause> 
<subclause id="H99CD90B0FD474AEA9507BDA511A2D2FF" indent="up1"><enum>(II)</enum><text>480.</text></subclause></clause> 
<clause id="H2F89DD5A988F451BB73167C4374B663D" indent="up1"><enum>(ii)</enum><text>In the case of an individual who has attained age 22 as of the date of the enactment of the <short-title>Bipartisan Retirement Security Act of 2005</short-title>, the adjustment factor determined under this subparagraph for such individual is the product derived by multiplying the ratio determined under clause (i) by the ratio (not greater than 1) of—</text> 
<subclause id="HB08C20DFC1C648A089124DF561D2802E"><enum>(I)</enum><text>the number of calendar years for which contributions have been made to such individual’s individual security account pursuant to section 251(b)(1), to</text></subclause> 
<subclause id="HA850AE74327B4953B76EEF00D4ED5F15"><enum>(II)</enum><text>40.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF0ECDD8CF00442ECAF59F8008B008BE8"><enum>12.</enum><header>Maintenance of benefit and contribution base</header> 
<subsection id="H8FB7F45E4B004FDFA0CD7E2908E75349"><enum>(a)</enum><header>In general</header><text>So much of section 230 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/430">42 U.S.C. 430</external-xref>) as precedes subsection (d) is amended to read as follows:</text> 
<quoted-block style="traditional" id="H0EE10CCDAFC84A0B841E304510A62FC8" display-inline="no-display-inline"> 
<section id="HFC604CFF273D4598975CC2C174C86755"><enum>230.</enum><header>Maintenance of benefit and contribution base</header> 
<subsection id="H4DCD209B993C48A8001FD681141DED7" display-inline="yes-display-inline"><enum>(a)</enum><text>Not later than November 1 of each calendar year (beginning with or after 2005), the Commissioner shall determine and publish in the Federal Register the contribution and benefit base determined under subsections (b) and (c) which shall be effective with respect to remuneration paid after such calendar year and taxable years beginning after such year.</text></subsection> 
<subsection id="H5B105AC012E34713AFAFEF927CC0F3F9"><enum>(b)</enum><text>For purposes of this section, and for purposes of determining wages and self-employment income under sections 209, 211, 213, and 215 of this Act and sections 54, 1402, 3121, 3122, 3125, 6413, and 6654 of the Internal Revenue Code of 1986—</text> 
<paragraph id="HCD4A91F1962448DE891B1C54C0E8BBB3"><enum>(1)</enum><text>the <quote>contribution and benefit base</quote> with respect to remuneration paid (and taxable years beginning)—</text> 
<subparagraph id="HE69505EAD1644C159906731FC6B4E655"><enum>(A)</enum><text>in 2006 shall be $97,500,</text></subparagraph> 
<subparagraph id="H4F2ACD0DF0214DADA5F3BC5B0649FFCC"><enum>(B)</enum><text>in 2007 shall be $106,800,</text></subparagraph> 
<subparagraph id="HFA66C09275A546B1986B13A1A3A7DDFB"><enum>(C)</enum><text>in 2008 shall be $117,000,</text></subparagraph> 
<subparagraph id="HE734C145CAA446649E6FA296868E09D0"><enum>(D)</enum><text>in 2009 shall be $129,000, and</text></subparagraph> 
<subparagraph id="HB2F36536ECE6491CA1E2EA4E3081A2C9"><enum>(E)</enum><text>in 2010 shall be $142,500; and</text></subparagraph></paragraph> 
<paragraph id="H1E5B0B49A0CD4E25AD531383635C4192"><enum>(2)</enum><text>the <quote>contribution and benefit base</quote> with respect to remuneration paid (and taxable years beginning) in any calendar year after 2010 shall be equal to the dollar amount equal to the lowest amount which, if applied under this title as the benefit and contribution base for the preceding year, would have caused the total untaxed covered remuneration for such year to constitute no more than 13 percent of the total amount of wages paid, and self-employment income derived, in such year by all individuals.</text></paragraph><continuation-text continuation-text-level="subsection">Each contribution and benefit base determined under paragraph (2) shall (if not a multiple of $25) be rounded to the nearest multiple of $25.</continuation-text></subsection> 
<subsection id="H7B08482777194E97B7961FDF3DACD73E"><enum>(c)</enum><text>For purposes of this section, the term <term>total untaxed covered remuneration</term> for a calendar year means the total amount of wages paid to, and self-employment income derived by, all individuals in such calendar year, which was, with respect to each individual paid such wages and deriving such self-employment income, in excess of the contribution and benefit base for that calendar year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7DE8E1C8E39148F0B8994DB58E5B7C60"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to remuneration paid in (and taxable years beginning in) any calendar year after 2005.</text></subsection></section> 
<section id="HA9D7DA1CE0384C83AD93CB7BDEF8E5CB"><enum>13.</enum><header>Acceleration of increase in social security eligibility age</header><text display-inline="no-display-inline">Section 216(l) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/416">42 U.S.C. 416(l)</external-xref> is amended—</text> 
<paragraph id="HBD86B4702B304F58A51FD622B2A24900"><enum>(1)</enum><text>in paragraph (1), by striking subparagraphs (A), (B), (C), (D), and (E) and inserting the following:</text> 
<quoted-block id="H5C88E6CCCAD04CA9B8BA00FA03388C64"> 
<subparagraph id="H20CD432E7D714C78B8DC4BCC01669620" indent="up1"><enum>(A)</enum><text>with respect to an individual who attains early retirement age (as defined in paragraph (2)) before January 1, 2000, 65 years of age; and</text></subparagraph> 
<subparagraph id="H924B19F0C08C4B6180600723C93398A0" indent="up1"><enum>(B)</enum><text>with respect to an individual who attains early retirement age after December 31, 1999, and before January 1, 2012, 65 years of age plus <fraction>2/12</fraction> of the number of months in the period beginning with January 2000 and ending with December of the year in which the individual attains early retirement age; and</text></subparagraph> 
<subparagraph id="HF4D73C4FF5F4428C8296EC7F45C8E857" indent="up1"><enum>(C)</enum><text>with respect to an individual who attains early retirement age after December 31, 2011, 67 years of age.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H06E4432A48ED404884FF04310018BA14"><enum>(2)</enum><text>by striking paragraph (3).</text></paragraph></section> 
<section id="H93A5E91414104D68B3F59D0000E8506B"><enum>14.</enum><header>Mechanism for remedying unforeseen deterioration in social security solvency</header> 
<subsection id="H9915DF4535D44BD4B661828B461EDDD7"><enum>(a)</enum><header>In General</header><text>Section 709 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/910">42 U.S.C. 910</external-xref>) is amended—</text> 
<paragraph id="HC490539BE37346A3B8D93733E534BEE9"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph> 
<paragraph id="H5C63015BDFCD4F51995084E46E983AF"><enum>(2)</enum><text>by striking <quote><header-in-text level="subsection">Sec. </header-in-text> 709. (a) If the Board of Trustees</quote> and all that follows through <quote>any such Trust Fund</quote> and inserting the following:</text>

<section id="H6EF58AEA0DCC48EC9E9D067DF33204F6"><enum>709.</enum> 
<subsection id="HC7D6E5B0F1494062BC1DD9814229161D" display-inline="yes-display-inline"><enum>(a)</enum> 
<paragraph id="H7C55FF50F1A6497B8B00903333003861" display-inline="yes-display-inline"><enum>(1)</enum> 
