<subsection id="HB86F3E78200647B0BFB4D03E67001BFF"><enum>(a)</enum><header>Change in minimum wages</header><text>Section 212(n)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)(A)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="traditional" id="H40FFF536C5844D0FAD3417C1C955620" display-inline="no-display-inline"> 
<subparagraph id="HFA41835B8C5547F68B1D20751ED13D3D" indent="up1"><enum>(A)</enum><text>The employer—</text> 
<clause id="HE73F2136743044B2A298FC149C2DCB18" display-inline="no-display-inline"><enum>(i)</enum><text>is offering and will offer during the period of authorized employment to aliens admitted or provided status as an H–1B nonimmigrant wages that are at least—</text> 
<subclause id="HB4B6A519716D4C408D7D06C2E8B99195" display-inline="no-display-inline"><enum>(I)</enum><text>the locally determined prevailing wage level for the occupational classification in the area of employment;</text></subclause> 
<subclause id="HE13FCBC7B73448339061A739D7CCCEF2"><enum>(II)</enum><text>the median average wage for all workers in the occupational classification in the area of employment; or</text></subclause> 
<subclause id="H92D6CF679F114E7E9DBDD17DDED8EC13"><enum>(III)</enum><text>the median wage for skill level two in the occupational classification found in the most recent Occupational Employment Statistics survey;</text></subclause><continuation-text continuation-text-level="clause">whichever is greatest, based on the best information available as of the time of filing of the application; and</continuation-text></clause> 
<clause id="H38EFA24F51DB43A0B119D5AC843D3753"><enum>(ii)</enum><text>will provide working conditions for such nonimmigrant that will not adversely affect the working conditions of workers similarly employed.</text></clause><continuation-text continuation-text-level="subparagraph"> The wage determination methodology used under clause (i) shall be submitted with the application.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H80C5CE1815F1427DBED354F05D878C57"><enum>(b)</enum><header>Provision of W–2 forms</header><text display-inline="yes-display-inline">Section 212(n)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)</external-xref>) is amended by inserting after subparagraph (G) the following new subparagraph: </text> 
<quoted-block style="traditional" id="HC5896CB19AD54B7CBF495891F5A10095" display-inline="no-display-inline"> 
<subparagraph id="H3975E5B296DB4F36B007385D6D8637E9" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">If the employer employed, in such previous period as the Secretary shall specify, one or more H–1B nonimmigrants, the application shall be accompanied by the Internal Revenue Service Form W–2 Wage and Tax Statement filed by the employer with respect to such nonimmigrants for such period.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H70B73531BCA54BE7971DE9E785D7977"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to applications filed on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H4F6CF2D76500461F9D45C6102416CD07"><enum>3.</enum><header>Good faith recruitment requirement</header> 
<subsection id="HEF0A212174424234834274D2EDD6F469"><enum>(a)</enum><header>Extending time period for no displacement</header><text>Section 212(n) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)</external-xref>) is amended—</text> 
<paragraph id="H56B6DD0D02B04A15946471E8D2267F23"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(E)(i), by striking <quote>90 days</quote> and inserting <quote>180 days</quote> each place it appears; and</text></paragraph> 
<paragraph id="HEC8390ECBBDF494B9227088198E1002D"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)(C)(iii), in the matter before subclause (I), by striking <quote>90 days</quote> and inserting <quote>180 days</quote> each place it appears.</text></paragraph></subsection> 
<subsection id="H9E64F2BF070C4C76846787B25452B810"><enum>(b)</enum><header>Requiring active recruitment</header><text>Section 212(n)(1)(G)(i)(I) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)(G)(i)(I)</external-xref>) is amended by inserting <quote>actively</quote> before <quote>recruit</quote>.</text></subsection> 
<subsection id="HA9392BD4A6B644F0910948C1BE92C696"><enum>(c)</enum><header>Prohibition of outplacement</header><text>Section 212(n) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)</external-xref>) is amended—</text> 
<paragraph id="H24903878427540A8965647076CBAA7C2"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subparagraph (F) of paragraph (1) to read as follows:</text> 
<quoted-block style="traditional" display-inline="no-display-inline" id="H16ADBC7275C644A489F1EA576D44E008"> 
<subparagraph id="H93DE147A6F36491697F45160869D2C" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">The employer shall not place, out-source, lease, or otherwise contract for the placement of an alien admitted or provided status as an H–1B nonimmigrant with another employer, regardless of whether or not such other employer is an H–1B-dependent employer.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8DA7DE7E55EA4156A6253DBF02CD5F10"><enum>(2) </enum><text>by striking subparagraph (E) of paragraph (2).</text></paragraph></subsection> 
