<official-title>To reduce and eliminate electronic waste through recycling.</official-title>

<section section-type="section-one" id="H317C0544C01B453CB4BDBAAE92502324" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electronic Waste Recycling Promotion and Consumer Protection Act</short-title></quote>.</text></section> 
<section id="H26065075FE0A45F0B4596635467FA2B2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="HE169B9D4E91049088B90E9C1EA48D2C8"><enum>(1)</enum><text>the National Safety Council estimates that—</text> 
<subparagraph id="H90904B1466394D359FCF6F94F2BA7D11"><enum>(A)</enum><text>in 2003, over 60,000,000 personal computers became obsolete and between 1997 and 2007 more than 500,000,000 computers will need to be discarded; and</text></subparagraph> 
<subparagraph id="H6236E38C3237463D8F72935B2462E4D4"><enum>(B)</enum><text>at an average weight of 70 pounds, this will result in over 6,300,000,000 pounds of plastic and 1,600,000,000 pounds of lead added to the supply of waste needing to be managed;</text></subparagraph></paragraph> 
<paragraph id="H1726BE03E96F4A0FB4CA2C7CF3037521"><enum>(2)</enum><text>according to the Environmental Protection Agency—</text> 
<subparagraph id="HE1BCF78D01814D2E92DDADFDE0AB9982"><enum>(A)</enum><text>a computer monitor or television set generally contains 4 to 8 pounds of lead;</text></subparagraph> 
<subparagraph id="H669643946F4F490C9389770500CE607E"><enum>(B)</enum><text>mercury, cadmium, and other heavy metals are generally used in such equipment as well; and</text></subparagraph> 
<subparagraph id="H9014416B5C8849D690557D9E155B2D35"><enum>(C)</enum><text>households and businesses in the United States often do not discard older computers and televisions when buying newer versions of the same products;</text></subparagraph></paragraph> 
<paragraph id="H794924373DE64456A274C435F2C6D247"><enum>(3)</enum><text>according to experts, the average household may have between 2 and 3 older computers and televisions in storage, and approximately 20,000,000 to 24,000,000 computers and televisions are placed in storage each year;</text></paragraph> 
<paragraph id="H2C80F2888BC042DA936DEAF43419DDB"><enum>(4)</enum><text>according to the Environmental Protection Agency, discarded computer, television, and other electronic equipment—</text> 
<subparagraph id="H571AF45E7CEC442B00AE32EAAC545804"><enum>(A)</enum><text>when not discarded in large quantities, is currently managed in most States as municipal solid waste, just like ordinary trash; and</text></subparagraph> 
<subparagraph id="H06B4CC504DD74379B6410579006B4C17"><enum>(B)</enum><text>constitute 40 percent of the lead and 70 percent of the heavy metals that are found in landfills and, if not handled properly, can be released into the environment, contaminating air and groundwater and posing a significant threat to human health, including potential damage to kidney, brain, and nervous system function, and cancer in cases of excessive exposure;</text></subparagraph></paragraph> 
<paragraph id="HE2FFC0428F0B468DB9F833D875DAAC66"><enum>(5)</enum><text>materials used in computers, televisions, and similar electronic products can be recovered through recycling, which conserves resources and minimizes the potentially harmful human and environmental health effects of those materials; and</text></paragraph> 
<paragraph id="H0788F061C3084CAD982CE20010547157"><enum>(6)</enum><text>establishing a nationwide infrastructure for electronic waste recycling will—</text> 
<subparagraph id="HD8D68A3CF2E642F6823873F0F310925E"><enum>(A)</enum><text>facilitate access of people in the United States to recycling services; and</text></subparagraph> 
<subparagraph id="HA1FED6EDB4C9400D9D6EBD8C81C30C2"><enum>(B)</enum><text>improve the efficiency and use of electronic waste recycling.</text></subparagraph></paragraph></section> 
<section id="HA4F8569566BC478EA95B3C016D054617"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H189A56CDE121454AA61217BCC29D6087"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="HFC130B4989C24AD6BAF487AB2FF9DC78"><enum>(2)</enum><header>Cathode ray tube</header><text>The term <term>cathode ray tube</term> means a vacuum tube used to convert an electronic signal into a visual image, for use in a computer monitor, television, or other piece of electronic equipment.</text></paragraph> 
