<section id="H66B5B18EA292430F864CBAFBE445F75D" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child, Worker, and Consumer-Safe Chemicals Act of 2005</short-title></quote> or as the <quote><short-title>Kid Safe Chemicals Act</short-title></quote>.</text></section> 
<section id="HB765AB9D0D7840F281B9951D4B64DE00"><enum>2.</enum><header>Findings, policies, and goals</header> 
<subsection id="H58506336BBAA463F881CDEB5F628D3B7"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="HD2A2F1641239473B933B48C00C04E19"><enum>(1)</enum><text>The incidence of some diseases and disorders which have been linked to chemical exposures are on the rise.</text></paragraph> 
<paragraph id="H857CC03A59DC47929D8E632D75FE10F9"><enum>(2)</enum><text>The metabolism, physiology, and exposure patterns of developing fetuses, infants, and children to toxic chemicals differ from those of adults, which makes children more vulnerable than adults to the harmful effects of exposure to some synthetic chemicals.</text></paragraph> 
<paragraph id="HB3475F43B1B8453E97FFFE5DD36F4B1D"><enum>(3)</enum><text>Unlike pharmaceuticals and pesticides, manufacturers of most chemical substances are not required under current law to supply human or environmental toxicity information before selling their products to the public. Consequently, the vast majority of chemicals used in commercial products have never had any Federal review to evaluate potential toxicity to infants, children, developing fetuses, or adults.</text></paragraph> 
<paragraph id="H8C401C28D044470E8B484004CD179910"><enum>(4)</enum><text>Biomonitoring tests have shown that a fetus, infant, or child in the United States today often have many synthetic chemicals in their blood and tissue.</text></paragraph> 
<paragraph id="H11EA37FDD82C400E90F62BA1CA58A5D2"><enum>(5)</enum><text>Despite these alarming discoveries, the Environmental Protection Agency has reviewed the human health risks of only an estimated 2 percent of the 62,000 chemicals that were in use in 1976, when Congress passed the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>). The Environmental Protection Agency has issued regulations to ban or restrict the use of only 5 chemical substances in 29 years, due to the law’s excessively high administrative and legal hurdles.</text></paragraph> 
<paragraph id="HB7F4E40C8336462B003421DFE465E1D7"><enum>(6)</enum><text>A fundamental overhaul of United States chemical management is needed to build a non-toxic environment for our children.</text></paragraph></subsection> 
<subsection id="H4736791C8B8246AAB65900A44BB001B"><enum>(b)</enum><header>Policy</header><text>It is the policy of the United States to—</text> 
<paragraph id="H3821EBE6CD6B43139846B0A045923BCD"><enum>(1)</enum><text>promote children’s health as a paramount national goal, recognizing that developing fetuses, infants, and children are uniquely vulnerable to the harmful effects of some toxic chemicals during all stages of their development;</text></paragraph> 
<paragraph id="H07CA38DFB347469085A871854051B93"><enum>(2)</enum><text>minimize toxic substances in the environment of children, workers, and consumers by—</text> 
<subparagraph id="HD602524C12004C6D9D8D68CDBC5400D2"><enum>(A)</enum><text>promoting the use of safer substitutes and solutions to reduce exposure to hazardous chemicals by rewarding business innovation;</text></subparagraph> 
<subparagraph id="H1F5EEBD7594A47DDA0311FC5086505DB"><enum>(B)</enum><text>holding chemical manufacturers responsible for providing complete health and safety data for each chemical they produce prior to distribution of that chemical substance in commerce; and</text></subparagraph> 
<subparagraph id="HA844392D1804431C9F3F12C79B2F60D"><enum>(C)</enum><text>providing the Environmental Protection Agency with authority to allow the commercial distribution of chemical substances only where the data and information show there is a reasonable certainty that the chemical substances pose no harm to human health or the environment; and</text></subparagraph></paragraph> 
<paragraph id="HE475FB35541A4332B2CAB8FEB6D9A0B6"><enum>(3)</enum><text>provide the public and workers the full right to know about the health effects of the chemical substances to which they are exposed.</text></paragraph></subsection> 
<subsection id="H70FB8698AC4C4E11A900ADB7FF001D04"><enum>(c)</enum><header>Goals</header><text>It is the goal of the United States to eliminate the exposure of all children, workers, consumers, and sensitive subgroups to harmful chemicals distributed in commerce by 2020 by—</text> 
<paragraph id="HF6156F543BA14192BA80EA053E2661A7"><enum>(1)</enum><text>identifying the highest priority chemical substances for review by 2007;</text></paragraph> 
