<section section-type="section-one" id="H4EB844C2DE5A4EBCBED0005753AF5FD0" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equal Access to Justice Reform Act of 2005</short-title></quote>.</text></section> 
<section id="HA019432D541245A1A8ABA00E3A3C63D"><enum>2.</enum><header>Findings and statement of purpose</header> 
<subsection id="H5A87B70753B145A5A344F83100B5E28"><enum>(a)</enum><header>Findings</header><text>The Congress finds that—</text> 
<paragraph id="H72FD895028AA47139C5CA9DD1C6EA07C"><enum>(1)</enum><text>the Equal Access to Justice Act (<external-xref legal-doc="public-law" parsable-cite="pl/96/481">Public Law 96–481</external-xref>; 94 Stat. 2325 et seq.) (in this section referred to as <quote>EAJA</quote>) was intended to make the justice system more accessible to individuals of modest means, small businesses, and nonprofit organizations (in this section collectively referred to as <quote>small parties</quote>) through limited recovery of their attorneys fees when they prevail in disputes with the Federal Government;</text></paragraph> 
<paragraph id="H69053384FA744BB0BB0160B1D92D946E"><enum>(2)</enum><text>although EAJA has succeeded, at modest cost, in improving access to the justice system for small parties, EAJA retains formidable barriers to attorneys’ fees recovery (even for small parties that completely prevail against the Government), as well as inefficient and costly mechanisms for determining the fees recovery;</text></paragraph> 
<paragraph id="H8BEF70D635DC4422A6B8169E22E50882"><enum>(3)</enum><text>among the barriers retained by EAJA are—</text> 
<subparagraph id="H77BD29B6866740D7BBAAED76ACD6B2B2"><enum>(A)</enum><text>EAJA’s <quote>substantial justification defense</quote>, whereby the Government can deny attorneys’ fees recovery to prevailing small parties if the Government can show that its position, although proven illegal, was not abusive or entirely unreasonable;</text></subparagraph> 
<subparagraph id="H82B47A070C3949B69284AE3FB8D6C67"><enum>(B)</enum><text>EAJA’s hourly rate cap on attorneys’ fees of $125, which is well below the market rate for competent legal services in many legal markets (especially for complex and high-risk litigation against the Federal Government) and thus prevents fair reimbursement of attorneys’ fees for small parties and discourages competent counsel from undertaking meritorious cases on a contingency or reduced-fee basis; and</text></subparagraph> 
<subparagraph id="H4A56EDEEDD1C4085A78FF4C78347CC59"><enum>(C)</enum><text>EAJA’s outdated small business eligibility requirements, which have not increased or indexed for inflation the net worth threshold of $7,000,000 established in 1985;</text></subparagraph></paragraph> 
<paragraph id="H672504388D154FEE92D8C3FA897DDBF"><enum>(4)</enum><text>among the inefficiencies retained by EAJA are—</text> 
<subparagraph id="H44C66FF9FB844DB694A54FA9442C12E1"><enum>(A)</enum><text>EAJA’s substantial justification defense, which initiates collateral litigation over attorneys’ fees recovery that both consumes significant Federal resources and prolongs the time, expense, and risk of pursuing fees recovery to the prevailing small party;</text></subparagraph> 
<subparagraph id="H2B516F970D154784838991DCCD0059"><enum>(B)</enum><text>EAJA’s omission of any mechanism (such as the offer in compromise feature of Federal Rule of Civil Procedure 68) that would apply after a small party has prevailed on the merits of its claim to encourage both sides to reach a prompt and reasonable settlement of attorneys’ fees;</text></subparagraph> 
<subparagraph id="H8BF435701855470BA8131FA02923FFC5"><enum>(C)</enum><text>EAJA’s failure to create an educational and technical assistance function within an appropriate agency to facilitate more efficient use, settlement, and payment of claims under EAJA; and</text></subparagraph> 
<subparagraph id="H40E7282DD21F4415B0E26BF2F49F4572"><enum>(D)</enum><text>EAJA’s failure to reassign congressional reporting obligations to an appropriate, existing agency (EAJA lodges annual congressional reporting with the Administrative Conference of the United States, an agency which ceased to exist in 1995);</text></subparagraph></paragraph> 