<paragraph id="HA8D269F071EB4CDB85B096967100A2A1"><enum>(3)</enum><header>Computer</header> 
<subparagraph id="H8B8A1122629B464895FFDEFD3153B719"><enum>(A)</enum><header>In general</header><text>The term <term>computer</term> means an electronic, magnetic, optical, electrochemical, or other high speed data processing device that performs logical, arithmetic, or storage functions.</text></subparagraph> 
<subparagraph id="H638088DC941D4985BD88A4401FE373A2"><enum>(B)</enum><header>Exclusions</header><text>The term <term>computer</term> does not include an automated typewriter or typesetter, video game console, portable hand held calculator, personal digital assistant, cellular telephone, or other similar device.</text></subparagraph></paragraph> 
<paragraph id="H8F5F51C852484E12984FCA25A161CD11"><enum>(4)</enum><header>Consumer</header><text>The term <term>consumer</term> means—</text> 
<subparagraph id="HBC1AEFE8B406426887D407061D0874C3"><enum>(A)</enum><text>an occupant of a single, detached dwelling unit or a single unit of a multiple dwelling unit who—</text> 
<clause id="HC6053A2344154412AED281E025CD0FF"><enum>(i)</enum><text>has used a computer monitor, a television, or another piece of electronic equipment that contains a display screen or a system unit; and</text></clause> 
<clause id="HF6D6550DD27F4D5FB41F357E6E60006F"><enum>(ii)</enum><text>used the equipment described in clause (i) at the dwelling unit of the occupant; and</text></clause></subparagraph> 
<subparagraph id="H0DBEC1F1A62F4013BE9DF7F8248FF1C"><enum>(B)</enum><text>a commercial, educational, or other entity that discarded for recycling not more than 20 display screens or system units per year during the previous 5 years.</text></subparagraph></paragraph> 
<paragraph id="H7F70289928294A70BFCCFB069F8E0076"><enum>(5)</enum><header>Display screen</header> 
<subparagraph id="H4BA3A54295AE48EDB32500F44B03BAE"><enum>(A)</enum><header>In general</header><text>The term <term>display screen</term> means a cathode ray tube, flat panel screen, or other similar video display device with a screen size of greater than 4 inches, measured diagonally.</text></subparagraph> 
<subparagraph id="H83C3480C45424482B975A3ED984B20AA"><enum>(B)</enum><header>Exclusion</header><text>The term <term>display screen</term> does not include commercial or industrial equipment, or household appliances, that contain—</text> 
<clause id="HBE4864CD62794D17AA48F96C664D03C9"><enum>(i)</enum><text>a cathode ray tube;</text></clause> 
<clause id="H133BD123E9FB405E87003039BE58D39C"><enum>(ii)</enum><text>a flat panel screen; or</text></clause> 
<clause id="H3D064DF5EB234404A5F429C14291D2C7"><enum>(iii)</enum><text>another similar video device.</text></clause></subparagraph></paragraph> 
<paragraph id="HC0D4C2AEEB1E4FDB945E7BAFE267F5EA"><enum>(6)</enum><header>Hazardous waste</header><text>The term <term>hazardous waste</term> has the meaning given the term in section 1004 of the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903</external-xref>).</text></paragraph> 
<paragraph id="HDD4EDDEF36D142D4BE1923F39BAF9349"><enum>(7)</enum><header>Recycle</header><text>The term <term>recycle</term> means the performance of a process by 1 or more persons by which a display screen or a system unit is—</text> 
<subparagraph id="H857614C67D0D432680C48E8060092771"><enum>(A)</enum><text>sorted;</text></subparagraph> 
<subparagraph id="HADB52873118E49C99F83C922241DED3"><enum>(B)</enum><text>if necessary, transported;</text></subparagraph> 
<subparagraph id="HDFD837A199CD4D12AE7BDA790081747E"><enum>(C)</enum><text>to the maximum extent practicable, separated to recover any component or commodity inside the display screen or system unit that can be reduced to raw materials or products; and</text></subparagraph> 