<paragraph id="H653FD1D2186D4E9794E711C698ED232E"><enum>(2)</enum><text>making a safety determination for, at a minimum, the first 300 priority chemical substances by 2010 and banning or restricting the use of a chemical substance if it cannot be shown to meet the safety standard; and</text></paragraph> 
<paragraph id="HE453A05FEF80404AA0CFCFC8876DE7D"><enum>(3)</enum><text>making a safety determination for all chemical substances by 2020, and banning or restricting the use of a chemical if it cannot be shown to meet the safety standard.</text></paragraph></subsection></section> 
<section id="H9D10C97D33C243E1B7C1B07FFADB5F"><enum>3.</enum><header>Protection of children's health from chemical substances</header> 
<subsection id="H5FDF5AE4248E46FB00AB8DECCA006859"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>) is amended by adding at the end the following:</text>

<title id="HB0F3F8FD12EB472CA1552D907EAB71D4"><enum>V</enum><header>Child Safe Chemicals </header> 
<section id="HDA8D6BC3A5DE4D62B976A750003FAB4B"><enum>501.</enum><header>Manufacturer safety certifications</header> 
<subsection id="HDAE157D158CB4238A2F29C8E421443A3"><enum>(a)</enum><header>Safety statement and information</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this title, each manufacturer of a chemical substance distributed in commerce shall submit to the Administrator—</text> 
<paragraph id="H31E8FFBDBA4B4A6BA8F8554186F3D1FF"><enum>(1)</enum><text>a statement signed by the chief executive officer of the manufacturer certifying, based on available information after a good faith inquiry, that—</text> 
<subparagraph id="H02595031B06E4F6800E9E5C11889255D"><enum>(A)</enum><text>the chemical substance meets the safety standard defined in section 503(a); or</text></subparagraph> 
<subparagraph id="H1D1A7BD2C68E414CB3FB7F308383BB33"><enum>(B)</enum><text>there is insufficient data to determine whether the chemical substance meets that safety standard; and</text></subparagraph></paragraph> 
<paragraph id="H4310D19656804C97A50422DC042FE092"><enum>(2)</enum><text>all reasonably available information in the company's possession or control that has not previously been submitted to the Administrator regarding the physical, chemical, and toxicological properties of the chemical substance, and the annual production volume and known uses of, and exposure and fate information relating to, the chemical substance.</text></paragraph></subsection> 
<subsection id="H9FF85AB0CC314EFEAAFF2E6F88CBF664"><enum>(b)</enum><header>Updating of information</header><text>Each manufacturer of a chemical substance described in subsection (a) shall update the information described in subsection (a)(2)—</text> 
<paragraph id="H1A15BAB182F44B95B404AD004CD463B7"><enum>(1)</enum><text>at a minimum, every 3 years; and</text></paragraph> 
<paragraph id="H7E2CE4DC1184435DAF866D2FE400F4FB"><enum>(2)</enum><text>at any time at which there becomes available significant new information regarding a physical, chemical, or toxicological property of, or exposure to, the chemical substance, including at a minimum any information that shows a new potential toxic effect, corroborates previous information showing or suggesting a toxic effect, or suggests a toxic effect at a lower dose than previously demonstrated.</text></paragraph></subsection> 
<subsection id="H29E43F1D558D4CC3A4DDDEB6F699D0F3"><enum>(c)</enum><header>New chemical substances</header><text>Prior to a new chemical substance being distributed in commerce, the chief executive officer of the manufacturer must certify the safety of that chemical substance as directed in subsection (a).</text></subsection> 
<subsection id="HE8DC6C08C18F4EBEB966040009A9E83"><enum>(d)</enum><header>Definition of toxicological property</header><text>For the purposes of this title, <term>toxicological property</term> means actual or potential toxicity, bioconcentration, or other biological or adverse effects, including but not limited to effects on mortality, morbidity, reproduction, development, the immune system, the endocrine system, the brain or nervous system, or any other biological functions in humans or animals.</text></subsection></section> 
<section id="H64B0A8352823474F95DFFED470EA963D"><enum>502.</enum><header>Priority list of chemical substances for EPA safety determination</header> 
<subsection id="H48F4EE53D6184DDBA074B64C48703444"><enum>(a)</enum><header>Priority list</header> 
<paragraph id="H7C0632FE061F49D1815E6D83153B86AF"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this title, the Administrator shall develop a priority list of not less than 300 chemical substances (referred to in this title as the <term>priority list</term>) which shall be the first chemical substances for which a safety determination is made, as set forth in section 503. Chemical substances that may pose the greatest risk to humans shall be ranked as highest priority.</text></paragraph> 