<subparagraph id="H3EDE34A0AD05482EA0DB6C1196470209" display-inline="yes-display-inline"><enum>(A)</enum><text>If the Board of Trustees of the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund determines at any time, using intermediate actuarial assumptions, that the balance ratio of either such Trust Fund for any calendar year during the succeeding period of 75 calendar years will be zero, the Board shall promptly submit to each House of the Congress and to the President a report setting forth its recommendations for statutory adjustments affecting the receipts and disbursements of such Trust Fund necessary to maintain the balance ratio of such Trust Fund at not less than 20 percent, with due regard to the economic conditions which created such inadequacy in the balance ratio and the amount of time necessary to alleviate such inadequacy in a prudent manner. The report shall set forth specifically the extent to which benefits would have to be reduced, taxes under section 1401, 3101, or 3111 of the Internal Revenue Code of 1986 would have to be increased, or a combination thereof, in order to obtain the objectives referred to in the preceding sentence.</text></subparagraph> 
<subparagraph id="HFDED955E416546AB9F1BD74998E4AAB9" indent="up2"><enum>(B)</enum><text>In addition to any reports under subparagraph (A), the Board shall, not later than May 30, 2006, prepare and submit to Congress and the President recommendations for statutory adjustments to the disability insurance program under title II of this Act to modify the changes in disability benefits under the <short-title>Bipartisan Retirement Security Act of 2005</short-title> without reducing the balance ratio of the Federal Disability Insurance Trust Fund. The Board shall develop such recommendations in consultation with the National Council on Disability, taking into consideration the adequacy of benefits under the program, the relationship of such program with old age benefits under such title, and changes in the process for determining initial eligibility and reviewing continued eligibility for benefits under such program.</text></subparagraph></paragraph> 
<paragraph id="H0EE7CC67E27940938E71F8D634E0F895" indent="up1"><enum>(2)</enum> 
<subparagraph id="H7E5B28290BB743BE821089CFCADADA43" display-inline="yes-display-inline"><enum>(A)</enum><text>The President shall, no later than 30 days after the submission of the report to the President, transmit to the Board and to the Congress a report containing the President's approval or disapproval of the Board's recommendations.</text></subparagraph> 
<subparagraph id="HD47C5D5E966241DE8F9D8DCBD9202079" indent="up1"><enum>(B)</enum><text>If the President approves all the recommendations of the Board, the President shall transmit a copy of such recommendations to the Congress as the President's recommendations, together with a certification of the President's adoption of such recommendations.</text></subparagraph> 
<subparagraph id="HB0D93FDED29D4BCFA85C60E9A000BEE3" indent="up1"><enum>(C)</enum><text>If the President disapproves the recommendations of the Board, in whole or in part, the President shall transmit to the Board and the Congress the reasons for that disapproval. The Board shall then transmit to the Congress and the President, no later than 60 days after the date of the submission of the original report to the President, a revised list of recommendations.</text></subparagraph> 
<subparagraph id="HCBE99ED6842441C18BD85104FACC5C69" indent="up1"><enum>(D)</enum><text>If the President approves all of the revised recommendations of the Board transmitted to the President under subparagraph (C), the President shall transmit a copy of such revised recommendations to the Congress as the President's recommendations, together with a certification of the President's adoption of such recommendations.</text></subparagraph> 
<subparagraph id="HFD6305D7D953488CAC00FC9300206476" indent="up1"><enum>(E)</enum><text>If the President disapproves the revised recommendations of the Board, in whole or in part, the President shall transmit to the Board and the Congress the reasons for that disapproval, together with such revisions to such recommendations as the President determines are necessary to bring such recommendations within the President’s approval. The President shall transmit a copy of such recommendations, as so revised, to the Board and the Congress as the President’s recommendations, together with a certification of the President’s adoption of such recommendations.</text></subparagraph></paragraph> 
<paragraph id="H377BB05CDE02442585C48F8C20095357" indent="up1"><enum>(3)</enum> 
<subparagraph id="HAB5599515C694BE89D7DD0DDBCC2C413" display-inline="yes-display-inline"><enum>(A)</enum><text>This paragraph is enacted by Congress—</text> 
<clause id="H0C979BE46BDF42178673DAB80CF29A0" indent="up1"><enum>(i)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such it is deemed a part of the rules of each House, respectively, but applicable only to the extent that it is inconsistent with such rules; and</text></clause> 
<clause id="H17FAD10A22CD49C18BF9CBA22884422" indent="up1"><enum>(ii)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text></clause></subparagraph> 
<subparagraph id="H1BCA30B5FA0C402AB7DC69EF3FDCF9" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, the term <term>joint resolution</term> means only a joint resolution which is introduced within the 10-day period beginning on the date on which the President transmits the President's recommendations, together with the President's certification, to the Congress under subparagraph (B), (D), or (E) of paragraph (2), and—</text> 
<clause id="H3994C6FBCF85461382F37D47E0FF2100"><enum>(i)</enum><text>which does not have a preamble;</text></clause> 
<clause id="HC223CFFD22B44CDBAEBC86CC25F92FB5"><enum>(ii)</enum><text>the matter after the resolving clause of which is as follows: <quote>That the Congress approves the recommendations of the President as transmitted on ______ pursuant to section 709(a) of the Social Security Act, as follows:________</quote>, the first blank space being filled in with the appropriate date and the second blank space being filled in with the statutory adjustments contained in the recommendations; and</text></clause> 
<clause id="H33E3B95B98474744B6A786B7BADEEB8"><enum>(iii)</enum><text>the title of which is as follows: <quote>Joint resolution approving the recommendations of the President regarding social security.</quote></text></clause></subparagraph> 
<subparagraph id="H97EC07E9D1A249BE929B96002047A8D4" indent="up1"><enum>(C)</enum><text>A joint resolution described in subparagraph (B) that is introduced in the House of Representatives shall be referred to the Committee on Ways and Means of the House of Representatives. A joint resolution described in subparagraph (B) introduced in the Senate shall be referred to the Committee on Finance of the Senate.</text></subparagraph> 
<subparagraph id="HB2500A8C671E4912A5F1BA1201002024" indent="up1"><enum>(D)</enum><text>If the committee to which a joint resolution described in subparagraph (B) is referred has not reported such joint resolution (or an identical joint resolution) by the end of the 20-day period beginning on the date on which the President transmits the recommendation to the Congress under paragraph (2), such committee shall be, at the end of such period, discharged from further consideration of such joint resolution, and such joint resolution shall be placed on the appropriate calendar of the House involved.</text></subparagraph> 