<paragraph id="HBCE539455171434D835D686E870500D8"><enum>(5)</enum><text>none of these barriers or inefficiencies exists in the primary Federal fee-shifting statute applicable to State and local governments, Revised Statutes section 722 (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988(b)</external-xref>), resulting in—</text> 
<subparagraph id="H5A4F767566C84F10A48ED118DB6166B7"><enum>(A)</enum><text>an unequal level of accountability to Federal law among governments in the United States (shielding the Federal Government to a greater degree than State and local governments from the consequences of violating Federal law);</text></subparagraph> 
<subparagraph id="H1ED111B26D9F49D5BC398EAB4CEB9868"><enum>(B)</enum><text>an uneven playing field for small party victims of Federal law violations (discouraging resistance to illegal action by the Federal Government); and</text></subparagraph> 
<subparagraph id="HE66224416EEA4D07870073499D9992B0"><enum>(C)</enum><text>an inefficient use of Federal agency resources (burdening the Federal budget);</text></subparagraph></paragraph> 
<paragraph id="HFE1F1F8144BB44C2A4A4EA6EDCA9028"><enum>(6)</enum><text>a further barrier and inefficiency is the practice of Federal agencies of paying their EAJA liabilities from the General Treasury rather than their own agency budgets, relieving those agencies of the financial consequences of their misconduct (i.e., EAJA liability) and burdening the Federal budget unnecessarily;</text></paragraph> 
<paragraph id="H6C9FA83414294A90BE82B7DF4031AD29"><enum>(7)</enum><text>it is in the national interest to remove these barriers and inefficiencies for small parties, particularly small business owners, involved in disputes with the Federal Government in order to develop sound policies relative to the national economy in which small businesses play a significant and strategic role; and</text></paragraph> 
<paragraph id="H80E341854E9C43799E34272D96FFD6CD"><enum>(8)</enum><text>the removal of these barriers and inefficiencies is essential to—</text> 
<subparagraph id="HE2D7049D489B498EA9527DD7C50071BE"><enum>(A)</enum><text>equalize the level of accountability to Federal law among governments in the United States;</text></subparagraph> 
<subparagraph id="HAD5DB6CF24A64AD39825F3EA2DFE04C5"><enum>(B)</enum><text>discourage marginal or abusive Federal enforcement actions directed at small parties;</text></subparagraph> 
<subparagraph id="HC48FC4E4266446C8B9B6A65752D5DDB0"><enum>(C)</enum><text>stop the practice of paying EAJA liabilities from the General Treasury, which has insulated agencies from the financial consequences of their misconduct and burdened the Federal budget unnecessarily;</text></subparagraph> 
<subparagraph id="H294E5DB178944D6B978916DE11A80040"><enum>(D)</enum><text>refine and improve Federal policies through adjudication;</text></subparagraph> 
<subparagraph id="HC76071B9DEBA4F7CBC8D14CFAE2B484"><enum>(E)</enum><text>promote a fair and cost-effective process for prompt settlement and payment of attorneys’ fees claims; and</text></subparagraph> 
<subparagraph id="H0670866724A74963B3999EB569143500"><enum>(F)</enum><text>provide a fairer opportunity for full participation by small businesses in the free enterprise system, further increasing the economic vitality of the Nation.</text></subparagraph></paragraph></subsection> 
<subsection id="H162F296385D747E0808ED26C00DFE159"><enum>(b)</enum><header>Purpose</header><text>It is, therefore, the purpose of this Act to remove existing barriers and inefficiencies in EAJA in order to—</text> 
<paragraph id="H691281F5095C43DC8F7D74D669404223"><enum>(1)</enum><text>equalize the level of accountability to Federal law among governments in the United States;</text></paragraph> 
<paragraph id="HC3F138EE019D4499AB6127D2F3003488"><enum>(2)</enum><text>discourage marginal or abusive Federal enforcement actions directed at small parties;</text></paragraph> 
