<official-title>To protect the right of elected and appointed officials to express their religious beliefs through public prayer.</official-title>

<section id="H3907DFF744394338B0B3CFFF38C6CF99" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Prayer Protection Act of 2005</short-title></quote>.</text></section> 
<section id="HC1AD089C787B4BCBAF31EAD468A1BD26"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="HE07323E64CA740CD93451500C4CC2FFC"><enum>(1)</enum><text display-inline="yes-display-inline"> The Establishment Clause of the First Amendment to the United States Constitution was intended by our Founding Fathers to prohibit one religious denomination from enjoying the exclusive backing of government and to prohibit the Federal establishment of any type of religious uniformity or orthodoxy that rewards observers and punishes violators.</text></paragraph> 
<paragraph id="H1CEE59E133D24AC898F184C6D453995C"><enum>(2)</enum><text>The First Amendment guarantees the right of elected and appointed officials to express their religious beliefs through public prayer.</text></paragraph> 
<paragraph id="HDF7181A09F8A41F894FA3DE44E473752"><enum>(3)</enum><text>The exercise of this right does not violate the Establishment Clause.</text></paragraph> 
<paragraph id="HAD68679F3AF94DFDB020DDEDAB7DF2DF"><enum>(4)</enum><text>The courts and the legislatures of the several States are in the best position to protect this right.</text></paragraph> 
<paragraph id="H7E3DB622D0F743AD99893776C71CFFCA"><enum>(5)</enum><text>Article III, Section 2, clause 2 of the United States Constitution expressly grants Congress the authority to define the appellate jurisdiction of the Federal court system.</text> </paragraph></section> 
<section id="HC6A19F2991D046A88002FB5B782F24EE"><enum>3.</enum><header>Limitation on appellate jurisdiction</header> 
<subsection id="H9FEE36EF902747579ED3C1E0D948E03"><enum>(a)</enum><header>Amendment to Title 28</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/81">Chapter 81</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>

<section id="H3A5E6C4899CA4D0FA65D128056CB12DB"><enum>1260.</enum><header>Matters not reviewable</header><text display-inline="no-display-inline">Notwithstanding any other provision of this chapter, the Supreme Court shall not have jurisdiction to review, by appeal, writ of certiorari, or otherwise, any matter that relates to the alleged establishment of religion involving an entity of the Federal Government or a State or local government, or an officer or agent of the Federal Government or a State or local government, acting in an official capacity, concerning the expression of public prayer by that entity, officer, or agent.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB2103D388B2A4B95AA48B308D85F66F9"><enum>(b)</enum><header>Table of Sections</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/81">chapter 81</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>

<subsection id="HC38CB27D1DF5461C9B7C8F22DC46AB4E"><enum>(a)</enum><header>Amendment to Title 28</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/85">Chapter 85</external-xref> of title 28, United States Code, is amended by adding at the end of the following:</text>

<section id="H9E573E7740BC44AFBA7DD9FF05A12BB"><enum>1370.</enum><header>Limitation on jurisdiction</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the district courts shall not have jurisdiction of any matter that relates to the alleged establishment of religion involving an entity of the Federal Government or a State or local government, or an officer or agent of the Federal Government or a State or local government, acting in an official capacity, concerning the expression of public prayer by that entity, officer, or agent.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="H9534ABCFD64349D88CFC8F86BF008520"><enum>5.</enum><header>Extrajurisdictional cases not binding on States</header><text display-inline="no-display-inline">Any decision of a Federal court which has been made before, on, or after the date of the enactment of this Act, to the extent that the decision relates to an issue removed from Federal jurisdiction under section <external-xref legal-doc="usc" parsable-cite="usc/28/1260">1260</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/28/1370">1370</external-xref> of title 28, United States Code, as added by this Act, is not binding precedent on the court of any State, the District of Columbia, or any commonwealth, territory, or possession of the United States, or on the court of any subdivision thereof.</text></section>