<subparagraph id="H7F3E0420A66C4A7D00A5C64BDADFAEE7" indent="up1"><enum>(E)</enum> 
<clause id="H27C272FB411947F5AC9B47F413B3E005" display-inline="yes-display-inline"><enum>(i)</enum><text>On or after the third day after the date on which the committee to which such a joint resolution is referred has reported, or has been discharged (under subparagraph (D)) from further consideration of, such a joint resolution, it is in order (even though a previous motion to the same effect has been disagreed to) for any Member of the respective House to move to proceed to the consideration of the joint resolution. A Member may make the motion only on the day after the calendar day on which the Member announces to the House concerned the Member's intention to make the motion, except that, in the case of the House of Representatives, the motion may be made without such prior announcement if the motion is made by direction of the committee to which the joint resolution was referred. All points of order against the joint resolution (and against consideration of the joint resolution) are waived. The motion is highly privileged in the House of Representatives and is privileged in the Senate and is not debatable. The motion is not subject to amendment, or to a motion to postpone, or to a motion to proceed to the consideration of other business. A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order. If a motion to proceed to the consideration of the joint resolution is agreed to, the respective House shall immediately proceed to consideration of the joint resolution without intervening motion, order, or other business, and the joint resolution shall remain the unfinished business of the respective House until disposed of.</text></clause> 
<clause id="HC635C32D90F54442A6A761023F00C58D" indent="up1"><enum>(ii)</enum><text>Debate on the joint resolution, and on all debatable motions and appeals in connection therewith, shall be limited to not more than 2 hours, which shall be divided equally between those favoring and those opposing the joint resolution. An amendment to the joint resolution is not in order. A motion further to limit debate is in order and not debatable. A motion to postpone, or a motion to proceed to the consideration of other business, or a motion to recommit the joint resolution is not in order. A motion to reconsider the vote by which the joint resolution is agreed to or disagreed to is not in order.</text></clause> 
<clause id="HAFBC5CAA31A3438CB3B73EA2DDD22018" indent="up1"><enum>(iii)</enum><text>Immediately following the conclusion of the debate on a joint resolution described in subparagraph (B) and a single quorum call at the conclusion of the debate if requested in accordance with the rules of the appropriate House, the vote on final passage of the joint resolution shall occur.</text></clause> 
<clause id="HA5467F13D3DF40CE89EFF93198A9E85" indent="up1"><enum>(iv)</enum><text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate or the House of Representatives, as the case may be, to the procedure relating to a joint resolution described in subparagraph (B) shall be decided without debate.</text></clause></subparagraph> 
<subparagraph id="H5FE71BA77539461C912CAAE0C534D8AD" indent="up1"><enum>(F)</enum> 
<clause id="H6C475D01B95D4DA8A1878C50E51B6BB0" display-inline="yes-display-inline"><enum>(i)</enum><text>If, before the passage by one House of a joint resolution of that House described in subparagraph (B), that House receives from the other House a joint resolution described in subparagraph (B), then the following procedures shall apply:</text> 
<subclause id="HAB9A2B55775C4CFA973610229CD1B3E3" indent="up1"><enum>(I)</enum><text>The joint resolution of the other House shall not be referred to a committee and may not be considered in the House receiving it except in the case of final passage as provided in subclause (II).</text></subclause> 
<subclause id="H9FA68007D24D467BAE04EB253F732DC6" indent="up1"><enum>(II)</enum><text>With respect to a joint resolution described in subparagraph (B) of the House receiving the joint resolution, the procedure in that House shall be the same as if no joint resolution had been received from the other House, but the vote on final passage shall be on the joint resolution of the other House.</text></subclause></clause> 
<clause id="H56BAA7954CB845ABBF26EDFF502D7C14" indent="up1"><enum>(ii)</enum><text>Upon disposition of the joint resolution received from the other House, it shall no longer be in order to consider the joint resolution that originated in the receiving House.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H69687F8A7AD545F5BB00B2FB25E12016"><enum>(b)</enum><text>If the Board of Trustees of the Federal Hospital Insurance Trust Fund or the Federal Supplementary Medical Insurance Trust Fund determines at any time that the balance ratio of either such Trust Fund</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE42E911C5A194705B1AD00C7533F1E3B"><enum>(b)</enum><header>Conforming Amendments</header><text></text>

<section id="H2DC729BAC15548CA981B266C678CA2D8"><enum>15.</enum><header>Increase in widow’s and widower’s insurance benefits</header> 
<subsection id="H0D6366B4544E4D9185EC8EE599A5AF2B"><enum>(a)</enum><header>Widow’s insurance benefits</header><text>Section 202(e) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(e)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block act-name="Social" id="HE7AA2D26CA63428CA4CEBAED8D138C76"> 
<paragraph id="H473EFEF055E64297A41C92BFB712E846" indent="up1"><enum>(9)</enum> 
<subparagraph id="HCC8A1B1D7A9F4D30BE6034C2B1148360" display-inline="yes-display-inline"><enum>(A)</enum><text>In any case in which the amount of a widow’s insurance benefit (as determined under the preceding paragraphs of this subsection) for the entitlement month of the widow (or surviving divorced wife) is less than the minimum benefit amount for such month determined under subparagraph (C), the amount of such benefit for such month and each succeeding month shall be increased to such minimum benefit amount (or the amount most recently established in lieu thereof under section 215(i)).</text></subparagraph> 
<subparagraph id="HD12D4FCB5CA141B3AF58CF443CB2A268" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, the term <term>entitlement month</term> of a widow (or surviving divorced wife) means, in connection with her benefit under this subsection, the first month of her entitlement to such benefit.</text></subparagraph> 
<subparagraph id="H217245135596406DBBD06EFBF5D4592" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph (A), the minimum benefit amount determined under this subparagraph for the entitlement month of the widow (or surviving divorced wife) is an amount equal to the lesser of—</text> 
<clause id="H9D5BC80058D84D909CEEC98335253147"><enum>(i)</enum><text>75 percent of the sum of—</text> 
<subclause id="HCF9542019F3548B800A6120517EF9EA2"><enum>(I)</enum><text>the imputed deceased individual’s benefit for such month, as determined under subparagraph (D) or (E) (as applicable), and</text></subclause> 
<subclause id="HCFD1348CA31948A1B40277D1EEBB72E"><enum>(II)</enum><text>the imputed survivor benefit for such month, as determined under subparagraph (F), or</text></subclause></clause> 
