<official-title>To amend the Davis-Bacon Act to provide that a contractor under that Act who has repeated violations of the Act shall have its contract with the United States canceled and to require the disclosure under freedom of information provisions of Federal law of certain payroll information under contracts subject to the Davis-Bacon Act.</official-title>

<section section-type="section-one" id="H6D7F7684B0DF4045A07798BC66BB1051" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Davis-Bacon Enforcement Act of 2005</short-title></quote>.</text></section> 
<section id="H229852523AC04F188E74BDA700736B00"><enum>2.</enum><header>Repeated violations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/3144">Section 3144</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" act-name="Davis-Bacon Act" id="H79AE322B3E6A49E3B3DA142E68018050"> 
<subsection id="H07A10B5E131E4267A2E591F5EEE007A2"><enum>(c)</enum><text>If the Secretary determines that a contractor under a contract with the United States has engaged in a pattern of violations of this Act, the Secretary shall cancel such contract and establish that such contractor is ineligible to receive a contract with the United States for a 10-year period designated by the Secretary, unless the contractor is able to show the Secretary that such violations were not intentional but were the result of simple and unsystematic errors.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6706C42C5ACC4DA388BE4468B944329F"><enum>3.</enum><header>Disclosure of information</header> 
<subsection id="HCF194A7C64494DA981D872151BA5E241"><enum>(a)</enum><header>General Rule</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/552">Section 552(a)</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H113DA1D5E3B046ED9CE175002E9F2844"> 
<paragraph indent="up1" id="HE6CAD902CA1C4F4988DD6BBB006141A7"><enum>(7)</enum><text>The names and addresses of employees in payroll records established under a contract which is subject to subchapter IV of subtitle II of title 40, United States Code, shall be made available, notwithstanding subsection (b)(6), for inspection in connection with an audit to determine compliance with such Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB433E796AB7D4C94BD387F3D00CC7087"><enum>(b)</enum><header>Construction</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/552">Section 552(a)</external-xref> of title 5, United States Code, shall not be construed to prevent or prohibit the disclosure required by <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(a)(7)</external-xref> of title 5, United States Code, as added by the amendment made by subsection (a).</text></subsection></section>