<subparagraph id="H778A76D5CF9F4EDFB675324931C6BC8"><enum>(D)</enum><text>treated such that any remaining material is disposed of properly and in an environmentally sound manner consistent with the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="HC88176D9ABFA426EB3FDEEEC801C63B3"><enum>(8)</enum><header>System unit</header><text>The term <term>system unit</term> means—</text> 
<subparagraph id="H209F0B15C1014EC58613AB8C14617EA7"><enum>(A)</enum><text>the casing or portion of a computer that contains the central processing unit, which performs the primary quantity of data processing; and</text></subparagraph> 
<subparagraph id="H93D9624337844CE29356D81E4BD3FBDF"><enum>(B)</enum><text>the unit that, together with the memory, forms the central part of the computer, to which peripheral devices may be attached.</text></subparagraph></paragraph> 
<paragraph id="H06BD171FEFC14AB3B12918E0170095E2"><enum>(9)</enum><header>Universal waste</header><text>The term <term>universal waste</term> has the meaning given the term in the Environmental Protection Agency Standards of Universal Waste Management established under <external-xref legal-doc="regulation" parsable-cite="cfr/40/273">section 273</external-xref> of title 40, Code of Federal Regulations (and successor regulations).</text></paragraph></section> 
<section id="H85E4F61CB42E48B486FE31C085B01F9"><enum>4.</enum><header>Credit for recycling electronic waste</header> 
<subsection id="H981A0C9D5F4044769C32BE037B19DDF"><enum>(a)</enum><header>In general</header><text>Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to business related credits) is amended by adding at the end the following new section:</text>

<section id="HC073C1D4F28241A8A3A861F10389CB2B"><enum>45N.</enum><header>Credit for recycling electronic waste</header> 
<subsection id="H3FB2771B6B254FF5868D14FA5C5E9F13"><enum>(a)</enum><header>Allowance of credit</header><text>For purposes of section 38, in the case of an eligible taxpayer, the electronic waste recycling credit for any taxable year is an amount equal to $8 per unit of qualified electronic waste that is collected from consumers and recycled during the taxable year.</text></subsection> 
<subsection id="H76C081633947407F95A7853377655DDF"><enum>(b)</enum><header>Eligible taxpayer</header><text>For purposes of this section, the term <term>eligible taxpayer</term> means any person which—</text> 
<paragraph id="H3FCDD206AEFD4A3291D07D2631ABEEA3"><enum>(1)</enum><text>collects from consumers and recycles, or arranges for the recycling of, not less than 5,000 units of qualified electronic waste during that person’s taxable year,</text></paragraph> 
<paragraph id="HBFF7CDABA14C4EDE815CC62D2944F730"><enum>(2)</enum><text>submits with the person’s tax return documentation of the final destination of all units of electronic waste collected from consumers during the person’s taxable year for the purpose of recycling, and</text></paragraph> 
<paragraph id="H707F5FF83CA14F47B9F69E4E00C572A0"><enum>(3)</enum><text>certifies that all reclamation and recycling carried out by the person was performed by an eligible recycler.</text></paragraph></subsection> 
<subsection id="HC792DACEA12A43E4B653989765AFF754"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H4941ECCEC543438F89B643DF3D8308F5"><enum>(1)</enum><header>Qualified electronic waste</header><text>The term <term>qualified electronic waste</term> means any display screen or any system unit.</text></paragraph> 
<paragraph id="H1F7425E4BF9140DE8834083160A74ED8"><enum>(2)</enum><header>Consumer, display screen; recycle; system unit</header><text>The terms <term>consumer</term>, <term>display screen</term>, <term>recycle</term>, and <term>system unit</term> have the meaning given the terms by section 3 of the Electronic Waste Recycling Promotion and Consumer Protection Act.</text></paragraph></subsection> 
<subsection id="H3EB2E4FF390142D980C858388CD9193"><enum>(d)</enum><header>Final regulations</header> 
<paragraph id="H8EA84A1AD28745998ECB13E18D8F00BE"><enum>(1)</enum><header>In general</header><text>Not later than the date which is 180 days after the date of the enactment of this section, the Secretary, after consultation with the Administrator of the Environmental Protection Agency, shall issue such final regulations as may be necessary and appropriate to carry out this section.</text></paragraph> 