<paragraph id="H76F1818A65C040579FB303DE2F1734D"><enum>(2)</enum><header>Updating of list</header><text>Additional chemical substances shall be added to the priority list at least annually until all chemical substances which meet the criteria set forth in subsection (b) have been added to the priority list.</text></paragraph> 
<paragraph id="HF284E1D13CAA4ED18E3ED927EC4596B2"><enum>(3)</enum><header>Treatment as final agency action</header><text>Development of the priority list shall not be considered to be a final agency action for the purpose of subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as <quote>the Administrative Procedure Act</quote>), but the Administrator’s failure to issue or update a priority list by the deadline established in the Act shall be considered a failure to perform a nondiscretionary duty.</text></paragraph></subsection> 
<subsection id="HB54E543176914465AA539107A8596D7E"><enum>(b)</enum><header>Criteria for identifying prioritized chemical substances</header><text>In determining the priority list of chemical substances for a safety determination, the Administration shall take into account whether the chemical substance—</text> 
<paragraph id="H1B2E85D8385F4F75B726E62131B2D301"><enum>(1)</enum><text>is found in human blood, fluids, or tissue, unless the chemical substance is not synthetic and is naturally present at the level found in blood, fluids, or tissue;</text></paragraph> 
<paragraph id="H2283CD1FF7E84146A1363DBB12B2FCF5"><enum>(2)</enum><text>is found in food or drinking water, unless the chemical substance is not synthetic and is naturally present at the level found in food or drinking water;</text></paragraph> 
<paragraph id="H16D35561C8A0445C00091700F5F8787E"><enum>(3)</enum><text>is manufactured or discharged into the environment at a volume of more than 1,000,000 pounds annually;</text></paragraph> 
<paragraph id="HC36FAC72DC7E430DB7A9B020C53DC1ED"><enum>(4)</enum><text>is a known or suspected reproductive, neurological, or immunological toxicant, carcinogen, mutagen, or endocrine disruptor, or causes negative developmental effects; or</text></paragraph> 
<paragraph id="HD2D420B4858F49AF896D6FB6EAA0547"><enum>(5)</enum><text>is persistent or bioaccumulative.</text></paragraph></subsection></section> 
<section id="H83B3C3E1FA574E90A9F2639349931FDA"><enum>503.</enum><header>EPA Safety determination for chemical substances</header> 
<subsection id="HD8BD2577DF00438BB38BE2832398688F"><enum>(a)</enum><header>Definition of safety standard</header><text>In this section, the term <term>safety standard</term> means, with respect to a chemical substance (or another chemical substance with a common mechanism of action)—</text> 
<paragraph id="HA40F40F95A9A484BA7CA9B9DFD138128"><enum>(1)</enum><text>a standard that provides a reasonable certainty that no harm will be caused by aggregate exposure of a fetus, infant, child, worker, or member of other sensitive subgroup; and</text></paragraph> 
<paragraph id="H760B1F4EC7644DBFAE7275453707D308"><enum>(2)</enum><text>in the case of a fetus, infant, or child, a standard that accounts for their special vulnerability to potential pre- and post-natal exposures by applying an additional 10 fold safety factor to the level established for adults.</text></paragraph></subsection> 
<subsection id="HA1CC42CEF7CD49F781A91D69D616AE16"><enum>(b)</enum><header>Chemical safety information</header> 
<paragraph id="H5365F9EEFDB74BDFA98DFFC46815CC98"><enum>(1)</enum><header>In general</header><text>On receipt of a request from the Administrator, a manufacturer of the chemical substance shall provide to the Administrator all information requested under this subsection.</text></paragraph> 
<paragraph id="H71B30809BD644C09B0D90375AA008F65"><enum>(2)</enum><header>Information</header><text>In making a determination with respect to a chemical substance under subsection (c), the Administrator shall take into account each of the following:</text> 
<subparagraph id="H133B1137C7E148A900EEFDA104F38631"><enum>(A)</enum><text>Environmental fate and transport, including degradation, persistence in the environment, mobility, and distribution across environmental media, of the chemical substance.</text></subparagraph> 
<subparagraph id="H4A9D1EBD3A874FD0803D0169B823BECF"><enum>(B)</enum><text>Biological fate and transport, including metabolism, bioaccumulation and biomagnification potential, and toxicokinetics.</text></subparagraph> 
<subparagraph id="H9B6B7586926D4E47BB05EEEAF6F8DE00"><enum>(C)</enum><text>Acute, subchronic, and chronic human health effects of exposure to the substance, including reproductive, developmental, genotoxic, neurotoxic, immunotoxic, and endocrine-disrupting effects.</text></subparagraph> 
<subparagraph id="H2D5618B63A95408484A1A7CF9957BDB"><enum>(D)</enum><text>The potential for additive or synergistic effects to result from exposure to multiple chemical substances.</text></subparagraph> 