<paragraph id="HA2C680961F7243F7A58E2073B4123227"><enum>(3)</enum><text>stop the practice of paying EAJA liabilities from the General Treasury, which has insulated agencies from the financial consequences of their misconduct and burdened the Federal budget unnecessarily;</text></paragraph> 
<paragraph id="H98AAA8AB1FC14C4C84D3DC4721F8E1B1"><enum>(4)</enum><text>refine and improve Federal policies through adjudication;</text></paragraph> 
<paragraph id="HF29CD3EDC2084852A724FFBE1CE828B"><enum>(5)</enum><text>promote a fair and cost-effective process for prompt settlement and payment of attorneys’ fees claims; and</text></paragraph> 
<paragraph id="HBFDF6A09661345DEB08466F0ECABDEE"><enum>(6)</enum><text>provide a fairer opportunity for full participation by small businesses in the free enterprise system, further increasing the economic vitality of the Nation.</text></paragraph></subsection> 
<subsection id="H83595DCD011C489895D5DB481497D17F"><enum>(c)</enum><header>Compliance policy</header><text>In complying with the statement of congressional policy expressed in this section, each Federal agency, to the maximum extent practicable, should—</text> 
<paragraph id="HA095F02C7A2C48FD8EC34D16A61CBEC8"><enum>(1)</enum><text>avoid unjustified enforcement actions directed at small parties covered by EAJA;</text></paragraph> 
<paragraph id="HF8A0E43E6B3748AF818524A19B879EB4"><enum>(2)</enum><text>alleviate unnecessary burdens of compliance with justified enforcement actions directed at small parties covered by EAJA; and</text></paragraph> 
<paragraph id="H1BBBDD16D17E4183A9B2CF9FEE0368C4"><enum>(3)</enum><text>minimize impediments to prompt resolution and payment of reasonable attorneys’ fees to prevailing small parties covered by EAJA.</text></paragraph></subsection></section> 
<section id="HA5BBD727C5C2496CA77700742034ECE3"><enum>3.</enum><header>Reporting and technical assistance by office of advocacy</header> 
<subsection id="H3ABD5177313845B3B51260C8CD8E9CD"><enum>(a)</enum><header>Functions of office of advocacy</header><text>Section 202 of <external-xref legal-doc="public-law" parsable-cite="pl/94/305">Public Law 94–305</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/634b">15 U.S.C. 634b</external-xref>) is amended—</text> 
<paragraph id="H3AB23298934843A184DC0009C541E1D"><enum>(1)</enum><text>in paragraph (3), by inserting before the semicolon at the end the following: <quote>and for ensuring that the justice system remains accessible to small businesses for the resolution of disputes with the Federal Government;</quote>; and</text></paragraph> 
<paragraph id="H4C97C68CA56C4584AB58EFE62BD2CFB"><enum>(2)</enum><text>by striking paragraph (11) and inserting the following:</text> 
<quoted-block id="HE3E14127B3D0461B95B08843FFAC0458"> 
<paragraph id="H61A1A10980EF42EFB92B45D1A03992FA"><enum>(11)</enum><text>advise, cooperate with, and consult with the President and Attorney General with respect to section 303(b) of the Small Business Economic Policy Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/631b">15 U.S.C. 631b(b)</external-xref>) and <external-xref legal-doc="usc" parsable-cite="usc/5/504">section 504(e)</external-xref> of title 5, United States Code; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5322CBB179144343926100AE63FB817"><enum>(b)</enum><header>Duties of office of advocacy</header><text>Section 203 of <external-xref legal-doc="public-law" parsable-cite="pl/94/305">Public Law 94–305</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/634c">15 U.S.C. 634c</external-xref>) is amended—</text> 
<paragraph id="H0088D6DF1BAB4254BC5BFBDA58F83009"><enum>(1)</enum><text>in paragraph (2), by inserting before the semicolon at the end the following: <quote>, including the resolution of disputes with the Federal Government and the role of procedures established by the Equal Access to Justice Act (<external-xref legal-doc="public-law" parsable-cite="pl/96/481">Public Law 96–481</external-xref>; 94 Stat. 2325) in such disputes</quote>; and</text></paragraph> 