<paragraph id="H8F0CE6C8107845F9A332843B93D087E7"><enum>(2)</enum><header>Inclusion</header> 
<subparagraph id="HEEF8563C5FC74014A4E0459D3F07B0C5"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the regulations issued under paragraph (1) shall include—</text> 
<clause id="H6BA30216C711437285FEFE76C29BB13"><enum>(i)</enum><text>requirements for certifying recyclers as eligible to recycle qualified electronic waste,</text></clause> 
<clause id="H3F2BAADB8FD2437CBDDFD6663B9C89D5"><enum>(ii)</enum><text>requirements to ensure that all recycling of qualified electronic waste is performed in a manner that is safe and environmentally sound, and</text></clause> 
<clause id="H047D370A1483462F907EB1A6E5CEC382"><enum>(iii)</enum><text>a provision which allows a tax credit under this section to be shared by 2 or more eligible taxpayers, provided that the total tax credit for a unit of electronic waste under this section does not exceed $8.</text></clause></subparagraph> 
<subparagraph id="H010707B0D814440082CC001C33256890"><enum>(B)</enum><header>Limitation</header><text>The Secretary shall not certify a recycler as eligible under this subsection unless the recycler is—</text> 
<clause id="H14655311578A446FB63C7CC440A48C00"><enum>(i)</enum><text>a taxpayer, or</text></clause> 
<clause id="H55F64BE3462440E0B7260287005CC2D7"><enum>(ii)</enum><text>a State or local government.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HF657BB0A8CED4E63BAA415EAB461B86B"><enum>(e)</enum><header>Termination</header><text>This section shall not apply with respect to any unit of qualified electronic waste which is recycled after the date which is 3 years after the date on which the final regulations issued pursuant to subsection (d) take effect.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3891FAC924714BF0BDBE4FABFBE026E4" display-inline="no-display-inline"><enum>(b)</enum><header>Credit allowed as part of general business credit</header><text>Section 38(b) of such Code is amended by striking <quote>plus</quote> at the end of paragraph (25), by striking the period at the end of paragraph (26) and inserting <quote>, plus</quote>, and by adding at the end the following new paragraph: </text>

<paragraph id="HFE83E40905AF4E7DBC117C61F664C8F6"><enum>(27)</enum><text>in the case of an eligible taxpayer (as defined in section 45N(b)), the electronic waste recycling credit determined under section 45N(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2057D1BE60E14C70BE2DB5E1EC04CEFC"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subpart D of part IV of subchapter A of chapter 1 of such Code is amended by adding at the end the following new item:</text>

<toc-entry idref="HC073C1D4F28241A8A3A861F10389CB2B" level="section">Sec. 45N. Credit for recycling electronic waste</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3ACD474EE45341C995BEB36C2E413DD5"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to display screens and system units recycled after the date on which the final regulations issued pursuant to section 45N of such Code (as added by this section) take effect.</text></subsection></section> 
<section id="H594006045ED044A48029C2BF6C83F502"><enum>5.</enum><header>Consumer credit for recycling electronic waste</header> 
<subsection id="HEF1314A8E1484A1E9E14C75229AB6DFB"><enum>(a)</enum><header>In general</header><text>Subpart A of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 25D the following new section:</text>

<section id="H3C353826C7A2459482C01656702A576"><enum>25E.</enum><header>Consumer credit for recycling electronic waste</header> 
<subsection id="H25167EA400534CA1A316C43E8BE1488"><enum>(a)</enum><header>Allowance of credit</header><text>In the case of an eligible consumer, there shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to $15 for the recycling of 1 or more units of qualified electronic waste.</text></subsection> 
<subsection id="HBC9FDCD2D5C54389BF828175CB7CAC65"><enum>(b)</enum><header>Eligible consumer</header><text>For purposes of this section, the term <term>eligible consumer</term> means any individual—</text> 