<subparagraph id="HC08A12443AAF469FBF515DE945466BDE"><enum>(E)</enum><text>The ecotoxicity of a chemical substance to avian, terrestrial, and aquatic species.</text></subparagraph> 
<subparagraph id="H6294335F703C43328F00AC97110072EF"><enum>(F)</enum><text>The presence of the chemical substance in, at a minimum—</text> 
<clause id="H76209674173443AE8F459366B570F4D4"><enum>(i)</enum><text>human blood, fluids, or tissue; and</text></clause> 
<clause id="HE35D04743AEC4D9FAFBE21BF8BD707AA"><enum>(ii)</enum><text>food or drinking water.</text></clause></subparagraph> 
<subparagraph id="H0738932B10324C2CAC766DFC2DE6AB73"><enum>(G)</enum><text>The uses of the chemical substance and associated known and potential releases and exposures.</text></subparagraph></paragraph> 
<paragraph id="H4058A30E892A4E4B99FFB270529B014C"><enum>(3)</enum><header>Minimum data set</header><text>The Administrator shall establish a minimum set of data requirements that would ensure that determinations under subsection (c) are based on reliable data.</text></paragraph> 
<paragraph id="HF42DD88F6C274D6F8889DE9A2D421D4"><enum>(4)</enum><header>Tiering process</header><text>The Administrator shall have the authority to develop a tiering process for the submission of the information.</text></paragraph></subsection> 
<subsection id="HACE5EDE98B054589BDC260CEAABF403"><enum>(c)</enum><header>Safety determination</header> 
<paragraph id="H537BFCDAC82648C7AB2523851621AF8D"><enum>(1)</enum><header>Priority chemicals</header> 
<subparagraph id="H7BFE7D23FB8C4A6381DB414D19C21501"><enum>(A)</enum><header>In general</header><text>Not later than 3 years after the date on which a chemical substance has been placed on the priority list, the Administrator shall determine whether the manufacturer has established that the chemical substance meets the safety standard.</text></subparagraph> 
<subparagraph id="H50226ECE9D974A41849F06A9CBA59422"><enum>(B)</enum><header>Interim standards</header> 
<clause id="H9078F3A5B6BF4665BE365BF6A77FCD81"><enum>(i)</enum><header>Notice of pending determination</header><text>If the Administrator fails to act within the deadlines established in subparagraph (A), a manufacturer affected by the failure to act shall issue to the Administrator, the public, and each known customer of a chemical substance a written notice that a determination of safety is pending.</text></clause> 
<clause id="H5A2E82A919C0479480347E60A84872DD"><enum>(ii)</enum><header>Failure of administrator to act</header><text>Not later than 5 years after the date on which a chemical substance has been placed on the priority list, if the Administrator has not made a determination under subparagraph (A), the chemical substance shall not be distributed in commerce.</text></clause></subparagraph></paragraph> 
<paragraph id="H71090E7A3D0D47E78DE93960534EA091"><enum>(2)</enum><header>Other chemical substances</header><text>Not later than 15 years after the date of enactment of this title, the Administrator shall determine whether each chemical substance distributed in commerce meets the safety standard. Not less than 1 time every 15 years thereafter, the Administrator shall reassess the safety of all chemical substances distributed in commerce.</text></paragraph> 
<paragraph id="H618BFC0E3117437FA3B436A421F80158"><enum>(3)</enum><header>New chemical substances</header><text>As of the date that is 90 days after the date of enactment of this title, no new chemical substance shall be distributed in commerce unless the chemical substance has met the safety standard under subsection (a), as determined by the Administrator.</text></paragraph></subsection> 
<subsection id="HC9602CB065B543ADBD7C99679CFD0095"><enum>(d)</enum><header>Biomonitoring</header> 
<paragraph id="H331B6FF8E644451090D8202100B7B000"><enum>(1)</enum><header>In general</header><text>Within 5 years after the date of enactment of this title, and every 3 years thereafter, a manufacturer of a chemical substance shall carry out a biomonitoring study to determine the presence in human blood, fluids, or tissue for any chemical substance—</text> 
<subparagraph id="H56615DBCE2C7475EB9608610976875E8"><enum>(A)</enum><text>which is manufactured in quantities greater than 1,000,000 pounds during 1 calendar year; or</text></subparagraph> 
<subparagraph id="H97FD53DDD7AE40CC9B99101CF2007023"><enum>(B)</enum><text>for any chemical substance distributed in commerce—</text> 
<clause id="HD0B1ED820D174E81B59DAF5864491785"><enum>(i)</enum><text>to which humans are exposed; and</text></clause> 
<clause id="H3383CBA43AC541AB9D42D2487B0054F8"><enum>(ii)</enum><text>for which there is cause for concern regarding the exposure (as determined by the Administrator), such as a potential for persistence or bioaccumulation of the chemical substance.</text></clause></subparagraph></paragraph> 