<clause id="HCE128542811F45ED00DC32FEACAE8636"><enum>(ii)</enum><text>the increased benefit cap determined under subparagraph (G) for such month.</text></clause></subparagraph> 
<subparagraph id="H23998BFA5A4B408D90A4AD4EC50305B7" indent="up1"><enum>(D)</enum> 
<clause id="H70683E3D49934919002BA33646D75F42" display-inline="yes-display-inline"><enum>(i)</enum><text>For purposes of subparagraph (C)(i)(I), if the deceased individual died in a month for which he was not entitled to any benefit under this title based on his wages or self-employment income or the wages and self-employment income of the widow (or surviving divorced wife), the imputed deceased individual’s benefit for the entitlement month of the widow (or surviving divorced wife) is the sum of—</text> 
<subclause id="H70FEB9ABD45E47B698740300D9A03B86" indent="up1"><enum>(I)</enum><text>the imputed old-age insurance benefit (determined under clause (ii)) of the deceased individual for her entitlement month (if any), and</text></subclause> 
<subclause id="H2C28C09107E84450B96CB9A43B410061" indent="up1"><enum>(II)</enum><text>the imputed husband’s insurance benefit (determined under clause (iii)) of the deceased individual for her entitlement month (if any).</text></subclause></clause> 
<clause id="H7C823B934C2F46DEAB3FB5D5F4A9D9E3" indent="up1"><enum>(ii)</enum><text>The amount of the imputed old-age insurance benefit of the deceased individual for the entitlement month of the widow (or surviving divorced wife) is the amount of the old-age insurance benefit to which he would have been entitled for such month—</text> 
<subclause id="HD8AB6ED4F5F3445A967D63CA4BF3C5E"><enum>(I)</enum><text>determined, in the case of such a deceased individual who had attained age 62 as of the date of his death, as if he had applied for such benefit in the month of his death and had survived throughout the subsequent period ending with her entitlement month, or</text></subclause> 
<subclause id="H102B40A86A414C4DA8BC4033F96EF706"><enum>(II)</enum><text>determined, in the case of such a deceased individual who died before attaining age 62 but would have attained age 62 before the end of her entitlement month, as if he had survived throughout the subsequent period ending with her entitlement month, and had applied for such benefit during the first month for which he would have been eligible for such benefit (assuming a primary insurance amount for the deceased individual determined under paragraph (2)(B) of this subsection).</text></subclause><continuation-text continuation-text-level="clause">For purposes of determining the deceased individual’s imputed old-age insurance benefit under this clause, the determination of whether the deceased individual was a fully-insured individual (as defined in section 214(a)) shall be made as of the date of his death. In any case in which the deceased individual died before attaining age 62 and would not have attained age 62 before the end of the entitlement month of the widow (or surviving divorced wife), the deceased individual’s imputed old-age insurance benefit shall be deemed to be zero.</continuation-text></clause> 
<clause id="HB8CD9196F4FD46EBA897A4B5C5FCAA38" indent="up1"><enum>(iii)</enum><text>The amount of the imputed husband’s insurance benefit of the deceased individual for the entitlement month of the widow (or surviving divorced wife) is the amount of the husband’s insurance benefit under subsection (c) to which he would have been entitled for such month (assuming, for purposes of reduction under subsection (k)(3)(A), the entitlement to an old-age insurance benefit for such month, if any, as described in clause (ii))—</text> 
<subclause id="HBBBF38E3B87445E1B2FCD4D1D1B4BB00"><enum>(I)</enum><text>determined, in the case of such a deceased individual who had attained age 62 as of the date of his death, as if he had applied for such benefit in the month of his death and had survived throughout the subsequent period ending with her entitlement month, or</text></subclause> 
<subclause id="H085605CDA9B04C14889E3956151E00F7"><enum>(II)</enum><text>determined, in the case of such a deceased individual who died before attaining age 62 but would have attained age 62 before the end of her entitlement month, as if he had survived throughout the subsequent period ending with her entitlement month and had applied for such benefit during the first month for which he would have been eligible for such benefit.</text></subclause><continuation-text continuation-text-level="clause">In any case in which the deceased individual died before he attained age 62 and would not have attained age 62 before the end of the entitlement month of the widow (or surviving divorced spouse), the deceased individual’s imputed husband’s insurance benefit shall be deemed to be zero.</continuation-text></clause></subparagraph> 
<subparagraph id="H92F904B9B33A40378B7511785CB1B1F0" indent="up1"><enum>(E)</enum> 
<clause id="H9389CA0F67BD4346A02EAAF9F57C14AD" display-inline="yes-display-inline"><enum>(i)</enum><text>For purposes of subparagraph (C), if the deceased individual died during a month for which he otherwise would have been entitled (but for his death) to an old-age insurance benefit under subsection (a) or a disability insurance benefit under section 223, or to a husband’s insurance benefit under subsection (c) based on the wages and self-employment income of the widow (or surviving divorced wife), the imputed deceased individual’s benefit for the entitlement month of the widow (or surviving divorced wife) is the sum of—</text> 
<subclause id="H351BF20CAAFD44B596EA0089D7274D8E" indent="up1"><enum>(I)</enum><text>the amount of the old-age or disability insurance benefit (if any) to which he would have been entitled for her entitlement month if he had survived throughout the period subsequent to his death and ending with such month, and</text></subclause> 
<subclause id="HEAA0C7526BF9448AA1C169E9DBF318A5" indent="up1"><enum>(II)</enum><text>the amount of the husband’s insurance benefit (if any) to which he would have been entitled for her entitlement month based on her wages and self-employment income if he had survived throughout the period subsequent to his death and ending with such month (assuming, for purposes of reduction under subsection (k)(3)(A), the entitlement to an old-age or disability insurance benefit for such month, if any, as described in subclause (I)).</text></subclause></clause> 
<clause id="HC8472038B23D422A0000BCBC4FD28D5" indent="up1"><enum>(ii)</enum><text>If the deceased individual otherwise would have been entitled (but for his death) to a disability insurance benefit under section 223 for the month in which he died, the amount determined under clause (i) shall be determined as if he had survived throughout the period commencing with the month of his death and ending with the entitlement month of the widow (or surviving divorced wife) and he had remained entitled to disability insurance benefits throughout such period (or until becoming entitled to old-age insurance benefits under subsection (a) during such period).</text></clause></subparagraph> 
<subparagraph id="H1BBC51B5A4834C4884E523806D26101E" indent="up1"><enum>(F)</enum><text>For purposes of subparagraph (C)(i)(II)—</text> 