<paragraph id="HC2BEE71BBA4A4BD7B14FF84FE69100FB"><enum>(2)</enum><text>in paragraph (3), by inserting after <quote>the <act-name parsable-cite="SBA">Small Business Act</act-name></quote> the following: <quote>, including those related to the Equal Access to Justice Act,</quote>.</text></paragraph></subsection> 
<subsection id="H3507EDCFBFA94071005B3B3C55AA4B00"><enum>(c)</enum><header>Reports to Congress</header> 
<paragraph id="H1D104B43D0064CC2A9C93D211F9560B6"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Attorney General, in cooperation with the Chief Counsel for Advocacy of the Small Business Administration, shall transmit to the congressional committees specified in paragraph (2) a report containing—</text> 
<subparagraph id="HBAE40F2913024D399C555D1199A6715B"><enum>(A)</enum><text>an analysis of the effectiveness of the Equal Access to Justice Act (<external-xref legal-doc="public-law" parsable-cite="pl/96/481">Public Law 96–481</external-xref>; 94 Stat. 2325) (in this paragraph referred to as <quote>EAJA</quote>) in achieving its purpose to ease the burden upon small businesses and other small parties covered by EAJA of engaging in dispute resolution with the Federal Government, including—</text> 
<clause id="H5A792736144B4A32B51C95547D3F2459"><enum>(i)</enum><text>the relative awareness of EAJA in the small business community;</text></clause> 
<clause id="HAF8BF80A3C674890A9A57D8BC0A3AC41"><enum>(ii)</enum><text>the relative awareness of EAJA’s requirements among Federal agencies;</text></clause> 
<clause id="H31D5DC48422040D58E1B1D8F8194F5DF"><enum>(iii)</enum><text>the extent and quality of rules and regulations adopted by each Federal agency for processing, resolving, and paying attorneys’ fees claims under EAJA;</text></clause> 
<clause id="H06BD079E823B46F9A6A3BACB3553258D"><enum>(iv)</enum><text>the extent to which each Federal agency claims any exemptions in whole or in part from EAJA’s coverage;</text></clause> 
<clause id="H8AFE85D97BB24A7AB2C6F658673963FA"><enum>(v)</enum><text>the frequency or degree of use of EAJA’s procedures by prevailing small businesses; and</text></clause> 
<clause id="H530490AEC336403585341992001C3948"><enum>(vi)</enum><text>an analysis of the costs and benefits of EAJA generally;</text></clause></subparagraph> 
<subparagraph id="H556CEEBB7A364722A544A29FC5F009C"><enum>(B)</enum><text>an analysis of the variations in the frequency and amounts of fee awards paid by specific Federal agencies and within specific Federal circuits and districts under <external-xref legal-doc="usc" parsable-cite="usc/5/504">section 504</external-xref> of title 5, United States Code, and <external-xref legal-doc="usc" parsable-cite="usc/28/2412">section 2412</external-xref> of title 28, United States Code, including the number and total dollar amount of all claims filed with, and all claims processed, settled, litigated, and paid by, each agency under EAJA; and</text></subparagraph> 
<subparagraph id="H75660A039A0C4B8984EB3727B47387BC"><enum>(C)</enum><text>recommendations for congressional oversight or legislative changes with respect to EAJA, including any recommendations for promulgation or amendment of regulations issued under EAJA by specific Federal agencies.</text></subparagraph></paragraph> 
<paragraph id="HE42B82122F2F4DE79E49E7E71ED46713"><enum>(2)</enum><header>Specified committees</header><text>The congressional committees referred to in paragraph (1) are the following:</text> 
<subparagraph id="H6373DD9E237F4C149008882E95866522"><enum>(A)</enum><text>The Committee on the Judiciary and the Committee on Small Business of the House of Representatives.</text></subparagraph> 
<subparagraph id="HBE89F59BA97B499AB1F73E5189D5084E"><enum>(B)</enum><text>The Committee on the Judiciary and the Committee on Small Business and Entrepreneurship of the Senate.</text></subparagraph></paragraph> 