<paragraph id="HFFC729DCB09249A3A2FB54103E16EF51"><enum>(2)</enum><header>Standard</header><text>The Administrator shall by regulation establish a standard for biomonitoring studies under this subsection that includes—</text> 
<subparagraph id="HBC4888FE67AF486BB7174570C04E8BD8"><enum>(A)</enum><text>the use of a representative sample that ensures that likely exposed populations including children are oversampled; and</text></subparagraph> 
<subparagraph id="H0FF84341114348F5B638EBCC0274DA1D"><enum>(B)</enum><text>a determination of appropriate detection levels of chemical substances.</text></subparagraph></paragraph> 
<paragraph id="HB795E22C39AA474F00DBC57EDFE357D7"><enum>(3)</enum><header>Substance detection</header><text>A manufacturer of a chemical substance subject to paragraph (1) shall make available to the public a practicable method (as determined by the Administrator) for detecting the presence of the substance or any of its metabolites in human blood, fluids, and tissue.</text></paragraph></subsection></section> 
<section id="H7D98779B866D4A5B83DE5E2660ACF138"><enum>504.</enum><header>Reduction of health hazards for children, workers, and consumers</header> 
<subsection id="HB8F6C975BE9B470EA700FEACD4D48C1"><enum>(a)</enum><header>Market restrictions</header><text>No person shall manufacture a chemical substance if—</text> 
<paragraph id="H3F74CDD9DC9D4F90A82C6CB2BC04611D"><enum>(1)</enum><text>the Administrator determines that the person failed to act in accordance with section 501 or section 503;</text></paragraph> 
<paragraph id="HA92882D999EE45FABCAA824E8173B51C"><enum>(2)</enum><text>the Administrator determines that the chemical substance does not meet the safety standard defined in section 503(a); or</text></paragraph> 
<paragraph id="H03675AC1FA054B5ABD9E3609BCCD4EF"><enum>(3)</enum><text>the Administrator has not made a safety determination for the chemical substance by the deadline established in paragraph (1)(B)(ii), (2), or (3) of section 503(c).</text></paragraph></subsection> 
<subsection id="H683C67B774274804ACC88567ADB0DD73"><enum>(b)</enum><header>Use exemptions</header><text>The Administrator may allow manufacturing for a specified use of any chemical substance where the Administrator determines such use meets the safety standard defined in section 503(a).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HE30B4B8A863E47B19DB7A5DFF93CF65"><enum>(c)</enum><header>Exemption from biomonitoring</header><text>Any manufacturer that submitted to the Administrator a biomonitoring study of a chemical substance on or before the date of enactment of this title shall be exempt from the initial biomonitoring under section 503(d) for that chemical substance.</text></subsection> 
<subsection commented="no" id="H51952573B7FD42E9846D3CC8DE87560"><enum>(d)</enum><header>Other exemptions</header> 
<paragraph commented="no" id="H9BE5B3734B6041FC9B03354028464886"><enum>(1)</enum><header>In general</header><text>The President, in his non-delegable duty, may make an exemption from this section for a specific use of a chemical substance for a period not to exceed 5 years if after public notice and comment he determines that—</text> 
<subparagraph id="H4D4C72F8561345E3BF6B0065D242E2E1"><enum>(A)</enum><text>an exemption is in the paramount interest of national security, or if the lack of availability of the chemical substance would cause significant disruption in the national economy; and</text></subparagraph> 
<subparagraph commented="no" id="H33BBB47D86584729B172EC5EF9D5467"><enum>(B)</enum><text>no feasible alternative for the specified use of the chemical substance is available.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HBB693E3B1F4448FAAE5BCDAC83006BA7"><enum>(2)</enum><header>Renewability</header><text>The President may renew an exemption under paragraph (1) for additional 5 year periods if the President concludes after public comment that such a renewal is necessary.</text></paragraph> 
<paragraph id="HE3C00AAB6F7B49DD9C22C408AA7BDBA5"><enum>(3)</enum><header>Public notice</header><text>A manufacturer of a chemical substance for which an exemption under this subsection is made shall provide notice of the exemption to each known customer, and the President shall provide the public with a notice of such an exemption.</text></paragraph></subsection></section> 
<section id="H6BE85D9157B541EA8F5955EFFC11FDD5"><enum>505.</enum><header>Animal testing alternatives</header> 
<subsection id="H742BDEF9BAE440CAB0006F6B66998F34"><enum>(a)</enum><header>Alternatives to animal testing</header> 
<paragraph id="HCAD7D5FC7E6C424C9252E7218CDF1EF5"><enum>(1)</enum><header>In general</header><text>To minimize the use of animal testing of chemical substances, the Administrator shall—</text> 