<clause id="H4217AA899AE446F3A71DD08D5652F4B5"><enum>(i)</enum><text>In the case of a widow (or surviving divorced wife) who is entitled for her entitlement month to an old-age insurance benefit under subsection (a) or a disability insurance benefit under section 223, or otherwise would have been entitled (but for the deceased individual’s death) to a wife’s insurance benefit under subsection (b) for such month, the amount of her imputed survivor benefit for such month is the sum of—</text> 
<subclause id="H0EC259E8086F4C87B45DC1C36BC03635"><enum>(I)</enum><text>the amount of such old-age or disability insurance benefit (if any), and</text></subclause> 
<subclause id="H3A17E736164F4C088B6DA9004691D865"><enum>(II)</enum><text>the amount of such wife’s insurance benefit (if any), assuming, for purposes of reduction under subsection (k)(3)(A), the entitlement to an old-age insurance or disability insurance benefit for such month (if any), as described in subclause (I).</text></subclause></clause> 
<clause id="H4C076BE7ED924E038C59587BAAB402AA"><enum>(ii)</enum><text>In the case of a widow (or surviving divorced wife) who is not described in clause (i) but has attained (or would attain) age 62 as of the end of her entitlement month, the amount of her imputed survivor benefit is the sum of—</text> 
<subclause id="H4A2D4451F6C44B0089BABDCEC3716732"><enum>(I)</enum><text>the amount of the old-age insurance benefit under subsection (a) to which she would be entitled for such month if she filed application for such benefit during such month, and</text></subclause> 
<subclause id="H53E7D90C028A4F62A2907DF448BA6DC2"><enum>(II)</enum><text>the amount to which she otherwise would have been entitled (but for the deceased individual’s death) as a wife’s insurance benefit under subsection (b) for such month, based on the deceased individual’s wages and self-employment income, if she had filed application for such benefit during such month (assuming a primary insurance amount for the deceased individual determined under paragraph (2)(B) of this subsection and assuming, for purposes of reduction under subsection (k)(3)(A), the entitlement to an old-age insurance benefit for such month, if any, as described in subclause (I)).</text></subclause></clause><continuation-text continuation-text-level="subparagraph">In any case in which the widow (or surviving divorced wife) would not attain age 62 before the end of the her entitlement month, her imputed survivor benefit shall be deemed to be zero.</continuation-text></subparagraph> 
<subparagraph id="HD27D9A8D130F4091965E323399A25748" indent="up1"><enum>(G)</enum><text>The increased benefit cap determined under this subparagraph for the entitlement month of the widow (or surviving divorced wife) is the amount which would be the amount of a theoretical individual’s old-age insurance benefit under subsection (a) (reduced as provided in subsection (q)) if—</text> 
<clause id="H7ED8A857B3DD4AE9B3B78B3F5474B154"><enum>(i)</enum><text>such theoretical individual’s primary insurance amount for the first month of entitlement were equal to the average of the primary insurance amounts upon which old-age insurance benefits under subsection (a) are payable for—</text> 
<subclause id="H2D7BDE23A1714723B5B4BB0BB6629D9"><enum>(I)</enum><text>in any case in which the entitlement month of the widow (or surviving divorced wife) is the month of December, such month, or</text></subclause> 
<subclause id="H173E26F353944D8B931D7BF71552847D"><enum>(II)</enum><text>in any other case, the latest month of December preceding such entitlement month,</text></subclause></clause> 
<clause id="H6BE0C8FC3E634FF9AA2175A1D686D63"><enum>(ii)</enum><text>such first month of such theoretical individual’s entitlement to such old-age insurance benefit were the entitlement month of the widow (or surviving divorced spouse), and</text></clause> 
<clause id="HDCAB96F02DF94041BF00639D93A524ED"><enum>(iii)</enum><text>the month in which the theoretical individual attained or would attain retirement age (as defined in section 216(l)) were the month in which the widow (or surviving divorced wife) attained or would attain retirement age (as so defined).</text></clause></subparagraph> 
<subparagraph id="H4823C37B36DB44239512AA87FCC63FFB" indent="up1"><enum>(H)</enum><text>If, in determining the amount of the benefit under this section pursuant to this paragraph, the imputed old-age insurance benefit or imputed husband’s insurance benefit of the deceased individual was deemed to be zero pursuant to the last sentence of clause (ii) or (iii) of subparagraph (D), or the imputed survivor benefit of the widow (or surviving divorced wife) was deemed to be zero pursuant to the last sentence of subparagraph (F), effective for any month after the entitlement month of the widow (or surviving divorced wife) in which the deceased individual would have attained age 62 or she attains age 62, the Commissioner shall recompute the amount of the benefit under this paragraph by substituting a reference to such later month for each reference in the preceding provisions of this paragraph to her entitlement month.</text></subparagraph> 
<subparagraph id="HFA646D53721A44C9A14147E6D6857097" indent="up1"><enum>(I)</enum> 
<clause id="H284782F17D534F69838699608F9BFECA" display-inline="yes-display-inline"><enum>(i)</enum><text>Any reference in this paragraph to the widow’s insurance benefit (as determined under the preceding paragraphs of this subsection) shall be deemed a reference to such benefit, taking into account all applicable reductions and deductions under this title.</text></clause> 
<clause id="HDB1536F564A048978DF2464F3ED3BF08" indent="up1"><enum>(ii)</enum><text>Any reference in this paragraph to the imputed old-age insurance benefit or imputed husband’s insurance benefit described in subparagraph (D), the old-age insurance benefit, disability insurance benefit, or husband’s insurance benefit described in subparagraph (E), or the old-age insurance benefit, disability insurance benefit, or wife’s insurance benefit described in subparagraph (F) shall be deemed a reference to such benefit, taking into account applicable reductions under this section but disregarding reductions or deductions otherwise applicable under this title.</text></clause> 
<clause id="HEA064072E49346C5A2D9B7912F65BD1C" indent="up1"><enum>(iii)</enum><text>A widow’s insurance benefit which has been increased under this paragraph shall be subject to all reductions and deductions otherwise applicable to widow’s insurance benefits under this title, except that such benefit shall not be subject to any reduction otherwise applicable under subsection (q)(1).</text></clause></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAB8B236B04BA46889362B7ECB818757B"><enum>(b)</enum><header>Widower’s insurance benefits</header><text>Section 202(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(f)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H53A7DA9F6D264094A60012B6D2DDCC18" indent="up1"><enum>(9)</enum> 
<subparagraph id="HE5E7218AB1964EB097377500008F9DC9" display-inline="yes-display-inline"><enum>(A)</enum><text>In any case in which the amount of a widower’s insurance benefit (as determined under the preceding paragraphs of this subsection) for the entitlement month of the widower (or surviving divorced husband) is less than the minimum benefit amount for such month determined under subparagraph (C), the amount of such benefit for such month and each succeeding month shall be increased to such minimum benefit amount (or the amount most recently established in lieu thereof under section 215(i)).</text></subparagraph> 