<paragraph id="H1286C65B44394986946FB8EE131C09AD"><enum>(1)</enum><text>with respect to whom a credit under this section has not been allowed in any preceding taxable year, and</text></paragraph> 
<paragraph id="HB8C5C72AE14F4A17004E36C504FFF940"><enum>(2)</enum><text>who submits with the individual’s tax return such information as the Secretary requires to document that each unit of qualified electronic waste was recycled by a recycler certified by the Secretary pursuant to subsection (d).</text></paragraph></subsection> 
<subsection id="H67A85AF35C3A422E81F2F83F500E969"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H3B2B0937402F43349D31812F1DC9AFEF"><enum>(1)</enum><header>Qualified electronic waste</header><text>The term <term>qualified electronic waste</term> means any display screen or any system unit.</text></paragraph> 
<paragraph id="H84710066BAE0472CA8BC71259C2E90D9"><enum>(2)</enum><header>Consumer, display screen; recycle; system unit</header><text>The terms <term>consumer</term>, <term>display screen</term>, <term>recycle</term>, and <term>system unit</term> have the meaning given the terms by section 3 of the Electronic Waste Recycling Promotion and Consumer Protection Act.</text></paragraph></subsection> 
<subsection id="H2805F234EF664E9C8F5E1C019D63EAC"><enum>(d)</enum><header>Final regulations</header> 
<paragraph id="H8B3684B04FC9404F8701F13100CC1356"><enum>(1)</enum><header>In general</header><text>Not later than the date which is 180 days after the date of the enactment of this section, the Secretary, after consultation with the Administrator of the Environmental Protection Agency, shall issue such final regulations as may be necessary and appropriate to carry out this section.</text></paragraph> 
<paragraph id="H0606D341EFDE45AC9C78047F78AC344B"><enum>(2)</enum><header>Inclusion</header> 
<subparagraph id="H7862B77E1E684A16A98F1C6E7387A77F"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the regulations issued under paragraph (1) shall include—</text> 
<clause id="H07E11BB259964AA3A6F2922E73250075"><enum>(i)</enum><text>requirements for certifying recyclers as eligible to recycle qualified electronic waste, and</text></clause> 
<clause id="H0F11124B7FB041E480CFFB60B8E2904D"><enum>(ii)</enum><text>requirements to ensure that all recycling of qualified electronic waste is performed in a manner that is safe and environmentally sound.</text></clause></subparagraph> 
<subparagraph id="H68D213C9FEDC441A8FADDA2D4947F9BF"><enum>(B)</enum><header>Limitation</header><text>The Secretary shall not certify a recycler as eligible under this subsection unless the recycler is—</text> 
<clause id="HDB1B862143194E1D9C7EB6CB0311B2C"><enum>(i)</enum><text>a taxpayer, or</text></clause> 
<clause id="H8BF45E9FAF214CA48EAB091168A0D013"><enum>(ii)</enum><text>a State or local government.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HCF555A06B2874C5C99D5ACA7D5A3FBB2"><enum>(e)</enum><header>Termination</header><text>This section shall not apply with respect to any unit of qualified electronic waste which is recycled after the date which is 3 years after the date on which the final regulations issued pursuant to subsection (d) take effect.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDA412AA864FD4F2CB807667495C5F8E8"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subpart A of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 25D the following new item:</text>

<subsection id="HDB3DDCA75D614BE0BF9F50F194AE37B"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to display screens and system units recycled after the date on which the final regulations issued pursuant to section 25E(d) of such Code (as added by this section) take effect.</text></subsection></section> 
<section id="H177927E749784D5D9365663BBF627D20"><enum>6.</enum><header>Prohibitions of disposal without recycling</header> 
<subsection id="H887AF76702064E04A7C6DE823B509D96"><enum>(a)</enum><header>Display screen and system unit disposal ban</header> 
