<section id="H5F5636E9D90A4F2FA03DBD147E921596" section-type="section-one"><enum>1.</enum><header>Establishment of new fashion model nonimmigrant classification</header> 
<subsection id="HA6A3CC95C81545C2B9471EFD86173028"><enum>(a)</enum><header>In general</header> 
<paragraph id="H6D570F4ACEC24F88BE00C8C2B530624"><enum>(1)</enum><header>New classification</header><text>Section 101(a)(15)(O) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(O)</external-xref>) is amended—</text> 
<subparagraph id="H0322DF990FF24527A65EEA8769C111B8"><enum>(A)</enum><text>in clause (iii), by striking <quote>clause (i) or (ii)</quote> and inserting <quote>clause (i), (ii), or (iii)</quote> and by redesignating such as clause (iv); and</text></subparagraph> 
<subparagraph id="H3E998E91823B4A9EAC8438B370787651"><enum>(B)</enum><text>by inserting after clause (ii) the following new clause:</text> 
<quoted-block style="OLC" id="H4FC134D7FA8941AF82132CBFD6D8DB24" display-inline="no-display-inline"> 
<clause id="H6877F6F4D6FB4888B044065E0000E958" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">is a fashion model who is of distinguished merit and ability and who is seeking to enter the United States temporarily to perform fashion modeling services that involve events or productions which have a distinguished reputation or that are performed for an organization or establishment that has a distinguished reputation for, or a record of, utilizing prominent modeling talent; or</text></clause> <after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H8EB67CBBECF14A3F8F48B831D6D0981"><enum>(2)</enum><header>Numerical limitation</header><text>Section 214(a)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(a)(2)(A)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="traditional" id="H75D06558245B463BAE46FCB4BBCD7D" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">The number of aliens who may be issued visas or otherwise provided nonimmigrant status under section 101(a)(15)(O)(iii) in any fiscal year shall not exceed 1,000.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> 
<subsection id="H3E41D6BF075641E4B2C7BE2B29E164BB"><enum>(b)</enum><header>Elimination of H-1B classification for fashion models</header><text>Section 101(a)(15)(H)(i)(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(b)</external-xref>) is amended—</text> 
<paragraph id="H7C164FF7F92F4FA3A2F1889C49C68708"><enum>(1)</enum><text>by striking <quote>or as a fashion model</quote>; and</text></paragraph> 
<paragraph id="H689AF95FF05A49F89C55FFEECD4EA273"><enum>(2)</enum><text>by striking <quote>or, in the case of a fashion model, is of distinguished merit and ability</quote>.</text></paragraph></subsection> 
<subsection id="HEE490A8B572E4361AB734052C6F02E70"><enum>(c)</enum><header>Effective dates</header> 
<paragraph id="H02D0A041FEF149EB9FB3058B2FB481B8"><enum>(1)</enum><header>Implementation of new fashion model nonimmigrant classification</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security shall promulgate regulations to implement the amendments made by subsection (a). Nothing in this section shall be construed as preventing an alien who is a fashion model from obtaining nonimmigrant status under section 101(a)(15)(O)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(O)(i)</external-xref>) if such alien is otherwise qualified for such status.</text> </paragraph> 
<paragraph id="HB251669CBF97472FA8A3AB67A324C699"><enum>(2)</enum><header>Elimination of H-1B classification for fashion models</header><text>The amendments made by subsection (b)—</text> 
<subparagraph id="H966B9B85F1894334BC1DEEDDA141211"><enum>(A)</enum><text>shall apply on the effective date of the regulations promulgated under paragraph (1); and</text></subparagraph> 
<subparagraph id="HA9BEC6B410904ED8BDD3F1A596E14240"><enum>(B)</enum><text>shall not apply to the classification of an alien under section 101(a)(15)(H)(i)(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(b)</external-xref>) as a fashion model pursuant to a petition for such classification that was filed before such effective date.</text></subparagraph></paragraph></subsection> </section>