<subparagraph id="H62E8041BEB88461E8889EFD3F6EBD58C" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, the term <term>entitlement month</term> of a widower (or surviving divorced husband) means, in connection with his benefit under this subsection, the first month of his entitlement to such benefit.</text></subparagraph> 
<subparagraph id="H99D4F2AC956B4B6FB36898636DEA10EF" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph (A), the minimum benefit amount determined under this subparagraph for the entitlement month of the widower (or surviving divorced husband) is an amount equal to the lesser of—</text> 
<clause id="H1AC0D1371176469185A488102F00FDA2"><enum>(i)</enum><text>75 percent of the sum of—</text> 
<subclause id="H56C7A46261764871B8CB4ECBB7B5D937"><enum>(I)</enum><text>the imputed deceased individual’s benefit for such month, as determined under subparagraph (D) or (E) (as applicable), and</text></subclause> 
<subclause id="H04CDBEA5A7E347459CDD1CF1D7C5E42D"><enum>(II)</enum><text>the imputed survivor benefit for such month, as determined under subparagraph (F), or</text></subclause></clause> 
<clause id="H1746A890EB574C7BA300F721001DFD63"><enum>(ii)</enum><text>the increased benefit cap determined under subparagraph (G) for such month.</text></clause></subparagraph> 
<subparagraph id="HA3BB63CDD94E406189B922B4A03DA700" indent="up1"><enum>(D)</enum> 
<clause id="H5497668E6A7F4408004B043B79ED9200" display-inline="yes-display-inline"><enum>(i)</enum><text>For purposes of subparagraph (C)(i)(I), if the deceased individual died in a month for which she was not entitled to any benefit under this title based on her wages or self-employment income or the wages and self-employment income of the widower (or surviving divorced husband), the imputed deceased individual’s benefit for the entitlement month of the widower (or surviving divorced husband) is the sum of—</text> 
<subclause id="HD2E557DD6AEF40B793CB1361926E81D8" indent="up1"><enum>(I)</enum><text>the imputed old-age insurance benefit (determined under clause (ii)) of the deceased individual for his entitlement month (if any), and</text></subclause> 
<subclause id="H7464AC0972F742EBB6D5B37800300955" indent="up1"><enum>(II)</enum><text>the imputed wife’s insurance benefit (determined under clause (iii)) of the deceased individual for his entitlement month (if any).</text></subclause></clause> 
<clause id="H3ED78B83C6AB48F693AE022D95A100AC" indent="up1"><enum>(ii)</enum><text>The amount of the imputed old-age insurance benefit of the deceased individual for the entitlement month of the widower (or surviving divorced husband) is the amount of the old-age insurance benefit to which she would have been entitled for such month—</text> 
<subclause id="HAC97E5A9BB7D4C58922BFA60E6AE1787"><enum>(I)</enum><text>determined, in the case of such a deceased individual who had attained age 62 as of the date of her death, as if she had applied for such benefit in the month of her death and had survived throughout the subsequent period ending with his entitlement month, or</text></subclause> 
<subclause id="H87A6B814C1824E53812203C812A8A3CD"><enum>(II)</enum><text>determined, in the case of such a deceased individual who died before attaining age 62 but would have attained age 62 before the end of his entitlement month, as if she had survived throughout the subsequent period ending with his entitlement month, and had applied for such benefit during the first month for which she would have been eligible for such benefit (assuming a primary insurance amount for the deceased individual determined under paragraph (2)(B) of this subsection).</text></subclause><continuation-text continuation-text-level="clause">For purposes of determining the deceased individual’s imputed old-age insurance benefit under this clause, the determination of whether the deceased individual was a fully-insured individual (as defined in section 214(a)) shall be made as of the date of her death. In any case in which the deceased individual died before attaining age 62 and would not have attained age 62 before the end of the entitlement month of the widower (or surviving divorced husband), the deceased individual’s imputed old-age insurance benefit shall be deemed to be zero.</continuation-text></clause> 
<clause id="HB915DE15674946608886E3DB3BAEB73D" indent="up1"><enum>(iii)</enum><text>The amount of the imputed wife’s insurance benefit of the deceased individual for the entitlement month of the widower (or surviving divorced husband) is the amount of the wife’s insurance benefit under subsection (b) to which she would have been entitled for such month (assuming, for purposes of reduction under subsection (k)(3)(A), the entitlement to an old-age insurance benefit for such month, if any, as described in clause (ii))—</text> 
<subclause id="H6ADFCF5F49BE45DAA8D2FBBA2E705D5"><enum>(I)</enum><text>determined, in the case of such a deceased individual who had attained age 62 as of the date of her death, as if she had applied for such benefit in the month of her death and had survived throughout the subsequent period ending with his entitlement month, or</text></subclause> 
<subclause id="H1FE7D67B7B6341A39436338809D20022"><enum>(II)</enum><text>determined, in the case of such a deceased individual who died before attaining age 62 but would have attained age 62 before the end of his entitlement month, as if she had survived throughout the subsequent period ending with his entitlement month and had applied for such benefit during the first month for which she would have been eligible for such benefit.</text></subclause><continuation-text continuation-text-level="clause">In any case in which the deceased individual died before she attained age 62 and would not have attained age 62 before the end of the entitlement month of the widower (or surviving divorced husband), the deceased individual’s imputed husband’s insurance benefit shall be deemed to be zero.</continuation-text></clause></subparagraph> 
<subparagraph id="HC233022A57844DF8A03654AE14070997" indent="up1"><enum>(E)</enum> 
<clause id="H50BFE0B903264E7B9D79A5738827BDD5" display-inline="yes-display-inline"><enum>(i)</enum><text>For purposes of subparagraph (C), if the deceased individual died during a month for which she otherwise would have been entitled (but for her death) to an old-age insurance benefit under subsection (a) or a disability insurance benefit under section 223, or to a wife’s insurance benefit under subsection (b) based on the wages and self-employment income of the widower (or surviving divorced husband), the imputed deceased individual’s benefit for the entitlement month of the widower (or surviving divorced husband) is the sum of—</text> 
<subclause id="HF2A6687B1B15422B92F584A6E633EDE9" indent="up1"><enum>(I)</enum><text>the amount of the old-age or disability insurance benefit (if any) to which she would have been entitled for his entitlement month if she had survived throughout the period subsequent to her death and ending with such month, and</text></subclause> 