<paragraph id="HB37EEA1B73E543749D92CD7C5061ED52"><enum>(3)</enum><header>Report on small business and competition</header><text>Section 303 of the Small Business Economic Policy Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/631b">15 U.S.C. 631b</external-xref>) is amended—</text> 
<subparagraph id="H5F9F69741C2D4EBA94A382C840B7C924"><enum>(A)</enum><text>in subsection (a) by striking paragraph (5) and inserting the following:</text> 
<quoted-block id="H9DB3E31D3C004567B8CA58FEBDBA400"> 
<paragraph id="HEE919DEAE32547D8A1503B2923B91F03"><enum>(5)</enum><text>recommend a program for carrying out the policy declared in section 302 (including a policy to ensure that the justice system remains accessible to small business enterprises for the resolution of disputes with the Federal Government), together with such recommendations for legislation as the President may deem necessary or desirable.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HDC8CEC8D87774ACA80A4D77D532400A2"><enum>(B)</enum><text>in subsection (b)—</text> 
<clause id="H0ACBF2D8815641C889548B8EF2F3A159"><enum>(i)</enum><text>by striking <quote>(b)</quote> and inserting <quote>(b)(1)</quote>; and</text></clause> 
<clause id="H5FC6388E1BF74AF281770782B091B38"><enum>(ii)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H2B476AB40BCC485B81AC0991A8A3942E"> 
<paragraph indent="up1" id="H379B4FFF25E94EA0B7DA8B29AABA7E86"><enum>(2)</enum><text>The President, after consultation with the Chief Counsel for Advocacy of the Small Business Administration and the Attorney General, shall transmit simultaneously as an appendix to such annual report, a report that describes, by agency and department—</text> 
<subparagraph id="HA9D4AAE0856A45E2949388AD4681CA19"><enum>(A)</enum><text>the total number of claims filed, processed, settled, and litigated by small business concerns under <external-xref legal-doc="usc" parsable-cite="usc/5/504">section 504</external-xref> of title 5, United States Code, and <external-xref legal-doc="usc" parsable-cite="usc/28/2412">section 2412</external-xref> of title 28, United States Code (originally enacted pursuant to the Equal Access to Justice Act (<external-xref legal-doc="public-law" parsable-cite="pl/96/481">Public Law 96–481</external-xref>; 94 Stat. 2325));</text></subparagraph> 
<subparagraph id="H4C3AADFE9501423DBD3202FE7D51F012"><enum>(B)</enum><text>the total dollar amount of all outstanding awards and settlements to small business concerns under such sections;</text></subparagraph> 
<subparagraph id="H99837742C73546EDBB08A00E4B24F7"><enum>(C)</enum><text>the total dollar amount of all claims paid to small business concerns under such sections;</text></subparagraph> 
<subparagraph id="HF6C112AC7251441FBA6BAEFFCB78E27B"><enum>(D)</enum><text>the underlying legal claims involved in each controversy with small business concerns under such sections; and</text></subparagraph> 
<subparagraph id="H7872BF8BEFD2406BAF1E72FF3CB442FD"><enum>(E)</enum><text>any other relevant information that the President determines may aid Congress in evaluating the impact on small business concerns of such sections.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H2A9C00E127DE4C019E590974DD15E993"><enum>(3)</enum><text>Each agency shall provide the President with such information as is necessary for the President to comply with the requirements of this subsection.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H0A829418646B48DDAF4F0356B6018ECB"><enum>(C)</enum><text>in subsection (d)—</text> 
<clause id="HF156680689194A9EB9009CEE2C6700DB"><enum>(i)</enum><text>by striking <quote>(d)</quote> and inserting <quote>(d)(1)</quote>; and</text></clause> 
<clause id="H5381E4EA5362498A9FA5C359E25741FC"><enum>(ii)</enum><text>by adding at the end the following:</text>

<paragraph indent="up1" id="H84E52143E6D448149817CEDE7DD81BEB"><enum>(2)</enum><text>All reports concerning the Equal Access to Justice Act (<external-xref legal-doc="public-law" parsable-cite="pl/96/481">Public Law 96–481</external-xref>; 94 Stat. 2325), or the congressional policy to ensure that the justice system remains accessible to small business enterprises for the resolution of disputes with the Federal Government, shall be transmitted to the following congressional committees:</text> 