<subparagraph id="H1A1678DCD7B24A79A891B6016D3D15B9"><enum>(A)</enum><text>require the use, where practicable, of—</text> 
<clause id="H497E1E26B8FB4D8C96E00003BF339A1"><enum>(i)</enum><text>existing data to fill data gaps by calling for mandatory disclosure of all existing data, and thoroughly investigating sources of existing data;</text></clause> 
<clause id="H6DE184D107E747BA8E12FD80091C15E6"><enum>(ii)</enum><text>replacement alternatives that—</text> 
<subclause id="H6F400F9AC2E8480E901FAB182176003B"><enum>(I)</enum><text>do not involve the use of an animal to test the chemical substance; and</text></subclause> 
<subclause id="H04931FAC021C42F885E8D6C99C976E"><enum>(II)</enum><text>provide information that is equivalent in scientific quality to the animal testing method; and</text></subclause></clause> 
<clause id="HAA5EB78C8D4341A58CCEB303911DB8E0"><enum>(iii)</enum><text>reduction alternatives that use fewer animals than conventional animal-based tests when replacement alternatives are impracticable, including the use of tests that combine two or more endpoints;</text></clause></subparagraph> 
<subparagraph id="H45E0BEB746B44BA2A4F607C065428503"><enum>(B)</enum><text>encourage, where practicable—</text> 
<clause id="HCF8A900C37C44E5BBCAACC8311B2DDB"><enum>(i)</enum><text>the grouping of similar chemicals into categories to limit testing to only those chemicals which are representative of the group; and</text></clause> 
<clause id="HC7D5600D07FA448CB9B62D2D9EDA76BD"><enum>(ii)</enum><text>the forming of industry consortia to jointly conduct testing to avoid duplication of tests; and</text></clause></subparagraph> 
<subparagraph id="H1D7E150CA4DE44188BEA94219B00B1AC"><enum>(C)</enum><text>fund research and validation studies to reduce and replace the use of animal tests as provided in this section.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H561A83DB03904CB6873C46F60499FED"><enum>(2)</enum><header>List of alternative testing methods</header><text>Not later than 1 year after the date of enactment of this title, and triennially thereafter, the Administrator, in consultation with the Interagency Science Advisory Board established in section 507, shall publish a list of the alternative testing methods described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H6CE61E26E79F42E9A5432F69D728F4E4"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000.</text></subsection></section> 
<section id="H32AADB233D2D4AA88588603067C8ACC1"><enum>506.</enum><header>Safer alternatives and green chemistry</header> 
<subsection id="HE3C6334C144F4A62A3A969EC1B5250A8"><enum>(a)</enum><header>Safer alternatives program</header><text>Within 1 year after the date of enactment of this title, the Administrator shall establish a program to create market incentives for the development of safer alternatives to existing chemical substances. This program shall include, but not be limited to—</text> 
<paragraph id="H019C10B82290481BA41F25FF8DB9AC55"><enum>(1)</enum><text>expedited review of new chemical substances for which the manufacturer submits an alternatives analysis indicating that the new chemical substance is the safer alternative for a particular use than existing chemical substances used for the same purpose;</text></paragraph> 
<paragraph id="H70F86EDD56004691A8DDC1A91C8D08F9"><enum>(2)</enum><text>recognition for a chemical substance found by the Administrator to be a safer alternative for a particular use by means of a special designation intended for use in marketing the safer alternative, and periodic public awards; and</text></paragraph> 
<paragraph id="H2D5DED21F5734A03A8E29FC806E189CE"><enum>(3)</enum><text>other incentives as the Administrator considers appropriate to encourage the development, marketing and use of chemical substances found by the Administrator to be safer alternatives for the particular uses.</text></paragraph></subsection> 
<subsection id="HAE756881016E4EC586B1B385FAA129C"><enum>(b)</enum><header>Green chemistry research and clearinghouse network</header> 
<paragraph id="HA716B11BA3ED4466A00038A52C6EA52"><enum>(1)</enum><header>In general</header><text>The Administrator shall establish a network of not less than 4 green chemistry and technology research and clearinghouse centers, located in various regions of the United States, to support the development and adoption of safer alternatives to chemical substances, particularly chemical substances placed on the priority list.</text></paragraph> 
<paragraph id="H5F6AD5AA080B483AA41398F760F1368F"><enum>(2)</enum><header>Requirements</header><text>The research and clearinghouse centers described in paragraph (1) shall—</text> 
<subparagraph id="H3B92C8CD455A43A0A863BAD8868F8575"><enum>(A)</enum><text>provide technical assistance relating to alternatives analysis, green chemistry, and green technology techniques to small and medium-sized manufacturers of chemical substances;</text></subparagraph> 