<subclause id="HE28DEDD811384CFD006EE69CDBDC0B2" indent="up1"><enum>(II)</enum><text>the amount of the wife’s insurance benefit (if any) to which she would have been entitled for his entitlement month based on his wages and self-employment income if she had survived throughout the period subsequent to her death and ending with such month (assuming, for purposes of reduction under subsection (k)(3)(A), the entitlement to an old-age or disability insurance benefit for such month, if any, as described in subclause (I)).</text></subclause></clause> 
<clause id="HE87FB957D6AD456893A949001E35FF2" indent="up1"><enum>(ii)</enum><text>If the deceased individual otherwise would have been entitled (but for her death) to a disability insurance benefit under section 223 for the month in which she died, the amount determined under clause (i) shall be determined as if she had survived throughout the period commencing with the month of her death and ending with the entitlement month of the widower (or surviving divorced husband) and she had remained entitled to disability insurance benefits throughout such period (or until becoming entitled to old-age insurance benefits under subsection (a) during such period).</text></clause></subparagraph> 
<subparagraph id="H0414D2D0EC9F4C5097E0CEDD1556651B" indent="up1"><enum>(F)</enum><text>For purposes of subparagraph (C)(i)(II)—</text> 
<clause id="H001638F6590746EFB504972F30595F97"><enum>(i)</enum><text>In the case of a widower (or surviving divorced husband) who is entitled for his entitlement month to an old-age insurance benefit under subsection (a) or a disability insurance benefit under section 223, or otherwise would have been entitled (but for the deceased individual’s death) to a husband’s insurance benefit under subsection (c) for such month, the amount of her imputed survivor benefit for such month is the sum of—</text> 
<subclause id="H525186CE1B5348829286DDF159FFF1FA"><enum>(I)</enum><text>the amount of such old-age or disability insurance benefit (if any), and</text></subclause> 
<subclause id="HE0CAE4404A454FCC9E00A926829C063"><enum>(II)</enum><text>the amount of such husband’s insurance benefit (if any), assuming, for purposes of reduction under subsection (k)(3)(A), the entitlement to an old-age insurance or disability insurance benefit for such month (if any), as described in subclause (I).</text></subclause></clause> 
<clause id="HC432341624F04140A07638C43EDB3000"><enum>(ii)</enum><text>In the case of a widower (or surviving divorced husband) who is not described in clause (i) but has attained (or would attain) age 62 as of the end of his entitlement month, the amount of his imputed survivor benefit is the sum of—</text> 
<subclause id="HE992F4823E224BEA985573B8C9CA4D79"><enum>(I)</enum><text>the amount of the old-age insurance benefit under subsection (a) to which he would be entitled for such month if he filed application for such benefit during such month, and</text></subclause> 
<subclause id="H4863CA7A122B4C7DBD671647117EECDC"><enum>(II)</enum><text>the amount to which he otherwise would have been entitled (but for the deceased individual’s death) as a husband’s insurance benefit under subsection (c) for such month, based on the deceased individual’s wages and self-employment income, if he had filed application for such benefit during such month (assuming a primary insurance amount for the deceased individual determined under paragraph (2)(B) of this subsection and assuming, for purposes of reduction under subsection (k)(3)(A), the entitlement to an old-age insurance benefit for such month, if any, as described in subclause (I)).</text></subclause></clause><continuation-text continuation-text-level="subparagraph">In any case in which the widower (or surviving divorced husband) would not attain age 62 before the end of the his entitlement month, his imputed survivor benefit shall be deemed to be zero.</continuation-text></subparagraph> 
<subparagraph id="HEAF3A48D228C4D21B34B0039E2B02DF8" indent="up1"><enum>(G)</enum><text>The increased benefit cap determined under this subparagraph for the entitlement month of the widower (or surviving divorced husband) is the amount which would be the amount of a theoretical individual’s old-age insurance benefit under subsection (a) (reduced as provided in subsection (q)) if—</text> 
<clause id="H0F50EC8066D5486CA679393B7B006000"><enum>(i)</enum><text>such theoretical individual’s primary insurance amount for the first month of entitlement were equal to the average of the primary insurance amounts upon which old-age insurance benefits under subsection (a) are payable for—</text> 
<subclause id="HBB797B201D654D8FA0FA9EAFA9891819"><enum>(I)</enum><text>in any case in which the entitlement month of the widower (or surviving divorced husband) is the month of December, such month, or</text></subclause> 
<subclause id="H710F03CDD991413AA851CE58B71659AC"><enum>(II)</enum><text>in any other case, the latest month of December preceding such entitlement month,</text></subclause></clause> 
<clause id="HE630ACCD0B6C431D9596D9CA0841D2B"><enum>(ii)</enum><text>such first month of such theoretical individual’s entitlement to such old-age insurance benefit were the entitlement month of the widower (or surviving divorced husband), and</text></clause> 
<clause id="HF534316680214216ACEC4B75ED15007E"><enum>(iii)</enum><text>the month in which the theoretical individual attained or would attain retirement age (as defined in section 216(l)) were the month in which the widower (or surviving divorced husband) attained or would attain retirement age (as so defined).</text></clause></subparagraph> 
<subparagraph id="H94248FE0957949D4AD98B984D609DEC6" indent="up1"><enum>(H)</enum><text>If, in determining the amount of the benefit under this section pursuant to this paragraph, the imputed old-age insurance benefit or imputed wife’s insurance benefit of the deceased individual was deemed to be zero pursuant to the last sentence of clause (ii) or (iii) of subparagraph (D), or the imputed survivor benefit of the widower (or surviving divorced husband) was deemed to be zero pursuant to the last sentence of subparagraph (F), effective for any month after the entitlement month of the widower (or surviving divorced husband) in which the deceased individual would have attained age 62 or he attains age 62, the Commissioner shall recompute the amount of the benefit under this paragraph by substituting a reference to such later month for each reference in the preceding provisions of this paragraph to her entitlement month.</text></subparagraph> 
<subparagraph id="HF60EC7DFB6B144169ECDF31C569BCD8B" indent="up1"><enum>(I)</enum> 
<clause id="HA6696EF85F074A189D79D000DB01B6" display-inline="yes-display-inline"><enum>(i)</enum><text>Any reference in this paragraph to the widower’s insurance benefit (as determined under the preceding paragraphs of this subsection) shall be deemed a reference to such benefit, taking into account all applicable reductions and deductions under this title.</text></clause> 
<clause id="HD0698414CD2544B2B55C3CCB937D00D6" indent="up1"><enum>(ii)</enum><text>Any reference in this paragraph to the imputed old-age insurance benefit or imputed wife’s insurance benefit described in subparagraph (D), the old-age insurance benefit, disability insurance benefit, or wife’s insurance benefit described in subparagraph (E), or the old-age insurance benefit, disability insurance benefit, or husband’s insurance benefit described in subparagraph (F) shall be deemed a reference to such benefit, taking into account applicable reductions under this section but disregarding reductions or deductions otherwise applicable under this title.</text></clause> 
