<section section-type="section-one" id="HE43237BBFD164391BC2D19C530EE5F98" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Vaccine Authority Act</short-title></quote>.</text></section> 
<section id="H6F6BEF8291534EC8BBA783FD1898F944"><enum>2.</enum><header>National Vaccine Authority</header><text display-inline="no-display-inline">Title XVII of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300u">42 U.S.C. 300u et seq.</external-xref>) is amended by adding at the end the following section:</text>

<section id="H6322C23E84D14073A73331ED58950683"><enum>1711.</enum><header>National Vaccine Authority</header> 
<subsection display-inline="yes-display-inline" id="H0B24EC18BEF041A78BD16E82475116A"><enum>(a)</enum><header>In general</header><text>There is established within the Department of Health and Human Services an administrative unit to be known as the National Vaccine Authority. There shall be in such Department the position of Assistant Secretary for Vaccines. The Assistant Secretary shall be the head of the National Vaccine Authority, and shall be appointed by and shall report to the Secretary. The Secretary shall carry out this section acting through the Assistant Secretary.</text></subsection> 
<subsection id="HEB391AF68DC149DEA500BAB3836FB51B"><enum>(b)</enum><header>Federal and private vaccine contracts; quantities; locations</header> 
<paragraph id="HA153A5F1BD794AD4BF674BBD1044F216"><enum>(1)</enum><header>In general</header><text>The Assistant Secretary for Vaccines (in this section referred to as the <quote>Assistant Secretary</quote>) shall ensure that the National Vaccine Authority serves as the central clearinghouse for the Department of Health and Human Services with respect to Federal and private contracts for the purchase or distribution of vaccines. The Assistant Secretary shall monitor the supply and distribution of vaccines under such contracts, including ongoing monitoring of the location of vaccines under the contracts.</text></paragraph> 
<paragraph id="H433EF2C909C74C09B5498EF7F66C23"><enum>(2)</enum><header>Authority for federal contracts</header><text>The Assistant Secretary shall enter into contracts to increase production of vaccines when necessary.</text></paragraph> 
<paragraph id="H666E8B0C2EF74CAFB0CB31B6CB542EF6"><enum>(3)</enum><header>Consultation</header><text>The Assistant Secretary shall consult with manufacturers of vaccines in order to determine the availability of vaccines.</text></paragraph></subsection> 
<subsection id="HCBB5B5C20BC44C62ABF937D8DB83E644"><enum>(c)</enum><header>Supervision of identification of vaccine strains</header> 
<paragraph id="H30BF27BB57624BBB816FE0E100002BD4"><enum>(1)</enum><header>In general</header><text>The Assistant Secretary shall oversee the identification of vaccine strains.</text></paragraph> 
<paragraph id="H9403DE9204F04B9982A791603EFFF0B5"><enum>(2)</enum><header>Centers for disease control and prevention</header><text>The Assistant Secretary shall establish, and periodically review and as appropriate revise, time tables by which the Director of the Centers for Disease Control and Prevention is required to identify the strains necessary to produce vaccines.</text></paragraph></subsection> 
<subsection id="H4071D1C36C7A49AE94F18E42FF5F009D"><enum>(d)</enum><header>Monitoring of vaccine production</header><text>The Assistant Secretary shall identify any delays in the production of vaccines and shall ensure that such delays are accounted for as the delays occur.</text></subsection> 
<subsection id="H5B4A2BAD3EE643E6BB7251400236D090"><enum>(e)</enum><header>Supervision of vaccine distribution</header><text>The Assistant Secretary shall oversee and monitor the distribution of vaccines. In carrying out the preceding sentence, the Assistant Secretary shall identify parties to contracts for the distribution of vaccines and the entities with responsibilities under the contracts for the distribution of the vaccines, including pursuant to third-party contracts. In the event of a delay in the distribution of vaccines, the Assistant Secretary shall identify the reasons for the delay.</text></subsection> 
<subsection id="H9094CA105E4549AB82DA66794550E645"><enum>(f)</enum><header>Emergency response and contingency plan</header><text>The Assistant Secretary shall develop, and periodically review and as appropriate revise, an emergency response and contingency plan regarding vaccines.</text></subsection> 
<subsection id="HED7B5F8295CF4AC482EED44C00DC1200"><enum>(g)</enum><header>Commission on juvenile vaccines</header><text>The Assistant Secretary shall establish a commission to determine the current state of juvenile vaccines.</text></subsection> 
<subsection id="H20A20AD9EBB24F8D96D1AF70A3041B68"><enum>(h)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this section, there are authorized to be appropriated such sums as may be necessary for each of the fiscal years 2006 through 2010.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