<subparagraph id="H214791CD07384E52902381B0C406803D"><enum>(B)</enum><text>provide technical training relating to alternatives analysis, green chemistry, and green technology techniques to students and professionals;</text></subparagraph> 
<subparagraph id="HEB2CE28800CC4616B628F76610006674"><enum>(C)</enum><text>conduct alternatives analysis, green chemistry and green technology research; and</text></subparagraph> 
<subparagraph id="HA61F1B9F08F34799B847B5652D4F7E61"><enum>(D)</enum><text>provide grants to promote and support the research, development, adoption and use of alternatives to the activities identified in subparagraphs (A), (B), and (C).</text></subparagraph></paragraph> 
<paragraph id="HB65651E1DEC1414D80AC6487B9F1E0EA"><enum>(3)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection—</text> 
<subparagraph id="H3017E224249B4BA381A9C8C5BD4F1DD6"><enum>(A)</enum><text>for fiscal year 2006, $40,000,000; and</text></subparagraph> 
<subparagraph id="HA782A0BCBBD849D8875D280560C9439C"><enum>(B)</enum><text>for each of fiscal years 2007 through 2010, $30,000,000.</text></subparagraph></paragraph></subsection></section> 
<section id="H8F3FBF4A5E16467EBE2F65319DD864D"><enum>507.</enum><header>Interagency Science Advisory Board on Children’s Health and Toxic Substances</header> 
<subsection id="H86A36845099D43F98FFDA4A2B72BA3C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this title, the Administrator shall form an Interagency Science Advisory Board on Children’s Health and Toxic Substances which shall include at a minimum representatives from the National Institute of Environmental Heath Sciences, the Centers for Disease Control and Prevention, the National Toxicology Program, the National Cancer Institute, the National Tribal Science Council and not less than 3 centers of children’s health at leading universities.</text></subsection> 
<subsection id="H30C4612AF173438EA30781F0FA9628C3"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the Board shall be to—</text> 
<paragraph id="HC19AF22A724A4E408DC29D8DD15D2BB4"><enum>(1)</enum><text>provide independent advice and peer review to the Administrator and Congress on the scientific and technical aspects of problems and issues related to the requirement of this title;</text></paragraph> 
<paragraph id="H000416804C5C4089B721755CC0653D3"><enum>(2)</enum><text>review the scientific and technical basis for the standards, rules, guidance, and other science-based decisions under this Act and providing expert consultation and advice to the Administrator; and</text></paragraph> 
<paragraph id="H904887314FC1407CA0409ECF002C57F4"><enum>(3)</enum><text>reduce the duplication of the efforts by manufactures to conform with the requirements of this title, and to reduce animal testing.</text></paragraph></subsection></section> 
<section id="H6BFA26E404E146529358EEB0F84D9948"><enum>508.</enum><header>Cooperation with international efforts</header><text display-inline="no-display-inline">In cooperation with the Secretary of State and the head of any other appropriate Federal agency (as determined by the Administrator), the Administrator shall cooperate with any international effort—</text> 
<paragraph id="HA70E679AF3C149048EA962A1686841E2"><enum>(1)</enum><text>to develop a common protocol or electronic database relating to chemical substances; or</text></paragraph> 
<paragraph id="HB75A05F6A88C439388AFC1B956F75469"><enum>(2)</enum><text>to develop safer alternatives for chemical substances.</text></paragraph></section> 
<section id="H711434CE16EE47D0A289438F17E79886"><enum>509.</enum><header>Public access to information</header> 
<subsection id="H2B9D722EB56047E691EABF7B07A83C56"><enum>(a)</enum><header>Transmission to administrator</header><text>Each Federal agency and Federal institution shall transmit to the Administrator all information provided to the Federal agency or institution relating to a hazard of or risk of exposure to a chemical substance.</text></subsection> 
<subsection id="HCB3D953A552D433EAAB782DFE6A49559"><enum>(b)</enum><header>Electronic database</header> 
<paragraph id="H4F917C747F60424DB87CBEB4CA3C32B4"><enum>(1)</enum><header>Standard</header><text>Not later than 180 days after the date of enactment of this title, the Administrator, in collaboration with interested parties, shall establish standards for an electronic format for sharing of information relating to the toxicity and use of, and exposure to, chemical substances.</text></paragraph> 
<paragraph id="HB037932E638049EFA76FF034584FCFB8"><enum>(2)</enum><header>Database</header><text>Not later than 3 years after the date of enactment of this title, the Administrator, in collaboration with interested parties, shall develop, and establish procedures for maintaining, a database in which to store the information described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H370972DBB64E45B9B5B457F3EEAED1BF"><enum>(c)</enum><header>Public access</header><text>The Administrator shall make available to the public—</text> 
