<section id="H67F5B9B40A9342E590DC91396813ED4E" section-type="section-one"><enum>1.</enum><header>Clarification of nonrecognition rules to tiered common trusts funds</header> 
<subsection id="HE47CBE5980F24E138304ED680002F576"><enum>(a)</enum><header>In general</header><text>Subsection (h) of <external-xref legal-doc="usc" parsable-cite="usc/26/584">section 584</external-xref> of the Internal Revenue Code of 1986 (relating to nonrecognition treatment for certain transfers to regulated investment companies) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H3D27583C225D407EB05FB28966AEAF05"><enum>(5)</enum><header>Tiered common trust funds</header> 
<subparagraph id="H6A255D30F43C4EA29FEEBA5CD3B88FB"><enum>(A)</enum><header>In general</header><text>If—</text> 
<clause id="H0BBF42CF7E084BF5920005A2DD9900E"><enum>(i)</enum><text>substantially all of the assets of a common trust fund is stock in one or more regulated investment companies,</text></clause> 
<clause id="H470BA466E57247FFA16653D8691437E4"><enum>(ii)</enum><text>at least some of such stock was received in an exchange described in paragraph (1)(B) on which no gain or loss was recognized, and</text></clause> 
<clause id="H699641120D39423AAEBC08B990AD23F4"><enum>(iii)</enum><text display-inline="yes-display-inline">the stock described in clause (i) is distributed by such common trust fund to participants in such common trust fund in exchange solely for their interests in such common trust fund,</text></clause><continuation-text continuation-text-level="subparagraph">no gain or loss shall be recognized by such common trust fund by reason of such distribution, and no gain or loss shall be recognized by any participant in such common trust fund by reason of such exchange.</continuation-text></subparagraph> 
<subparagraph id="H034AC4991C3E44CFA6F4CF16CF3C84"><enum>(B)</enum><header>Basis rules</header><text>The basis of stock received in an exchange referred to in subparagraph (A)(iii) shall be determined under paragraph (2)(B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3F0625A9BF69427CA5D00A8E5E3CCC"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to distributions after the date of the enactment of this Act in taxable years ending after such date.</text> </subsection></section>
