<official-title>To amend title XVIII of the Social Security Act to extend the annual enrollment periods of the Medicare prescription drug benefit program and under the Medicare Advantage program, and to suspend Medicare prescription drug late enrollment penalties for two years after the initial enrollment period.</official-title>

<section id="H33A86BFE0AC44E2EA9F27BC7859D008C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Medicare Beneficiaries’ Informed Choice Act of 2005</short-title></quote>. </text></section> 
<section id="HFFE06FF228834E2A9978AB1047607075"><enum>2.</enum><header>Extension of annual enrollment periods for the Medicare prescription drug benefit program and Medicare Advantage program</header> 
<subsection id="HE58810262D144D2D9330D82BD019C474"><enum>(a)</enum><header>In general</header> 
<paragraph id="H6A5A75319ACF4E4789192DF398F5A503"><enum>(1)</enum><header>Enrollment for 2006</header><text>Clause (iii) of section 1851(e)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-21">42 U.S.C. 1395w–21(e)(3)(B)</external-xref>) is amended by striking <quote>May 15, 2006</quote> and inserting <quote>November 14, 2006</quote>.</text></paragraph> 
<paragraph id="HE26B588658DF4E6181A781D084F1BD95"><enum>(2)</enum><header>Enrollment for subsequent years</header><text>Clause (iv) of such section is amended by striking <quote>beginning on November 15 and ending on December 31 of the year before such year</quote> and inserting <quote>the six-month period beginning on November 15 of the year before such year</quote>.</text></paragraph></subsection> 
<subsection id="HFDB5D81160C34FF6A411249DAF41A3CF"><enum>(b)</enum><header>Conforming effectiveness of election</header><text>Section 1851(f)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-21">42 U.S.C. 1395w–21(f)(3)</external-xref>) is amended by inserting after <quote>the following year</quote> the following: <quote>, except that in the case of an election made on or after January 1 of a year, the election shall take effect on the first day of the first month that begins at least 14 days after the date of such election</quote>.</text> </subsection></section> 
<section id="HF348C3BCE4EC44B10003B2A00A561D6"><enum>3.</enum><header>Suspension of late enrollment penalties for Medicare prescription drug benefit</header><text display-inline="no-display-inline">Section 1860D–13(b)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-113">42 U.S.C. 1395w–113(b)(3)(B)</external-xref>) is amended by inserting <quote>more than two years</quote> after <quote>any month beginning</quote>.</text></section> 
<section id="H715A1AF2CF274C48AA89F3750331AEE4"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall be effective as if included in the enactment of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text> </section>