<subparagraph id="H81CFA2E5D572453BA6EB4C758E28E52"><enum>(A)</enum><text>The Committee on the Judiciary and the Committee on Small Business of the House of Representatives.</text></subparagraph> 
<subparagraph id="H759A4CF814F24242B16DAAB0317C1866"><enum>(B)</enum><text>The Committee on the Judiciary and the Committee on Small Business and Entrepreneurship of the Senate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section> 
<section id="HDF19E6564A984297B11BB32C686E9EE0"><enum>4.</enum><header>Equal access for small parties in civil and administrative proceedings</header> 
<subsection id="HEED9DE598AB747A2A53E99417725636D"><enum>(a)</enum><header>Elimination of substantial justification standard</header> 
<paragraph id="HDA141B3166FC4B42B986002511D025E1"><enum>(1)</enum><header>Administrative proceedings</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/504">Section 504</external-xref> of title 5, United States Code, is amended—</text> 
<subparagraph id="HA526E4DCE9A049D1A467A0B99358E528"><enum>(A)</enum><text>in subsection (a)(1), by striking <quote>, unless the adjudicative officer</quote> and all that follows through the period at the end and inserting a period; and</text></subparagraph> 
<subparagraph id="H91FC260D90EB4A3400EC4F640036AAA3"><enum>(B)</enum><text>in subsection (a)(2), by striking <quote>The party shall also allege that the position of the agency was not substantially justified.</quote>.</text></subparagraph></paragraph>

<subsection id="HC790B64D92164C40853B4D965CF5EF07"><enum>(e)</enum> 
<paragraph display-inline="yes-display-inline" id="HECAFBCC7C61C4C4696EA021CA77CCE00"><enum>(1)</enum><text>The Attorney General, after consultation with the Chief Counsel for Advocacy of the Small Business Administration, shall report annually to the Congress on the amount of fees and other expenses awarded to individuals during the preceding fiscal year pursuant to this section and <external-xref legal-doc="usc" parsable-cite="usc/28/2412">section 2412</external-xref> of title 28. The report shall describe the number, nature, and amount of the awards, the claims involved in the controversy, and any other relevant information which may aid the Congress in evaluating the scope and impact of such awards for individuals engaged in disputes with Federal agencies. Each agency shall provide the Attorney General with such information as is necessary for the Attorney General to comply with the requirements of this subsection.</text></paragraph> 
<paragraph indent="up1" id="HCB7405EC0BED4C39858E26C1DCFE1870"><enum>(2)</enum><text>A requirement that the President report annually on proceedings affecting small business concerns under this section and under <external-xref legal-doc="usc" parsable-cite="usc/28/2412">section 2412</external-xref> of title 28 is provided in section 303(b) of the Small Business Economic Policy Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/631b">15 U.S.C. 631b(b)</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEE018699F32A440190FC2E3D08FE00C6"><enum>(i)</enum><header>Applicability</header><text>The provisions of this section and the amendments made by this section shall apply to any proceeding pending on, or commenced on or after, the effective date of this Act.</text></subsection></section> 
<section id="HC7481081E75F42C6852FF3F9549800AB"><enum>5.</enum><header>Definition of prevailing party in EAJA cases</header> 
<subsection id="HA47E0A6C89D04BC18DD56F76F4771207"><enum>(a)</enum><header>Title 5</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/504">Section 504(b)(1)</external-xref> of title 5, United States Code, is amended by adding at the end the following new paragraph:</text>

<subsection id="HF907EE9735B94921901CD4B1633052F9"><enum>(b)</enum><header>Title 28</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/2412">Section 2412</external-xref> of title 28, United States Code, is amended—</text>