<clause id="HCF5166681B534469A22761639C00B9AC" indent="up1"><enum>(iii)</enum><text>A widower’s insurance benefit which has been increased under this paragraph shall be subject to all reductions and deductions otherwise applicable to widower’s insurance benefits under this title, except that such benefit shall not be subject to any reduction otherwise applicable under subsection (q)(1).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6B3C42FFB09441A4924F42B47CF698E5"><enum>(c)</enum><header>Cost-of-living adjustments to guaranteed widow’s and widower’s insurance benefits</header><text>Section 215(i)(2)(A)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(i)(2)(A)(ii)</external-xref>) is amended—</text> 
<paragraph id="H9438BFE41BB94349BA14ABA932B83EA"><enum>(1)</enum><text>in subclause (II), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HD36CECAFDFA94F29B9FF6E12A13BE8C3"><enum>(2)</enum><text>in subclause (III), by striking <quote>1978.</quote> and inserting <quote>1979, and</quote>;</text></paragraph> 
<paragraph id="H490F5BED8D9D4C3EAE0063281259A990"><enum>(3)</enum><text>by adding at the end the following new subclause:</text> 
<quoted-block id="H66F800AC69BB4EE9A4E887ABAF64765E"> 
<subclause indent="up3" id="H3F1917065CA94D6C97F6222072B507D0"><enum>(IV)</enum><text>the benefit amount to which an individual is entitled for that month under subsection (e) or (f) of section 202 if such benefit amount has been increased under paragraph (10) of such subsection.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4CB3EB51411648958269C2AC45B9B95D"><enum>(4)</enum><text>in the matter following subclause (IV) (added by paragraph (3)), by striking <quote>(I), (II), and (III)</quote> and inserting <quote>(I), (II), (III), and (IV)</quote>.</text></paragraph></subsection> 
<subsection id="HBD629FE458004BD68C80AE3EE4FE82E8"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to widow’s and widower’s insurance benefits for which applications are filed in months after November 2005.</text></subsection></section> 
<section id="HE5C18D4AB2F849E8A12BED2EF9A34FBF"><enum>16.</enum><header>Limitation on benefits of married couple to level of maximum worker benefits</header> 
<subsection id="H0D6C2546C84B4D6C9994FFE56F2C56EC"><enum>(a)</enum><header>Wife’s insurance benefits</header><text>Section 202(b)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(b)(2)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="traditional" id="H7B0F4A2B29C44C958CCD68ED2CB969E6" display-inline="no-display-inline"> 
<paragraph id="H954A2448E52E464694EDA9DF6E25B463" indent="up1"><enum>(2)</enum><text>Except as provided in subsections (k)(5) and (q), such wife’s insurance benefit for each month shall be equal to the excess (not less than zero) of—</text> 
<subparagraph id="HB1FB238F0B604F0BACC31257DDC95E5D" display-inline="no-display-inline"><enum>(A)</enum><text>the lesser of—</text> 
<clause id="H617940208939437DBF90C9BCE075A6D8" display-inline="no-display-inline"><enum>(i)</enum><text>150 percent of her husband’s primary insurance amount, or</text></clause> 
<clause id="HDF7CA50FCEB34309A37C44A15BBC8C4"><enum>(ii)</enum><text>the primary insurance amount for such month of a hypothetical individual—</text> 
<subclause id="H6B8612FEFCD54584AA79431CE5B12D7" display-inline="no-display-inline"><enum>(I)</enum><text>who is entitled to old-age insurance insurance benefits for such month,</text></subclause> 
<subclause id="HC7EAAF28E46147A300C25B887C6D83F"><enum>(II)</enum><text>who became entitled to such benefit upon attaining age 62 during the month in which her husband became entitled to old-age insurance benefits, and</text></subclause> 
<subclause id="H48C0B8C2B0D44893BF9F830654569D8E"><enum>(III)</enum><text>to whom wages and self-employment income were credited in each of such hypothetical individual’s elapsed years (within the meaning of section 215(b)(2)(B)(iii)) in an amount equal to the maximum amount includible under this title as wages and self-employment income for such year, over</text></subclause></clause></subparagraph> 
<subparagraph id="H4B55A824DBCB4971BEE007E288F6937F"><enum>(B)</enum><text>the primary insurance amount of her husband.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1E5C2F6ACDF841F1AFF51795CF512B97"><enum>(b)</enum><header>Husband’s insurance benefits</header><text>Section 202(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(c)(2)</external-xref>) is amended to read as follows:</text>

<paragraph id="HA0A29255E2144D9880DA2D0491D7D36F" display-inline="no-display-inline" indent="up1"><enum>(2)</enum><text>Except as provided in subsections (k)(5) and (q), such husband’s insurance benefit for each month shall be equal to the excess (not less than zero) of—</text> 
<subparagraph id="H8D9EF5ED64814A6CAA95B5B23043A496" display-inline="no-display-inline"><enum>(A)</enum><text>the lesser of—</text> 
<clause id="HB32701F2377644D6B1FB2331D46F74D9" display-inline="no-display-inline"><enum>(i)</enum><text>150 percent of his wife’s primary insurance amount, or</text></clause>

<subclause id="HAAA4B785C455490ABCB15E94D0B784FA" display-inline="no-display-inline"><enum>(I)</enum><text>who is entitled to old-age insurance insurance benefits for such month,</text></subclause> 
<subclause id="H5D8CA5086F2D4E3DBAA947CA7FF23D9D"><enum>(II)</enum><text>who became entitled to such benefit upon attaining age 62 during the month in which his wife became entitled to old-age insurance benefits, and</text></subclause> 
<subclause id="H9EDA1172776C4EB49082A06DADE58801"><enum>(III)</enum><text>to whom wages and self-employment income were credited in each of such hypothetical individual’s elapsed years (within the meaning of section 215(b)(2)(B)(iii)) in an amount equal to the maximum amount includible under this title as wages and self-employment income for such year, over</text></subclause></clause></subparagraph> 
<subparagraph id="H2970D58142F44CFDA3E27970A1BA73CD"><enum>(B)</enum><text>the primary insurance amount of his wife.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB9AABE26248A41BE86DAE9F159E3D45E" commented="no"><enum>(c)</enum><header>Application of family maximum</header><text>Section 203(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/403">42 U.S.C. 403(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="traditional" id="H70AB24E514E54606B9D7C673A3D675A0" display-inline="no-display-inline"> 
<paragraph id="HC54F65D8015E470E96C1B08DBE3BB93D" indent="up1" commented="no"><enum>(11)</enum><text>For purposes of determining under this subsection the amount of reduction in total monthly benefits to which beneficiaries may be entitled for a month on the basis of the wages and self-employment income of an individual, the amount of a wife’s insurance benefit or a husband’s insurance benefit for each month based on such wages and self-employment income shall be deemed to be equal to one-half of the primary insurance amount of the individual for such month (subject to subsections (k)(5) and (q) of section 202).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H586798BBDC454D888100AD854573E13B"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to wife’s insurance benefits and husband’s insurance benefits in cases in which the spouse becomes eligible for old-age insurance benefits or disability insurance benefits in any calendar year after 2005.</text></subsection></section>
