<official-title>To enforce the numerical limits Congress has placed on immigration.</official-title>

<section id="HDB20D3DCCB86410481B2F2E1CA12B53D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truth in Immigration (TRIM) Act</short-title></quote>. </text></section> 
<section id="HB4E10C4DCECE419F8E874188D5B52600"><enum>2.</enum><header>Annual report on the illegal alien population</header> 
<subsection id="H6B6433B67BBF4DC4B67D00CBC0BF6B43"><enum>(a)</enum><header>Annual report</header> 
<paragraph id="HBAAD168927E14706ACCA020397C30046"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall annually report to the Congress on the number of aliens, listed by country of last known habitual residence, who are estimated to be unlawfully residing in the United States as of August 31 of the year in which the report is submitted.</text> </paragraph> 
<paragraph id="H603C8DBD688C42488CFFDAFC462CAA99"><enum>(2)</enum><header>Detail</header><text>The Secretary shall provide the greatest degree of detail that is feasible in making the determination described in paragraph (1).</text></paragraph> 
<paragraph id="H1ECE3A42B30C4C8B90BA3BF8A6A6FDC"><enum>(3)</enum><header>Deadline</header><text>The Secretary shall transmit each report required by this subsection to the Congress not later than September 31 of each year, beginning with the first September 31 that occurs after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H3FBC0E7DEAED48468DD583B96D536747"><enum>(b)</enum><header>Review</header><text>The Comptroller General of the United States shall conduct a review each year of the Secretary’s methodology, data, and conclusions to ensure that they represent the best available data and practices and are consistent from year to year. The results of such review shall be transmitted to the Congress not later than 60 days after the date on which the Secretary’s report was transmitted.</text></subsection></section> 
<section id="HEB69A9F699B44D8294628900C4381823"><enum>3.</enum><header>Enforcing numerical limits on immigration</header><text display-inline="no-display-inline"> Section 202 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H04AAC8C7744543F5AF311FE0DA48FC9B"><enum>(f)</enum><header>Reductions to account for illegally resident population</header> 
<paragraph id="H6AD77E4ED54A4F208225479E0320AAC"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H98FBEEEA29AD4537B50960CE96A100B"><enum>(A)</enum><header>Reduction</header><text>Notwithstanding any other provision of law, and except as provided in subparagraph (B), the total per country level of legal immigration determined under this section for each country shall be reduced by one-half of the number of illegal aliens from that country who were residing in the United States as of August 31 of the preceding fiscal year.</text></subparagraph> 
<subparagraph id="HBF312EDF01F64DC3815749C481B3B852"><enum>(B)</enum><header>Limitation</header><text>Notwithstanding subparagraph (A), no reduction under such subparagraph with respect to any single foreign state or dependent area may exceed one-half of the total per country level of legal immigration that otherwise would apply under this section for any fiscal year.</text></subparagraph></paragraph> 
<paragraph id="HC20C62530F27457085ACA23A7587CC1"><enum>(2)</enum><header>Order of reductions</header><text>In carrying out the reduction required by paragraph (1), the Secretary of State and the Secretary of Homeland Security shall reduce from immigrant categories in the following order:</text> 
<subparagraph id="H63391F204B124FFFAD4B17E0DE5B5DED"><enum>(A)</enum><text>Diversity lottery winners, if any, described in section 203(c).</text></subparagraph> 
<subparagraph id="H4B8DD3B2F6DF4000B7D9F5FCDE004D00"><enum>(B)</enum><text>Brothers and sisters of citizens described in section 203(a)(4).</text></subparagraph> 
<subparagraph id="H1F8FACD7663E4A42825852E9C1C416B3"><enum>(C)</enum><text>Married sons and married daughters of citizens described in section 203(a)(3).</text></subparagraph> 
<subparagraph id="H694AAA4010B24340ABF8428B2E98B879"><enum>(D)</enum><text>Unmarried sons and unmarried daughters of permanent resident aliens described in section 203(a)(2)(B).</text></subparagraph> 
<subparagraph id="H31005B5D20B442C299152CADCB002383"><enum>(E)</enum><text>Unmarried sons and daughters of citizens described in 203(a)(1).</text></subparagraph> 
<subparagraph id="H4F1BA2010C0649D2A88E7BEA9693D57"><enum>(F)</enum><text>Skilled workers, professionals, and other workers described in section 203(b)(3).</text></subparagraph> 
<subparagraph id="HF081301747994D1B928DF07131B6AC3E"><enum>(G)</enum><text>Special immigrants described in section 203(b)(4).</text></subparagraph> 
<subparagraph id="H80243000E79849EAA6CEB4A0BC12B7FD"><enum>(H)</enum><text>Aliens who are members of the professions holding advanced degrees or aliens of exceptional ability described in section 203(b)(2).</text></subparagraph> 
<subparagraph id="H81A715F9134D4C28B3C073156962862C"><enum>(I)</enum><text>Priority workers described in section 203(b)(1).</text></subparagraph> 
<subparagraph id="H71794A1AB03C41E88FD659E7A3011EA"><enum>(J)</enum><text>Employment creation described in section 203(b)(5).</text></subparagraph> 
<subparagraph id="H2D6788AF5F854912A34175BA004D51DF"><enum>(K)</enum><text><quote>K</quote> special immigrants described in section 203(b)(6).</text></subparagraph> 
<subparagraph id="HE59D3B79D3364E11AAF4CDF2005641D4"><enum>(L)</enum><text>Spouses and children of permanent resident aliens described in section 203(a)(2)(A).</text></subparagraph> 
<subparagraph id="H131367F61A0B4FDAB19C273C23158304"><enum>(M)</enum><text>Aliens not subject to quotas described in section 201(b).</text></subparagraph></paragraph> 
<paragraph id="H29ADCF29F21C41D7A37DFD50AE537B99"><enum>(3)</enum><header>Not available in any other year</header><text>Reductions made under this subsection with respect to a fiscal year shall not be re-allocated to any other category or individual and shall not be used in determining the availability of immigrant visas in any other fiscal year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