<subsection id="HA337585503574596BBB4B0321C3F7375"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to applications filed on or after the date of the enactment of this Act, except that the amendments made by subsection (a) shall not apply to displacements for periods occurring more than 90 days before such date.</text></subsection></section> 
<section id="H4F6F87F35B614C5893C5DC3EAA5DBBC"><enum>4.</enum><header>Notice requirement</header> 
<subsection id="H1A47CB2B419B40C38295F2B34100A000"><enum>(a)</enum><header>In general</header><text>Section 212(n) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)</external-xref>) is further amended—</text> 
<paragraph id="H45D9619202D647E4B16BB8AC43DC72B0"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>and the employer certifies that the prior notice requirement of paragraph (6) has been met with respect to the application</quote>; and</text></paragraph> 
<paragraph id="H45784C52FCC043D28D8D763BC7DDB6E1"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HF5BD6F67107549C5987213003C1C835F" display-inline="no-display-inline"> 
<paragraph id="HD028B6F9FAA3488784EE23311717B305" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), the prior notice requirement of this paragraph, with respect to an application of an employer, is that employer has made copies of the application (or, a summary of essential information derived from such application, including the number of H–1B nonimmigrants being sought, their occupational classifications, the wages offered, the period of intended employment, the locations at which they will be employed, and a statement that a copy of the application is available for public inspection in conspicuous locations at the employer’s principal place of business and at worksites where H–1B nonimmigrants will be employed) accessible for examination by affected United States and foreign workers at least 30 days in advance of the filing of the application with the Secretary of Labor through—</text> 
<subparagraph id="H82E78636EC274F78BF4D5EAA9EC54E"><enum>(A)</enum><text>posting of such application (or summary) in conspicuous locations at worksites where H–1B nonimmigrants will be employed;</text></subparagraph> 
<subparagraph id="H3C33C7F8DACF4739B05D0008E6F0F4A2"><enum>(B)</enum><text display-inline="yes-display-inline">electronic notification to employees in the occupational classifications for which H–1B nnimmigrants are being sought; and</text></subparagraph> 
<subparagraph id="HA76C32CF5B574C6D915557A13BAB5CD"><enum>(C)</enum><text display-inline="yes-display-inline">provision of a copy of the application to each H–1B nonimmigrant on whose behalf the application is being filed.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8B2D04FB4DF14708B9E057C1DB020001"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to applications filed more than 30 days after the date of the enactment of this Act.</text></subsection></section> 
<section id="H899F9F1DBE6C47128C25BECC313FA1F5"><enum>5.</enum><header>Reduction of period of authorized admission as H–1B nonimmigrant</header> 
<subsection id="HB24B816B2C314CD19079F6CFC07875B7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 214(g)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(4)</external-xref>) is amended by striking <quote>6 years</quote> and inserting <quote>3 years</quote>.</text></subsection> 
<subsection id="H1DA5DB13695A405097A7E44B4C3171FD"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to the period of authorized admission of an alien as an H–1B nonimmigrant under section 101(a)(15)(H)(i)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(B)</external-xref>) that begins on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H89C78FD6369F4D46948CFBF68550586"><enum>6.</enum><header>Removal of exemption from H–1B numerical limitation for certain aliens</header> 
<subsection id="HF5C09FE2E2B549AD886E1EDF1B339200"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 214(g)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(5)</external-xref>) is amended—</text> 
<paragraph id="H01F03E1A214943D3A268F24BB784E775"><enum>(1)</enum><text>in subparagraph (A), by adding <quote>or</quote> after the semicolon;</text></paragraph> 
<paragraph id="H51E7798EEF724346A7BE7F2171B1A6C2"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>; or</quote> and inserting a period; and</text></paragraph> 
<paragraph id="H61691225D068480AB4AF96818F34DFF5"><enum>(3)</enum><text>by striking subparagraph (C).</text></paragraph></subsection> 
<subsection id="HBF1C21C1C0D744CC98F700C200DD4ED7" commented="no"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to the issuance of a visa (or other provision of status) under section 101(a)(15)(H)(i)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(B)</external-xref>) on or after the first day of the first fiscal year beginning after the date of the enactment of this Act.</text></subsection></section> 
<section id="H15D79BDCBA554715924DD5D3CA723E36"><enum>7.</enum><header>Requirement of a degree from certain institutions for H–1B specialty occupation nonimmigrants</header> 
<subsection id="HB49E23BCA6C0473993301DF415F59500"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 214(i)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(i)(2)</external-xref>) is amended—</text> 