<paragraph id="HA976C02CB835407E00A7AE1529C0500"><enum>(1)</enum><header>In general</header><text>Effective beginning on the date that is 3 years after the date of enactment of this Act, if the Administrator determines that a majority of households in the United States have sufficient access to a recycling service for display screens and system units, it shall be unlawful for the operator of a landfill, incinerator, or any other facility for the transfer, disposal, or storage of municipal solid waste to knowingly receive from a consumer a display screen or system unit, except for the purpose of recycling or arranging for the recycling of the display screen or system unit by a recycler certified as an eligible recycler by the Administrator.</text></paragraph> 
<paragraph id="HFEC10F33E1DD42219B219166BF1CE1FD"><enum>(2)</enum><header>Procedures</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall develop and issue guidelines covering waste handlers and waste transfer stations to assist in developing recycling procedures for display screens and system units.</text></paragraph> 
<paragraph id="H5879F2820096426F808755AFB147877D"><enum>(3)</enum><header>Exemptions</header><text>As part of the guidelines issued pursuant to paragraph (2), the Administrator shall classify display screens and system units as universal waste and provide for the exemption of display screens and system units from the requirements of the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>) as necessary to facilitate the collection, storage, and transportation of display screens and system units for the purpose of recycling.</text></paragraph></subsection> 
<subsection id="H8D07093978884D87B9C5CC83E7343CE4"><enum>(b)</enum><header>Enforcement</header><text>A violation of subsection (a) by any person or entity shall be subject to enforcement under applicable provisions of the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>).</text></subsection></section> 
<section id="H1D9D03188A9A46019DE71242F6A74C74"><enum>7.</enum><header>Recycling of display screens and system units procured by the Federal Government</header> 
<subsection id="H705805CA21A049FB8185D53047FBDE1"><enum>(a)</enum><header>Definition of executive agency</header><text>In this section, the term <term>executive agency</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/40/11101">section 11101</external-xref> of title 40, United States Code.</text></subsection> 
<subsection id="H523B06EC6CAC4E9CAAA003331E4F2D2"><enum>(b)</enum><header>Requirement for recycling</header><text>The head of each executive agency shall ensure that each display screen and system unit procured by the Federal Government—</text> 
<paragraph id="H5AE078D6D271420CB7C372428529D880"><enum>(1)</enum><text>is recovered upon the termination of the need of the Federal Government for the display screen or system unit; and</text></paragraph> 
<paragraph id="H46561FBD132F4F43BA2712FD75E7B949"><enum>(2)</enum><text>is recycled by a recycler certified as an eligible recycler by the Administrator through—</text> 
<subparagraph id="H291A86329419425893B8D28E06816FFB"><enum>(A)</enum><text>a program established after the date of enactment of this Act by the executive agency, either alone or in conjunction with 1 or more other executive agencies; or</text></subparagraph> 
<subparagraph id="HBD7DC6AA8B0C43A4A200DB611B04B665"><enum>(B)</enum><text>any other program for recycling or reusing display screens and system units.</text></subparagraph></paragraph></subsection></section> 
<section id="H51CEE1BE5A324B70901FD3C851F3718D"><enum>8.</enum><header>Nationwide recycling program</header> 
<subsection id="HE4ACFF7311EE4029BC7BB15444BA7BD0"><enum>(a)</enum><header>Study</header> 
<paragraph id="HEAE29DBFE127453E91BC497193EA3B4D"><enum>(1)</enum><header>In general</header><text>The Administrator, in consultation with appropriate executive agencies (as determined by the Administrator), shall conduct a study of the feasibility of establishing a nationwide recycling program for electronic waste that preempts any State recycling program.</text></paragraph> 
<paragraph id="HB3C3C2B5DC2A47798DF8E0CE7C4400F"><enum>(2)</enum><header>Inclusions</header><text>The study shall include an analysis of multiple programs, including programs involving—</text> 
