<section id="HAA016E2DFC7B4B3C955060FC5DA6C200" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="HF20F509407C7470AB1003127422D8F76"><enum>(1)</enum><text display-inline="yes-display-inline">Obesity-related diseases cost the United States economy more than $100,000,000,000 every year.</text></paragraph> 
<paragraph id="H9E48823661F54483A07ED8A8133D2DA0"><enum>(2)</enum><text>Almost half of young people aged 12 through 21, and more than a third of high school students, do not participate in vigorous physical activity on a regular basis.</text></paragraph></section> 
<section id="H88167E3673134F0F98593461441B2C04"><enum>2.</enum><header>Physical education</header><text display-inline="no-display-inline">Section 1111(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)</external-xref>) is amended—</text> 
<paragraph id="HC9D4969E4DCB4550A16490F93281D5F6"><enum>(1)</enum><text>in paragraph (1)(C)—</text> 
<subparagraph id="HC5663553015E44F2AA8DC7CE85EDC6D"><enum>(A)</enum><text>by striking <quote>arts, and</quote> and inserting <quote>arts,</quote>; and</text></subparagraph> 
<subparagraph id="H17AEFF957800476088B7C51BB66EE3C"><enum>(B)</enum><text>by striking <quote>science,</quote> and inserting <quote>science, and (beginning in the 2006–2007 school year) physical education,</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HB5700789D7AE4C8FAE2119A33DE6B26D"><enum>(2)</enum><text>in paragraph (3)—</text> 
<subparagraph id="H0C75027BAF3C46758356E2773800B2CE"><enum>(A)</enum><text>in subparagraph (A)—</text> 
<clause id="H71BACFE895324959A4FCB256B257B105"><enum>(i)</enum><text>by striking <quote>and science</quote> and inserting <quote>science, and physical education</quote>; and</text></clause> 
<clause id="H7AD215A0788541B1998B9641EDDE16B8"><enum>(ii)</enum><text>by inserting before the period <quote>and no State shall be required to meet the requirements of this part relating to physical education assessments until the beginning of the 2008–2009 school year</quote>; and</text></clause></subparagraph> 
<subparagraph id="HEC5F742CC89C429CB7EE960015681BA4"><enum>(B)</enum><text>in subparagraph (C)(v)—</text> 
<clause id="H877C2766F68040EDAB2C39BBD8009EEB"><enum>(i)</enum><text>in subclause (II)(cc), by inserting <quote>and</quote> after the semicolon; and</text></clause> 
<clause id="HD099E189DE504AC497E616D77C50B031"><enum>(ii)</enum><text>by adding at the end the following:</text>

<subclause id="H10D2CFB5D8DE4C4BA08200C7C702C526" indent="up1"><enum>(III)</enum><text>beginning not later than school year 2008–2009, measure the proficiency of all students in physical education and be administered not less than 1 time during—</text>

<item id="H704AABD25BF94D6A905BFFEE142CBD59"><enum>(bb)</enum><text>grades 6 through 9; and</text></item> 
<item id="H8A46B7401EC146659B88DC13492E34A6"><enum>(cc)</enum><text>grades 10 through 12;</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section>
