<official-title>To amend the Comprehensive Environmental Response Compensation and Liability Act of 1980 (“Superfund”) to provide that manure is not considered a hazardous substance or pollutant or contaminant under that Act, and for other purposes.</official-title>

<section id="H8F98C107FB254A3F97A5222063880792" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Animal waste</header> 
<subsection id="HC4500BE9D8BF4422A6F784922F73F5CA"><enum>(a)</enum><header>Amendment of Superfund</header><text display-inline="no-display-inline">Title III of the Comprehensive Environmental Response Compensation and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>) is amended by adding the following new section at the end thereof:</text>

<section id="HD8D6EFB4A08E404BAD8C074C4D28C6EB"><enum>312.</enum><header>Exception for manure</header> 
<subsection id="H1E12570B963C49748100F128678322FB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Upon the date of enactment of this section, manure shall not be included in the meaning of ‘hazardous substance’ under section 101(14) of this Act or <quote>pollutant or contaminant</quote> under section 101(33) of this Act.</text></subsection> 
<subsection id="H135F420509BA46C5AF0000757854D39"><enum>(b)</enum><header>Elimination of paperwork requirements</header> 
<paragraph id="H877F0A89ABE44F1C91563312D178D290" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The enactment of this section shall not be construed to impose any liability under provisions of the Emergency Planning and Community Right-to-Know Act of 1986 for manure.</text></paragraph> 
<paragraph id="HA346728631E04D6B0000F12369CA1BF7" indent="up1"><enum>(2)</enum><text>The enactment of this section shall not be interpreted or construed to affect or abrogate the establishment nor the provisions of the Air Quality Compliance Agreement, published in Volume 70, No. 19 of the Federal Register on Jan. 31, 2005, and entered into by agricultural operators and the Administrator.</text></paragraph></subsection> 
<subsection id="HB31D0F5B3AB04DEE826C564E5C7D75FC"><enum>(c)</enum><header>No effect on other environmental law</header><text display-inline="yes-display-inline">Nothing in this section shall affect the applicability of any other environmental statute as it relates to the definition of manure, or the responsibilities or liabilities of any person regarding, the treatment, storage, or disposal of manure.</text></subsection> 
<subsection id="H087321817E944DA08EA25B084E7D413C"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">For the purposes of this section, the term <quote>manure</quote> means—</text> 
<paragraph id="H890880D5C08C406A914437E76B6300B9"><enum>(1)</enum><text display-inline="yes-display-inline">digestive emissions, feces, urine, urea and other excrement from livestock (as defined by 7 C.F.R. 205.2);</text></paragraph> 
<paragraph id="HBEDFE598D6D44FBA9272E32733DC698F"><enum>(2)</enum><text display-inline="yes-display-inline">any associated bedding, compost, raw materials or other materials commingled with such excrement from livestock (as defined by 7 C.F.R. 205.2); </text></paragraph> 
<paragraph id="HBE98E4BE48DD48E8B1F938EF2B520C8"><enum>(3)</enum><text display-inline="yes-display-inline">any process water associated with the items referred to in paragraph (1) or (2); and</text></paragraph> 
<paragraph id="H3667B46E7C344153ADF2519232C4DC39"><enum>(4)</enum><text display-inline="yes-display-inline">any byproducts, constituents, or substances contained in, originating from, or emissions relating to the items described in paragraph (1), (2), or (3).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H875946E19AD847948644D0BB935D5E56"><enum>(b)</enum><header>Amendment of SARA</header><text display-inline="yes-display-inline">Section 304(a)(4) of the Superfund Amendments and Reauthorization Act of 1986 (Pub. L. 99-499; 100 Stat. 1655.) is amended by adding the following at the end thereof: <quote>The notification requirements under this subsection shall not apply to releases associated with manure (as defined in section 312 of the Comprehensive Environmental Response Compensation and Liability Act of 1980).</quote> .</text></subsection> </section>