<paragraph id="H44051B13E4A249FDBB79B9B606B76421"><enum>(1)</enum><text>in subparagraph (A), by adding <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H05D530347E0C4BECB1A33C2BE2BA22DF"><enum>(2)</enum><text>in subparagraph (B), by inserting <quote>, from a bona fide educational institution in the United States or from an educational institution that is at least equivalent to such an institution in the United States,</quote> after <quote>paragraph (1)(B)</quote>;</text></paragraph> 
<paragraph id="H02900C3FC3B740CEBD21E82476F5DE7C"><enum>(3)</enum><text> in subparagraph (B), by striking <quote>, or</quote> and inserting a period; and</text></paragraph> 
<paragraph id="H56157650355441528C40DFD01364138C"><enum>(4)</enum><text>by striking subparagraph (C).</text></paragraph></subsection> 
<subsection id="H83D51A3017014FF0A9F4B9BC77B2B2F6"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to applications filed on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="HD5829066208E4FF79F92E0BE1023ABE3"><enum>8.</enum><header>Tripling H–1B nonimmigrant petitioner fee</header> 
<subsection id="HCC13C1F0CC4C4DC68C24820500F2BA6D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 214(c)(9)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(9)(B)</external-xref>) is amended by striking <quote>$1,500</quote> and inserting <quote>$4,500</quote>.</text></subsection> 
<subsection id="H7E80A82FE6CC45B9A35D4956E1A600CF"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 214(c)(9)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(9)(A)</external-xref>) is amended, in the matter preceding clause (i), by striking <quote>before</quote>. </text></subsection> 
<subsection id="H4A6A993F88ED4872B60400524FFADEE3"><enum>(c)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to petitions filed on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H98E5A86C6EF84EEDBC003786863549D8"><enum>9.</enum><header>Labor enforcement</header> 
<subsection id="HD60FB06D44914851997CDD19980927CF"><enum>(a)</enum><header>Centralization of administrative and enforcement functions</header><text>Section 212(n)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="H466D92D122884C1989BBB52E8A48DB2" display-inline="no-display-inline"> 
<subparagraph id="H1CABFC064D0944A485A8238964F3FC40" indent="up2"><enum>(J)</enum><text>The Secretary shall be responsible under this paragraph for investigations of wage complaints, as well as investigations of allegations of fraud in the filing of applications under this subsection.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD7B67D8136E8400AA03E49EAC5E8D5C6"><enum>(b)</enum><header>Audits</header><text>Section 212(n)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)(A)</external-xref>) is amended by adding at the end the following: <quote>In addition, the Secretary may conduct surveys of the level of compliance by employers with the provisions and requirements of this subsection and may conduct annual compliance audits in the case of employers that employ H–1B nonimmigrants. In the case of an employer that employs H–1B nonimmigrants that represent 15 percent or more of the total number of individuals employed by the employer, the Secretary shall conduct annual compliance audits of such employer.</quote>.</text></subsection></section> 
<section id="H20432EE0DBA04D9A9D24A971A52F6400"><enum>10.</enum><header>Private right of action</header> 
<subsection id="HEE84244F7C4D4636802798469C3BEAD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 212(n)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)</external-xref>), as amended by section 8(a), is further amended by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HC08562D5BA9D4721A0DE5CE520D655D0" display-inline="no-display-inline"> 
<subparagraph id="HDE0FFD2249494657BF8948E46233B0B3" indent="up2"><enum>(K)</enum><text display-inline="yes-display-inline">In addition to any other remedies available under this paragraph, a person who is harmed by a violation by an employer of a requirement of this subsection may bring a civil action against the employer in any court of competent jurisdiction for damages or other appropriate relief.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF08B51BE0DD947C3B1FF58C0EAF7B173"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to violations occurring on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="HF510B892E1EB4E0E9559725E4DB85813"><enum>11.</enum><header>Application of nondisplacement requirement to all H–1B employers</header> 
<subsection id="H66E43A40133342ABAD87D5FA24D4CC81"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 212(n)(1)(E)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)(E)(ii)</external-xref>) is amended by striking <quote>an H–1B dependent employer (as defined in paragraph (3))</quote> and inserting <quote>an employer that employs H–1B non-immigrants</quote>.</text></subsection> 
<subsection id="H7B5789C8244B42FF9E601EDF3DB42C19" display-inline="no-display-inline"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to applications filed on or after the date of the enactment of this Act.</text></subsection></section>