<subparagraph id="H6AE986147C8D4C79B8116E61E38092F"><enum>(A)</enum><text>the collection of an advanced recycling fee;</text></subparagraph> 
<subparagraph id="HDCB48179D4C84574B21EDFF40C03EB1"><enum>(B)</enum><text>the collection of an end-of-life fee;</text></subparagraph> 
<subparagraph id="HE409A28E87F343B1B8E45846F1EC4E2E"><enum>(C)</enum><text>producers of electronics assuming the responsibility and the cost of recycling electronic waste; and</text></subparagraph> 
<subparagraph id="HAB676CAC5FF548FA9BD067796D07AB99"><enum>(D)</enum><text>the extension of a tax credit for recycling electronic waste.</text></subparagraph></paragraph></subsection> 
<subsection id="H9731DA4B046B4BBDB42BE1009F83011B"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall submit to Congress a report describing—</text> 
<paragraph id="H4E2AA1E2492F4BD0A0CB9B3DC6BEF9AA"><enum>(1)</enum><text>the results of the study conducted under subsection (a);</text></paragraph> 
<paragraph id="HF7BF2BDDC42046BDB1C01B568F88185"><enum>(2)</enum><text>1 or more prospective nationwide recycling programs, including—</text> 
<subparagraph id="HEE15346FED8D4DA6819FF9D650072EE"><enum>(A)</enum><text>a cost-benefit analysis of each program, including—</text> 
<clause id="HA1E86BCA756C46E6B9C6693DCD5DD9A5"><enum>(i)</enum><text>the cost of the program to—</text> 
<subclause id="H3089960BB9834379BA65CC367780B7BE"><enum>(I)</enum><text>consumers;</text></subclause> 
<subclause id="HFB266656C59B42A180783E0010F16D54"><enum>(II)</enum><text>manufacturers;</text></subclause> 
<subclause id="HF6CF003B87384FEEB57F0807C260C622"><enum>(III)</enum><text>retailers; and</text></subclause> 
<subclause id="H5FEAB151ED844D0FBA6EBB005E33E1DF"><enum>(IV)</enum><text>recyclers; and</text></subclause></clause> 
<clause id="H2D35F1C150524BA0A7EC32D1F142B012"><enum>(ii)</enum><text>the estimated overhead and administrative expenses of carrying out and monitoring the program; and</text></clause></subparagraph> 
<subparagraph id="HE8B46D8E18FC42139817B8B8D8B0D392"><enum>(B)</enum><text>the quantity of display screens and system units projected to be recycled under the program;</text></subparagraph></paragraph> 
<paragraph id="H63AA5BFBD95B4C2FB683201586EE7573"><enum>(3)</enum> 
<subparagraph display-inline="yes-display-inline" id="H25714DD9BA624BFF00B70041C5D85DFC"><enum>(A)</enum><text>the benefits of establishing a nationwide take-back provision that would require, as part of the program, all manufacturers of display screens or system units for sale in the United States to collect and recycle, or arrange for the recycling of, display screens and system units; and</text></subparagraph> 
<subparagraph id="H127C2C294D774BDFA235D6B1B89E754C" indent="up1"><enum>(B)</enum><text>a projection of the quantity of display screens and system units that would be recycled annually under a nationwide take-back provision;</text></subparagraph></paragraph> 
<paragraph id="HDF402DD9E2D14E53B4AB01E2D93696B5"><enum>(4)</enum> 
<subparagraph display-inline="yes-display-inline" id="H77159EA0BF414F35B5BDDDB21DE3119"><enum>(A)</enum><text>any emerging electronic waste streams, such as—</text> 
<clause id="HFD44B36717B84900B0F6C8AB94CCCB7C" indent="up1"><enum>(i)</enum><text>cellular telephones; and</text></clause> 
<clause id="H452C6C9877D642DA901B9166AD441559" indent="up1"><enum>(ii)</enum><text>personal digital assistants; and</text></clause></subparagraph> 
<subparagraph indent="paragraph" id="HF35A2A7CF6BF4C8AA2FD003986A2B64B"><enum>(B)</enum><text>a cost-benefit analysis of including an emerging electronic waste stream in a national recycling program; and</text></subparagraph></paragraph> 
<paragraph id="HF9C60DB7E904435EAD8486896894AAC0"><enum>(5)</enum><text>the progress of the Administrator in carrying out section 6, including—</text> 
<subparagraph id="HEFB47C1FB40B4D31AF00CF1873BC1F96"><enum>(A)</enum><text>information on enforcement of the prohibition; and</text></subparagraph> 
<subparagraph id="H42E485F282BC47D1A683FBD42EB865B"><enum>(B)</enum><text>any increase in recycling as a result of the prohibition.</text></subparagraph></paragraph></subsection></section>