<paragraph id="HD60EE2A2FF064F6B9B2209B349C9CF6C"><enum>(1)</enum><text>any information provided to the Administrator relating to the properties and hazards of a chemical substance; and</text></paragraph> 
<paragraph id="H7A3D32BF70B542C08382F624A6DC981"><enum>(2)</enum><text>any nonconfidential information, as described in section 510, provided to the Administrator relating to exposure to the substance.</text></paragraph></subsection> 
<subsection id="H91EA4A4F89E44A9384B647B457364EA"><enum>(d)</enum><header>Reliable information</header><text>The Administrator shall establish procedures to ensure data reliability that include—</text> 
<paragraph id="H2A47A0E3E4554024B5D810A076B7283"><enum>(1)</enum><text>not less than 1 time each year, the Administrator shall randomly inspect not less than 3 percent of the commercial and private laboratories which develop the data required by the title on the various properties and characteristics of a chemical substance; and</text></paragraph> 
<paragraph id="H5944F4BC969646619097E1EFCED60E8"><enum>(2)</enum><text>annually, the Administrator shall perform a comprehensive data audit on a statistically significant number of the data submissions submitted by manufacturers under this title.</text></paragraph></subsection></section> 
<section id="H023AD72431CB4CE3BA1DBE936B92A2FF"><enum>510.</enum><header>Confidential business information</header> 
<subsection id="HB30B5CB1935E4A129CDF38AB9748CE11"><enum>(a)</enum><header>In general</header><text>If a manufacturer of a chemical substance submits to the Administrator or any other Federal agency or institution any confidential business information (as defined in section 350.27 of volume 40, Code of Federal Regulations, as in effect on the date of enactment of this title), the chief executive officer shall provide to the Administrator or other Federal agency or institute—</text> 
<paragraph id="H1A4D4DF164C74F9596EF8340CF7BC17"><enum>(1)</enum><text>a written justification for maintaining the confidentiality of the information, including, if applicable, a statement that the information must be kept confidential to protect a trade secret of the manufacturer; and</text></paragraph> 
<paragraph id="H02CF7AED52D44FCA86027982512D23CD"><enum>(2)</enum><text>certification that the information is not otherwise publicly available.</text></paragraph></subsection> 
<subsection id="H634CDE364792403BB96D3D8673BECA8"><enum>(b)</enum><header>Information from foreign countries</header><text>Any information provided to the Administrator by an officer or employee of a foreign government shall be considered to be confidential business information if the information is considered to be confidential business information by the officer or employee of the foreign government, except as described in subsection (c).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H21AE78EFBF4A413D9EEFEB21D968AA54"><enum>(c)</enum><header>Nonconfidential information</header><text display-inline="yes-display-inline">The name of a chemical substance and all information concerning its effects on human health or the environment shall not be considered to be confidential business information under this section.</text></subsection></section> 
<section id="H67B61B3902354B51A81ED74524B964AD"><enum>511.</enum><header>Relationship to other law</header><text display-inline="no-display-inline">Nothing in this title affects the right of a State or political subdivision of a State to adopt or enforce any regulation, requirement, liability, or standard of performance that is more stringent than a regulation, requirement, liability, or standard of performance established by this title.</text> </section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H32FF3F7E51034139B6CE6CEE62500032"><enum>(b)</enum><header>Effect of section</header><text>Notwithstanding the amendment made by subsection (a)(1), any regulation promulgated (including any prohibition or restriction issued) under the provisions repealed by that subsection before the date of enactment of this Act shall remain in effect until the date on which the Administrator of the Environmental Protection Agency promulgates new regulations under title V of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>) (as added by subsection (a)(2)).</text></subsection> 
<subsection id="HE843EE4B8F17432788CF8BA1771086B1"><enum>(c)</enum><header>Conforming amendments</header> 
<paragraph id="HC5D07DBFE190407CA279D54736369421"><enum>(1)</enum><header>Testing of chemical substances and mixtures</header><text>Section 4 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2603">15 U.S.C. 2603</external-xref>) is amended—</text>
